Home quarantine now ok for patients infected with Omicron sub-variants

Penny's Bay is among places where patients with subvariants are taken for isolation

Health officials said today, Wednesday, that Covid-19 patients infected with Omicron subvariants will now be allowed to quarantine or isolate at home, if their living conditions allow this.

Previously, all those found to carry the BA.2.12.1, BA.4 or BA.5 subvariants were all automatically sent to quarantine or isolation facilities such as the one in Penny’s Bay.

Speaking at today’s press briefing, Dr Chuang Shuk-kwan of the Centre for Health Protection said that as of yesterday, 1,093 cases involving Ba.2.12.1 and 372 of BA.4 or BA.5 had been detected in Hong Kong.

“We have looked at these cases. The severity of these cases compared to (the prevalent strain) BA2.2. showed little difference,” said Chuang.

And although the World Health Organization has said that BA.5 is more transmissible, it has not seen any abnormal severity in the cases involving the subvariant, she added.

Chuang reported a total of 3,805 new Covid infections, of which 180 were imported.

Asked why the tally remained far off from the 6,000 that the government had forecast for this week, Chuang said the number of cases is still on the rise.

“Our view is that it will continue to climb,” she said, adding public hospitals remain concerned that any significant rise in the numbers could overwhelm the public health care system.

She said 364 new infections were reported by 299 schools involving 293 students and 71 teachers and staffers. Two schools were told to suspend certain classes where at least two infections were found.

Of the imported cases, she said 68 were detected at the airport, 102 at quarantine hotels, and 10 were found after the patients had ended their seven-day isolation.

Among the countries from where the imported cases were found, the United Kingdom remained the top source, with 58; followed by the United States and the Philippines with 15 each.

Hospital Authority’s Dr Larry Lee reported one Covid-19 related death, which pushed the death tally in the fifth wave up to 9,235.

The 67-year-old male patient who tested positive on Jul 16, was taken by ambulance to Caritas Hospital last night after reportedly committing suicide by hanging at Lai Chi Kok Reception Centre. He was certified dead at the hospital.

Lee said the man had three vaccine jabs and suffered from hypertension and diabetes. His case has been referred to the Coroner for further investigation.

A total of 1,207 Covid patients are now being treated in public hospitals. They include  17 who are in critical condition while 32 are seriously ill. Five of the critically ill patients are in intensive care units.

Filipina in $14.6 million theft gets extra 17 months in jail on appeal

The Court of Appeal yesterday added 17 months to the sentence of a Filipino domestic helper who was jailed for four years and 11 months in September last year for stealing jewelry and gold bars worth more than HK$14.6 million from her former employer, business executive David Liang.

Carmelita Galay Nones, 47, will now serve a total of six years and four months in jail after justices Kevin Zervos, Maggie Poon and Anthea Pang granted the Department of Justice’s application for a tougher sentence on her.

The appeal court ruled that High Court judge Andrew Bruce erred in principle by giving too much weight to Nones’ guilty plea and unverified claim that she had stolen to pay for her mother’s medical expenses, while failing to consider the severity of the crime.

Nones was originally sent to jail by Judge Bruce for four years and 11 months, after admitting six counts of theft on Sept. 7 last year.

Under Hong Kong’s laws, theft carries a maximum of 10 years in jail.

Nones was working at the Deepwater Bay residence of Liang when she stole an assortment of watches, jewelry and gold bars worth more than $14.6 million from him and his wife between Jun 17, 2018 and Sept 4, 2019.

About 200 valuable items were stolen from the couple, including 38 diamond-studded necklaces, 23 bangles, 40 pairs of earrings, 16 bracelets, two gold bars, four luxury watches, 31 gold coins, 25 rings, as well as cash.

Nones had pawned some of the stolen goods with the help of her niece Maricris Galay Nones, 32, and cousin Cristina Noble Alagna, 51. Both women were sentenced to one year and four months in jail.

The rest of the items worth some $4 million which she entrusted to her sister, Marina G. Biala, 49,were turned over to the police. A charge of theft against Biala was subsequently dropped.

The thefts came to light in July 2019 when police noticed suspicious transactions during a regular pawnshop inspection.

During mitigation, Nones’ counsel, Oliver Davies told the court that while Nones admitted stealing from the Liangs expensive items worth a total of $14,603,200, she only made roughly $1.1 million pawning the items.

Most of the stolen jewelry was recovered, either because Mrs Liang redeemed them from the pawnshops for a total of $1.451 million, or recovered from Nones’ other co-accused.

Davies submitted that the Liang’s net loss from Carmelita’s theft was $1.9 million.

He also said Nones had used all the money she made pawning the stolen jewelry to pay for her mother’s dialysis treatment. Her mother reportedly passed away in December 2020.

The lower court was presented with an “impact statement” from Mrs Liang, in which she said she had felt violated by the theft of her personal properties.

Mrs Liang also said her former helper had used the ill-gotten money to build houses and buy luxury goods in her hometown of La Union in the Philippines, and attached some 200 photos to support her claim.

Davies, however, said there was no evidence to show that the properties allegedly bought by Nones were registered in her name. He did admit than one of the houses belonged to her boyfriend, Eldon.

In sentencing, Judge Bruce said he was “more than prepared” to accept that there was a violation of Mrs Liang’s privacy, but disregarded the claim about Nones having used the proceeds from her crime to buy properties.

While saying that the crime involved a serious breach of trust on the part of Nones, the judge accepted that the defendant had been motivated by the “terrible burden” of having to care for her sick mother in the Philippines.

The appeal judges disregarded this reasoning, saying there was no evidence Nones had paid for her mother’s medical expenses using the proceeds from her crime.

Instead, the judges accepted Mrs Liang’s impact report that Nones had used the ill-gotten money to fund a lavish lifestyle back in the Philippines.

Judge Zervos added that the trial judge appeared to have overlooked an aggravating factor in the offense – Nones’ attempt to conceal her involvement in the crimes by asking her relatives to pawn or keep some of the items she had stolen.

Following Nones’ sentencing, sources close to Mrs Liang told The SUN that the employer had kept most of the jewelry in a safe inside her bedroom, and was clueless as to how Carmelita managed to learn the combination to open the safe and steal the items.

Mrs Liang also had more than the usual number of jewelry in her safe during the relevant times because she had taken out some of the more expensive pieces from a safety deposit box in a bank to use for her son’s wedding.

The source also said the employer had asked investigators in the Philippines to check on Nones’ lifestyle, and received photos showing the helper had built two lavish houses in her hometown, and owned a number of vehicles.

Despite this effort, Mrs Liang failed to recover any of  her losses from Nones’ theft.

Isang Pilipina na nabistong overstay na ng walong buwan habang iniimbestigahan ng pulis sa dalawang beses na pagnanakaw sa isang tindahan ng Wellcome, ay sinampahan ng isa pang kaso nang humarap siya ngayon (July 19) sa West Kowloon Court sa Cheung Sha Wan.

Si Olivia Tabas ay kinasuhan ng pagkakaroon ng isang Hong Kong ID card na hindi kanya, matapos makita sa mga gamit niya ang HKID ng isang Indonesian.

Dahil dito ay hiningi ng taga-usig na itigil muna ang pagdinig ng mga naunang kaso laban kay Oliva Tabas at ipagpatuloy ito sa August 30 para sa karagdagang imbestigasyon.

Habang iniimbestigahan si Taban sa mga kasong ito sa Tsuen Wan Police Station ay nadiskubre na ang visa ni ya ay walong buwan nang paso, kaya kinasuhan din siya violation of condition of stay.

Ayon sa Immigration Ordinance, pwede lang siyang maglagi sa Hong Kong nang hanggang 14 na araw matapos ma-terminate ang kanyang kontrata, kaya higit walong buwan na siyang overstay nang mahuli siya noong May 5.

Covid numbers drop anew but health officials say surge is still likely

Chuang warns further increase in cases could affect the provision of healthcare services

Health officials reported a total of 3,256 new coronavirus infections Tuesday, 237 of them imported.

This is the second consecutive day that the tally has dropped slightly but the Centre for Health Protection has warned against complacency.

CHP’s Dr Chuang Shuk-kwan said, “We have seen infection numbers remaining over 3,000 for several days and they are likely to keep rising. We can see that the healthcare systems begin to become stretched in some other places, such as the UK and Australia.”

“We are worried that if the figures continue to go up, it may affect Hong Kong’s healthcare services, especially services provided by the Hospital Authority,” she added.

However, Dr Larry Lee of the Hospital Authority said a top-level monitoring team that is assessing the situation daily could mobilize manpower and add beds quickly should that become necessary.

Lee also reported four more Covid-related deaths, involving one male and four female patients aged between 90 and 99. All except the 99-year-old female patient had chronic illnesses.

Despite her advanced age, the patient had two vaccine shots and was relatively healthy until she developed a fever and became lethargic on Jul 8. A rapid antigen test showed she was positive for Covid, with a Ct value of 17.3, indicating a heavy viral load. Her condition deteriorated until she passed away yesterday.

The three other patients were one male aged 96 and two other females aged 90 and 92 who all had long-term illnesses.

The male patient had an inflamed gall bladder and renal failure while the two females both had arrhythmia. They all died in hospital after testing positive for coronavirus.

Lee said a total of 1,190 Covid patients are receiving treatment in public hospitals, and among them, 20 are in critical condition, including seven in intensive care units; and 40 are seriously ill.

Chuang said 498 additional cases were reported from schools, involving 408 students and 90 staff members. Some of the cases were from the previous day.

While the number of infections reported by the schools each day has gone up to between 300 and 400 recently, she said the figure is still within 10% of the total caseload.

She also said that about 700,000 people are tested in schools each day, so the daily infection figure remains small in comparison.

Eight schools have been told to suspend classes in which more than two infections have been reported.

Of the 237 additional imported cases, 122 were detected at the airport, 89 during hotel quarantine, and 26 after the newly arrived patients had completed their seven-day isolation.

Britain again topped the list of countries from where the infected patients had come, with 59 cases, followed by the United States with 54. The Philippines, which had 16 infections, was among those cited with at least 10 cases.


HK Covid caseload steady but school infections spike

Among the new cases were 888 reported by schools, involving mostly students

Health authorities reported 3,436 new Covid cases on Monday, which was nearly the same level as yesterday.

Of the new cases, 254 were imported; and among the local infections, 888 had come from schools. The cases involved 751 students and 137 teachers and staff.

However, the unusually high number was due to an accumulation of positive results detected during the weekend when there were no classes.

Dr Chuang Shuk-kwan of the Centre for Health Protection said at today’s press briefing that among the new cases were several linked to a school bus route at St Catherine's International Kindergarten in Kowloon Tong.

Chuang said dozens of children at the school have been put under quarantine due to the widening outbreak linked to the No 18 bus route. 

Four more students who took the bus in the mornings tested positive today. They included two in a nursery class, where another pupil who did not take the bus also fell ill, indicating that the virus had spread within the classroom. This class has been suspended for a week.

In another class that has also been suspended, a teacher who took the bus fell ill, and was followed by two of her students. 

The school has since replaced the bus with a new one.

Seven other schools have classes that have been suspended for a week after two or more infections were detected in each.

Dr Larry Lee of the Hospital Authority reported three new deaths, involving a man and two women aged between 58 and 101. This raised the death toll in the fifth wave to 9,227.

Lee said a total of 1,182 Covid patients are receiving treatment in public hospitals, including 149 new admissions.

Among them, 17 are in critical condition, 38 are in serious condition, and four of those critically ill are in hospital intensive care units.

The outbreaks in some hospitals continue to widen. Three more staff in the medical ward of North District Hospital were confirmed, raising the total infections there to four patients and six staff members.

At Hong Kong Buddhist Hospital, three elderly patients aged 85 to 95 also tested positive. There are now 13 patients and five medical staff in the hospital who have been infected, but they are all in stable condition.

Newly discovered cases involving the more infectious Omicron sub-variant were also reported.

According to Chuang, 82 cases of the BA.2.12.1 sub-variant were found during genome sequencing, and 30 additional cases of the BA.4 or BA.5 subvariants.

Ilang oras matapos ianunsyo ng Hong Kong Police na nawawala ang isang Pilipina ay nilinaw ng Overseas Workers Welfare Administration na nasa boarding house ito ng employment agency at gusto nang putulin ang kontrata.

Ayon kay OWWA welfare officer Virsie Tamayao, nakausap niya mismo si Earl Joy Momo, ang sinasabing nawawala na Pilipinang domestic helper.

“Nakausap ko ang worker at nasa agency boarding house siya ngayon,” sabi ni Tamayao bilang sagot sa tanong ng The SUN.

“Day off niya last Saturday at sinadya niyang hindi bumalik sa workplace dahil gusto na niyang i-terminate ang kanyang contract.”

Ikinalat kaninang umaga ng pulis ang balita na si Momo, 28 taong gulang, ay hindi na nakitang muli magmula nang umalis sa bahay ng employer sa Dynasty Heights, Kowloon Tong, noong Sabado.

Dumulog ang employer sa pulis bago maghatinggabi kagabi para ipaalam na nawawala ang kanilang domestic helper.

Agad namang nagpakalat ng litrato ni Momo ang pulis at nagbigay ng mga palatandaan sa kanyang anyo. Sinabi din nila na nakasuot ng itim na pantaas ang Pilipina nang huling makita.

Pinay nakaiwas sa kulong kahit higit isang taon nang overstay

Shatin Court, kung saan dininig ang kaso ng Pilipina

Isang Pilipina ang nakaiwas ngayon (July 18) sa kulong na karaniwang parusa sa mga nag-overstay, kahit isang taon at tatlong buwan siyang nagtatrabaho nang walang visa bilang domestic helper.

“Salamat, Lord,” ang bulalas ni Margie Coleta, 42 taong gulang, paglabas sa korte sa Shatin, matapos siyang patawan ni Acting Principal Magistrate David Cheung Chi-wai ng sentensyang apat na linggong pagkakakulong, na suspendido ng anim na buwan.

Inabot ng dalawang taon at walong buwan ang paglilitis sa kaso niya bago siya nasentensiyahan.

Ayon kay Coleta hindi niya napansin na mas maiksing visa ang binigay sa kanya nang dumating siya dito noong November 2017 dahil mapapaso na ang kanyang passport. Nag renew siya ng passport, pero hindi nagpa extend ng visa bago ito napaso noong July 19, 2018.

Hindi siya naging alerto dito dahil ang employment agency nila ang nag apply para sa kanyang working visa at hindi siya pinagbilinan na huwag kalimutang i renew ito bago mapaso.

Dahil sa kasong kinaharap niya ng mahigit dalawang taon, napagtanto niya na hindi dapat iasa sa employment agency ang lahat ng bagay, lalo na ang tungkol sa visa. 

Inihabla si Coleta ng Immigration Department nang mag renew siya ng visa sa ikalawang kontrata sa kanyang employer noong Nov. 15, 2019.

Tatlong kaso ang iniharap sa kanya:

  • Overstaying, dahil ang visa na ibinigay sa kanya noong dumating siya ay hanggang July 19, 2018 lang, at Nov. 15, 2019 na nang malamang overstaying siya.
  • Pagsisinungaling sa Immigration officer, dahil sinabi niya na dumating siya noong Jan. 13, 2018, pero hindi ito totoo.
  • Paggamit ng pekeng dokumento, dahil kasama sa mga dokumentong isinumite sa Immigration ang pekeng landing slip na may petsang Jan. 13, 2018.

Kalaunan ay iniurong ng taga-usig ang ikalawa at ikatlong kaso, dahil itinuro niya ang kanyang employment agency na siyang umayos ng kanyang papeles, at umasa lang siya at kanyang employer na gagampanan nito nang maayos ang paghahanda ng mga dokumentong kailangan niya para mag-renew ng visa.

Pero sa unang kaso, ang pag-overstay, umamin si Coleta sa pagkakasala dahil hindi niya maitatanggi na nakatatak sa dating pasaporte niya kung hanggang kailan lang siya dapat manatili sa Hong Kong. Hindi tanggap sa batas ang dahilan na hindi lang niya ito napansin.

Pinarusahan siya ni Magistrate Cheung ng anim na linggong pagkabilanggo, na binawasan ng dalawang linggo dahil sa kanyang pag-amin, pero suspendido ng 12 buwan. 

Ang ibig sabihin nito, ayon na rin sa paliwanag sa kanya ng tagasalin sa Cebuano, ay hindi siya makukulong kung hindi siya gagawa ng pagkakasala sa loob ng susunod na isang taon.

Sa labas ng korte ay ipinaliwanag ni Coleta kung bakit nagluwag sa kanya ang hukom.

 “Nang dumating kasi ako sa Hong Kong, malapit nang mag-expire ang passport ko. Nag-renew ako ng passport sa Konsulado bago ito mapaso,” ika niya.

“Ang hindi ko alam, kasabay pala nito mag-expire ang visa sa ibinigay sa akin. Walang nagsabi sa akin, kaya kampante naman ako nang mag-expire ang unang kontrata ko at nag-renew ako ng visa sa Immigration," dagdag niya.

"Kung hindi pa sinabi ng Immigration officer na overstaying na ako, hindi ko pa malalaman."

Nagpasalamat si Coleta sa kanyang dating employer dahil buo ang suporta sa kanya at pinatira pa siya sa bahay nito sa halos dalawang taong itinagal ng kaso. Ayon sa kanya, handa pa rin itong pumirma bilang employer niya kung bibigyan siya ng Immigration ng pangalawang pagkakataon.
