Verdict reserved in case of retired British doctor accused of molesting helper

Eastern Magistrate Edward Wong will give his verdict on Dec 14

In the end, it became a case of “she said, he said.”

This essentially sums up the re-trial of 84-year-old retired British doctor Brian Drew Apthorp, who is charged with three counts of indecent assault against his former Filipina domestic helper, referred to as “X” during the court hearings.

The prosecution ended up relying merely on the testimony of X in trying to prove its case against Apthorp, after the video clips, photographs and the helper’s notebook which the police had collected as part of the evidence, were not admitted in the re-trial.

Through about three days of testimony, X related the events which formed the bases for the three separate acts of indecent assaults that the octogenarian doctor had allegedly committed towards her, including fondling her during a supposed medical check-up, and forcing her to masturbate him during massage sessions.

In turn, the defense subjected her to intense cross-examination, through which the helper was pictured as a scheming woman who only wanted money from the frail and elderly employer. In his closing statement, the defense lawyer said X’s testimony was riddled with “demonstrable lies.”

At the close of the trial on Friday, Eastern Court Magistrate Edward Wong said he would give his verdict in the case on Dec. 14, and extended Apthorp’s bail of $201,000 until then.

The High Court ordered the re-trial on April 29 this year, after setting aside Apthorp’s conviction by  Magistrate Daniel Tang in July last year. Tang sentenced the defendant to 30 months in jail after finding him guilty on two counts of indecent assault.

Judge Esther Toh ruled the conviction unsafe and unsatisfactory because of Tang’s refusal to allow solicitor Jonathan Midgley, who was hired belatedly by Apthorp to defend him, to cross-examine X.

At the start of the re-trial, the defense had tried to ask for a “permanent stay of proceedings” in the case against Apthorp, citing as one of the grounds the supposed deterioration in the defendant’s health and the inadequacy of the evidence against him.

Wong rejected the application, but asked the prosecution to amend the second charge, saying it was too broad in scope.

Apthorp originally faced two counts of indecent assault, one that allegedly happened on Sept. 11, 2018 while the second charged covered several occasions between November 2018 and April 2019.

The defense objected to the second charge, saying it lacked particulars and that the agreed facts did not mention that the assaults happened on multiple occasions during the period indicated.

The prosecution agreed to amend the second charge, and ended up splitting it into two charges. The second charge pertained to an incident that allegedly happened between November and December 2018, and the third, in April 2019.

All of the alleged incidents happened inside Apthorp’s house at 35B, Shouson Hill Road.

The re-trial commenced after Apthorp pleaded not guilty to all charges.

X was the only witness called for the prosecution. She said that a few days after she began working for Apthorp, the elderly man told her to go to his room for a medical examination. But the employer ended up fondling her breasts before inserting something hard into her private parts.

X said she was too shocked to resist, but kept her eyes closed during the entire proceeding. Later, she complained to a fellow Filipina helper, Janice Villanueva, who was then about to leave for Canada after working for Apthorp for several years. The other helper reportedly assured her that it was just a regular check-up that the doctor conducts on his household staff.

The two other incidents pertained to massage sessions with Apthorp, during which X said he would always be asked by the employer to “empty his balls,” or for her to masturbate him. X said she did as she was told even if it disgusted her because she was scared of losing her job.

During cross-examination, the defense lawyer asked X about certain money matters, including a loan she supposedly asked the doctor for so she could have dental surgery done in the Philippines.

X said she went home that time not because of any dental work, but because of Immigration’s policy for foreign domestic workers to “exit” Hong Kong within a year of moving to a new employer.

Defense also brought up the $163,000 compensation claim that X had filed against Apthorp with the Equal Opportunities Commission, and her subsequent civil action for more than $1 million in damages, suggesting she was only after his money.

X denied all the counter-accusations.

She also denied Apthorp had fired her because she stopped going to his house while he was away on holiday. X said she was in touch with the employer regularly via email and that he had only wanted to make it appear that she had disappeared so he could pretend to have fired her.

In a separate case for a judicial review, a High Court judge ruled in favor of X’s application to challenge the government’s failure to properly investigate her more serious allegations of trafficking and forced labor against Apthorp.

Judge Russell Coleman agreed with X, and said the authorities had prematurely curtailed their investigation into her case. He ordered for an investigation into her case to be reopened.

However, the Department of Justice merely said it would study the judgment and “consider the way forward.”

Pinoy na may 15 kaso ng panloloob at pagnanakaw, lilitisin sa District Court

Si Quiatchon ay unang humarap sa Kowloon City court para sa 12 kasong burglary at 3 theft 

Iniakyat sa District Court kamakailan ang kaso ng isang Pilipinong akusado ng 12 beses na panloloob sa iba’t ibang establisimiyento sa Kowloon at tatlong pagnanakaw ng ari-arian ng ibang tao sa loob ng dalawang buwan.

Naka-ilang beses nang humarap sa West Kowloon magistracy si Jefrey Quiatchon, 35 taong gulang na aplikante sa refugee status, sa lingguhang bail review hearing na kanyang hiningi.

Doon ay nag-alok siya ng perang pang-piyansa kapalit ng pansamantalang kalayaan, pero tinanggihan siya ng mga mahistradong dinaanan ng kaso.

Nang matapat ang kaso noong Huwebes (Nov. 14) kay Magistrate Jeffrey Sze, nagdesisyon ito na hindi angkop sa magistracy ang kaso ni Quiatchin dahil sa bigat ng akusasyon at ebidensiyang iniharap ng pulisya.

Magsisimula ang pagdinig ng kaso sa District Court sa Dec. 8.

Nagsimula ang listahan ng akusasyon ng pulis laban kay Quiatchon sa isang panloloob noong June 7 sa isang Indian restaurant sa Yau Ma Tei, Kowloon. Isang tablet computer ang natangay daw niya.

Noong araw ding iyon, pinasok naman daw niya ang isang noodle shop sa Yu Chau Street sa Mong Kok, at nagnakaw ng isang mobile phone.

Ang ikalimang kaso ay noong June 18, kung saan pinasok daw niya ang isang Shanghainese restaurant sa Shek Kip Mei St. sa Sham Shui Po at nagnakaw ng $3,0000 at isang apron.

Kinabukasan, pumasok naman daw siya sa isang Vietnamese restaurant sa Fuk Wa St., Sham Shui Po, at tumangay ng isang mobile phone.

Isa namang café-restaurant ang pinasok niya noong June 15 sa Camp St., Cheung Sha wan, at kinuha niya ang isang mobile phone.

Sa ikawalong kaso ay pinasok niya ang isang dumpling shop sa Lai Chi Kok Road, Mong Kok, noong June 25 at tumangay ng dalawang mobile phone.

Nasundan ito ng pagpasok sa isa pang restaurant sa Tung Choi St., Mong Kok, noong July 1 at pagtangay sa isang tablet computer.

Ang ika-sampung kaso ay panloloob sa isang Chinese restaurant sa Lai Chi Kok Rd., Mong Kok, noong araw ding iyon at pagtangay sa isang mobile phone at isang kahon na may lamang isang batong jade.

Pagnanakaw naman ang ika-11 kaso ni Quiatchon nang kunin daw niya ang isang liham na pag-aari ng isang Iris Sun noong July 4 sa Fuk Wing St, Sham Shiu Po.

Sa araw ding iyon ay ninakaw naman niya ang isa pang liham sa Fuk Wing St, Sham Shiu Po, na pag-aari ng isang Chen Hun-yan .

Sa ikatlong pagkakataon noong araw ding iyon, ninakaw naman niya ang isang liham na pag-aari ni Tam Ping-sun sa Fuk Wing St, Sham Shiu Po.

Balik si Quiatchon sa panloloob kinabukasan, July 5, nang pasukin naman niya ang isang noodle shop sa Fuk Wing St, Mong Kok, at kunin ang isang tablet computer at isang cash box na may lamang $1,000.

Online bookings open Sunday for bivalent booster vaccine

Residents may get the bivalent booster shot starting on Thursday, Dec. 1

Hong Kong residents who wish to take as their fourth dose BioNTech’s second-generation Covid-19 vaccine that targets the highly transmissible Omicron variant may start booking their shots on Sunday, with the jabs set to be available starting on Dec 1.

The first batch of the bivalent vaccine arrived as the daily Covid tally reached 8,874 on Saturday, of which 509 were imported.

Nine more coronavirus patients died. 

In the wake of the renewed uptick in cases, the government has rejected a further relaxation of social distancing measures, saying this amounted to “adding fuel to the fire”, and would make Hong Kong’s pandemic situation “burn more fiercely”.

Speaking in a television interview, Undersecretary for Health Dr Libby Lee said “there will be no room if we rush through relaxation.”

Addressing people who said they are not afraid of coming down with the virus, Dr Lee said they should also take heed of the elderly and children at their homes as they may not be as strong as they are.

She also repeated an appeal for people to get vaccinated, especially the young and the elderly, to prevent complications and even deaths.

Health experts recommend the bivalent vaccine against Omicron subvariants BA.4 and BA.5, the most common strains affecting most parts of the world now, to be given as a fourth dose or as a third one for recovered patients.

It is particularly recommended for residents aged 50 and above, immunocompromised individuals aged over 12 and those who are over 18 who are at high risk of exposure to the coronavirus.

But according to the Secretary for the Civil Service Ingrid Yeung who is in charge of the city’s vaccination drive, people can still choose not to get the bivalent vaccine and opt for the one based on the original virus strain when they book their appointments online.

The new bivalent vaccine will be offered at community vaccination centers, inoculation stations in hospitals and designated private and outpatient public clinics starting next Thursday.

The only people not allowed to take the new vaccine are those who have never been vaccinated, or received the suitable number of doses.

About 770,000 doses of the second-generation vaccine arrived in Hong Kong, the first batch of a total of 1.9 million doses procured by the government. The rest of the stock is expected to arrive by the end of the year.

Meanwhile, Chief Executive John Lee has tested negative on his sixth day in quarantine after coming down with Covid-19 on his return to Hong Kong from the Asia-Pacific Economic Cooperation summit in Thailand.

CE Lee wrote on his social media accounts that “except for the occasional cough,” he no longer had any health issues. He added there was only “one line” on his latest rapid antigen test.

2 Pilipinang may kasong drug trafficking kulong habang dinidinig ang kaso

Hindi pumayag ang Magistrate sa Kowloon City na  makalayang pansamantala ang dalawang Pilipina.

Dalawang Pilipinang may kasong drug trafficking ang ibinalik sa piitan ngayon matapos ipinagpaliban ang paglilitis laban sa kanila sa Kowloon City Magistracy.

Si Chymbelyn Cadelina, 39 taong gulang, ay nahaharap sa tatlong kaso.

Ang una ay drug trafficking, na inihain laban sa kanya matapos siyang maaresto kasama ang isang lalaking Bangladeshi sa isang silid sa  Mirador Mansion sa Nathan Road noong Nov. 15 at nasamsam sa kanila ang 32 gramo ng methamphetamine hydrochloride o shabu at iba pang bagay na gagawing ebidensiya laban sa kanila.

Kinasuhan rin siya ng pagkakaroon ng lason na kasama sa Part 1 ng Poisons List, na paglabag sa Pharmacy and Poisons Ordinance, at overstaying dahil ayon sa kanyang visa, dapat noong 2017 pa siya umalis sa Hong Kong.

Ang Bangladeshi na kasama niyang nahuli, si Amit Foysal, 40, ay kinasuhan din ng drug trafficking at pagkakaroon ng Part 1 poison.

Si Foysal ay hindi nakarating sa pagdinig ngayon dahil may sakit, kaya ipagpaliban ni Acting Principal Magistrate Peony Wong ang kanyang pagdinig sa Dec. 2.

Dahil dito, hiningi ng abogado ni Cadelina na payagan siyang mag-piyansa upang hindi siya maapektuhan ng pagkaantala ng kaso, dahil hindi malaman kung hanggang kailan mananatili sa ospital ang kasamahan niya sa kaso.

Itinaas niya sa $3,000 ang alok na piyansa ni Cadelina mula sa $2,000. Sinabi rin nito na nangako si Cadelina na mag-report sa istasyon ng pulis araw-araw at hindi aalis sa tinitirhan niya.

Pero tumanggi si Magistrate Wong dahil mabigat ang kaso, malakas ang ebidensiya laban sa kanya at overstayer siya noon pang 2017.

Samantala, pinagpalban din ang paglilitis ng kasong drug trafficking ni Rhea Nerissa Maristela, 26 taong gulang at nagtatrabaho bilang waitress, dahil sa hiling ng pulisya ng karagdagang anim na lingo upang suriin ang lahat ng drogang nakuha sa kanya nang arestuhin siya sa Nathan Road sa Tsim Sha Tsui noong Oct. 13.

Sinabi ng taga-usig na hindi pa natatapos ang pagsusuri ng pinaghihinalaang droga sa laboratory ng gobyerno, kaya hiniling niyang ituloy na lang sa susunod na taon ang pagdinig.

Pinagbigyan naman ito ni Magistrate Wong, at itinakda ang susunod na pagdinig sa Jan. 6.

Dahil hindi niya hiniling na payagan siyang mag-piyansa, ibinalik si Maristela  sa kulungan.

Court tells prosecutor to check if key witness in assault case can testify

The attacks on the Filipino victims happened outside this Wanchai park

Principal Magistrate Ada Yim ordered the prosecution in a wounding and assault case heard at Eastern Court yesterday (Nov 24) to find out if a key witness is still in Hong Kong and if not, whether the case could proceed even without him.

She made the order after Filipino driver Delfin D. Villaremo, 55, asked if the case of assault occasioning bodily harm filed against him could continue even if his alleged victim had already gone back to the Philippines.

The said victim, William L. Maun, had pointed to Villaremo as the one who had punched him during a melee outside Tai Wo playground in Wan Chai on Oct. 9.

Magistrate Yim extended Villaremo’s bail of $1,000 until the next hearing of the case on Jan. 5.

She also advised him to inquire with the Duty Lawyer scheme on how he could get legal representation for his next court appearance.

Villaremo’s co-defendant, Romeo D. Miranda, will however, remain in jail after the magistrate again rejected his offer to post a cash bail of $3,500, surrender his travel document, and report regularly to police.

Miranda, a permanent resident working as a construction worker, is charged with the more serious case of wounding for allegedly using a kitchen knife to slash a fellow Filipino identified in the charge sheet as Benson Jy Mateo Agunoy, in the same incident.

In denying his bail application a second time, Yim cited the seriousness of the case and the strong evidence against Miranda, apart from his previous conviction for a similar offence.

Previously, Miranda had asked the court to allow him temporary liberty so he could see his five-year-old daughter and three-year-old son.

But Yim said then it was necessary to keep him in prison so he would not re-offend or interfere with  the witnesses.

The two accused were arrested separately in the morning of Oct. 11, or more than a full day after they allegedly attacked the two victims, then fled.

The two men who were injured were taken to Ruttonjee Hospital for treatment.

Villaremo told the police he had rushed to Miranda's defence after seeing a group of Chinese and Filipino men ganging up on him.

Pilipinong akusado ng pagpapasugal, ipina aresto dahil di sumipot sa korte

Hindi sumipot  sa Kowloon City Magistracy ang Pilipino kaya pinaaresto

Ipinaaresto ang isang Pilipino ngayon matapos hindi magpakita sa pagdinig ng kanyang kaso sa Kowloon City Magistracy.

Inutos din ni Magistrate Andrew Mok ang pagkansela ng piyansang ibinayad sa pulis ni Rolando Ledesma, 53 taong gulang at walang trabaho. Hindi rin ito papayagang magpyansa kapag nahuli, hanggang humarap sa korte.

Inakusahan si Ledesma ng pagpapatakbo ng isang pasugalan at paglabag sa mga panuntunan laban sa Covid-19 para sa mga negosyong pinupuntahan ng mga tao.

Isa siya sa 13 kataong kinasuhan matapos mahuli sa raid ng mga pulis sa isang pasugalan sa Shanghai St., Kowloon noong Sept. 13.

Ang 12 iba pa ay kinasuhan ng ilegal na pagsusugal. Isa sa kanila ay Pilipina, pito ay Chinese, at tig-iisa na Nepalese, Indian, Moroccan at Dutch.

Sila ay nahaharap sa kaso na may parusang multa na hanggang $2,000 at pagkakulong na hanggang tatlong buwan sa unang pagkakasala. Tataas ito sa $5,000 at anim na buwang kulong sa ikalawang pagkakasala, at $10,000 at kulong ng hanggang siyam na buwan sa ikatlong pagkakasala.

Pero di hamak na mabigat ang parusang itinakda sa unang kasong isinampa laban kay Ledesma.

Ayon sa Section 5 ng Gambling Ordinance, ang sino mang mapatunayang nagpapatakbo ng isang pasugalan ay maaaring patawan ng multang aabot ng $5 million at pagkakakulong ng hanggang pitong taon.

Sa ikalawang asunto, si Ledesma ay inakusahang lumabag sa Prevention and Control of Disease (Requirements and Directions) (Business and Premises) Regulation, kung saan obligado ang lahat ng negosyo na sumunod sa mga panuntunang ipinatutupad ng Secretary of Food and Health.

Ang maaaring parusa dito ay multang aabot sa $50,000 at pagkakulong ng anim na buwan.
