FDHs issued rare notices to act as court jurors

Most jury trials are held at the Court of First Instance in the High Court

A number of Filipina domestic helpers have expressed alarm on receiving letters from the Hong Kong Judiciary recently, informing them that they are being added to the list of people who may be called as jurors in court trials or inquests by the Coroner.

In the first week of October alone, at least six Filipina members of Domestic Workers Corner, a Facebook group, received the notice from the High Court Registrar. The letters sparked concern because it is rare for FDHs to get the notification.

However, at least one of DWC’s administrators, Bebs Leonardo, said she received the same letter in August last year, but decided not to respond to it because her employer reportedly told her that FDHs are exempted from jury service.

The standard letter states: “Whereas it appears that you are a person (a) qualified to serve as a juror under section 4 and (b) not exempt from service as a juror under section 5, you are hereby notified that your name will be added to the list of jurors, unless 14 days after the receipt of this notice, you notify me in writing that you claim exemption from jury service…”

The letter said the recipient can claim exemption if he/she is not qualified for the jury service under section 4 of the Jury Ordinance and that he/she is exempt from service as a juror under section 5.

Otherwise, their names would be placed in the potential list of jurors and they should be ready to comply when summoned to appear in court, where a further elimination process is made to select the seven people who will sit through the trial, and render judgment.

Those who are exempted from jury service include diplomats, judges and their spouses, lawyers, police officers, journalists, teachers, students and members of the People’s Liberation Army.

The list does not include FDHs, although theoretically, the nature of their job which could entail taking care of infants and elderly people, is a ground that they could use to ask for an exemption.

Another ground that can be used is if the juror is able to satisfy the court or the coroner that he/she has no sufficient knowledge of the language to be used in the trial, which is often English, but may also be Cantonese.

DWC founder Rodelia Pedro Villar says members who received the notice mostly had some qualms.

“Natakot sila kasi they are not aware at hindi alam ano dapat gawin,” Villar said.

But she said at least one member was happy, claiming she had already been selected as a juror. However, she did not know what she was expected to do in court.

Another notified member was apprehensive, saying she had no criminal record. But she said she was waiting for a feedback from her employer before replying to the registrar.

“I am not aware that we domestic helpers are part of this. I advised those [notified] members that they need to give attention and ask for help on what to do,” Villar said.

Jury duty, while exciting for some, is avoided by others because a trial could last for weeks, even months. The longest jury trial ever recorded in the High Court was the Carrian civil case, which lasted for a year.

But once called for jury service, a person must show up in court and comply with the order. If a juror does not show up when called or withdraws after appearance without the judge’s permission, he/she shall be guilty of an offense and liable to a $5,000 fine unless a valid reason is given.

The Jury Ordinance also penalizes an employer who terminates, threatens to fire or discriminates against a worker for performing jury service. He shall be guilty of an offense and liable to a $25,000 fine and 3 months imprisonment.

The High Court registrar compiles a provisional list of jurors once every two years in or before October, and the jurors will be confirmed in or before the following February.

Each week, the registrar draws at random from the list a number of jurors to sit in a trial by jury, which could be civil or criminal in nature, or an inquest by the Coroner. At the end of the trial the jurors are the ones who render judgment.

In a civil case, they are called upon to decide whether there was merit in the claim, even the amount that should be paid to the claimant. In a criminal case, they will decide whether the defendant is guilty or not. In an inquest, they decide the cause and circumstances that led to death.

“Jurors are not legal experts and so they are given clear directions on points of law by the trial judge. The personal responsibility of each juror is to ensure that justice is done... not merely to the person on trial but also to the whole community,” the Judiciary says.

Under the Jury Ordinance, a Hong Kong resident can serve as a juror if he/she has reached the age of 21 but is not yet 65; of sound mind and has no disabilities such as hearing or visual impairments. He/she should be of good character and has sufficient knowledge of the language (Chinese or English) of the court proceedings.

The selection process starts with the Commissioner of Registration compiling the personal data of a person who appears to be qualified and sends these to the High Court registrar, who notifies the person that his name is about to be added to the jurors list.

A summons requesting the presence of the juror in the High Court or the Coroner’s Court will be sent by registered post at least 21 days before a trial.

People who sit in a jury trial are paid an allowance by the High Court for each day of their appearance.

Mandatory testing for Covid-19 being studied amid spike in cases

Health officials say they want to make testing mandatory for certain high-risk groups

Two senior Hong Kong health officials have indicated that the government is looking at the legality of requiring all residents to undergo tests for Covid-19 amid signs that the local outbreak is worsening.

Health and Food Secretary Dr Sophia said in a news conference this morning, Oct. 8, that requiring certain groups of people to undergo tests would allow experts to come up with appropriate measures to contain the outbreak.

Currently, the only ones required to take the test are newly arrived travelers and people classified as close contacts of confirmed patients. A voluntary testing scheme is also in place for people deemed as high-risk, such as care home workers and drivers of public transportation.

Her statement was echoed at a later news conference by Director of Health Dr. Constance Chan, who said, “The coronavirus pandemic is deteriorating, and the situation is worrying.”

She said in the past week, a total of 12 cases with unknown sources were recorded. The week before, there were only two such cases.

She also said that calculations by experts at University of Hong Kong showed that the reproduction rate of the coronavirus has risen from negative one, to one, meaning one patient is infecting another on average.

The viral load detected in some cases is also high, meaning they are very infectious.

Dr Constance Chan spoke at the daily news briefing on the Covid-19 situation, where it was reported that in the past 24 hours, 18 new cases were reported, of which only 4 were imported. Of the 14 local cases, one had an unknown source.

Most, or 11 of the cases, were from an outbreak at Home of Treasures care home for disabled people in Kwai Chung, where the first case was reported yesterday.

Dr Chuang Shuk-kwan from the Centre for Health Protection said another patron of the China Secret Bar in Tsim Sha Tsui where nine other cases were linked earlier, was also a confirmed case today.

Another linked case is a family member of a previously reported infected patient.

The only case with no known source of infection is a 65-year-old male retiree who lives in Braemar Hill Mansions in North Point, and regularly visited the Fitness First gym in Hopewell Centre in Wanchai.

The imported cases included two returnees from India, another from Tunisia, and the fourth was an air crew from Russia.

Dr Constance Chan said that in response to the spike in local cases, the Hospital Authority has extended the operation hours for the distribution of specimen bottles in 46 GOPCs (general out-patient clinics).

The clinics will  now open from 9am to 1pm, and 2pm to 6pm, Monday to Wednesday, to distribute the bottles to people in high-risk groups.

The government is also considering setting up provisional testing centers in areas where many of the new cases were detected, specifically Kwai Chung, Kowloon City, Tsim Sha Tsui and Wanchai.

In addition, health and tourism officials will meet with hotel representatives to look into the possibility of enforcing gathering regulations in hotel rooms. Dr Chan said they had been informed that many young people use their “staycation” bookings in hotels to hold parties.

She reminded young people of the danger of bringing home the virus that they may acquire from social gatherings, and possibly infect elderly relatives.

The health director said many of the young patients often only have mild symptoms, but the elderly are vulnerable. Nearly 50% of all Covid-19 related deaths were patients 80 years old and above.

But as to the possibility of bars being shut again because of the resurgence in infections among its patrons, Dr Sophia Chan said it would be a last resort.

She said representatives of the bar sector had promised to step up anti-epidemic measures when they met yesterday. These include having their staff tested, and requiring patrons to make health declarations.

Maid jailed 3 weeks for using bosses’ Octopus cards for fares, shopping

A 36-year-old Filipina helper was jailed for three weeks today, Oct 7, at Eastern court, after she admitted stealing the auto-reload Octopus cards of her employers and using $417.30 of their stored value for her fare and to buy clothes.

C.L. Bastillo walked meekly into the holding room escorted by police after pleading guilty to four counts of theft, followed by her sentencing by Magistrate Bina Chainrai.

The helper admitted stealing the auto-reload Standard Chartered Octopus cards of her female employer Wan Yuk-ki on May 25 and her male employer Yeung Chuk-sheng’s auto-reload HSBC Octopus card on July 5.

In the two other charges, she admitted using the cards to pay for her transportation fares and to buy goods.

The prosecution said that Bastillo had been employed by the Chinese couple since October 2019 to help another maid with the chores in their flat at Valiant Park, 52 Conduit Road, Mid-Levels, Central.

Kwan usually put her card in her wallet while Yeung kept his in his phone case.

In June, Kwan discovered the theft when the Octopus card in her wallet lacked the add-value function. She found out it was the card she gave Bastillo on her first day at work, and it had been switched with her own.

A check with the Octopus card provider showed a total of $26 of stored value had been used to pay bus fares.

On July 5, Yeung tried but failed to access the car park at Valiant using the Octopus card in his wallet. He found out it was his wife’s card. He checked the CCTV footage and saw Bastillo take his Octopus and replace it with his wife’s at 3:10pm that day.

The couple did not confront the maid for fear of the safety of their sons, aged 4 and 2.

On Aug 4, Yeung suspected his card was used for other transactions and checked with Octopus Hong Kong. He learned $391.30 of stored value was used to buy goods between July 5 and Aug 1, including $198 worth of clothes at Giordano and $39 at Bossini.

The prosecution said the maid handed her resignation on Aug 15 and admitted taking the cards and using them to pay her fares and to buy clothes. The couple reported the case and Bastillo was arrested. A search of her locker yielded Giordano and Bossini receipts.

In mitigation, the defense lawyer asked Chainrai to impose a fine, but the magistrate refused, saying the maid’s offenses were premeditated and constituted breach of trust. The counsel also cited his client’s labor claims against her employers, but Chainrai said they had nothing to do with her police case.

The magistrate sentenced the helper to three weeks in jail for each of the four offences, with the sentences to run concurrently.

CG tells CARD graduates to share their learning and be ‘positive influencers’

Congen Tejada told graduates, spread the word about CARD's important lessons 

Consul General Raly Tejada has exhorted overseas Filipino workers who graduated from the first virtual training given by CARD Hong Kong Foundation to keep up their good work and spread the word about what they had learned.

In his keynote speech at the landmark event, ConGen Tejada said: “Continue doing good works and be positive influencers in the community.”

The online ceremony held on Sept 27 honored 25 OFWs who completed CARD HK’s first online financial literacy program, and 19 in entrepreneurship training.

The basic fin-lit lessons took five Sunday sessions, and the entrepreneurship which included business planning and presentation, took three sessions. Seven trained OFW trainors led by Victoria Munar, plus the foundation’s co-founder Edna Aquino, chair Alex Aquino, and CARD Philippines’ Jireh Duhina took turns doing the online lectures.

ConGen paid tribute to CARD HK for not letting the coronavirus contagion stop it from remaining true to its advocacy of providing financial education to OFWs so that they may be assured of a better future when they go home for good.

“(Fortunately) CARD was one of the very few organizations that remained undeterred by the global pandemic, and through sheer persistence, adapted to the new normal by delivering its training programs through digital and online platforms,” he said.

He also cited the graduates for taking time to join the training, and in the process, “transform (their) stories of defeat and desperation, to one that celebrates a victorious homecoming.”

He called the graduates “living proof and example of every OFW’s desire to build a better life for themselves and their families.”

In his speech, Dr Aristotle Alip, chairman emeritus of CARD NGO in the Philippines, and founder of the conglomerate that make up CARD MRI (Mutually Reinforcing Institutions) said online training has paved the way for his group to reach more OFWs all over the world, including those who lost their jobs due to the pandemic.

He said the huge number of OFWs forced to return home would further push up the country’s unemployment and poverty rates.

Latest government figures indicate nearly 50% of the country’s adult population is now out of work, while the poverty rate is expected to top 17.% of the total population of 110 million, or nearly 16 million people.

Alip said CARD MRI’s clients now total about 7 million, and by the year’s end, this number is expected to increase by about 10%, or 700,000.

CARD MRI’s mission to help the country’s poor could get a boost if more people are able to access its financial literacy program, said Alip.

“The Philippines is ranked as among the lowest in terms of financial literacy which is quite sad, but again, this is an opportunity for all of us (to get the message across),” he added.

Alip said there has already been a number of requests to CARD “from many parts of the world” to bring its fin-lit program to them.

Also among the speakers was Edna Aquino, who spoke of how CARD Foundation managed to hurdle initial challenges to bring its programs for OFWs across the digital divide, while Alex Aquino spoke of how online learning has helped the Foundation advance its mission to help Filipinos abroad.

OFWs 50 years old and above can get free flu shots at Polo

If you are an overseas Filipino worker aged 50 years old or older, you can get a free influenza vaccine at the Philippine Overseas Labor Office.

The project is part of the Hong Kong Health Department’s Vaccination Subsidy Scheme (VSS) to be launched this Thursday, Oct. 8.

The free flu shots to be administered in Polo will be given on three successive Sundays starting on Oct. 11, and on Thursday, Nov. 5, in its conference room on the 29th floor of United Centre building in Admiralty.

The free vaccination will be given from 10:30am to 2:30 pm. The only requirement is for the worker to bring her Hong Kong ID card.

Under the main vaccination program or VSS, those qualified to get subsidized vaccination are all residents aged 50 and above, children aged 6 months to under 12 years old (primary students), and persons with disabilities or those receiving disability allowance.

All qualified residents may go to enrolled private doctors in their clinics to receive the shot, which is subsidized by the DH up to $240 per dose.

A government statement said enrolled clinics are allowed to charge an extra fee, although around 40% of them do it without charging extra.

Enrolled doctors are supposed to display the VSS logo near the entrance of their clinics and a poster showing their charges.

The list of enrolled doctors and their service fees after deducting the government subsidy has been uploaded to the eHealth System (Subsidies): (apps.hcv.gov.hk/Public/en/SPS/Search).

In addition, under the Seasonal Influenza Vaccination School Outreach, a government outreach team will provide free vaccinations for schoolchildren in participating schools.

The outreach service for kindergartens, kindergarten-cum-child care centres and child care centres will start on Oct 8 while the service for primary schools will begin on Oct 22.

Parents of eligible children who do not receive the free shots in the school outreach can arrange to have subsidised vaccination for their kids in private clinics enrolled in the VSS.

A statement from the Centre for Health Protection said influenza viruses and the coronavirus that causes Covid-19 will possibly both spread this coming winter.

A person getting influenza and Covid-19 at the same time may be more seriously ill. Thus, getting the flu vaccine at the onset of winter is very important.
