The all-Filipino migrants group of art enthusiasts, Guhit Kulay, has marked a milestone with the opening of its art exhibit at the Consulate on Dec. 8, to mark International Migrants Day. Deputy Consul General Germinia Usudan cut the ribbon at the opening rites. The art exhibit, the first by a migrants group in the Consulate, will run till Dec 15.

Community members examine the works of art.
About 100 people attended the opening of the landmark exhibit titled “Obra: Likhang Sining at Galing ng Migranteng Pilipino.” The day’s highlight was a coloring contest in two cat-egories: adults and children. For Dec 15, a face painting contest is set to be held.

The works came in various genres.

According to GK president Noemi Manguerra, the group members now number 30. It took them nearly six months of preparation – given that most of them are off only once a week – to mount the exhibit, which features not just paintings and sketches, but also sculpture, photography, solar art work, self-designed and sewn gowns, and fashion accessories.

GK was formed two years ago by a group that attended an art workshop at the Consulate given by Pintura Circle, an art group made up of Filipino Hong Kong residents. The co-founders were, apart from Manguera, Cristina Cayat, Cecil Eduarte and Ruby Timtim.

The group’s membership grew rapidly following a series of art jamming sessions organized by GK to encourage like-minded migrants to gather and give vent to their passion. Since then, they have been invited to hold their own art exhibits, notably by groups such as Enrich and NIDO Hong Kong.

In the first quarter of last year, GK was among participating groups of artists in “Beyond Myself,” a traveling exhibit co-organized by Enrich and was held in London, Manila and Hong Kong.

The participating artists in the exhibit are: Noemi Manguerra, Cristina Cayat, Cecilia Eduarte, Divine Olavides Dela Torre, Jacklyn R. Ex-DH jailed for different birthdays on passports

Magistrate ordered the defendant jailed after she decided to use her real birth year in her new passport

A Filipina former domestic helper has been jailed for 12 weeks after admitting that she had used passports with different dates of birth to enter Hong Kong.

E. Gaddi, 63, an industrial engineer who came here to work as a maid in 2011,  pleaded guilty before Shatin Magistrate Wong Tsz-ho on Dec 17 to three counts of making a false statement to Immigration officers.

The prosecution charged that on Dec 19, 2011, Gaddi presented to an Immigration officer a passport issued in 2008 that stated her date of birth as Apr 13, 1957. The defense lawyer said Gaddi’s real birthday is Apr 13, 1956.
In the second charge, the prosecution said the Filipina presented on May 23, 2013 a new passport still giving her birthday as Apr 13, 1957 to apply for a visa extension.

On a recent visit to Hong Kong on Jul 15, 2019, Gaddi presented to an Immigration assistant another passport that again showed her birthday as Apr 13, 1957.

Gaddi was stopped on Nov 15 at the Hong Kong-Macau Ferry Terminal when she presented a passport with an Apr 13, 1956 birthday, as did not match her Immigration records.
A check of her HK and Macau IDs showed Apr 13, 1957 as her birthday, the prosecution said.

The defence lawyer said Gaddi had used Apr 13, 1956 when she applied for a passport in 2008, but when she got the document, she noticed that the birth year was wrongly stated as 1957. Despite this, she used the passport to apply for a work visa to Hong Kong on Dec 19, 2011.

When she applied for a replacement of the 2008 passport on Jun 24, 2013 so she could process a new contract, Gaddi reportedly asked the Consulate to amend the wrong data but was told they could not do that here, the prosecution said.

During mitigation, the defense lawyer said Gaddi used to have a good job as an industrial engineer, but she got sick of ovarian cancer and quit after her second surgery.
She studied the food supplements business before she came to Hong Kong in 2011.

She returned to Manila in November 2014 but still made trips to Hong Kong to visit a niece who is a resident working here.

The defense lawyer said Gaddi later went to Macau in 2017-2019 to work as a helper to support her sick father and to start her food supplement business there. She got the job through an agency.

The lawyer said Gaddi later sought the agency’s services to apply for a new passport using her real birth year. An Immigration officer noticed the discrepancy when she used the passport to come to HK on Nov 15.

The defense counsel asked for leniency, saying that Gaddi did not intentionally change her birthday data for criminal intentions and she pleaded guilty to show remorse.

Magistrate Wong gave her eight weeks in jail for each charge, with the sentences for the second and third charges taking effect after the second and fourth week.

High Court orders retrial of Filipina convicted of theft

Posted on 18 December 2019 No comments

The judge upheld the defense claim that the magistrate failed to consider evidence of a possible set-up

The High Court has allowed a Filipina domestic worker’s appeal against her conviction for theft of 1,700 renminbi from her employer, and ordered a retrial, the date of which will be fixed at Eastern Court.

Judge Frankie Yiu set aside the verdict of Eastern Magistrate Lam Tsz-kan on May 16 finding Ana Liezel Berbana guilty of the charge.

The judge upheld the argument by Berbana’s lawyer, Philip Ross, that the magistrate had ruled based on incomplete evidence and incomplete police investigation.
First, Ross said Lam erred in rejecting the defense of fabrication by failing to consider all opportunities that Wong had to plant the alleged stolen property in Berbana’s jacket.

Secondly, Ross said the magistrate erred in rejecting the appellant’s account of why she signed a police notebook after a search of her room was done, rather than signing before.  The defense lawyer said Lam failed to consider the evidence in support of Berbana’s claim before declaring it “unreasonable, and therefore, not credible.”

Ross applied for costs, saying is has been a year since the alleged theft happened and a retrial could take months. If the magistrate had considered the strength of the defendant’s evidence, she would never have gone through this trouble, he said.
“The money has been returned and she hasn’t got a job for a year,” the lawyer said.

But Judge Yiu said he could not grant costs because the case would still be retried.

Berbana was exultant after Judge Yiu pronounced his decision.

“Panalo ako rito, wala naman talaga akong kinuha,” she said.
Before the hearing, she said outside the courtroom that Lam had ignored her evidence that the police made her sign a search document without searching.

Ross, who represented Berbana through Legal Aid in the previous trial, said he would defend her again in the retrial if she nominated him.

Berbana, now 34, was arrested on Dec 21, 2018 for allegedly stealing 17 pieces of Rmb100 banknotes from her employer’s money box. Berbana pleaded not guilty but was convicted by Lam and sentenced to six weeks in prison on May 16.

The defendant claimed during the trial that Wong made up the theft charge out of spite because she had complained about using her own money to buy food for the household.

Despite her conviction, Berbana was able to pursue her claim for one month’s wage in lieu of notice, unpaid salary, annual leave, air ticket, and food and travel allowance in the Labour Tribunal.
