Most Filipinos stay away from drugs, says report

The Filipino community, despite being the biggest non-Chinese ethnic group in Hong Kong, has one of the lowest incidences of drug abuse in the last three years, accounting for only 0.3 per cent of the total, according to figures published by the government’s Narcotics Division.

The figures, compiled by the Central Registry of Drug Abuse (CRDA) from among the reported drug abusers, reported young drug abusers and young people arrested for drug offences, also show Filipino drug abusers declined from 16 in 2019 to 15 in 2021, which was in keeping with the trend among the non-Chinese.

The Nepalese had the biggest number of drug abusers among the ethnic minorities, although its count was steadily falling from 239 in 2019 to 186 in 2021, which reflected a decline in percentage from 4.2 per cent to 3.1 per cent.

The other ethnic groups represented were South Asians (Indian, Pakistani, Bangladeshi, Sri Lankan), with 129 or 2.2 per cent in 2021;  Vietnamese with 93 or 1.6 per cent; Filipinos, with 15 or 0.3; British, with 12 for 0.22 per cent; and others with 49 for 0.82 per cent.

But the slack left by the ethic minorities was taken up by the ethnic Chinese, which increased from 88.8 per cent (5,052) of total abusers in 2019 to 91.9 per cent (5,505) in 2021.

Overall, the Action Committee Against Narcotics (ACAN) noted that the number of drug abusers in 2021 increased by 4 per cent (from 5,776 to 6,019) compared with that in 2020.

“This increase was mainly driven by the rising number of reported drug abusers aged under 21, which increased by 44 per cent (from 607 to 873) compared with that in 2020 and accounted for 15 per cent of the total number of reported drug abusers in 2021,” it added.

In its report, ACAN added: “The three most common types of drugs abused in 2021 were heroin, methamphetamine (commonly known as "Ice") and cocaine while the three most popular types among young drug abusers aged under 21 were cannabis, cocaine and ketamine (commonly known as "K"). The number of newly reported drug abusers in 2021 increased by 24 per cent (from 1 596 to 1 979) compared with that in 2020.”

Other findings included: 

  • More people (especially youngsters) were reported to abuse cocaine and cannabis.
  • The numbers of reported cocaine abusers and cannabis abusers in 2021 increased by 47 per cent (from 727 to 1 071) and 33 per cent (from 749 to 994) respectively, compared with those in 2020.
  • The number of reported young cocaine abusers aged under 21 increased by 85 per cent (from 209 to 387) while the number of reported young cannabis abusers went up by 48 per cent (from 326 to 483).

  •  The number of persons arrested for drug offenses in 2021 increased by 20 per cent (from 3 849 to 4 634) compared with that in 2020. For the same period, the number of young arrestees aged under 21 increased by 32 per cent (from 514 to 678), and cannabis was the main drug involved.

Dr Donald Li, ACAN Chairman, said that although the drug situation is generally under control, the community needs to be always on alert, especially with the increase of young drug abusers.

"The COVID-19 epidemic is changing rapidly and brings stress of various degrees to members of the public. However, drug abuse is never a proper way of coping with stress. By taking drugs, one will only get into deep trouble and seriously harm his or her health. Under the epidemic, it is all the more necessary to adopt a healthy lifestyle, relieve stress in a healthy manner, and resist the temptation of drugs firmly," he said.

Pales says she is not crazy to have inflicted this kind of injury on herself  

Hindi naman ako baliw para saktan ang sarili ko.” (I am not crazy to have hurt myself).

This was the lament of Eden Gumba Pales, 37, who sobbed on the phone when asked for her reaction to the acquittal on Wednesday of her former employer on six charges relating to her alleged assault of the Filipina helper over a seven-month period.

In acquitting 35-year-old female teacher Mak Pui-shan, West Kowloon deputy magistrate Li Cheuk-wai said Pales, the main witness in the case, was unreliable, and gave statements that were full of loopholes and flaws.

Mak was acquitted of one count of common assault, three counts of assault occasioning bodily harm, one count of administering poison to Pales – a dishwashing liquid which the employer allegedly mixed with congee which she then forced the helper to eat – and a count of criminal intimidation.

The first five charges were related to various events that allegedly happened at Mak’s family home in Tsuen Wan between October 2020 and May 2021 and the last, on May 29, 2021, four days after Pales left to complain about the alleged assault.

The most striking evidence presented during the trial were photos of the bruises on Pales’ thighs which she claimed were caused by a steel spatula that Mak had used to hit her, and several long scratches on her back which the employer also allegedly caused earlier.

Also part of the evidence of the prosecution was a medical report on the bruises sustained by Pales and a police officer who took her to the hospital for the check-up.

Pales claimed she was never allowed to take a day-off since she started working for Mak in late March 2020 until she was forced to escape in May last year, so how could she have sustained all the injuries shown to the court without anyone knowing about them?

She also asked, what might have been her motivation for bringing false charges against her former employer?

But for the magistrate, the prosecution’s case hinged on Pales’ credibility as a witness, saying the case was one of “one versus one” situation. Ip noted that the alleged victim’s statement were contradictory and that she changed her answers several times during cross-examination.

Among the contradictory statements cited by Li were Pales’ claim that only she and Mak were present when she was forced to eat congee with cleaning detergent, but later said Mak’s husband was in the master bedroom.

Li also noted that the police who searched Mak’s house did not find the actual bottle of cleaning detergent in the flat that the employer had allegedly used in the incident, so the court could not determine if there was indeed poison in it.

The magistrate also pointed out that Pales had claimed the skin on her head became swollen after Mak pulled her hair and banged her head against a wall, yet she did not include this in her written statement with the police.

As for the allegation that Mak had scratched the helper’s back, Li found the claim incredible as that would have involved the employer jumping over a bed and inserting her hands under the helper’s clothes to carry out the alleged assault.

Li also pointed out that Pales had told police that Mak scratched her back once with one hand, but in court, said the employer had used both hands.

Asked why they were 18 scratch marks on her back, Pales told the court some of them were made in the past.

The magistrate also said police did not find the frying pan that Mak had allegedly used to hit her on both her thighs. In court, Pales said there was a mistake in translation because what she had told police was that she was assaulted with a spatula but Li dismissed this as another untruth, saying the helper was well-versed in English.

Pales said she was hurt by the finding that she had been untruthful, and also by the magistrate’s failure to address the various injuries she sustained during what she claimed were repeated assaults on her.

In-between sobs, Pales said the decision made her lose trust in Hong Kong’s justice system.

Kung alam ko lang po na hindi ko makukuha ang justice dito buti pang umuwi na lang ako.” (Had I known that I wouldn’t get justice here I would have just gone home. )

But not all hopes are lost for Pales. According to Kitty Chong, a solicitor at Daly and Associates which is representing Pales in a civil claim against Mak, the case can still be pursued.

“At this stage, we can still pursue the civil claim. However, as to whether we will continue pursuing the same, the decision ultimately lies with Eden. We will be having further meetings with Eden to render advice to her, including the range of any potential damages.”

Chong said her firm was frustrated by the acquittal but since they were not present at Mak’s trial, they did not know yet what the employer had said in court and what led to the magistrate’s finding.

“If there is any potential challenge of the finding of facts, it would be up to the prosecution to appeal the decision,” she said.

But she added a civil case may still be pursued because the standard of proof that is required is not as high as that for criminal cases where a conviction could only be rendered if the charges are proved “beyond reasonable doubt.”

Edwina Antonio, a case officer of the Mission for Migrant Workers who has accompanied Pales during all her court appearances as a witness, was also saddened by the decision. But she said the Mission remains firmly by her side on whatever moves she wants to take next.

Antonio said Pales is in a dire strait as she is a single parent to a 17-year-old daughter whom she has failed to provide for in the past 10 months that her case had been in court.

The Overseas Workers Welfare Administration which has given her shelter has reportedly given the helper a small amount to set up a business back home, but that recently failed.

Pales says her experience in Hong Kong has traumatized her so much that she cannot imagine herself working abroad again. But at the same time, she does not know how she could continue supporting her daughter when she goes home.

Pales, a first-time domestic helper, arrived in Hong Kong on Mar 9, 2020 and moved in with Mak, her husband and their two sons, aged 5 years and 5 months at their Tsuen Wan home after spending 20 days in quarantine.

Pales claimed the first time the defendant attacked her was between October and November in 2020 when the employer pulled her hair and banged her head against the wall when she forgot an order to clean the baby’s toys.

The next assault allegedly happened in mid-February last year, when the baby started crying inconsolably as she tried to let him finish his bowl of porridge. This time, Mak allegedly pumped dishwashing detergent onto a bowl with congee and ordered the helper to eat it.

A few days later Mak allegedly attacked her again for no reason while she was fixing the couple’s bed. The employer allegedly clawed her back, leaving it with about 10 fingernail scratches that caused the skin to bleed.

The worst of the alleged attacks happened on May 25 when Mak was angered by the baby’s crying who refused to finish his congee. Mak allegedly grabbed hold of a spatula and used it to beat the helper’s stomach and thighs.

Pales said she escaped the next day when Mak’s family went out for lunch and went to her agency's boarding house before seeking police help.

During her cross-examination, Pales said Mak destroyed her orginal phone and gave her a new one that she would lock during the daytime and unlock during the night so she could communicate with her family in the Philippines.

As she was not allowed to take a day-off the defendant transferred her entire salary of 4,630 to her sister’s bank account every month.

Pales said she did not disclose the attacks to anyone because she did not want to lose her job as she was the breadwinner in her family and had no savings.

She also said her mother had high blood pressure and could suffer a stroke if she knew about her ordeal.

In dismissing this explanation, magistrate Li said Pales knew her rights very well and could have asked her agency to find her another job.


Fine raised to $25k for disobeying compulsory testing as cases dip to below 7k

Failing to comply with mandatory testing could make you liable to pay a $25 fine

Health officials have reported 6,981 Covid-19 cases on Wednesday, the lowest since Feb 23 and the fifth consecutive day that the infection rate had fallen to four digits.

But as the number of cases comes down, authorities moved to toughen punishment for people who refuse to comply with compulsory testing notices, usually issued for residents in buildings where the virus is found in the sewage, or a cluster of cases are detected.

From tomorrow, the former $10,000 fine will be more than doubled to $25,000 with a jail sentence of up to six months.

Parents who are deemed not to have used their “best endeavours” to ensure compliance by their children of forced testing, could likewise be punished.

Those who refuse to follow quarantine or isolation orders could also be fined up to $10,000 and jailed for half a year.

Health officials say the stricter enforcement rules, approved by the Legislative Council Tuesday night, are being taken to contain the spread of the coronavirus.

Meanwhile, Dr Chuang Shuk-kwan of the Centre for Health Protection said at the daily press conference this afternoon that of the newly confirmed cases, 2,994 were confirmed through PCR tests, and the remaining 3,987 from rapid antigen tests.

They took the city’s infection tally in the Omicron outbreak to more than 1.13 million.

Dr Sara Ho of the Hospital Authority reported 135 deaths linked to Covid-19, pushing the fatality toll in the fifth wave of the pandemic to 7,493.

But she told a reporter that a 12-month-old baby who died at Caritas Medical Centre this morning after lapsing into a coma at his home in Cheung Sha Wan did not appear to be  coronavirus case.

The infant tested negative for the coronavirus on a rapid antigen test. His case will be referred to the coroner for further investigation.

Ho said among the newly added cases today were 117 recorded in public hospitals in the past 24 hours, involving 71 men and 46 women aged 41 to 105. The remaining 18 others tested positive between Feb 25 and Mar 28 but their deaths were not reported on time.

Among the relatively young fatalities was a 41-year-old man who had a record of drug abuse and had burst a vein in his thigh, resulting to massive bleeding.

His death was not likely the result of Covid-19 although he tested positive on Mar 13 and was admitted to hospital on Mar 28 due to an unrelated skin condition.

Another younger fatality was a 45-year-old with late-stage cancer that had spread, a 52-year-old man with kidney failure, and a 58-year-old man who also had cancer.

Ho said 10,702 patients are still undergoing treatment at public hospitals and infection control centres. Among them, 22 are in critical condition, 45 are in serious condition and 89 patients in critical condition are in intensive care.

There were 1,469 patients who recovered and discharged as of midnight last night.

Chuang said no new case was reported from residential care homes although this was not unusual as most of the facilities already had outbreaks earlier.

 

Filipina DH caught in sting job jailed 4 weeks for theft

A Filipina domestic helper who couldn’t resist dipping into the bag of her employer’s mother and taking away $220 found herself in bigger trouble when it emerged she had been set up so she would admit to having stolen a larger amount earlier.

L. Cordero, 31 years old, was sentenced for a total of four weeks in jail at Eastern Magistracy earlier today after pleading guilty to stealing the $220 and about $3,350 in various currencies, as well as a Haagen-Dasz gift card, belonging to her employer.

The first theft happened happened between Jan 8 and 10 in the employer’s house at Pokfulam Terrace.

The defendant took away bills including 150 euros, 20 Japanese yen, US$20, 400RMB, 200 New Taiwan Dollar and 21,000 Korean won; as well as the ice cream gift card from inside a cabinet in the employer’s room.

The employer did not confront Cordero but told family members about the missing money.

Yesterday, the employer’s mother decided to take matters into her hand when visiting her daughter’s house. She put marked money in her wallet and deliberately left her bag with the wallet out in the open while pretending to go someplace else.

Little did Cordero know that apart from the marked bills, a CCTV had been set up to catch her in the act of taking the money from the elderly woman’s purse.

The police were called at about 1:40pm and they found the missing marked money in a cabinet inside the helper’s room.

At the police station, Cordero readily admitted the offences, and said she was forced to steal because she needed money.

In mitigation, her lawyer asked for a suspended sentence, citing Cordero’s clear record, guilty plea, and remorse for what she had done.

The lawyer said the helper first came to Hong Kong in March 2020 and was apparently terminated, but was able to secure a new work visa with her latest employer on Mar 8, 2021. 

Despite being paid $5,000 a month, Cordero was said to be hard up as she sent all her salary to her family back home, where she was supporting her three young children as well as two younger siblings. Her husband worked as a driver, earning the equivalent of $1,500 a month.

The lawyer said the defendant was tempted to steal because of her financial difficulty and was likely to lose  her job as a result of the case.

In sentencing, magistrate Jacky Ip started off with a six-week sentence on the first case, but after giving a discount for the defendant’s guilty plea, reduced it to four weeks. For the second offence, the sentence was two days, to be served concurrently with the first sentence.

FDHs complain of long hours, violence at work

Long hours at work is the top complaint of FDHs.

Almost all foreign domestic helpers in Hong Kong -- 98 per cent, to be exact -- complained of long working hours last year, topping the list of concerns over their work conditions, the Mission for Migrant Workers said in its latest service report.

Cynthia Abdon-Tellez, the Mission's general manager, said this was made worse by the Covid-19 pandemic, which forced many employers to work from home, and their children to study at home.

Since most Hong Kong flats are small, the helpers had been forced to time their work to avoid disturbing their employers, thus spending longer hours daily while keeping themselves busy, she said.

This has also led to mental health issues, not just among employers, but especially among helpers who are forced to compromise and not look for a better work environment, lest they be denied a new visa by the Immigration Department for job hopping if they, she added.

The 2021 Service Report was compiled by the Mission to document the assistance it gave to 8,418 FDHs who approached it last year.

“Our clients usually report more than one problem when they approach us for help,” the Mission said. “For example, someone whose contract got terminated may also complain about illegal collection of agency fees as well as maltreatment.”

Thus, it added, “the percentages presented here are based on incidence reports from the total number of cases.”

While cases were few, violence was an additional burden for women who are migrant workers, the Mission said.

“From cases of migrant workers who experienced torture – wounded with fishing rods and kitchen implements, ordered to carry extremely heavy loads, and denied medical treatment – to the migrant who was raped and became pregnant due to the abuse, these are cases not usually heard in a developed city like Hong Kong,” it said.

In its report, the Mission said that of the 98 per cent who reported working long hours, 27 per cent were working more than 16 hours a day and 72 per cent working 11 to 16 hours.

These numbers were essentially unmoved from the previous year, which saw 98 per cent complaining of long hours, 27 per cent of whom were working for more than 16 hours and 71 per cent working 11-16 hours.

This contrasts with the work conditions in 2019: While those complaining of long hours in 2019 were fewer at 96 per cent along with those working for 11-16 hours at 52 per cent, significantly more were being made to work for more than 16 hours at 44 per cent.

FDHs who were denied statutory holidays also increased last year, with complaints up to 45 per cent from 15 per cent in 2019, before the start of the Covid-19 pandemic in Hong Kong.

Other FDH working conditions improved, however, as shown in fewer complaints during the pandemic compared to 2019:

  • Insufficient food: 29 per cent in 2019 to 14 per cent in 2021,
  • Physical abuse: 25 per cent in 2019 to 1 per cent in 2021
  • Under-payment: from 13 per cent in 2019 to 2 per cent in 2021
  • Unpaid Salary: 3 per cent in 2019 to 1 per cent in 2021
  • Documents taken by employer: 8 per cent in 2019 to zero in 2021
  •  Documents taken by employment agency: 8 per cent in 2019 to zero in 2021
  • Ill-treatment: 25 per cent in 2019 to 7 per cent in 2021
  • Rape/sexual harassment: 2 per cent in 2019 to zero in 2021


Warning against holiday gatherings as Covid-19 cases drop slightly to 7,596

Hong Kong posted a slightly lower infection figure of 7,596 on Tuesday, as health officials warned people not to gather during the upcoming Ching Ming festival and Easter holidays.

The new tally is just slightly lower than the 7,685 recorded yesterday, but is the fourth consecutive day that the daily count has been in the four digits.

Cases confirmed from positive rapid test results numbered 4,432 while there were an additional 3,164 cases from PCR tests conducted by laboratories.

A total of more than 1.13 million infections have been reported in the fifth wave of the epidemic in Hong Kong.

Dr Chuang Shuk-kwan said that while there has been a continuous drop in the daily reported cases, the number is still high and it’s difficult to forecast that no more surge will occur.

Chuang said people should refrain from going out in the coming holidays to prevent a new spike in cases.

The Omicron outbreak intensified after the Chinese New Year in mid-February, prompting the authorities to forbid multi-household gatherings.

Earlier, government health adviser David Hui issued the same warning, saying he was concerned that public gatherings during the upcoming holidays would cause a rebound in Covid-19 infections.

Speaking on a radio show, Hui said there are still a lot of infected persons with little or no symptoms, and they could easily pass on the virus to others if people gathered.

“If more families gather, then the risk of an outbreak is high. I think people should go tomb sweeping on separate days... and people can go on weekends too,” Hui said.

Meanwhile, the Hospital Authority reported 149 additional deaths from Covid-19, including 129 who passed away at public hospitals in the past 24 hours. Twenty others died between Mar 25 and 27 but their cases were not reported on time.

The official fatality toll stands at 7,358 overall, with the death rate at 0.65%. However, health experts say the cases will still have to be analyzed to determine the actual number that are directly attributable to the coronavirus.

Chuang mentioned two deaths involving elderly persons, both unvaccinated, who passed away at the privately-run medical facility at Chinese University which has been accepting Covid-positive cases.

One of them, a 106-year-old woman, was determined to have died from the coronavirus using guidelines from the World Health Organization, said Chuang.

The patient who suffered from chronic illnesses tested positive on Mar 15, and was transferred to CUHK on Mar 21. She passed on yesterday.

The other fatality is a 89-year-old man with chronic illnesses who tested positive on Mar 5 and was transferred to CUHK on Mar 16. Another test conducted on Mar 27 yielded a negative result, but he died of bacterial pneumonia yesterday.

Chuang said the man’s death has been classified as not directly related to Covid.

Responding to a reporter’s query, Dr Sara Ho of the Hospital Authority confirmed the death of a 25-year-old woman with blood-related ailment who was found unconscious at her Kennedy Town home by family members.

The woman was taken to a hospital where she was declared dead. A post-mortem showed she was positive for Covid-19.

Ho said the woman had two doses of a Covid vaccine. Her death will be added to the fatality toll tomorrow.

Two deaths of male patients who were both under 60 years old were also reported.

One was a 43 years old who suffered from diabetes and had undergone surgery following a stroke and brain hemorrhage. Tests done before the surgery showed he was Covid positive. Ho said experts will determine the immediate cause of death.

The other one was 49 years old and a substance abuser who suffered from delusions. Although he tested positive for coronavirus, Ho said it was probably his long history of abuse of psychotropic drugs that caused his death.

Separately, Ho said more than 20, 000 infected patients have been prescribed oral antivirals as of yesterday.

The first drug, Molnupiravir, was prescribed by doctors to residents of elderly care homes from Mar 4, while Paxlovid was dispensed on Mar 16.

Ho said both medicines have proved effective in treating Covid-19 that they are now available at public hospitals, community treatment facilities, designated clinics and elderly care homes.

Thirteen private hospitals have also started prescribing the drugs. Ho said the HA is discussing with the medical industry on whether more private doctors should be allowed to prescribe the drugs to patients.
