Ang problema sa pagiging mali-mali

Posted on 27 April 2019 No comments

Call us!

Call us!

Call us!

Call us!

Registered voters in other places can vote in HK, says consul

Consul Timmy at daily briefing on overseas voting

Filipinos registered as active voters in other places abroad can vote in Hong Kong as long as they can get authorization from the Commission on Elections through the Consulate.

This was according to Consul Fatima Quintin, who gave a briefing on the outcome of the overseas voting in Bayanihan Centre today, Apr 26.

“Right now, may authority na puwedeng i-request ng overseas voter na bumoto in Hong Kong or elsewhere, basta active registered voter ka sa ibang lugar. And then we just request the authorization,” Consul Quintin told The SUN at the close of today’s voting.
Quintin said there were some Filipinos who wanted to vote at Bayanihan but could not because they had neither registered here nor in the Philippines.

She made the statement as the daily turnout from the month-long vote dipped to its lowest, with only over 260 casting their ballots.

Quintin said today’s voting was marred by one vote-counting machine failing and having to be replaced by a new one because it could not read a voter’s ballot. A diagnostic feed confirmed the problem, she said.
Around three over-votes were reported but the voters involved did not file protests, Quintin said.

“We reminded the voters to vote 12 senators and one partylist, pwedeng mag-undervote pero huwag mag-overvote. Yung iba naman ay aminado talaga na nag-overvote sila,” she election supervisor said.

She said in cases where votes are invalidated because of over-voting, the election secretariat would rather that a formal complaint was filed so that the cases would be investigated by the Comelec and the voters affected would know exactly what happened.

In similar cases in the past days, the affected voters would immediately blame the Consulate and claim the VCMs were rigged to favor other candidates. Some have even gone on social media claiming there had been cheating.
Quintin admitted that the turnout for midterm elections has traditionally been lower than the presidential election but said the ongoing elections are as important because “50% ng senators and papalitan ngayon.

“Hopefully we’ll have better numbers tomorrow,” Quintin said.

She said one reason for the sluggish turnout could be the voters’ awareness that there are still holidays to come. “Ngayon siguro, better distributed yung voters kasi may holiday sa May 1 at May 13,” she said.

Asked what the Consulate is doing to encourage voters to cast their ballots, she said that at the transaction windows, the staff remind people to vote each time they go there for passport processing or document releasing.

Pinay accused of forcibly feeding ward eyes bind-over deal

The case is being heard in Kwun Tong court

A Filipina domestic helper who has been accused of willfully assaulting her 3-year-old ward may yet be allowed to settle her case by way of a bindover.

The prosecutor in the case of “willful assault” against Marlyn dela Cruz in Kwun Tong Court today (Apr 26) sought  a four-week adjournment of the hearing pending the Justice Department’s action on an application for a bound- over settlement.
Dela Cruz, who worked for a family in Tseung Kwan O, was arrested in early February after her employers complained that she allegedly jabbed a spoon into the mouth of her ward to force the child to eat.

The maid’s act, which happened on Feb 5, was seen by the child’s parents when they reviewed a CCTV footage at home. They reported to the police and Dela Cruz was arrested.
The Filipina has been terminated by her employer since and she now stays at the Consulate’s shelter.

The magistrate adjourned the case until May 24 and approved the defendant’s application for bail.

Under Section 27 of the Offenses Against the Person Ordinance,  it is an offense for someone taking care of a child under 16 years of age to commit an act that is likely to cause the young person unnecessary suffering or injury to health.
The words “unnecessary suffering or injury to health” includes injury that leads to loss of sight or hearing, injury to a limb or organ of the body, or mental derangement.

Pinoy tourist locked up 2½ years for trying to cash fake travelers checks

District Court in Wanchai

A Filipino tourist who tried to exchange US$50,000 worth of fake travelers checks at a money exchange in Central was sentenced to two and a half years in jail after he was found guilty of using a false instrument.

The sentencing of Noel Rambuyon, 42, an aircon technician in Qatar, came just half an hour after District Court Judge Stanley Chan found him guilty of the offence. The defendant was tried for three days last month

The judge rejected Rambuyon’s claim that he went to the Travelex Worldwide Money shop in Central on Feb 6 last year only to inquire if they would change his Thomas Cook travelers checks.

Chan accepted the evidence given by two Travelex staff that Rambuyon had entered their shop and said he wanted to cash his travelers checks which were all in US$1,000 denomination.
Lim Ming-yee, a sales consultant at the shop, said she had undergone training to detect fake bank instruments, and knew right away that what Rambuyon had presented to her colleague Lily Wong was spurious because Thomas Cook did not issue US$1,000 checks.

The staff asked Rambuyon to wait, giving the excuse that it took time to verify the checks’ codes.  Unknown to him, they had already reported the case to the police and were just waiting for them to arrive.

Rambuyon was then arrested and charged with using false instruments.
In his statement to the police, he said the checks were given to him by his sister in Mindanao who said they were bequeathed to him by their father who died two years earlier.

During the trial, Rambuyon’s lawyer had insisted the defendant did not know the checks were fake and had gone to the Travelex shop only to inquire if they changed Thomas Cook travelers checks.

The court was told there were no Travelex branches in the Philippines so Rambuyon had to go to Hong Kong to make the inquiry
Thomas Cook sold its financial services division, including its travelers check business, to Travelex in November 2000.

But Judge Chan, in his verdict, doubted the defense claim.

“In my view, the fact that there was no Travelex in the Philippines does not mean the defendant had to travel to Hong Kong to make an enquiry. There are phones and the internet to make an inquiry,” he said.

Chan also noted the facts that the travelers checks that Rambuyon presented to the bank staff were unsigned; that there are no travelers checks denominated in US$1,000; and that he presented 50 pieces of the documents, for a total value of US$50,000, to the staff.

The judge said there was no doubt the defendant was asking to encash the checks, not knowing that the shop would not make the exchange for that amount of cash to an individual on a single day.

In mitigation, the defense lawyer said Rambuyon was, at the time of his arrest, working  as an aircon technician in Qatar, where he lived with his wife and four children.

The lawyer also said that there was no real loss to Travelex as the checks were fake.

“That’s a fact, not a mitigation,” the judge said.

In imposing the jail term of two and a half years imprisonment, the judge said there was no discount because Rambuyon was convicted after trial.
