Filipina DH wins sexual harassment suit vs absent male employer

The EOC filed the case on behalf of the Filipina after attempts at conciliation failed

A Filipina domestic helper who sued her Canadian male employer in District Court in July for masturbating in front of her and walking around the house naked has won her claim for damages which have yet to be assessed, plus costs. 

But enforcement of the ruling is another issue, as respondent Sean Joseph Scully returned to Canada for good on Jul 23, three days after the Equal Opportunities Commission filed a sexual harassment case against him on behalf of the victim.

In the decision written by Chief District Judge Justin Ko and published on Oct 21, Scully is said to have flown home to Canada after rejecting the court notices that were being handed to him at the airport by a male co-teacher at Fung Kai Liu Yun Sum Memorial School.

Instead of accepting the court letters which were posted to his school, Scully took them then wrote “Moved to Canada, Return to sender” before handing them back to his colleague, a Mr Au-yeung.

Judge Ko said he accepted that “the respondent must have realized what he was being served were court documents that required his attention and that the personal service effected on 23 July 2021 was valid.”

He dispelled doubts about service of the notices by saying there had been an exchange of correspondence between the EOC and Scully previously during attempts at conciliation,  before the proceedings against him began.

Despite having been properly served notice of the claim against him, Scully did not respond to the court summons, nor attended the hearing set for Sept 23.

The judge was thus forced to hear the case in his absence, and render judgment in favor of complainant Jinna D. Licayo, who originally claimed $150,000 in damages for her injured feelings, $20,000 in punitive or exemplary damages, plus costs and interest.

But at Licayo’s request, the judge dispensed with two of the items set out in her claim due to the absence of the respondent. This pertained to an admission by the respondent that he committed the act complained of and promise not to repeat it; and issue a written apology.

She instead asked the court, through the EOC, to assess the amount of damages that is due her.

"For the above reasons, I enter judgment for the claimant against the respondent for damages to be assessed with costs up to and including this hearing, to be taxed if not agreed," said the judge.

According to the claim, Scully hired Licayo as a stay-in domestic helper on Sept 12, 2017. Her primary duties included taking care of the couple and three children.

The helper said that from October 2017 to January 2019, Scully had sexually harassed her continually by “making unwelcome sexual advances… and/or engaging in unwelcome conduct of a sexual nature in relation to her”, in the words of the judge.

She accused the employer of entering the bathroom naked while she was taking a shower, masturbating in front of her, walking around the house naked in her presence, and making unwelcome sexual requests and remarks.

The victim said Scully’s acts offended, humiliated or intimidated her, creating a sexually hostile and intimidating work environment for her.

On Feb 25, 2019, Scully fired the helper. She filed a claim a month later at the Labour Department for outstanding wages and entitlements under her contract and the employer settled.

On Mar 29 that year, she lodged a sexual harassment complaint with the EOC against the employer. The EOC informed the respondent about the claim in a series of correspondence.

When the conciliation attempt fell through, the EOC told Scully in a letter dated May 3, 2021 that legal proceedings would be initiated against him if he did not respond to the last offer from Licayo within 14 days.

Getting no further word from the respondent, the EOC filed the case with the District Court.

Backing up the claimant’s position that there was sufficient service of notice to Scully were affidavits from Mr Au-yeung and affirmations from Ms Lam, executive officer of the school, and Ms Wong Hoi-ting, legal counsel of the EOC.

HK suspends Emirates Airlines after flying in 3 infected people

It's the second suspension for the Emirates flight in two months

Hong Kong authorities have banned flight EK384 operated by Emirates Arilines from flying in from Dubai for the next two weeks, after three of its passengers tested positive on their arrival tests.

The Centre for Health Protection said in a statement today, Oct 27, that the three passengers had taken the flight which originated from Bangkok, Thailand, then on to Dubai, United Arab Emirates, before arriving in Hong Kong on Oct. 25.

The infected passengers are a 10-year-old girl, a 16-year-old male and a 40-year-old female. The two females both tested positive for the L452R mutant strain, while the test result on the male patient is pending.

This is the second suspension meted on EK384 within a two-month period. It was also suspended from flying into Hong Kong on Aug 24, after five of its passengers tested positive on arrival test.

Two other confirmed cases were reported today, involving people who arrived from the United States.

They include a 77-year-old woman who flew in on KE607 from the US via Korea on Oct 23, and was in quarantine in Kerry Hotel in Hung Hom, and a 54-year-old male cargo flight crew who came via CX075 on Oct 25 and tested positive on arrival test.

The woman’s viral load was insufficient for testing for mutant strains, while the man’s test result is pending.

The new cases took Hong Kong’s total Covid-19 tally to 12, 335 confirmed cases.

According to the CHP, the air crew left Hong Kong for the US on Oct 21 and returned on Oct 25. His test result in Hong Kong on Oct 19 was negative, but his specimen collected upon his arrival at the airport tested positive.

As he was in Hong Kong during the incubation period, the places where he resided and visited here have been included in a compulsory testing notice. People who were at these places during specified periods must undergo testing on or before tomorrow, Oct 28.

Covid-19 patients to be isolated for 2 weeks after discharge from hospital

All recovered patients will now have to spend 14 more days in North Lantau Hospital 

Hong Kong begins implementing today, Oct. 27, a stricter rule for patients found infected with Covid-19. After being discharged from the hospital upon recovery, they will now be moved to the Infection Control Centre at North Lantau Hospital for 14 more days of isolation.

The new rule was announced by the government last night, following Chief Executive Carrie Lam’s statement at a press conference of a further tightening of Covid control measures to align them with those in the Mainland.

The government statement said, "As part of our proactive anti-epidemic strategy to maintain 'zero infection', patients who meet the discharge criteria will be subject to a 14-day isolation and health monitoring after being discharged from hospital.”

It said patients who have recovered from infection may still carry the virus, so the latest arrangement would further reduce the risk of the spread of the disease into the community.

Before being moved to the isolation facility, patients with symptoms can only leave hospitals at least 10 days after the onset of illness, and had two negative test results on samples taken 24  hours apart, with greatly reduced symptoms and clear chest scan. They should not have had fever within three days before discharge.

Those who are asymptomatic should also spend at least 10 days in hospital, and should produce two negative test results for either a RT-PCR test or stool sample test taken 24 hours apart.

All those who meet the discharge criteria will be transferred directly from the hospitals to the Infection Control Centre for the 14-day isolation and health monitoring.

As the Centre already takes care of stable patients aged between 18 and 65, those who were initially admitted there will have to stay two more weeks despite fulfilling discharge requirements.

The last batch to avoid being held back for another fortnight were the four patients who were discharged from public hospitals 24 hours before midnight last night.

According to the Hospital Authority, a total of 12,033 with confirmed or probable infection have been discharged so far.

Patients need to stay at least 10 days in a hospital before being moved to 2-week isolation

As of today, a total of 49 confirmed patients remain in 10 public hospitals and the Infection Control Centre. All of them, plus those who are found to carry the virus from today, will be subjected to the additional isolation period.

 Yesterday, CE Lam said that the tightened measures will also include greatly reducing the number of travelers who are allowed exemption from quarantine, but did not give a specific time frame nor the categories of people who will be stripped of the privilege.

Currently, those exempt from quarantine include top executives coming from business travels, staff of foreign consulates, air and sea crew, and even movie stars who get special dispensation from the government to shoot a film here, like Nicole Kidman recently.

Mrs Lam said only those who provide essential services to Hong Kong, such as cross-border truck drivers, will retain their quarantine exemption.

She said the requirement to use the LeaveHomeSafe app when entering government premises is also part of the heightened measures.

Responding to clamor from business people to reduce the quarantine period for new arrivals, Mrs Lam said this will happen only if the global Covid-19 situation improves, or there is a drastic reduction in the number of cases in a particular country, especially those considered as high risk.

Filipina DH says she lost $30k to same man in love scam

 'Tommy's Facebook profile page carries a religious saying 

A Filipina domestic helper has stepped forward to say the Caucasian-looking man who wooed, then duped a fellow worker of $10,000 a few weeks ago was the same person who fleeced more than $30,000 from her more than two years ago.

Viena, who is 38 years old and married, said that in her case, the scam started in June 2019 when she saw “Tommy Sandro Rivera” post an advertisement for a domestic helper on a Facebook site. She was then about to finish her contract, so she got interested.

The man said he was a Canadian citizen who owned a watch store in Central and was looking for a nanny for his young daughter, Clara. According to Viena, Tommy promised her an 8-hour job in his house in Discovery Bay, with a monthly salary of $6,000, so she immediately said yes.

A photo Viena sent of the man she knew as Tommy showed it looking like the same person who had tricked another Filipina, Sol, into “lending” him $10,000 earlier this month, supposedly to help him bring his eight-year-old daughter into Hong Kong.

The man who chatted up Sol on a dating site for single parents called Encore, gave his name as Dennise Robert Philips, father to a daughter named Stephanie. This time, he introduced himself as an American businessman who had permanent residency in Hong Kong.

In both cases, the scammer held himself out to be a religious man and a devoted father to his daughter. He also relentlessly pursued them, sending daily messages via messenger and on at least two occasions, showed his face during video chats.

However, on hindsight, it now appears to the women that the supposed live chats  with their scammer were pre-recorded, with the actual voice of the person shown on screen muted while somebody unseen talked over the image.

In Viena’s case, "Tommy" overdid this by reportedly breaking down in tears whenever he talked about his faith, and even reportedly sang religious songs to her over messenger.

Demonyo siya talaga. Ginamit pa ang pangalan ni Jesus, then may pakanta-kanta pa syang nalalaman about God pero demonyo pala,” she said. (He is evil. He used the name of Jesus, even sang about God but he turned out to be the devil himself).

The man must have been very convincing that when he asked Viena for about $3,000 to supposedly pay for the entry visa fee of his daughter, he immediately got what he wanted. His promise then was that he would pay her back as soon as he returned to Hong Kong along with his daughter.

Viena said she showed the supposed invoice for the visa fee amounting to $2,999.70 to her husband in the Philippines, and he agreed that she should lend the supposed employer the money as the promised return was far more.

The Filipina said she used her salary for that month to send money to Tommy using a Hang Seng Bank account that supposedly belonged to his contact in Immigration called Mr Cheung.

As in Sol’s case, the two men alternated in sending messages to the women to further loop them into their web of deceit. The supposed Immigration officer’s role was mainly to assure the women of the other man’s integrity.

But over the next few days, Tommy relentlessly asked Viena for more money for all sorts of excuses, from being detained because he could not pay his rent in Canada, to needing money for bail after he was arrested and taken to a police station. Exactly what Dennise had told Sol.

Viena said that was when she started borrowing from friends and relatives, and soon became deep in debt.

Paiba-ibang halaga yun, may $3,000, $4,000, $1,500, $2,500, hindi ko na matandaan isa-isa, pero nilagay ko dun sa reklamo ko sa pulis,” she said. (They were in different amounts. One for $3,000,….I cannot remember each one, but I managed to list them down in my complaint to the police).

Once, Tommy even told her to take out a loan using her passport as collateral. Viena said that confirmed her suspicion that the guy was actually an Indian national, as she overheard people around him talking in their language one time they had a chat.

Kaya nagduda ako kasi alam niya yung pagsasanla ng passport,” she said (That’s when I became suspicious because he knew about using our passport as collateral for a loan).

Despite this, Viena did as she was told, pawning her passport for $3,000 with an acquaintance in her Shatin neighborhood.

From depositing money into a Hang Seng account, Viena was told to remit funds through MoneyGram to a recipient in Benin, and finally, to a bitcoin account using a machine in Mong Kok.

When she realized she could no longer face her friends because of her mounting loans, Viena said she begged Tommy to pay her back. In response, he said he would do this if she agreed to be his girlfriend. After consulting her husband, Viena agreed, thinking it was the only way she knew of getting back her money.

By this time, even her husband was deeply in debt back in the Philippines because of Tommy’s repeated requests for money and promises of paying them all back on his return to Hong Kong.

Once, when she could no longer send money to him, Tommy told Viena she could make up for this by running an errand for him. He said one of his customers was depositing $20,000 to her bank account as payment for a watch. Viena was told to withdraw the cash and deposit it all in the bitcoin account he gave earlier. She complied.

Tommy sent an obviously fake Immigration invoice to entice Viena to send him money 

But when Mr Cheung asked afterwards if Viena could do the same thing for him, she declined, as it was nearing 10 pm and she did not dare leave her employer’s house without permission. What she did not say was that she had finally become suspicious of the tag team's motives.

By then, penniless and up to her neck in debt, Viena finally came to her senses. She went to Shatin Police Station to report the scam, and to the Consulate to apply for a new passport so she could renew her employment contract. 

Until now, Viena said she gets depressed thinking of how foolish she had been in believing the man who offered her a juicy job, but ended up fleecing her for money. 

She said she decided to step forward with her own story after reading the report on how Sol was tricked out of her hard-earned money by the same gang that had victimized her.

Dapat hindi na sila makapangloko pa ng iba,” Viena said. (They should not be allowed to scam any more people).

Anyone who suspects he/she has fallen prey to an online scam should seek help from the nearest police station, or from the assistance to nationals section of the Philippine Consulate on the 14th floor of United Centre Building, 95 Queensway, Admiralty.

PCG won’t endorse OFWs taking up work in 3rd countries for police clearance

Saret says the Consulate is keen to prevent 3rd country deployment from HK

Filipino migrants in Hong Kong looking to work abroad cannot expect to get an endorsement letter from the Consulate for a local police clearance, in what appears to be a crackdown on third-country deployment.

Consul Paulo Saret, head of the assistance to nationals section which issues the endorsement letter, said today, Oct 26, that only Filipinos who apply for a visa to a third country for valid reasons other than work will be given an endorsement letter.

He ruled out issuing an endorsement letter for those who terminate their employment contract in Hong Kong so they could go to popular third country destinations such as Canada, Poland or Russia.

In line with Philippine labor regulations, all Filipino workers abroad who want to move to a third country will have to go back home first, and go through the Philippine Overseas Employment Administration again.

The government in Manila imposed the third-country deployment ban decades ago to protect Filipino workers from falling victims to human traffickers and illegal recruiters in their host countries who charge then ridiculously high fees for fake jobs.

In June this year, the POEA warned workers in the Middle East and Taiwan of rogue recruiters who were offering jobs in Poland for high fees. The POEA said the promised jobs turned out to be illegal work or inexistent.

Recruiters in Hong Kong have also been attracting Filipinos here lately with promises of high-paying skilled labor jobs in Poland, such as factory workers. They mostly charge a $40,000 fee for invitation letters from purported employers and other costs.

The POEA said in its advisory that the recruited workers often encountered problems in their employment or immigration status once they were in Poland.

According to the Hong Kong Police, it is standard practice for some consulates, immigration or government authorities of other countries to require visa applicants to submit a police clearance.

The police have made an endorsement letter from the consulate as a fundamental requirement for issuing a “certificate of no criminal conviction” (CNCC).

“We do write an endorsement letter to the police for Filipinos who are applying for a police clearance, just for the police to know that the request for a clearance is not frivolous,” said Consul Paulo.

“Usually those who are applying for a visa from a third country approach us for a letter of endorsement,” he said. The arrangement gives the ATN a chance to interview the clearance applicant about where he needs it for.

He said some request for a clearance from the police because they are applying for an entry visa to, say, Canada. For the Consulate to issue an endorsement letter, the applicant must have a valid reason to go there, not to break their employment contract here in order to take a job in that country, he said.

“If you still have a contract, why are you going there? You need to go back to the Philippines,” Saret would tell an applicant.

He said he won’t write an endorsement letter for a worker who is seeking police clearance because she needs it to apply for a visa to countries that have no labor agreement with the Philippines, as that violates the government’s ban on third-country deployment.

Saret said normally, those who are issued an endorsement letter are Filipinos with fiancés in Australia or elsewhere who produce a letter of invitation stating they are being asked to go to the fiancés’ place.

“So, we ask them, are you legally allowed to get married? That’s because if they are married in the Philippines, no way because that will be basically bigamy,” he said.

If the applicant says she is single and will not go there to seek another employment, then the ATN gives her an endorsement letter, Consul Paulo said.

“But we make sure the applicant won’t break her legal contract with the employer and won’t breach our policy on prohibition against third-country recruitment,” he said.

There are Hong Kong people who also approach the ATN for an endorsement of their application for a police clearance, as they want to settle in the Philippines, especially if they are keen to obtain a retirement visa, the consul said.

On the Hong Kong Police website, it says an endorsement letter from the consulate must contain the applicant’s name and indicates that he is required to produce the CNCC.

It should also have a postal address of the consulate, immigration authority or government authority, as the CNCC will be sent directly to them by registered mail.

The Hong Kong Police said the request letter is considered to be valid within one year from its issuance date.

The police charge a processing fee of $225 per applicant that can be paid in cash, by Octopus card, EPS or crossed checks, while the Consulate’s endorsement letter is free of charge.

HK Police confirm filing of child abuse case against Filipina DH

Villanueva was charged with ill-treatment of her baby ward

 A Filipina domestic worker faces one count of abuse or neglect of a child after her male employer called the police on Oct 19 to complain that his five-month-old baby son was mistreated by the helper in their house on Dunbar Road, Kowloon City.

A spokeswoman for the police told The SUN that after investigation, the 42-year-old worker was charged with one count of ill-treatment of a child.

“The case was mentioned in West Kowloon Magistrates' Courts on Oct 23 and adjourned to Nov.15 for further enquiries,” said a police statement. “The defendant is being remanded in custody.”

Court records identified the accused as M N Villanueva.

According to media reports, she is accused of shaking the baby boy violently after he cried and refused to sleep. The boy’s mother allegedly heard her son cry, and got her husband to call the police.
