Indo helper charged with stealing jewelry, cash and gold from employer

A 44-year-old Indonesian domestic helper was charged with theft in Eastern Court on Tuesday, Nov 2, for allegedly stealing 22 jewelry pieces, 11 gold grains and $2,000 cash from her employer in Siu Sai Wan between Apr 1 and Oct 30. The value of the total haul was not given.

Defendant Agung P. Sariah, who has been in police custody since her arrest on Oct 31, was read the charge when she appeared before Magistrate Ada Yim.

The prosecution said the offense took place in the employer’s flat on Block 3, Island Resort, at 28 Siu Sai Wan Road in Hong Kong East. The prosecution said the stolen items included the following:  

2 gold bracelets

1 bracelet inlaid with jade

2 pairs of gold earrings,

4 gold rings,

1 gold necklace with gold pendant

Also allegedly stolen were 11 grains of gold (roughly 1 gram) and one red packet with $2,000 cash.

All the allegedly stolen articles were the property of the employer, Alice Kong Suet-kuen the prosecution said. No other details were mentioned in court and no plea was taken.

The magistrate adjourned the case for six weeks until Dec 14 as the prosecution requested more time for further investigation and legal advice.

The defendant was remanded in custody until her next court appearance.

2 Filipina asylum-seekers among 14 arrested in anti-illegal work raids

14 people were arrested in the Nov 1 raids on 10 premises

Two Filipina recognizance form holders were arrested with 12 other people during anti-illegal worker raids across Hong Kong on Monday, Nov 1, by Immigration officers.

Nine suspected illegal workers and five suspected employers were arrested in the raids carried out on 10 target sites including an industrial building, premises under renovation, restaurants, a retail shop and a shopping mall.

The arrested suspected illegal workers comprised three men and six women aged 31 to 50, a statement from the Immigration Department said on Tuesday. No names were supplied.

One man and four women, including the two Filipinas, were holders of recognizance forms, which prohibit them from taking any employment.

Five men aged 41 to 62 were suspected of employing the illegal workers.

Immigration warned that those who violate their condition of stay, particularly those not allowed to take up employment in Hong Kong, whether paid or unpaid, are liable to prosecution. If found guilty, they face a maximum fine of $50,000 and up to two years in jail.

All illegal immigrants who are subject of a removal or deportation order, overstayers or those who have been refused permission to land, are also banned from taking up employment or to set up a business. Offenders face a maximum fine of $50,000 and up to three years' imprisonment.

Employing people belonging to any of these categories is also a serious offence, for which the maximum penalty is a fine of $500,000 and imprisonment for up to 10 years.

2 immigration officers among 5 people arrested over fake ‘LeaveHomeSafe’ app

Police are investigating the alleged use by five people of a fake "LeaveHomeSafe" mobile application in entering Immigration Tower yesterday, Nov 1, the first day of the mandatory use of the app in getting into government venues.

According to a press statement on the government website, among those arrested were two immigration officers, a staff at the Audit Commission, and two contractors.

They had allegedly tried to use a fake version of the government app called “BackHomeSafe,” but were denied entry to the Immigration Tower and were arrested by the police after a report was made.

Both the Immigration Department and the Audit Commission have said that their arrested staff members have been suspended from duty and are currently being investigated by the police.

Both government agencies said they attach great importance to staff conduct, and anyone found to be involved in unlawful acts or misconduct will be dealt with in accordance with the law and established procedures.

At a press conference earlier today, the police said they had already taken down the website offering the fake app. But they are still looking for whoever created it.

They also warned that anyone urging people to use it could find themselves in trouble.

The police said the fake app has a different background color and font size than the genuine version.

It is not clear how the five who had tried to use it to enter Immigration Tower were found out.

Not a few people have shown aversion to using the LeaveHomeSafe app, which tracks those who have been to certain public venues for contact tracing purposes.

However, those who are suspicious of its other applications fear the details collected in the app could be used to track their every movement.

From yesterday, all those who enter government buildings, including hospitals, courts and even indoor wet markets were required to use the app. The only ones exempted are those aged 65 and above or 12 below, or those with handicap that prevent them using the app.

Meanwhile, two additional confirmed cases of Covid-19 were reported today, involving two returnees who were both found to carry the highly infectious L452R mutant strain of the coronavirus.

One is a 29-year-old man who came from Manila on Oct 29 aboard 5J272, and tested positive on his third day of quarantine at Best Western Hotel in Sai Ying Pun.

The other is a 37-year-old woman who had been to Spain, Greece, Portugal and Turkey before arriving in Hong Kong on Oct 31 aboard TK083. She tested positive on her arrival test.

They took Hong Kong’s total confirmed cases to 12,349.

Meanwhile, the Centre for Health Protection issued a compulsory testing notice for five premises in Hong Kong, where a preliminary positive imported case with the mutant strain had been to during the incubation period.

Placed under CTN are Block 21 of Baguio Villa in Pokfulam where the patient lived, as well as four places he had visited: the Hong Kong Football Club in Happy Valley, Lobster Bar and Grill at Island ShangriLa in Admiralty, Ye Shanghai Restaurant at Pacific Place, and The Wing lounge at Hong Kong International Airport.

Everyone who had been to these places at specified dates and times should get tested by Thursday, Nov. 4.

Alleged Filipina victims of suspected loanshark seek ATN help

The alleged loanshark met one of the Filipinas in Lohas Park to give her a loan and collect her passport

Two of the nine Filipinas whose passports were recovered from a local female resident suspected of loansharking activities in Tseung Kwan O went to the Consulate today, Nov 2, to report that they were among the victims of the woman.

This follows a confirmation from the police that they nabbed a 45-year-old local woman on suspicion of carrying on an unlicensed money lending business from her home in Lohas Park.

Consul Paulo Saret, head of the assistance to nationals section, said the two domestic helpers went to ATN to apply for new passports after admitting they gave their current ones to the suspect who lent them money.

The Consulate’s policy is that Filipinos who use their passports as loan collateral will be asked to execute an affidavit of undertaking not to re-offend before they are allowed to apply for a new passport.

“They admitted that they used their passports to borrow money, so, we’ll issue them a new passport but we’ll put them on our watchlist,” Saret said.

If they commit the same offence in future, they will no longer be issued passports.

One of the victims declined to narrate how she lost her passport to the suspected loanshark. She said she was ashamed and did not want people to know that she had borrowed money from the suspect.

Another one was said to have been introduced to the local woman by a mutual friend. She had asked for a loan of $4,000 but was only given $3,400 with the $600 being collected upfront as interest. She was told to pay the same amount as monthly interest until she could pay the full $4,000 back.

Saret warns those who swap their passports for loans will be put on watchlist

Despite getting the reports from the two workers, Saret said he had not been officially informed by the police about new loansharking syndicates that victimize Filipinos.

It appears the Chinese woman who was arrested in Tseung Kwan on Oct 26 was a “freelance” operator who conducted her illegal lending business alone, he said.

Saret said the Consulate has been warning the migrant workers time and again to avoid borrowing from unlicensed lenders as these could get them into trouble.

He said he was wondering why they keep patronizing and falling prey to loansharks despite the PCG’s warnings.

Police told The SUN nine Philippine passports and $35,000 cash were seized by officers who raided the woman’s flat in Lohas Park on Oct 26.

The police acted after receiving complaints about the woman charging very high interest rates for loans a little as $3,400.

Police said the suspect was released on bail but would have to report to them later this month.

High Court paves way for Erwiana to claim $809k in damages from ex-employer

A High Court judge has rejected attempts by Law Wan-tung and her estranged husband Barry Chui to block a bid to use the employer’s share in a Tseung Kwan O flat to pay $809,430 in damages awarded to abused helper Erwiana Sulistyaningsih.

The couple issued four summonses in relation to decisions made on Dec 5, 2019 and on Dec 4, 2020 by Recorder Stewart Wong, pertaining mainly to the lifting of  a charging  order on the property jointly owned by Law and Tsui to cover payment for Erwiana's damages.

After ordering the dismissal of the summonses, Wong directed that the charging order on the flat be removed by the Land Registry. He also ordered Tsui and Law to jointly pay the court costs.

“Taking into account the items claimed and the response from those acting for Law, I summarily assess the costs at $220,000, for which Tsui and Law are jointly and severally liable,” the judge said.

He said Erwiana’s own costs would be taxed in accordance with Legal Aid regulations.

The order effectively allows Erwiana's damages as determined by the District Court in its ruling on Dec 20, 2017, to be paid from Law's half-share in the flat located in Beverly Garden in Tseung Kwan O, said to be worth $7 million.

Two years before this, Law, who was her contractual employer, was ordered jailed for six years but was allowed early release on Nov 22, 2018, after being imprisoned for more than three years. She had been detained since her arrest in February 2015.

Separately, Law was ordered by the District Court on Feb 27, 2018 to pay $170,000 in damages to another Indonesian helper, Tutik Lestari Ningsih, who was subjected to false imprisonment and assault while in Law’s employ from Apr 2010 to Mar 2011.

Law’s first summons on Dec 13, 2019 applied for leave to appeal the Dec 5 decision lifting the charging order. Then she filed another summons on Jan 13 last year to apply to vary the costs order out of time.

Tsui separately filed a summons on Jan 5 this year to apply for an extension of time to appeal against the decision.

The fourth summons was filed by Law on Jan 28, 2021 applying for an extension of time to appeal against parts of the decision.

In his decision dismissing the summonses, Wong also gave his reasons for dismissing Law's application to inhibit himself from the case. He also ruled that Erwiana did not have to be included as a party in the summonses before the charging order could be lifted.

Summarizing the cases, the judge said the summonses were set to be heard by him on Apr 21 this year but the hearing was reset for Sept 29.

During that hearing, Law’s then lawyer, Ching Ming-yu, said that the convicted employer had petitioned for bankruptcy at the District Court but no order was made on her application. Ching also said he no longer had instructions to appear for Law.

As for Tsui, Wong took him to task for being “unhelpful, uncooperative and even obstructive” that made service of documents to him by Erwiana’s solicitors difficult. The lawyers said that Tsui became unreachable, then later said he  he could receive the documents only a day before the hearing. 

The judge’s decision cited points where Tsui acted “inexcusably and in blatant disregard” of his order and that of Deputy High Court Judge MK Liu, such as when he failed to comply with deadlines for filing an affirmation of facts pertaining to service of documents to Erwiana.

After failing to meet the 14-day deadline for filing the affirmation from the time of Wong's judgment on Apr 21, 2021, Liu asked for an extension of time. Liu allowed the application, but told the applicant to comply by June 14. However, he only complied with the order on Sept 28, a day before the adjourned hearing. 

“I disapprove of such conduct of Tsui in the strongest term,” he said.  

But most importantly, Wong said he was dismissing Law's application for leave to appeal the Dec. 5, 2019 decision releasing the charge order, as she failed to raise any new grounds to indicate that an appeal against the order had any reasonable prospects of success.

Free flu shots at Polo for qualified people extended for 5 days

Flu jab is free for those aged 50 and above, pregnant or have disabilities

Free influenza vaccination will still be available to Filipinos 50 years and over as well as children below 12 years old, pregnant women and persons with disabilities, at the Philippine Overseas Labor Office on five days this November.

The free vaccination against seasonal flu can be obtained at POLO this Thursday, Nov 4, and next Monday, Nov 8, from 9am to 1pm, and on Nov 14, 21 and 28 from 9:30am to 4:30pm, said Assistant Labor Attaché Angelica Sunga.

She posted the extended vaccination schedule on POLO’s Facebook page Sunday night.

“We are having three more Sunday sessions for November and two more weekdays that we are arranging with Dr Tam,” said Sunga, referring to Dr Tam Yat-hung of Shoebill Health Care, which is administering the shots.

She said there has been a strong demand for the jabs but the extensions depended on the availability of vaccine supply from the Hong Kong government.

Shoebill's Au says up to 500 people received the flu jab on Sunday

Jerry Au, project manager of the vaccination outreach being carried out by Shoebill, estimated that around 400 to 500 people received the jab on the last Sunday of October in the Polo conference room on the 29th floor of United Centre in Admiralty.

Au said this is the third year that Shoebill, a private health-care group, has been doing the vaccination outreach for Polo. He said Polo is a convenient venue for workers who go there for business transactions on their rest day.
