2 Filipina teens arrested for allegedly ganging up on compatriot

The alleged assault happened in a carpark in Tsui Ping (South) Estate

Two Filipina teenagers were arrested separately on Wednesday (Feb 8) after allegedly assaulting a fellow Filipina teen in a housing estate in Kwun Tong on Tuesday.

A police report said the arrests were made after the alleged victim, a 17-year-old Filipina resident, reported to police about being attacked by several girls in a parking lot in Tsui Ping (South) Estate.

The victim had bruises on her face, waist and upper arm, and sought treatment at United Christian Hospital on her own.

Following her complaint, the police arrested two other Filipina teenagers, one 17 years old who was picked up in Yau Ma Tei, and an 18-year-old who was found in Kowloon City, on suspicion of assault causing bodily harm. Both also hold HK ID cards.

After an investigation, the two suspects were released on bail and told to report back to the police station in early March.

Magkahiwalay na kaso laban sa 3 Pilipina pinag-sama

Pinag-isa ang magkakahiwalay na kaso laban sa tatlong Pilipina nang humarap sila kahapon sa Eastern Court sa kasong pagtitinda ng alak nang walang lisensya at pagtatrabaho nang ilegal sa isang kainan sa 8th floor ng Fai Man Bldg., sa Li Yuen Street West sa Central (na tinaguriang Alley-alley).

Nahuli ng pulis sina Mary Jean Batalla, Myrna Reyes at Rowena Abelido – na ngayon ay pawang walang trabaho -- noong nakaraang Agosto 19.

Noong huling humarap sa korte si Batalla, 52 taong gulang, limang kaso ang nakasampa laban sa kanya -- pagtitinda ng alak nang walang lisensiya, pagkakaroon ng ipinagbibiling alak, pagpapatakbo ng kainan nang walang karampatang pahintulot, at paglabag sa Prevention and Control of Disease Ordinance (Requirements and Direction) (Business and Premises) Regulation dahil bukas ang kainan nang lampas sa hatinggabi.

Sa bagong kaso ay dalawa na lang ang asuntong iniharap sa kanya: ang pagtitinda ng siyam na bote ng alak nang walang lisensiya, na labag saDutiable Commodities Ordinance, at ang pagtatrabaho sa Hong Kong kahit siya ay nag-overstay, na paglabag sa Immigration Ordinance.

Si Reyes, 33 taong gulang, ay nahulihan naman ng siyam na bote ng iba’t ibang klase ng alak at pagtatrabaho kahit labag sa Immigration Ordinance, dahil may utos ang Immigration Department na paalisin siya sa Hong Kong.

HC says illness of relative not ground for reducing sentence

CA judge says ailment of appellant's father no reason to lower her sentence

A High Court judge has dismissed an appeal by a Filipina convicted of overstaying on the ground that her sentence was too severe.

One of the grounds cited by Remedios Victoria Abara in asking for a lower sentence was that she wanted to go home earlier because her father was seriously ill.

Abara was sentenced to six months imprisonment after surrendering, then pleading guilty to a charge of overstaying for nearly 11.5 years.

In the judgment she handed down on Feb.6, Judge Esther Toh, sitting as a lone appeal court judge, said the magistrate who imposed the sentence “rightly considered that the ill health of her father was not a factor in mitigation because when the Appellant decided to overstay, her father was already in his 70s.”

Judge Toh cited a case presented by counsel for the respondent Department of Justice Jason Lau that stated that “the serious illness of a family member does not generally amount to a humanitarian ground for the reduction of sentence, except where it is exceptional.”

Apart from this, there was no other ground that could be used to mitigate the sentence because the right discounts had already been given to Abara for her guilty plea and surrender to the Immigration Department.

 


Abara arrived in Hong Kong to work as a domestic helper in 2009. Her employment contract was terminated the following year but she did not leave Hong Kong as required.

She finally surrendered to Immigration on Jun 13, 2022, after overstaying for a total of 11 years and 5.5 months.

When she appeared in court, she told the magistrate that she decided to surrender because she wanted to go back to the Philippines because of her sick father.

In sentencing, the magistrate used a starting point of 12 months, then gave a 1/3 discount for the appellant’s guilty plea, then reduced it further by two months for her voluntary surrender.

But the magistrate gave no further credit to Abara’s plea that she needed to go home sooner because of her sick father.

Having looked at previous cases of a similar nature and the sentences imposed in each, Judge Toh said she did not consider that the sentence of six months was “manifestly excessive or wrong in principle.”

She issued her decision during the hearing of the appeal on Jan. 16 this year, but handed down her reasons for judgment on Feb. 6.

PCG tells FDWs they must exit HK before their current contract ends

The Philippine Consulate has just issued a reminder telling all Filipino domestic workers that they must return home before their current employment contract ends.

The new rule supersedes all provisional measures taken by Hong Kong Immigration to address the difficulties encountered by migrant workers in returning to their home countries due to travel restrictions imposed amid the pandemic.

A diagram posted on the Consulate’s website today, Feb 8, includes two dates which indicate when a FDW still under contract must “exit” or go back home.

If the worker’s extended visa due to “deferred home leave” will expire on or before Apr 30 this year, he or she may apply for another year-long extension of the visa with the Immigration Department, but MUST still exit to the Philippines before the expiration of the visa extension.

If the extended visa expires from May 1 onwards, the worker will have to exit before the date indicated. For example, if the visa expires exactly on May 1, the worker will have to fly home no later than Apr 30, then return to Hong Kong to complete her contract.

 

The rule remains the same for those who have completed their contracts, or whose contracts were terminated prematurely.

Those who finished their two-year contract may ask Immigration to defer their mandatory exit from Hong Kong for no longer than one year. They will no longer be granted an extension after this, so they should exit before the extended visa expires.

If they do not wish to defer their home leave they should leave Hong Kong before starting to work under the new contract.

For all terminated workers, the 14-day rule remains. This means, they have to leave Hong Kong within 14 days after their contracts are deemed terminated.

Despite the exhaustive explanation, many questions remain, and foremost of these is whether a FDW can go elsewhere outside Hong Kong, including Macau, to be deemed as having satisfied Immigration’s policy of requiring all FDWs to exit Hong Kong every two years, of after each contract.

The answer to this, as many FDWs who have taken this route recently will attest, is yes.

However, Philippine policy directions may differ, as the government requires all overseas Filipino workers to return home after completing each two-year contract.

Sa halip ay inutusan ng Kowloon City Magistracy acting Principal Magistrate na si Peony Wong na magbigay si C. Zulueta, 20 taong gulang, ng 240 oras na libreng serbisyo sa komunidad.

Nalagay sa peligro ang anak dahil sa maling sapantaha

Sa 8 araw ni Prix sa ospital ay umabot sa P180k ang kinailangang bayaran ni Margie

Wala na sigurong mas masakit sa loob ng isang ina kundi ang makitang namimilipit sa sakit ang kanyang anak, lalo na kung malayo siya sa piling nito. Doble ang sakit kung ang bata ay hindi agad nagamot dahil mali ang sinabing sanhi ng unang doktor na tumingin dito.

Ito ang naranasan kamakailan ni Margie Barbas, isang domestic helper na limang taon nang nagtatrabaho sa Hong Kong, nang itawag sa kanya ang matinding pananakit ng tiyan ng kanyang 10 taong gulang na anak na si Prix Vincent noong Miyerkules, Jan. 18.

Agad namang pinakiusapan ni Margie ang kanyang tatay na dalhin ang bata sa isang pribadong doktor na malapit lang ang klinika sa kanilang bahay sa Sipalay, Negros Occidental. Ayon sa doktor, UTI o urinary tract infection ang sakit ng bata, at magagamot iyon ng antibiotics.

Pero pagdating ng Biyernes ng gabi, Jan. 20, ay kinabahan na si Margie, na mag-isang itinataguyod ang anak, dahil hirap nang huminga si Prix dahil sa sakit ng tiyan, kahit patuloy ang pag-inom niya ng antibiotics.

Muli ay pinagbilinan ni Margie ang kanyang ama na hirap ding magkikilos dahil kinailangang putulin ang isang paa kamakailan dahil sa diabetes, na patingnan ang bata.

Chat nina Margie at Prix bago ang operasyon 

Dahil diumano walang ospital sa Sipalay ay sa isang laboratoryo dinala ng natatarantang lolo ang kanyang apo kinabukasan.

“Pero nag-umpisa na rin siyang mag-isip na baka hindi tama ang sabi ng doktor,” sabi ni Margie tungkol sa ama.

Nang lalo pang tumindi ang sakit ng tiyan ng bata ay nagpatawag na ng ambulansiya si Margie kinabukasan para madala ang bata sa Queen of Mercy Hospital sa Bacolod City.

Pero pagdating doon, kahit namimilipit na sa sakit ang anak at bandang 7 na ng gabi ay kinailangan pa siyang i-swab test muna sa Covid-19 bago na eksamin. Pati ang dalawa niyang kasama na magbabantay ay pina test din muna dahil ito raw ang protocol sa ospital.

Ganoon na lang ang gulat at awa ni Margie sa anak nang malaman niya na appendicitis ang problema nito, at dahil sa hindi ito agad na diagnose ay pumutok na ang appendix, at nag-umpisa nang kumalat ang impeksyon sa katawan ng bata.

Dahil naging kumplikado ang sakit ni Prix ay kinailangang hiwain ang buong tiyan nito para mapigil ang pagkalat ng impeksyon o lason mula sa pumutok nitong appendix.

Hindi dito natapos ang problema ni Margie, na isang aktibong miyembro ng Mission Movers, ang grupong ginagabayan ng Mission for Migrant Workers para tumulong sa mga migranteng nangangailangan o may problema sa trabaho.

Nang dumating ang singil ng ospital ay laking problema na naman dahil umabot ito sa mahigit Php180,000, at kahit na nabawas ang Php14,000 para sa PhilHealth membership niya ay mabigat pa rin.

Gipit din kasi si Margie dahil katatapos lang niyang bayaran ang pagpapa-opera ng ama na kinailangang putulan ng paa noong nakaraang taon. Nasa lahi daw nila ang pagkakaroon ng diabetes, dahilan para madagdagan ang mga gumugulo sa isip ni Margie.

“Ang tanging pinagpapasalamat ko na lang ay naagapan ang buhay ng anak ko,” sabi niya.

Dahil sinabihan daw siya na hindi papalabasin si Prix sa ospital kung hindi mababayaran nang buo ang singil sa kanila ay napilitang manghiram ng pera si Margie sa ilang mga kaibigan at kaanak.

Nakalabas na ang anak niya nitong Biyernes lang, pero kailangan pa ring bumalik para tanggalin ang mga “stapler” na ginamit para isara ang tiyan niyang inoperahan.

Dalangin niya ngayon na gumaling na nang lubusan ang anak, at manatili naman siyang malusog para mabayaran ang lahat ng mga inutang para maitawid ang isa na namang naging pagsubok sa kanilang pamilya.
