Filipina to go on trial on charges of dangerous driving causing death, injuries

A Filipina who works as a family driver is set to stand trial after pleading not guilty today at the District Court to two charges relating to an incident in December 2021 when a car she had parked in Central rolled down backwards at a fast clip, causing death to one bystander and injury to four others.

Reshielle Lagurin Magsino, 45, looked distraught as her lawyer told the court that she was pleading not guilty to one count of dangerous driving causing death, and another of causing grievous bodily harm.

Judge Justin Ko set down the trial for six days starting on July 2 next year, and extended Magsino’s bail of $10,000 on the same conditions as before: that she would submit her travel document to court, not leave Hong Kong, remain at the Deepwater Bay address she had given, and report to the Aberdeen Police Station every Sunday, 6pm to 9pm.

The first charge relates to the death of 27-year-old French woman Elodie Ma, who was rushed to Queen Mary Hospital in critical condition after being run over by Magsino’s car at about 8pm on Dec. 20, 2021 at the junction of Peel Street and Staunton Street. She died less than 24 hours later.

Initial police report said she was trapped under the vehicle with car plate FL9192, and had to be freed by a group of bystanders.

Four others were wounded in the same incident, and were named as Truong Lise Pui Yee (who was initially listed in critical condition but recovered eventually), Riachi Julien, Moroz Dean Ian and Hui Yat-yuen.

In court today, Magsino was accompanied by a group of friends who gave her support. She was not asked to speak and her lawyer was the one who told the court of her “not guilty” plea to the charges against her.

The defense lawyer also said Magsino might be called to testify, along with an expert. Prosecution, on the other hand, said it would call nine witnesses, including police officers and a DNA expert. Short footages from seven CCTVs will also be presented as evidence.

Ang dalawang akusado ay magkahiwalay na humarap kanina sa iisang korte. 

Isang Pilipinang pumirma sa kontrata ng isang Indonesian bilang domestic helper kahit hindi ito nagtrabaho sa kanya ang humarap sa Shatin Court ngayon sa paratang na pakikipagsabwatan sa panloloko sa direktor ng Immigration.

Pinayagan ni Acting Principal Magistrate Cheang Kei-hong na magpiyansa si Juliet Santos, 60 taong gulang, upang makalaya hanggang sa susunod na pagdinig sa Sept. 25.

Pero ang pekeng DH niya na si Ana Miratul Faidah, 30 taong gulang, ay umamin sa naunang pagdinig kanina sa harap din ni Magistrate Cheang na pumirma nga siya ng pekeng kontrata nila ni Santos, at nahatulang nagkasala.

Itinakda ni Cheang ang pagbasa ng kanyang sentensiya sa Sept. 11.

Si Santos at Faidah ay parehong kinasuhan ng paglabag sa Common Law, na sa ilalim ng Section 159( C ) ng Crimes Ordinance ay may parusang hanggang 14 na taong pagkabilanggo.

Ayon sa naunang balita, may 53 aksidente na naitala ngayong unang anim na buwan ng taon lang, na nag resulta sa kamatayan ng 38 katao. Ito ang pinakamataas na bilang sa nagdaang tatlong taon.

DMW lawyers take over inquiry into P1.2M Canada student visa ‘scam’ in HK

Two officials from the Department of Migrant Workers spent nearly the whole day Sunday, August 13, interviewing nine of the 11 Filipino domestic workers in Hong Kong who have filed complaints against Cebu-based recruiters who allegedly defrauded them of more than Php1.2 million.

Lawyers Francis Bagay and Rachel Zozobrado-Nagayo listened to the overseas  Filipino workers recount how they were lured by the recruiters into paying an average of $18,700 each (P132,000) on the pretext that they could secure student visas to Canada for them in just three months.

The complaints were against PinoyCare Visa Center-Opportunities Abroad Visa Processing Services and its officers and staff who came to Hong Kong on February 19 and June 18 this year to recruit applicants, led by their chief executive officer Prisca Nina Mabatid and her lawyer-partner, Russ Mark Gamallo.

The complainants, two of whom were in the Philippines on family emergencies, also named fellow OFW Bryan Apostol Calagui among the respondents, claiming he was the one who enticed them to apply for the student visas through his widely-followed social media platforms.

Apart from their statements prepared by the Mission for Migrant Workers and notarized by the Philippine Consulate General, the complainants also handed videos which captured the promises made by Mabatid and Gamallo, as well as Calagui’s endorsements.

During their talks in Hong Kong, Mabatid and Gamallo told the applicants they could work and earn enough in Canada once they got there on a student visa, that Mabatid would lend them P1million each to support their application, and that they need not worry about getting accepted into a school, or of getting a failing mark. 

They were also assured that their visa application would be approved within only three months at most.

The complainants alleged that the acts by the recruiters constituted human trafficking, if not massive illegal recruitment. Apart from asking that the respondents be arrested and prosecuted for the alleged illegal acts, the complainants are also demanding the return of their money.

After the interviews that lasted from morning and until late afternoon, Bagay and Nagayo told the complainants that they were given 15 days to make their assessments and recommendations, so they could expect to hear of any new developments after that.

Ahead of their visit to Hong Kong, DMW Undersecretary Hans Cacdac told some 20 Philippines-based complainants against Mabatid and company who met with him on August 4 at his office in Pasig City that he was with them in their “advocacy.”

In fact, Cacdac said he had already endorsed the case to the National Bureau of Investigation for possible prosecution.

He added that the case that will be filed on behalf of the Philippine complainants would likely be massive illegal recruitment and possibly, syndicated estafa. Both of these charges are non-bailable, and punishable by life imprisonment if proven.

For those who are abroad and could no longer claim to having been illegally recruited, he said the proper charge would be human trafficking, which is equally severe.

Also consulted by the DMW team who visited Hong Kong were Mission case officers Edwina Antonio and Esther Bangcawayan, who assisted, and helped prepare the complainants’ sworn statements.

Mabatid promised HK applicants a 'loan' of P1M at zero interest to support their applications

The investigators also spoke with The SUN editor Daisy CL Mandap who witnessed how Mabatid promised to refund the applicants’ money after police were called as she and her team embarked on a second recruitment drive on June 18 this year.

Despite her pledge, Mabatid failed to show up at the Consulate the next Sunday, June 25, to meet with the complainants and give back their money.

One of her staff who identified herself as Al Lagradilla said in a phone call to a complainant that Mabatid decided to renege on her promise on the advice of her lawyers, as it was supposedly made under duress.

Filipino who slashed throat in attempted suicide set to go home

A 30-year-old Filipino who slashed his throat with a meat cleaver on Friday, Aug. 4, is on his way to recovery and will likely go home soon.

This was bared today, Sunday, by welfare attaché Dina Daquigan of the Overseas Workers Welfare Administration, when asked for an update on the case.

Daquigan  also confirmed that the Filipino who worked as a gardener in the Shek-O home of one of Hong Kong’s business moguls, tried to kill himself because of a lot of problems, but did not specify exactly what these were.

The Filipino, with the initials J.C., is Ilocano and is married to a fellow domestic worker in Hong Kong with whom he has a son.

According to a Filipina who also works in the Shek-O area, J.C. escaped serious injury because he was discovered by a co-worker shortly after he hurt himself.

The police earlier said they received a call at 9:43am on August 4 from the co-worker who saw J.C. covered with blood as he lay on his bed in their employer’s estate at No 10 Big Wave Bay Road, Shek-O.

Officers who arrived at the scene found him half-conscious, and immediately rushed him to Pamela Youde Nethersole Eastern Hospital in Chai Wan for treatment.

Video footage taken by a local media company showed J.C. bathed in blood, but with a wound that looked superficial as he was taken to the hospital on a stretcher. 

A police report classified the case as suspected suicide, although no suicide note was found at the scene.

Muli na namang nata target ang mga Pilipina sa tinatawag na “parcel scam,” kung saan sinasabihan sila na may pinadala sa  kanilang kargamento mula sa ibang bansa na naglalaman ng mamahaling gamit, pero kailangan nilang magbayad para maihatid ito sa kanilang bahay.

Sa isang post sa Facebook page na DWC Help and Learning Group, tinanong ni Rhea (di tunay na pangalan) kung ano ang dapat gawin ng taong pinadalhan diumano ng ganitong pakete.

Ayon pa dito, ang laman ng pakete ay “laptop, mobile devices, golden jewelries, watches, perfumes, wears (sic), flowers, cosmetics, grocery and brown envelope, etc.” Pinapahiwatig dito na yung sobre ay naglalaman ng pera.

Mga limang araw pa lang daw silang nag cha chat ni James ay agad daw siyang sinabihan na may ipapadala itong mga regalo, at pinadala ang airway bill.

Marami sa mga nakakita ng kanyang post ang agad na nagsabi na scam ang pinangakong regalo kay  Rhea. Sabi pa ng ilan, dapat ay kumpleto na ang bayad ng courier, at ang nagpadala ang dapat sumagot nito.

May nagsabi din na malamang kapag nagbayad  siya ay ang susunod namang sasabihin ay kulang pa iyon dahil na hold sa customs ang pakete, at kailangan siyang magbayad nang mas malaking halaga.

Ganitong ganito rin kasi ang nangyari sa ilang mga biktima ilang taon na ang nakakaraan, na umabot ng ilang libo na ang naipadadala bago nalamang hindi totoo ang ipinangakong regalo, at lalong hindi totoo ang saloobin ng nanuyo at nagpa-ibig sa kanila.
