3k fine for 1 overstay, arrest warrant for another

The two overstaying cases were heard in Shatin Court

A Filipina who overstayed her visa for more than two years got off with a relatively lenient sentence of $3,000 fine, while a recognizance paper holder who had previously overstayed for more than eight years was ordered arrested after failing to show up at the hearing of his case.

In the first case heard in Shatin Magistracy on Monday, Oct. 30, Acting Principal Magistrate Amy Chan convicted Leizel D. Manago, 33 years old, of violating her condition of stay after she pleaded guilty to the charge.

According to the charge sheet, Manago was permitted to remain in Hong Kong as a tourist only until Jan 23, 2021, but overstayed until her arrest in Tuen Mun on July 6, 2023.

Separately, Antonio A. Aranas failed to show up for the hearing of his overstaying case on the same day and court, so his bail was ordered forfeited and a warrant of arrest issued against him.

Aranas, 51, is in Hong Kong on recognizance, or on the promise that he would remain in Hong Kong and not work or commit any crime while his application for non-refoulement or against being sent back home, was being considered.

He is charged with having overstayed his visa for eight years and four months, after being allowed entry into Hong Kong.

The charge against him states that he was allowed by Immigration to remain in the city only until July 29, 2007 but stayed until Nov. 26, 2015, when he was arrested.

His application against non-refoulement allows him to stay in Hong Kong until it is decided with finality.

The accused walked free from Kwun Tong court after the verdict

A Filipina domestic helper who triggered an anti-theft alarm when she pushed a baby stroller through the exit of a Uniqlo store In Tseung Kwan O,  was acquitted today of stealing three trousers worth $597.

Lany Diones, 34 years old, emerged teary-eyed from Shatin Court after the verdict, escorted by her employer who attended all her hearings since the case was filed in June. They were holding hands when they went to the court’s cashier to claim Diones’ bail of $600.

“Prosecutors have failed to prove the defendant had criminal intention,” concluded Deputy Magistrate Dicky Cheung in a decision he read out in court.

The prosecution had the duty to prove it, and it had not done so, he added.

The decision came after a trial last Friday, in which prosecutors presented a CCTV footage of the incident on March 6 at the Uniqlo shop in a mall in Tseun Kwan O, and a part-time sales lady who explained what happened.

Diones also testified to give her side of the story.

Cheung noted that the prosecution did not add much to the agreed facts they presented and did not present direct evidence to show that Diones had “the requisite intention to commit theft.”.

Diones was charged by police with theft after arresting her for leaving the store with the trousers without paying.

During the trial, the CCTV footage showed that after the alarm sounded, Diones returned to the store and was intercepted by the sales lady who found the three trousers on the canopy of the stroller, partly covered by the jacket of Diones’ ward, the two-year-old daughter of her employer.

Diones testified that she was distracted by her ward’s crying for the third time since they entered the store, and that she had to appease her by trying to keep moving and thus passing through the exit without realizing it.

“I have difficulty believing her,” said Magistrate Cheung. “However, this disbelief is not enough” to reach the irresistible inference that she stole the trousers.

A person intent on stealing the trousers will not place them on the stroller’s canopy where it would be conspicuous, he said.

Filipina jailed 3 months for signing fake employment contract with Indo DH

The Filipina was taken behind bars after her sentence was read out

A Filipina resident who agreed to act as a pretend employer to an Indonesian domestic helper was today, Oct. 30, imprisoned for three months after pleading guilty to a charge of conspiracy to defraud the Immigration Director.

Juliet A. Santos, 60 years old, admitted the charge before Acting Principal Magistrate Chan Wai-mun in Shatin Court.

The Indonesian helper she purportedly hired as her domestic helper, Ana Miratul Faidah, had earlier admitted the same conspiracy to defraud charge.

According to the charge sheet, Santos conspired with Faidah and another Filipina named Jo-Ann Estrada, to defraud the Immigration Director  between an unknown day in May 2022 and March 19, 2023, by pretending to be the Indonesian woman’s employer.

Because of such misrepresentation, Faidah was allowed to enter and remain in Hong Kong as a foreign domestic worker until her arrest in May.

Both Santos and Faidah, as well as Estrada who never showed up in court, were charged with violating Section 159( C ) of the Crimes Ordinance, which imposes a maximum jail term of 14 years.

Santos was allowed to post bail while her case was being heard, indicating the relatively minor role she played in the conspiracy.

The case is the latest in a long line of fake employment contract conspiracies that have surfaced in recent months.

In July about 50 people, mainly domestic workers, were arrested in a crackdown on a syndicate that charged them about $20,000 to $40,000 each before supplying them with fake employment contracts which they used to apply for work visas.

This was apart from a number of workers on FDH contracts who were found working as dish washers in restaurants, and more recently, as packers in a food supply company.

Filipina escapes jail after pleading guilty to harming 2-year-old ward

The boy's ill-treatment by his carer happened twice on the same day

A Filipina domestic worker who admitted two counts of mistreating a two-year-old boy under her care walked free from court earlier today, Oct. 30, after being meted two concurrent 14-day jail terms, suspended for two years.

E.G. Tiongson, 43 years old, pleaded guilty to two counts of “willful assault by one in charge of a child or young person” before Acting Principal Magistrate Cheng Lim-chi in Fan Ling, who immediately sentenced her.

The two offences she admitted both happened on August 3 this year, inside the flat of Tiongson’s employer in Sze Tau Lung Tsuen, Sha Tau Kok in Fanling.

The charges alleged that Tiongson being a person over the age of 16 years who had custody over the child, “did willfully assault the said boy, in a manner likely to cause the said boy unnecessary suffering or injury to his health.”

Up until her sentencing, Tiongson was allowed to post bail of $400, indicating that the charges against her were not of a serious nature.

She was arrested and detained at the Sheung Shui Police Station before being allowed to post bail.

While she escaped a jail term, Tiongson’s conviction would likely prevent her from working in Hong Kong again, at least not in the near future.

Noise barrage held to demand swift action against illegal recruiters

Protesters call for end to human trafficking and illegal recruitment

Dozens of overseas Filipino workers joined a noise barrage called by United Filipinos – Migrante Hong Kong to urge the Philippine government to take swift action against a group accused of duping migrant workers of their hard-earned money with the promise of sending them to Canada on student visas.

The protest action was held outside City Hall in Central on Sunday afternoon, at the end of celebrations marking the 25th founding anniversary of the Filipino Migrant Workers Union (FMWU).

The group called on the government to file cases against former Cebu City councilor Nina Mabatid and her team from Pinoy Care Visa Center- Opportunities Abroad, as well as OFW blogger Bryan Calagui who is accused of promoting the Canada recruitment and personally assuring the applicants of the legitimacy of the operation.

They also want the alleged culprits to return the more than Php2 million in “processing fee” collected from their victims that now number more than 20, and to stop Mabatid and company from continuing their recruitment operation all over the Philippines and abroad, and from threatening the complainants with lawsuits.

Migrante International says it has collected sworn statements from over 200 other complainants across the Philippines and places like Oman, Saudi Arabia and Thailand who have also accused Mabatid and her PCVC-OA staff of fleecing each of them at least Php100,000.

All the complainants say that they were given the run-around after they paid money to the recruiters. Not one of them managed to get their visa application lodged with Canadian authorities, even if some managed to complete the long list of documents demanded by the recruiters.

Worse, Mabatid’s lawyer warned the Hong Kong complainants through mail  and WhatsApp messages that they faced being sued for breach of  contract and fined Php500,000 for demanding a refund, citing their supposed agreement that stipulated that the fee was non-refundable for whatever reason.

Protest was also against the OEC and the spiralling costs of fuel and food in the Philippines

At the same event, Unifil and its supporters also urged the scrapping of the overseas employment certificate or OEC, saying that with the Christmas holidays just around the corner, thousands of home-bound OFWs would again have to queue up for the document that they need to fly out of the Philippines.

The OFW Pass which is supposed to be phased in to gradually replace the OEC is equally hard to get, said the protesters, and could be used to exact other government fees from them.

The protesters also used the occasion to hit out at the spiraling costs of fuel and basic food items and their knock-on effects in the Philippines, and express support for the Palestinians caught in the crossfire between Hamas militants and the Israeli defense forces.
