Public hospitals overwhelmed as more than 16k new Covid cases reported

Total occupancy in acute hospitals is now at 106%

The Hospital Authority reported on Sunday that the overall occupancy of beds in acute hospitals is now at around 106%, meaning they now have more patients that they would normally admit.

The report was made as a total of 16,023 new Covid-19 patients were recorded, of which 876 were imported cases. The previous day’s tally was 15,774.

Forty new Covid-related deaths were also reported.

The new infections drove up the number of patients with Covid-19 who were admitted in public hospitals. As of Saturday, a total of 3,908 patients were already in hospital for treatment.

Among the new patients, 15 were critically ill while 22 were in serious condition. They took to 122 the total number of patients in critical condition, of which 38 are in intensive care. .

There were also 116 patients in serious condition.

Latest figures showed that 520 patients were admitted Saturday, while 337 had been treated and discharged.

Of the additional imported cases, 771 tested positive on PCR tests and 105 on rapid antigen tests.

An overwhelming majority, or 600 of the cases, were asymptomatic.

There were a total of 526 patients who tested positive on arrival at the airport, 280 on samples during Day 1 to Day 3, and the remaining 70 on Days to 7.

Walk-in applications now allowed, but OFW groups still want OEC scrapped

After weeks of complaints and protests for the abolition of the overseas employment certificate (OEC) the Philippine Overseas Labor Office has backed down and allowed applicants to ask for assistance without making a prior appointment.

Previously, the so-called “walk-in” service for OEC applicants still required them to apply for an appointment online before they were served. 

This fueled a lot of criticism as OFWs who tried to get immediate help were often those who were not adept at navigating the internet, or needed to make an emergency exit.

Dolores Balladares-Pelaez, chairperson of United Filipinos in Hong Kong welcomed the move Thursday, but maintained the OEC has to be scrapped for not serving any real purpose but to make life harder for overseas Filipino workers.

(The difficulty of obtaining the OEC has eased somewhat because walk-ins are now allowed. I think this is the result of the protests and the authorities’ desire not to be targeted by protesters calling for the OEC’s abolition).

But while she welcomed the measure, Balladares said “actually ang ginagawa ng gobyerno pamapatay sunog-galit lang ng mga OFWs” (What they are actually doing is to douse the flames sparked by the OFWs’ anger), suggesting that officials would not budge on their own to solve problems.

The demand for the OEC surged, and along with this, the complaints, starting early this month when many OFWs who were unable to go home for years due to strict pandemic rules are now able to leave.

Many found the registration under the new website of the Department of Migrant Workers far more difficult than when they had to do it through the Balik Manggagawa Online portal.

Theoretically, those who have not moved jobs should be able to secure their OEC easily online after their personal details have been copied to the DMW portal from the BMO site. However, many found this not to be the case because their files from the BMO could not be moved easily.

Add to this their difficulty of navigating the DMW website using just their handheld phones, and with no prior briefing by Polo staff.

The problem is worse for elder migrants who are not tech savvy, and many of whom do not even have an email address through which all communication from the website is coursed.

Without an OEC, an OFW cannot leave the Philippines. This exit requirement has put so much pressure on them to comply.

Consul General Raly Tejada said during a recent interview that the unprecedented volume of OEC applications in recent weeks due to many OFWs going for the Christmas holiday has put tremendous pressure on Polo staff.

“We are doing our job. It’s just the volume of applications is happening all at the same time. It’s the end of the year, the skies have opened and the people are able to fly home,” says Tejada.

After the Consulate was inundated with complaints over the OEC, CG Tejada called a meeting between Polo officers and those from the Department of Foreign Affairs’ side to tell them that they should “put in some intervention to alleviate the OFWs' difficulty.”

In response, Polo decided to open on Fridays and set up an extension office anew at the Bayanihan Center in Kennedy Town on Sundays, dedicated only to attending to OEC applicants.

Tejada likewise appealed to two DMW officials to take immediate action when they came to Hong Kong recently to observe the EOC processing system.

Undersecretary for Welfare and Foreign Employment  Hans Cacdac and Assistant Secretary in charge of OEC, Levinson Alcantara, reportedly saw with their own eyes the difficulty of tackling the new computerized application system.

After their visit, Polo began implementing flexibility in processing OEC, including allowing those without prior appointment to walk in for consultation.

While some of the problems linked to the OEC have been solved, CG is still urging OFWs who plan to go home during peak seasons to secure the exit pass early.

But realizing that this could not be done really early because the OEC is valid for only 60 days, CG said he would ask the DMW to consider extending the validity of the pass for at least six months.

High Court rejects Filipina’s appeal against conviction in 2 immigration cases

High Court judge confirms Filipina's conviction.

A Filipina’s appeal against conviction for two charges of breach of condition of stay has been dismissed by a Court of First Instance judge who ordered her to now serve her 12-month sentence.

“The appeal is dismissed.  The sentence of the Magistrate stands.  The appellant must return to carry out her sentence forthwith,” said Judge Audrey Campbell-Moffat in a decision released Friday by of the High Court.

Jasmin Andaya, a former domestic helper and former wife of a Hong Kong resident, had been convicted of overstaying from October 2005 until she was arrested on Jan 2, 2020 in an Immigration raid on a restaurant in Tai Hang, and of illegally taking up employment as an odd job worker in that restaurant.

For the first charge, she was sentenced to 12 months in jail by Magistrate Frances Leung  at the Shatin Magistrates’ Courts; for the second, she was sentenced to three months. Both sentences will run at the same time.

The judge supported the magistrate’s conclusion that Andaya had overstayed,

“The learned magistrate analyzed the evidence in a simple and straightforward manner….  The appellant, was, as a matter of fact, an over-stayer who was not allowed to work.  There was no evidence before her to suggest otherwise,” Judge Campbell-Moffat said. 

“She found, contrary to the defence case, that the appellant, on her own admission, knew that she had been a visitor in Hong Kong but had overstayed and that she was not allowed to work.”

She dismissed Andaya’s claim to have paid income taxes to prove that she believed she could lawfully work and that she was allowed to remain after October 2005. “The argument that she had paid salaries tax did not affect her status as a visitor nor her conditions of stay.  She remained in breach of them.,” the judge added.

The case began when Andaya was arrested in a raid by Immigration officers on Jan 2, 2020 on Palki Restaurant on Tsing Fung Street, Tin Hau. She failed to present identity documents but a check with the Immigration Department database showed that she had been overstaying since 2005.

The Immigration officer who arrested her testified that she admitted she worked at the restaurant as a waitress and said she had done so for less than a year.  She maintained that she was paid $400 per day.

In the recorded interview that followed, where Andaya was assisted by an Ilocano interpreter, she admitted that Immigration refused her application for a dependant visa after she and her husband separated and he refused to sponsor her.

She thus became a visitor and was allowed to stay in Hong Kong until October 2005.  “I knew I cannot work in Hong Kong.  I should leave before October 2005,” she said in the recording.

She added that she stayed in because she was hoping she and her husband would reconcile. She has  since lost her passport and Hong Kong ID card, and did not replace them,

Judge Campbell-Moffat also dismissed Andaya’s lawyer’s assertion that because she lied about having worked at the restaurant for less than a year, when she had in fact worked there since 2014, all her other admissions should therefore be treated as lies.

The lawyer did not present evidence or submissions to disprove that she was overstaying from October 2005 onwards, she said.

 “The applicable law is trite.  Section 41 of the IO (Immigration Ordinance), Cap 115 (“s41”), requires the prosecution to prove that the appellant was subject to a condition of stay which was contravened and that the appellant knew of the relevant condition,’ she said.

Pilipinang nakulong kasama ang sanggol niya, mananatili pa ng 2 buwan sa preso

Nahatulan sa Eastern Magistracy ang Pilipina. 

Isang Pilipina na nauna nang nahatulang nagkasala sa limang kasong isinampa sa kanya sa Eastern Magistracy – apat na may kinalaman sa pagpapatakbo ng isang kainan sa Central at isa dahil nag-trabaho siya nang bawal -- ang ikinulong ngayon nang 10 linggo.

Dahil napagsilbihan na ni Mary May Soriano ang dalawang linggo sa kanyang sentensiya, na kasama ang kanyang sanggol na anak na babae, makalalabas na ang mag-ina sa loob ng dalawang buwan.

Nahuli si Soriano at isa pang Pilipina noong March 13, 2021 sa Room 203 ng Fai Man Bldg., sa Li Yuen West sa Central sa isang raid ng mga pulis kaugnay ng kampanya ng gobyernong Hong Kong laban sa ilegal na pagtatrabaho.

Noong Nov. 30 ay nahatulan ni Magistrate Edward Wong na nagkasala si Soriano sa lima sa siyam na paratang sa kanya, pero pinawalang sala ang kasama niyang si Jenivib Balanggao matapos nitong igiit na customer lang siya nang magkahulihan sa kainan.

Ang ipinataw na parusa kay Soriano ay 12 linggong kulong para sa salang pagtitinda ng alak nang walang lisensiya at pagkakaroon ng alak na pambenta nang walang lisensiya.

Pinarusahan din siya ng dalawang linggo para sa dalawang kaso ng paglabag sa panuntunang ipinatutupad noon laban sa pagkalat ng Covid-19 – dahil nanatiling bukas ang kainan lampas sa 10pm na itinakdang oras ng pagsasaran ayon sa utos ng Secretary of Food and Health, at ang pagpayag na magkumpulan ang mga tao sa lugar na kanyang pinatatakbo.

Para sa pagtatrabaho nang ilegal – dahil ayon sa Immigration Ordinance ay bawal magtrabaho o magtayo ng negosyo ang isang turistang gaya niya -- ay pinarusahan siya ng 12 linggo sa kulungan.

Dahil inutos din ni Magistrate Wong sa sabay-sabay na pagdusahan ni Soriano ang mga parusa, ang naging kabuuang parusa ay 12 linggo.

At bilang pagtugon sa panawagan ng abogado ni Soriano na bigyan siya ng kaluwagan sa pagpaparusa dahil may alaga siyang sanggol sa kulungan, binawasan ni Magistrate Wong ng dalawang linggo ang sentensiya niya.
