Shatin magistrate spared the Filipina from going to jail so she can look after her autistic kid

A 34-year-old Filipina former domestic helper who pleaded guilty in Shatin Court to charges of overstaying in Hong Kong for more than three years and not registering the birth of her baby has managed to avoid spending time in jail so she can look after her autistic daughter.

M.J. Odango was sentenced on Wednesday by Magistrate Jason Wan to two months in prison, suspended for 12 months, for overstaying. But she was fined $1,000 for failing to register the birth of her daughter, now 3 years and 9 months old.

The prosecution charged her with breach of condition of stay for overstaying from Feb 12, 2018 to July 26, 2021 and for failing to register the birth of her daughter, who was born with autism.

Wan noted the seriousness of both crimes. He said normally the baby would be left to the care of the Social Welfare Department while the mother was in prison but acknowledged that because the baby has autism, she will need 24-hour care.

The defense lawyer hailed the sentence as “the humanity of the court” for considering the baby’s plight.

In mitigation earlier, he cited a psychologist’s report that said the baby girl still needed constant care despite being more than 3 years old. The report said keeping her away from her mom would damage her psychological development.

The lawyer said the defendant first came to Hong Kong to work as a domestic helper in 2010. Then she met a US pilot, Michael William, who became her boyfriend.

The defendant got pregnant and she and William had plans to wed in Hong Kong after he returned from a trip to the United States. However, William’s parents one day informed her that their son was killed in a car crash.

The woman lost her job in January 2018 and, instead of going home, she decided to overstay when her 14-day visitor visa lapsed on Feb 12 of that year, the lawyer said. She ruled out going home due to her frayed relationships with her sister and mother.

During her overstay, she did not work illegally and did not rely on the government for support, the lawyer said. She also showed her intention to return home and prepared for it by registering the baby with the Philippine government.

The man was seen to move slightly as rescuers checked for injuries

A male Filipino domestic worker who police say was drunk, was rushed to Queen Mary Hospital on Sunday, Nov. 14 after being hit by a bus along busy Des Voeux Road Central.

He reportedly sustained abrasions on his mouth and nose, and some of his teeth were loosened, but he did not appear to have suffered any major injuries.

The incident was reported to the police at 5:20pm, just seven minutes before they were called to attend to a drunk Filipina domestic worker who fell head first on the pavement in nearby Exchange Square. The Filipina later said she got dizzy because she was anemic.

A police spokesman said investigations showed the 35-year-old Filipino man had run onto the busy street from the westbound lane, and was struck by a bus as it approached the junction with Chiu Lung Street, a small alley near World-Wide House.

“The person suddenly ran onto the street and was hit by a bus,” the spokesperson said.

“He smelled of alcohol and was injured, but was in a conscious state.”

There are no records of the bus driver being arrested, police say

The 31-year-old male bus driver was questioned at the scene, but the police say there is no report of him being arrested.

Unconfirmed reports from several Filipinos who could be heard talking over some videos of the incident which were posted live on Facebook said the man had been drinking with friends, apparently from one of the alleys on the other side of the road.

One Filipina in the crowd could be heard saying she was among those who had been drinking with the man.

Another said the man had bumped into her before dashing across the road. She then heard a loud thud and the next thing she knew, the man was already sprawled on the street.

Consulate notes spike in cancer deaths among Filipinos in HK

Funeral honors in Iloilo for Merly, who died of uterus cancer in HK in January

A total of 26 Filipinos, including residents of Hong Kong, had succumbed to various types of cancer from January to October this year alone, exceeding by nearly 37% the death count for the whole of last year, according to data obtained from the Consulate.

The assistance to nationals section said all the 26 died in the city and their human remains or ashes had been repatriated home. An ATN officer said that in the whole of last year, the number of Filipino cancer patients who died in Hong Kong was 19.

Prominent victims who died this year were The SUN contributor Merly Bunda, 56, who lost to cancer of the uterus on Jan 18; and Maria Teresa “Tek” Barro, 56, former president of Radiant Organization of Amiable Drivers (Road HK) from 2015 to 2018, who died from complications of cancer on Aug 7.

Not included is Baby Jane Allas, who figured prominently in the news after suing her Pakistani employer who fired her after learning she had Stage 3 cervical cancer. Allas succumbed to kidney failure on Mar 27 in her hometown of Narra, Palawan.

ATN attends to the repatriation of deceased Filipinos in Hong Kong, while the Overseas Workers Welfare Administration is tasked with attending to the medical needs of sick migrant workers and liaising with their employers and agencies.

Separately, OWWA said it has received reports of 114 new cancer cases among Filipina domestic helpers since the start of the year until Nov 10.

Various community organizations like the Mission for Migrant Workers have also been looking after cancer patients on their own, especially those who need the support of their employers so they could continue their treatment in Hong Kong.

A few others have been quietly seeking treatment on their own, with their employers providing support by extending their work contract so they can continue subsidized hospitalization and treatment until they are well enough to return home.

The 10-month figure disclosed by Welfare Officer Virsie Tamayao indicates an average of 11 new cases reported to OWWA each month since January.

A spike could result in the remaining weeks of the year, given the number of workers who have not seen it fit to seek help from OWWA because they are being helped by other groups.

With scores of workers seeking help daily, both Tamayao and newly arrived Welof Dina Daquigan said they have their hands full working on a range of cases each day. As a result, OWWA could barely manage to maintain a data base on all medical cases referred to them for assistance.

According to Daquigan, in the first week of November alone, more than 10 cancer-stricken workers had sought their help.

Asked whether OWWA has plans to conduct educational programs on cancer prevention for Filipino migrant workers, she indicated her office could attend to that in 2022.

We hope to do that next year as it is almost end of the year. As of this time, we still have many cases to face daily,” Daquigan said.

Marites Palma, founder of Social Justice for Migrant Workers, said at least four new cancer cases were brought to her group’s attention recently.

One went home last Saturday after being treated for Stage 2 breast cancer at Pamela Youde Nethersole Eastern Hospital in Chai Wan. Two others in the same hospital also have breast cancer while the fourth is being treated for Stage 2 colon cancer in Tuen Mun Hospital.

Palma has said in an earlier interview that since January this year, her group has been asked for help by more than 20 workers afflicted with cancer in various stages.

On Nov. 4, Jenny Merdadero, another worker who has ovarian cancer flew home to Iloilo, while four days earlier, Elma dela Cruz also flew home after being treated for her brain tumor which resulted after her breast cancer had spread to other parts of her body.

Also about to go home is Tonette Simborio, who only last week, had happily shared with The SUN how her employer decided to renew their contract despite knowing she has stage 3 cancer of the uterus which has spread to her liver.

Simborio reported visiting OWWA earlier today with her employer so she could be assisted on her return home next week.

Tonette says she will leave HK next week to continue her cancer treatment back home 

Also at Eastern Hospital are two other FDWs with stage 4 cancer. One has overstayed her visa for four years and is battling with cervical cancer. The other is already on visitor’s visa after failing to process a new employment contract, and has abdominal cancer.

Both have been confined for more than a month because of continuous bleeding and fever, suggesting an infection. If they could, they would just want to go home, the patients said.

Police have classified the case of the injured Filipina as "drunk person"

A Filipina domestic helper who fell on the pavement of Exchange Square podium in Central after apparently drinking with some friends last Sunday, Nov 14, was sent to hospital with head injury.

Police said they received a 999 call around 5:27pm, reporting the incident about a non-ethnic Chinese woman accidentally injuring herself when she collapsed at the podium. The woman’s HKID number prefix showed she is a domestic worker, said a police spokeswoman.

She said officers who responded to the call saw the woman lying on the pavement with her head bleeding, but she was conscious. She said an ambulance team took the victim to Queen Mary Hospital in Pokfulam for treatment.

Police investigators initially classified the case as “person collapsed” but later reclassified it as “drunk person”. A video of the incident showed the conscious woman with a bandaged head being helped by the ambulance crew to a trolley and then wheeled away.

The mishap happened next to two carabao statues on the podium near IFC One, a favorite hangout of Filipinas on their rest days.

Some comments on Facebook posts of the incident said the woman had been drinking with some friends hours earlier. One kibitzer was heard saying on the video that there were four of them drinking.

Other accounts said the woman’s friends left early, leaving her alone resting on the marble bench. Then, as she got up in order to leave, she slipped and banged her head on the tiled flooring.

CE says new measures to curb movements of aircrew enough for now

CE Lam says further restrictions on cargo pilots could disrupt Hong Kong's food supply

Chief Executive Carrie Lam has said that the measures taken by Cathay Pacific in further restricting the movements of air crew after three of its cargo pilots tested positive for Covid-19 are appropriate for now.

Speaking ahead of today’s Executive Council meeting, Mrs Lam said any further restrictions could affect Hong Kong’s food supply, which mainly comes from overseas.

As it is, the decision by authorities to order 130 Cathay cargo pilots into 21-day quarantine as they had stayed in the same hotel in Germany as the three infected air crew has already affected the supply of goods to the territory, said Mrs Lam.

She noted that Cathay has taken additional steps to limit the movements of its aircrew by not allowing them to go out in the first three days of their return to Hong Kong unless for essential errands such as to get food or see a doctor, and avoid social gatherings.

“These measures were the result of talks between the Transport and Housing Bureau and Cathay Pacific in the past few days, so it wasn’t up to the airline alone,” she said.

But the CE warned further measures could be taken should a further increase in infections among the aircrew adversely affect Hong Kong’s pandemic response.

Meanwhile, the Centre for Health Protection said in a press statement that its latest investigation has revealed that the cases of the three cargo pilots have almost identical genetic sequence.

This means, the three have “very likely to have acquired the infection during their stay in Germany,” said the statement.

CHP earlier said the infection must have occurred in a hotel in Frankfurt where the first two pilots had checked in on Nov 1, and the third, on Nov 2.

All three pilots tested positive for Covid-19 with the L452R mutant strain three days after arriving in Hong Kong, and being allowed to go home in line with their quarantine exemptions.

The CHP also revealed that its investigation has revealed an almost identical genetic sequence in the cases of two men found to have the highly infectious Delta plus variant after staying next to each other at Four Points Hotel in Tung Chung.

This reinforces experts’ finding that the first case, 12374, had infected his next-door neighbor, 12382, probably after releasing the virus into the air while exercising.

CHP said it collected 73 environmental samples from rooms on the 15th floor of the hotel’s north wing where the men had stayed, and 13 of these had tested positive for Covid-19. Another eight samples tested indeterminate.

Five of the positive samples were taken from inside room 1515 where the index patient who came from the United Kingdom had stayed, while eight were from 1517, which was occupied by the second patient from Thailand.

As a precaution, CHP transferred a total of 44 guests who had stayed on the floor concerned from Nov 1 to 6, to Penny’s Bay Quarantine Centre.

As of midnight last night, only one confirmed case of Covid-19 was detected, involving a 21-year-old woman who flew in from India, and tested positive on her arrival test.

She took Hong Kong’s total Covid tally to 12,388 confirmed cases and one probable case.

Filipina DH tells police she gave up 3 ATMs to get $2k loan

Complainant's Hang Seng account was used to launder $500k in less than 3 months

A 28-year-old Filipina domestic helper whose three ATM cards had been allegedly used by other people to launder at least $500,000 in illicit funds this year has told police she did not know they would be used in a criminal activity.

A.N. went to the Wan Chai Police station on Nov 7 to complain against a fellow Filipina named Jennifer who gave her a $2,000 loan on Apr 25 this year, but took the cards as surety.

A.N. told The SUN that one of her friends who also took out a loan through Jennifer has also decided to file a complaint with the police, but four others who are in the same boat are hesitating.

In her police statement, A.N. said she met Jennifer after she responded to a post on Facebook offering an easy loan of $2,000. When she called up the phone number provided in the post, Jennifer answered, and said they should meet.

When they met one Sunday at Mei Foo MTR station, Jennifer allegedly told A.N. that to avail of the $2,000 loan, she had to hand in three ATM cards issued by HSBC, Hang Seng Bank and Bank of China.

A.N. did as she was told, then met up with Jennifer again on Apr. 25, during which she handed over the ATM cards and the passwords. Jennifer then gave her $2,000 and promised to return the cards after two months.

When Jennifer failed to comply with this promise, A.N. sent her a WhatsApp message asking for her ATM cards. Jennifer allegedly told her if she wanted her cards back, she must delete their conversations.

A.N. said she did as directed but the cards were still not returned to her. Not long after, when Jennifer still refused to return her ATM cards, A.N. said she called up the banks and requested for updated statements.

“On July 17th, I received the HSB (Hang Seng Bank) savings account statement and saw that there were numerous suspicious transactions in amounts not made by me,” she said.

A.N. said more than $500,000 had been passed through her account in less than three months.

“I can’t remember the total amount that went in and out of my account, but it reached half a million,” Darlene told The SUN.

On the advice of friends, she sought help from the police.

In turn, the police reportedly told her to ask the banks to close all her accounts.

A.N. said she went to Hang Seng last week to give them a copy of her police complaint and ask for her account to be closed. She was told to return after a month as they could not close her account right away.

Afterwards, she went to BOC, where she was reportedly told her the account had been frozen since August. A.N. asked the bank to close the account altogether.

As for HSBC, she still has to go to the bank and request for her account to be closed, as advised by the police.

Six men, including a 24-year-old Filipino resident, were confirmed today, Nov 15, by health officials as the latest coronavirus cases in Hong Kong.

Records from the Centre for Health Protection show that the six patients were all fully vaccinated with BioNTech in Hong Kong before they traveled abroad.

Five of the cases involved mutant strains of Covid-19. The mutation test result of one man is pending.

They took the number of cases in Hong Kong to 12,388.

Meanwhile, the CHP said its investigation into the cases of three Cathay Pacific cargo pilots who tested positive for Covid-19 days after arriving in Hong Kong show that they might have acquired the infection from a hotel in Germany where they had all stayed.

Contact tracing showed that two of the pilots arrived in Frankfurt on Nov 1 and checked into the Hyatt Regency Mainz. The third crew arrived in Frankfurt on Nov 3 and stayed in the same hotel. On their return to Hong Kong days later, they were all found to carry the Delta variant of the coronavirus.

As all three said they did not leave their hotel rooms or participate in any gatherings, the CHP concluded that their infections may have come from that hotel, and that a cluster outbreak may have occurred.

The CHP has immediately informed the health authority of Germany to follow up on the situation. At the same time, it arranged for all crew members of Cathay who had stayed in the German hotel on or after Nov 1 to be moved to a quarantine center.

As for today’s infections, the lone Filipino patient arrived from Manila on Cebu Pacific flight 5J 272 on Saturday, and he tested positive on his arrival test. He developed symptoms on Wednesday.

A 36-year-old man who lives on Block 5, Rambler Crest, Tsing Yi, tested negative before he traveled to South Africa on Oct 22. He returned to Hong Kong on Nov 11 via Flight QR818 and his specimen collected at the airport tested negative.

However, his sample tested positive during quarantine at the Regal Airport Hotel in Chek Lap Kok. He carries the N501Y mutant strain.

The place where he resided in Tsing Yi during the incubation period has been included in a compulsory testing notice. Specified persons who were at the venue for more than two hours during a specified period need to get tested on the specified date.

The other new patients were a 24-year-old man who arrived from Qatar via flight QR 818 on Nov 11 and developed symptom on Saturday while in quarantine at The Landmark Mandarin Oriental in Central. He tested positive for antibodies on Oct 6.

Also testing positive was a 68-year-old man traveled to the Netherlands and Germany, and arrived in Hong Kong from the United Arab Emirates via flight CX746 on Saturday. His mutation test result is still pending.

The remaining two patients are aged 23 and 17 who both arrived on flight TK83 from Pakistan via Turkey on Saturday. Their arrival tests showed both had Covid-19 with the L452R mutant strain
