HK to study Canadian model for possible FDW work hours regulation

For the first time, the Hong Kong government has committed to look at Canada’s working hours regulation for live-in caregivers to see if they could be extended locally, particularly to migrant domestic workers.
Chief Secretary Matthew Cheung reportedly made this pledge during a meeting at the Central Government Offices in Tamar on May 2 with civil society leaders to discuss various labor concerns, and the need for anti-human trafficking legislation.

Eman Villanueva, who represented the Asian Migrants’ Coordinating Body, said Cheung told the group the government is already doing a pilot test on contractual working hours in five industries.
After this, the scheme will be reviewed to see if it could be applied in other industries as well as to domestic workers, with the Canadian system as a guide.

“This is already a good start even if Chief Secretary Cheung did not promise anything concrete,” said Villanueva, who was the lone migrant worker at the meeting attended by lawyers, ethnic minority rights advocates, trade unions and pan democratic leaders.
Under Canada’s laws, live-in caregivers are obliged to work only a maximum of 48 hours a week. 

In contrast, Hong Kong has not legislated working hours for its workforce, although 44 hours a week is the norm for government employees.
For foreign domestic workers, however, the standard employment contract (SEC) does not provide how long they must work each day. As a result, live-in FDWs work for as long as their employers require them to. Studies invariably show most work no less than 11 hours a day, with a big number working longer than 16 hours.

AMCB, like many migrant support groups, is urging the government to amend the SEC to include a clause for an uninterrupted rest of 11 hours for FDWs, plus meal breaks.
They also want the SEC to stipulate “decent accommodation” for FDWs, and exclude the following as unsuitable and unsafe sleeping places: toilet, kitchen, laundry room, bathroom, living room, corridor, cupboard, veranda, staircase, fire exit, rooftop and others.

Migrant support organizations are also pushing for Hong Kong to sign and ratify, even without China leading the way, the International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families (CMW).
They are also calling on the Hong Kong government to stop the collection of illegal fees from migrant workers, and end its two-week rule and mandatory live-in policies. The two-week rule mandates that all FDWs whose contracts are terminated must leave Hong Kong within 14 days, while the live-in policy requires them to live in their employers’ house.

Hindi alintana ng grupo ni Cheryl Gomez ang malakas na buhos ng ulan noong Sabado, ika-4 ng Mayo, nang maglakad ang kanyang grupo papanhik sa bulubundukin ng Thousand Islands sa Tai Lam Chung,Tuen Mun, New Territories, para makalikom ng pondo para sa kawanggawa.

Umabot sa 10 ang sumama para magsaya at makaipon ng pera para pambili ng gamit ng mga mag-aaral ng Maytaraw Primary School sa Libacao, Aklan.

Kanilang binagtas ang madulas at maputik na daan na may habang 3 kilometro para isagawa ang kanilang misyon para sa kawanggawa. Matiwasay naman nilang natapos ang lakad na inabot ng dalawang oras, kasama na ang panaka-nakang pag selfie.
Ang lahat na kasali ay nagsabing guminhawa ang kanilang pakiramdam dahil sa ehersisyo, at  nakahanap pa sila ng mga bagong kaibigan.

Kabilang sa kanila si Alona Tercepona na nagsabi na hindi naging madali ang kanilang paglalakad dahil medyo madulas ang daan gawa ng pag-ambon ambon, at matalahib din.

“Pero very careful naman kami kaya natapos namin ng safe (ang lakad),” sabi niya.

Ayon pa kay Alona, mahilig talaga ang kanilang grupo na maglakad dahil kakaiba ang tuwa na nararamdaman kapag narating na ang tuktok o dulo ng paroroonan. Ibang klase din ang pakiramdam kapag nakalayo kahit pansamantala sa ingay at gulo ng mga mataong kalsada ng Hong Kong.

Dahil dito ay naisip daw nila na gamitin ang hilig para makatulong sa kapwa o sa komunidad na kanilang ginagalawan.
"I was touched by the sad plight of students and teachers in Maytaraw so we decided to push the hike to help them kahit papaano,” sabi ni Alona na naniniwala daw sa sinabi ni Marianne Moore na, “The heart that gives, gathers."

Hindi pa man natatapos ang kanilang pagpanhik sa Thousand Islands ay naplano na nilang magsagawa ng isa muling hike for charity, at balak nilang isama bilang katuwang sa proyekto ang Wimler Foundation, na nagbibigay tulong din sa mga batang hikahos na nag-aaral sa Pilipinas.
"Dagdag ni Cheryl: "I have been hiking for 10 years though irregularly. Wala po akong sariling grupo noon, kaya kung kani-kaninong group ako sumasama, mapa Indonesian yan or Filipino. Mayroong easy, moderate o extreme hikes, at lahat sinasamahan ko.”

Dahil sa pagsama sa mga hike for a cause katulad ng “One for Bataan” para sa mga nasunugan sa probinsiya, at “One for Porac” para naman sa mga biktima ng lindol sa bayang ito ng Pampanga kaya naengganyo siyang itatag itong lakad na ito.
“I'm so thankful na kahit very limited ang time ng anunsyo suportado ako ng mga kaibigan ko at mga naimbita,” sabi ni Cheryl.

Masaya sila kahit mukhang basang sisiw sila habang naglalakad dahil sa panaka-nakang pag-ulan. 
Kabilang sa kanila si Gigi Lingao na nag-enjoy ng husto sa lakad.

 "Ako yata ang pinaka matanda sa kanila. I enjoyed hiking with them kahit hindi ko kilala yung iba. Feeling young (ako) kasi tawanan kami lagi. Maganda talaga sa kalusugan ang hiking. Doble benepisyo din sa akin kasi my body was energized and I gained new friends.”

Dagdag niya, “Masarap sa pakiramdam kaya kahit 43 na ako pero feeling 30 lang. Isasama ko na talaga sa fitness goal ko itong hiking at least once a month. Nakakawala ng stress dahil unlike kung nasa mall ka puro gastos at temptation sa pagbili ang nangyayari.”
Iba naman ang dahilan ni Chinchin Recasa kung bakit ubod ng saya ang ginawa nilang paglalakad. "Eto ang pinakamasaya kasi some hikers tubig lang ang dala paakyat ng bundok, sa amin puno ang bag ng pagkain.”

Natutuwa daw siya na nakatagpo ng mga bagong kaibigan, at higit sa lahat, ang mapangiti ang mga batang natutulungan nila kahit sa maliit na bagay.

“Para sa kanila, malaking bagay na ito. Sana ay maging inspirasyon nila sa bawat araw ng paglalakad nila patungo sa eskwela na may mga taong handang tumulong sa kanila.”

Pagbabahagi naman ni Belle Gamarcha, “Kahit gaano man kahirap ang daanan ay nagpatuloy lang kami. Positive ang pananaw ng lahat, kaya panay kami kulitan at tawanan, talagang nakakagaan ng pakiramdam.”

Kakaiba daw ang pakiramdam ng mga nag ha hike dahil sa bukod sa sariwang hangin na malalanghap at magagandang tanawin ay may goal ka, yung maabot ang pinakatuktok ng lakaran.
“Pagbaba ninyong lahat at tiningnan mo yung pinanggalingan ninyo, masasabi mo sa sarili mo ang, ‘noon tinitingnan lang kita, ngayon ay narating na kita".

Pagkatapos ng kanilang mahabang paglalakad ay dumiretso sila sa Bayanihan Centre para bumoto kaya naging mas kapaki-pakinabang ang kanilang araw ng pahinga.

Para sa gustong sundan ang kanilang mga hakbang, sumakay lang ng MTR mula sa Central papunta sa Nam Cheong, at saka bumaba sa interchange para sa Tuen Mun. Bumaba sa istasyon ng Tuen Mun at kunin ang exit C. Mula sa palengke ng Tuen Mun ay sumakay sa green minibus 43. Sa panghuling babaan ay makikita ang daan paakyat sa Thousand Island.

3 Pinoy torture claimants fail to stop their deportation

The 3 torture cases are the latest in a series of applications or appeals rejected by the High Court 
Three Filipinos seeking to stop their deportation to the Philippines– one a supposed NPA member, another a target of a murderous drug dealer, and a third, an eyewitness to a rape case – all failed to convince the High Court to back their bids to remain in Hong Kong.

Two failed to secure leave or permission to challenge the decision of the Torture Claims Appeal Board denying their non-refoulement (or against being sent back home) claim, while the other lost his appeal against a High Court judge’s decision affirming the same order.
The judgment in the appeal case was handed down on May 2, while the decisions in the two leave to appeal applications were promulgated on Apr 24 and 30.

Among the three failed applicants is Gomer D Galiza, 33, who claimed that he feared the NPA (New People’s Army) in the Philippines because he chose to steal money and flee instead of following an order by his communist superiors to kill someone in 2014. He entered Hong Kong legally on Dec 30, 2014 but overstayed, and was arrested on Feb 11, 2015. He filed for non-refoulement two days after his arrest.
Since then, he has been fighting to remain in Hong Kong, and his latest court application was for leave for judicial review of the TCAB’s decision on Jan 22 this year denying his challenge to the Director of Immigration’s decision against granting his refoulement claim.

The second applicant is Richard O. Garrillo, 39, who claimed he would be harmed or killed by a drug dealer named Noel because he had reported him to the police in the Philippines. He also claimed to fear the police because he believed they were connected with Noel, whose brother is supposedly a high-ranking police officer.
Garrillo, who worked as a domestic helper between January 2001 and January 2002, said that on his return home, he accompanied a cousin who was a drug dependent to the police to report the drug dealer. But instead of arresting Noel, Garrillo said the police arrested and assaulted him and his cousin.

Garrillo said that while he was in Hong Kong on Dec 23, 2002 he learned that his cousin was killed, so fearing for his life back home, he decided to remain until he overstayed his visa on Dec 29 that year.
He remained illegally in Hong Kong for more than six years, until his arrest on Jan 18, 2009. He filed a torture claim the next day.

In August that year he abandoned his claim, saying he had resolved his problem. However, on Dec 18, 2010, he applied for his claim to be reopened, saying Noel had just been released from prison and could harm him if he went back home.
His torture application went to both the Immigration Director and the TCAB, which both denied the claim. On Apr 10 this year, the TCAB refused to grant him leave to appeal its decision.

In the meantime, Garillo claimed his father was murdered by Noel in 2015, while his brother was killed by the police in 2017.

The third case involves Juanito G. Portillo, who failed in his appeal against a decision by Deputy High Court Judge Josiah Lam denying his application for judicial review against the TCAB’s judgment on Feb 27 rejecting his refoulement claim.

Portillo had sought to convince both the Immigration Director and TCAB that he should not be sent back to the Philippines because his life was being threatened by a group of men in his hometown. The appellant said he was an eyewitness to an attempted rape and murder of a girl by these men in 2006, and they could possibly kill him to stop him testifying against them.
In all three cases, the authorities assessed the applicants’ claim based on the grounds allowed under section 3 of the Bill of Rights (BOR), which are risks of persecution and/or torture; and under BOR 2 (section2) risk of a violation to right to life.

Under BOR 3 risk of torture, an applicant must prove that he has a genuine and substantial risk of being subject to mental or physical torture; cruel, inhuman or degrading ill treatment; or punishment, if returned to his home state. 

BOR 3 “persecution risk”, requires the applicant to establish that he has a well-founded fear that he will face persecution because of race, religion, nationality or membership in a social group or political opinion, if he is expelled and returned to his home state.

Under BOR 2, on the other hand, the applicant must establish that there is a real risk that he will be arbitrarily deprived of his life, have a death penalty imposed upon him; or be the victim of genocide.

The Registrar in the two leave applications, and the High Court through Justice Aarif Barma and Judge Godfrey Lam in the appeal case, all decided that the applicants failed to meet the criteria set out in both BOR 3 and BOR 2 risks.

Further, in the appeal case, the judges ruled that appellant Portillo failed to raise any “viable ground” for his case.

In the leave applications, the Registrar ruled that there was no “reasonably arguable basis” for allowing either of the judicial review applications to proceed, and that there was no realistic prospect of success if leave were to be granted.
