Pinoy Disneyland performer roughed up, arrested by cops in Mong Kok rally

A Filipino male employee of Hong Kong Disneyland is in hospital for examination and treatment of injuries he sustained in a police operation during an anti-extradition bill rally in Mong Kok on Saturday evening, Aug 3.
 
Jethro Pioquinto, a performer at Disneyland, was pinned to the ground and arrested by police who caught up with him, video footages show.
 
Danny Baldon, an officer of the Consulate’s assistance to national section, said Pioquinto was placed in the custody of the North Point Police Station.

But later, he was taken to Pamela Youde Nethersole Eastern Hospital in Chai Wan where he was being treated for injuries he suffered during the police operation, Baldon said.
 
The ATN officer said he was not able to see Pioquinto at the police station because the authorities were investigating him for alleged rioting, so they were strict regarding visits.

Rioting is considered a serious offense that carries a maximum sentence of 10 years in prison.
 
Baldon said the Filipino was being assisted by a group of pro bono Hong Kong lawyers, identified by another source as Progressive Lawyers Group.
 
Friends of Pioquinto said in posts on Facebook that he was just walking in Mong Kok on his way home when he chanced upon an area where police were breaking up a rally that had turned into clashes.
 

A video clip showed police in battle gear running after a group of protesters until a man wearing a black shirt and black jeans tumbled to the ground and was ganged upon and subdued by the officers.
 

Videos of Pioquinto’s arrest were first uploaded online by one of his friends, Jacky Juntaro, who appealed for help on his behalf, and asked people to share his post until the right people are reached.

“Hong Kong police just arrested our Pinoy friend who’s not joining the protest but just passing by Mongkok, and the police knocked him down and arrested him! Pray for our beloved friend!” Juntaro said in his post.

Employer renewed contract of DH who allegedly abused her son, court heard

“You employed a thief, a molester of your son, (but) renewed her contract.”

Thus said defense counsel Phil Chau sarcastically to the mother of an 11-year-old boy whose Filipina nanny faces charges of child abuse and indecent assault.

Chau was cross-examining the mother, Ms Li, in Kowloon City Court on Aug. 2, after the employer testified on the second day of the trial of  Angela Vivo that the family’s maid for more than six years had also stolen various amounts of money from them.

Li accused the Filipina helper of stealing thousands of dollars from the boy’s piggy bank, but Chau said the employer just made this up to discredit Vivo before the Labour Tribunal where she filed a claim for long service award on Oct 9 last year.

Vivo, who had earlier denied three charges of ill-treating and two of indecently assaulting the boy, identified only as “X”, giving evidence as the lone defense witness, denied the accusations.

The trial was delayed anew, this time by a missing hospital discharge summary that the mother claimed she had submitted to investigators but the police could not find.

Chau demanded the prosecution produce the document which shows the results of the alleged victim's medical examination on Sept 10, 2018, a day after the boy allegedly told his parents that the maid had touched his penis “many times".

Vivo had just left the family's house for a vacation that day so she could take care of her sick mother in the Philippines.

Earlier in court, the boy's father, Mr Kan testified that he saw a scalp injury on his son after he took him swimming on Jul 12, 2015, at YMCA. When asked about the injury, X reportedly said “cheche” had pulled his hair.

On Sept 7, 2017, the father saw a bruise on X’s arm. The boy said the maid had pinched him for stepping on her foot.

During cross-examination, Chau said Kan did not know Vivo had told the mother that she accidentally caused the bruise on X’s arm when she saved him from a  passing vehicle.

Chau got Kan to admit that contrary to his statement, he was not at the agency, Star Care Employment Agency, when Li and X met with Vivo there after the boy was found to have bruises on his arm and leg.

At her turn to testify, Li told the court she found out about X’s scalp injury through a photo her husband showed her. They reported it to the agency.

But during cross-examination, Li was asked why she waited for three years, before telling the police about the alleged assaults.

Li replied a Labour Tribunal officer told her to report them to the police only after she mentioned the assaults  in a claim hearing.

Chau asked her if she had the boy undergo medical exam, and Li replied “yes”. She said she gave the report to police, but the prosecutor said he did not have the report on his file.

The lawyer also grilled Li about whether she fired Vivo but she said the maid left on her own. Chau got her to admit Vivo just wanted to go home for two months to take care of her sick mother and was planning to return to her job because she needed money for her mother’s medication. 

The first day of the trial was used mainly to show two video recorded interviews of the boy in Cantonese on separate occasions, in Nov 2018 and January 2019. He also testified on video from another room in the courthouse.

Magistrate Wong adjourned the trial until Aug 8 to allow the police to investigate and locate the missing piece of evidence, or apply to Queen Elizabeth Hospital for a new one. Vivo's bail was extended under the same conditions until then.

Maagang nakapag-asawa si Weng at maaga din siyang nagkaroon ng anak. Sa kasamaang palad ay naging iresponsable ang kanyang kabiyak at iniwan pa silang mag-iina kaya napilitang mangibang bansa si Weng.

Mag-isa niyang itinaguyod ang dalawang anak na tatlong taong gulang at pitong buwan pa lamang. Tiniis niyang mawalay sa mga anak sa mura nilang edad pero wala siyang magawa dahil gusto niyang mabigyan ng magandang kinabukasan ang mga pinakamamahal niyang mga anak.

Iisang direksyon lang ang tinahak ni Weng, ang mapaaral ang mga anak na lumaki na parehong matalino. Habang lumalaki sila ay lumalaki din ang kanilang mga gastusin pero hindi nawalan ng pag-asa si Weng na matatapos din ang kanyang paghihirap.

Umabot ang maraming taon at nanatili pa rin sa ibang bansa si Weng para kumayod. Pero ayon sa kanya ay malapit nang matapos ang kanyang pag-atang ng responsibilidad sa mga anak dahil magtatapos na ang kanyang bunso sa kursong HRM-Tourism.

Nakapagtapos na rin yung panganay niyang anak na lalaki na kumuha ng kursong Criminology at nakapasa kaagad sa board exam, kaya umuwi siyang may malaking ngiti sa labi para sa dobleng selebrasyon- ang pagtatapos ng kanyang bunso at tagumpay ng panganay.

Kabilang sa mga natuwa sa kanyang magandang kapalaran ang kanyang butihing amo na inimbitahang pumunta sa Hong Kong ang bunso ni Weng, ina at isang pamangkin. Regalo daw iyon ng amo sa pagtatapos ng pag-aaral ng bunso ni Weng.

Laking pasasalamat ni Weng sa Diyos dahil nalampasan niya ang hamon ng buhay.

Edad 21 taong gulang lang siya nang mag-abroad sa unang pagkakataon sa Middle East, hanggang lumipat siya sa Hong Kong.

Boy, 11, testifies against Pinay maid accused of abusing him

By Vir Lumicao An 11-year-old boy testified on Aug 1 against a Filipina domestic helper accused of ill-treating and indecently assaulting him. The alleged victim identified only as “X” was the first witness to be called after the trial got underway in Kowloon City court. He was first briefed by Magistrate Raymond Wong through a video chat in which he could only speak with the magistrate and the prosecution and defense lawyer. Thursday’s session, however, was mainly used to view two video recorded interviews in Cantonese of the boy by the prosecution on Nov 5, 2018 and Jan 3, 2019.

The defendant, Angela Vivo, who has denied three charges of ill-treatment and two of indecent assault on the boy, watched quietly as the video recorded interviews were played back on a big screen.

In the earlier video interviews when the boy was much younger, he looked bored and inattentive,shifting from side to side or curling up on his seat.

But the 11-year-old boy who was interviewed by Magistrate Wong looked serious and replied promptly as he was asked questions apparently meant to gauge his comprehension
Asked by the magistrate if he knew the difference between telling the truth and telling a lie, X said: “Telling the truth is telling facts, telling a lie is no one would believe you. “

The first count of ill-treatment against Vivo allegedly happened sometime in February 2016 near the Yaumatei Fire Station, the second in July of the same year in the boy’s house, and the third near the Mongkok Police Station on Sept 7 last year.

Vivo is also accused of indecently assaulting the boy in his home between 2016 and 2017, and again in 2018.

Suicide victim’s family to get payout from insurance

The family of a Filipina domestic worker who took her own life due to stress over financial problems stands to get more than Php600,000 from her mandatory insurance coverage plus death benefits from the Overseas Workers Welfare Administration.

That’s because the 40-year-old victim was a first-time overseas Filipino worker, and was still covered by the two-year mandatory insurance, and was an active OWWA member.

Her two-year contract would have lapsed this coming September.

According to Welfare Officer Virsie Tamayao, OWWA benefits cover death by suicide because stress is considered as a health-related concern of OFWs.

The compulsory insurance, which first-time OFWs are obliged to take before leaving the Philippines, appears to have been patterned after the OWWA coverage.

In a Q&A posted on the website of the Philippine Insurance Commission, item no 12 states categorically that suicide is covered under the “Agency Hired OFW Compulsory Insurance.”

The Q&A further states that the “the usual 2-year contestability period in insurance contracts is not applicable for the Agency-Hired OFW Compulsory Insurance.” This means that once the worker is deployed, he or she is automatically insured for death by suicide within two years.

The victim, who was single, plunged to her death on Jul 22 from her employer’s flat at Manhattan Hill residential tower in Lai Chi Kok, Kowloon, exactly one week after another Filipina apparently committed suicide in Cheung Sha Wan.

Officers said the victim was already dead when they arrived and there were no suspicious circumstances involved. They said her death was related to monetary problems and debt.

Tamayao, citing Consulate records, confirmed that the victim was apparently troubled by debt.

A public viewing of her remains has been set for Sunday, Aug 4. The body will be flown to her hometown in Quezon province the next day.

Commenting on the tragedy, outgoing Labor Attaché  Jalilo dela Torre said in a Facebook post: “There’s not much we can do because those are extremely personal decisions.

“But if you know of any friend or relative suffering from depression, you may reach out to the Good Samaritan,” he added, in reference to a Hong Kong NGO that provides telephone advice to people suffering from depression.
