Filcom urged to express opposition to job-hopping measure

Consul General Raly Tejada has made an impassioned plea to the Filipino community to express  disapproval over a proposal by the Hong Kong Labour Department to effectively legislate the so-called “job hopping” by foreign domestic workers.

“Please participate. Huwag po nating sayangin yung pagkakataon na maipaabot po natin ang ating saloobin,” he said. (Let’s not waste the chance to relay our concerns)

He made his call during a Filcom meeting at the Consulate today (Sunday), the first since the pandemic swept across the city. Key officials from the Philippines’ Department of Migrant Workers joined him at the forum to respond to questions from community leaders.

Congen Tejada said all members of the community should make their views known during the ongoing public consultation on amending the Code of Practice for Employment Agencies to include job-hopping.

“Let’s flood the public consultation with our voice. Kung hindi pa sila makinig, hindi po ba? (that should force them to listen to us)”, he said. “If we lose this chance, ano na ang mangyayari sa atin (what would happen to us)?”

He said everyone could just go to the website set up for the public consultation and send an email simply saying “I do not agree”. That should only take about five minutes, he said.

“211,000 tayo, what is 190,000 na domestic workers? That is a lot of people, baka mag crash ang kanilang website.” (There are 211,000 of us, while there are only  190,000 domestic workers. That is a lot of people, their website might even crash).

He was emphatic in assuring the leaders that he is with them in opposing the plan to include in the CoP a provision requiring employment agencies to warn FDWs against  job-hopping, and inform employers about refunding fees or giving them a replacement helper.

“A hundred percent I am with you, I have never wavered,” he said, prompting the audience to clap their hands in approval.

What prompted his response was a question from a Gabriela Hong Kong leader who asked if the Consulate was ready to come out with a public statement expressing support for the workers’ opposition to the plan.

“Why not? Why will I not support you? I will do it on my own terms but you cannot tell me what to write ha?,” he replied, obviously irked.

He later tempered this by saying “Sorry, I am being too passionate, but I’m with you, don’t worry about it. Don’t doubt it for a second, please.”

He had previously rejected suggestions from militant leaders in the community that the Consulate was keeping quiet on the issue so as not to create a diplomatic ripple.

He said that during his talks with Hong Kong’s Secretary for Labour Chris Sun, he has always argued that migrant workers have the right to change employers, so that should not be seen as job-hopping.

“Lagi po naming sinasabi na ang ating mga workers hindi lilipat kung walang abuse, walang non-payment of salaries…kung hindi kaaya-aya ang working conditions kami po ang mauuna na magsabi, iwan na ninyo ang employers ninyo,” he said.

(We often say our workers will not change jobs if there is no abuse, no non-payment of salaries…if the working conditions are oppressive we will be the first to tell you to leave your employers).

Sun’s response was an assurance that there is no sweeping policy to reject all applications for a change of employer by terminated workers, meaning they make a decision on a case-to-case basis.

Thus, he said the workers should learn how to justify their application for a change of employers without having to leave Hong Kong. They could do this by documenting any case of abuse or contract violation in a diary, or if the case is serious, to go to the police.

The assistance to nationals section of the Consulate or the Office of Migrant Workers could help by helping them draft an affidavit that would explain why their contracts were terminated, or why they decided to leave.

The major proposals include, among others, requiring EAs to set out in the service agreement the amount of fees charged for each category of services to enhance transparency and protect consumers; explaining clearly to foreign domestic helper (FDH) job seekers that under the prevailing policy, an application for change of an employer in Hong Kong within the two-year contract period will normally not be approved save for the exceptional circumstances, such that FDHs would understand the consequence of 'job hopping'; and EAs should not provide monetary incentives to FDHs in employment to induce the latter to terminate their contracts prematurely.”

Another proposal is to require EAs to divulge whether they have association with and are sharing the same premises with any financial institutions, so as to prevent EAs from colluding with financial institutions to arrange FDHs to take out loans.

As recommended by the Office of The Ombudsman, Labour also proposes to require EAs to provide basic information on boarding facilities for their FDH job seekers.

Mga may edad, patuloy na nabibiktima sa ‘Guess Who’ scam

 

76% ng mga biktima ng ganitong modus ay edad 60 pataas

Pinag-iingat ng mga pulis ang mga senior citizen at pati na rin ang mga nag-aalaga sa kanila para hindi sila mabiktima ng “Guess Who” o “Hulaan Mo Kung Sino Ako” scam.

Ito ay matapos maitala ang pagtaas ng halos tatlong beses ng mga ganitong kaso nitong nakaraang buwan lamang. Mula sa 84 na naitala noong Enero ay umakyat bigla sa 233 ang bilang ng mga ganitong kaso.

Sabi pa ng mga pulis, ito ang pinakamalaganap na panloloko sa telepono na isinasagawa ngayon ng mga kriminal sa Hong Kong.

Nitong unang tatlong buwan ng taon, 72 porsyento ng 597 na kaso ng telephone scam na naitala ay isinagawa sa ganitong pamamaraan. At 76 porsyento ng mga biktima sa ganitong modus ay edad 60 pataas.

Kabilang sa pinahuling biktima ang isang 82 taong gulang na lalaki na nalimas ang ipon niyang $1.2 million.

Nakuhanan din ng $100,00 ang isang 81 taong gulang na babae matapos siyang tawagan ng isang scammer kamakailan at nagpanggap na anak niya. Sabi ng lalaki ay inaresto siya at kailangan niya ng pampiyansa sa halagang $100,000.

Nakipagkita ang matandang babae sa scammer at inabot dito ang pera. Mabuti na lang at pagkatapos nito ay naisipan niyang tawagan ang anak at nalaman na naloko siya.

Kagabi ay muli na namang sinubok ng manloloko na hingan ng $50,000 ang matanda gamit ang parehong dahilan, pero kulungan ang kinabagsakan niya.

Sabi ng acting senior superintended ng pulis na si Rick Chan, napakadali sa mga sindikato ang manloko sa ganitong paraan at malamang na dumami pa ang magtangkang magkapera sa pamamagitan nito, kaya dapat na dobleng ingat ang mga may edad

Hindi naman daw nagkulang ang pulis sa pagtutok sa mga scammer dahil mula lang noong Setyembre ay napakiusapan nila ang mga telecom operator na i block ang mahigit 100,000 na nakapagdududang mga tawag sa telepono, at 2,200 na hyperlink sa mga kahina-hinalang website.

May 600 na mga local na numero ang sinuspindi din.

Sa kabila nito ay patuloy pa ring may mga nabibiktima, kabilang ang isang 68 taong gulang na lalaki na nawalan ng $2.1 million matapos ma hack naman ang kanyang telepono.

Ang biktimang si Hau, katulad ng maraming iba pang mga tao sa Hong Kong, ay nakatanggap ng tawag noong Agosto mula sa isang nagpakilalang opisyal ng Public Security Bureau ng China.

Sabi ng tumawag ay may kinalaman si Hau sa isang money laundering na kaso sa Guangzhou, at tinanong kung nagpunta siya kamakailan sa distrito ng Yuexiu.

Dahil hindi pa naman siya nakakarating man lang sa mainland ay nagpakatanggi si Hau. Pero dahil pilit siyang hiningan ng pruweba ay nagpadala siya ng kopya ng kanyang HKID card at mga kuha ng utos na magpa PCR test siya.

Pagkatapos nito ay pinuntahan siya ng isang batang babae na nagpanggap na “commissioner” at kasabwat ng scammer at inalok si Hau na lalagyan niya ng “mobile security app” ang kanyang telepono para sa kanyang proteksyon.

Ang nilagay pala nito ay tracker kaya napasukan ng sindikato ang kanyang telepono at nakapag withdraw ng may $2.1 million mula sa kanyang account.

Sabi ni Hau, sana pala daw ay pinutol na lang niya agad ang linya nang tawagan siya ng scammer dahil alam naman niyang hindi totoo ang paratang sa kanya.

Dagdag ng isa pang pulis, dapat ay putulin ng biktima agad ang tawag, at tapos ay ipagtanong kung totoo bang may mga opisyal na tumatawag na lang bigla at nag-aakusa sa sinumang sasagot ng isang krimen na hindi naman nila ginawa.

Ang isa pang naging biktima kamakailan ay isang 55 taong gulang na babaeng retirado na nawalan naman ng halos $7 million sa crypto investment scam, na naging dahilan din ng pagkawala ng pera ng ilang Pilipina kamakailan, na karamihan ay domestic worker.

May nakipagkaibigan sa kanya sa Instagram noong Enero at tinuro sa kanya ang isang website para diumano sa crypto currency investment.

Sa pagbubuyo ng hindi niya pa nakitang tao ay naglipat siya ng $6.96 million sa 19 na mga bank account nang maka 24 na beses, na ang buong akala niya ay napupunta lahat ito sa kanyang “investment.”

Nalaman niyang natanso siyang nang subukan niyang humiram ng pera sa isang anak, na agad na nagsabing scam ang pinasukan niya. Inireport niya ito sa mga pulis nito lang nakaraang linggo.

OEC, job-hopping allegation top agenda of tomorrow’s Filcom meeting

Long queues and difficulty of access are not the only problems linked to the OEC (File)

Calls for the scrapping of the overseas employment certificate and the host of government fees being attached to it, plus a collective stand against allegations of job-hopping among foreign domestic workers, top the agenda in tomorrow’s meeting between visiting officials from the Department of Migrant Workers and Filipino community leaders.

According to Consul General Raly Tejada, those who are confirmed to attend the meeting are DMW Undersecretary for Policy and International Cooperation Patricia Yvonne Caunan, Undersecretary for Finance and Internal Affairs Anthonette Velasco Allones, and Overseas Workers Welfare Administration Deputy Administrator Honey Quino.

He said that as of yesterday, DMW Secretary Susan “Toots” Ople who used to be a frequent visitor to Hong Kong, was not with the group and he was unsure if she would join the forum.

The Consulate advisory on the meeting said the Filcom’s opinion on alleged job-hopping of FDWs, which has long been called by migrant support organizations as untrue and discriminatory, will be sought for submission to the authorities.

Hong Kong’s Labour Department began an eight-week consultation on the issue starting on March 21, when it submitted a list of proposals to the Legislative Council, including getting employment agencies to tell FDWs hired through them that they should not terminate their contracts before the two-year expiration or they will be sent home within 14 days.

This so-called 14-day rule which mandates that FDWs whose contracts are pre-terminated, either by themselves or their employers, will be sent home within two weeks, has long been a policy of the Immigration Department.

However, requiring agencies to issue a reminder to the migrant workers about this rule has stoked fears of a hard-fist implementation of the policy, especially as it is paired with a proposal to refund fees paid by employers, or allow them to get a discount if they hire a new FDW through the same agency.

Migrant organizations led by United Filipinos in Hong Kong have called on the Consulate to take a firm stand against the job-hopping allegation as it promotes forced labor, or curtails the right of migrants to choose who to work for.

Another issue Unifil wants to bring to the table are the recurring problems tied to the OEC. These include the long queues for home-bound OFWs who need to secure them to guarantee their return to Hong Kong, and the various government fees being attached to this exit permit.

Unifil has long lobbied for its scrapping, saying it does not serve any purpose than to make life difficult for OFWs who want or need to go home.

Marites Palma, founder of Social Justice for Migrant Workers, is among those advocating for the removal of the OEC, and at the same time, stop the collection of government fees which are being attached to it, such as premium payments for Pag-IBIG, SSS and PhilHealth.

She said she also planned to complain about employment agencies that shirk their responsibilities to the FDWs they deploy from the Philippines.

Rodelia Pedro, founder of Domestic Workers Corner, said she would like to ask why OWWA only provides livelihood assistance to workers who were terminated or abused by their employers.

She said there are many veteran FDWs here who already want to go home to be with their families but hesitate because they cannot get the same help from OWWA.

Another issue she is concerned about is the limited space at the shelter run by OWWA. She said it would help a lot if OFWs who were terminated would have someplace to go to while looking for a new employer or pursuing a labor case.

Filcom leader's appeal against being sent home fails

The Court of Appeal has dismissed a Filipino community leader’s appeal against the government’s rejection of his claim not to be sent back to the Philippines for fear of being killed, tortured or harmed.

“At the outset, most if not all of the applicant’s allegations are vague, bare contentions and without basis in or support by evidence,” Justice of Appeal Poon Siu-tung said as he outlined the 15-year non-refoulement claim of Raymundo Perez.

Perez, founding chairman of the United Villasis Pangasinan Association and member of the Utol group, arrived as a tourist on Aug. 9, 2008 and overstayed when his two-week visa expired.

After he was arrested by police on Oct. 30, 2008, he filed his non-refoulement claim with the Immigration Department, claiming he would be harmed or killed by his boss named Antonio Villar over a monetary dispute.

After the Director of Immigration rejected his non-refoulement claim on Feb. 2, 2017, Perez appealed to the Torture Claims Appeal Board/Non-Refoulement Claims Petition Office.

But the Board affirmed the director’s findings, saying there was no evidence to suggest that Antonio was behind the death threats and that Antonio had passed away in 2019, rendering any risks of harm to Perez non-existent.

When his claim was rejected by the Board on April 4, 2019, Perez filed an application for leave to apply for judicial review at the Court of First Instance, saying the Board was procedurally unfair, that the decision was irrational, that it committed an error in law and that it was Wednesbury unreasonable -- a test of reasonableness based on a case, Associated Provincial Picture Houses Ltd v Wednesbury Corporation (1948).

But Deputy High Court Judge KW Lung refused his application, saying: “The role of this Court is supervisory, meaning that it ensures that the Board complied with the public law requirements in coming to its Decision on the applicant’s appeal. The Court will not usurp the fact finding power vested in the Director and the Board.”

Perez thus went to the Court of Appeal, saying he would “face hardship” if refouled, and that the Board had erroneously relied on “source of news which is not official recognised, or it is simply hearsay”.

Justice Poon, in his decision dated April 13 after he and fellow Justice of Appeal Aarif Tyebjee Barma heared the case on March 16, said: “… it is well-established that the assessment of evidence, COI (country of origin) and risk of harm, state protection and viability of internal relocation are primarily within the province of the Board (and the Director)  as primary decision makers.  The Court will not intervene by way of judicial review unless there are errors of law or procedural unfairness or irrationality in the decision of the Board.”

Besides, “… general assertions of the applicant’s fear if refouled do not constitute proper grounds of appeal,“ he said.

“Although he disagreed with the Leave Decision, nowhere in his Notice of Appeal or written submissions did the applicant identify with specific particulars as to how the Deputy Judge had erred in reaching the Leave Decision.  Accordingly, his submissions are plainly not proper grounds of appeal. A scammer called 'Teacher Austin' scolds a Filipina victim for not coughing up more money

May ilang mga Pilipina na karamihan ay mga domestic helper, ang umamin na nabiktima din sila sa phone chat ng mga di kilalang tao na sa umpisa ay nagpasagot lang sa isang survey kapalit ng pabuya, pero pagkatapos ay agad silang hinila sa isang patibong na kunyari ay crypto currency investment.

Ganito rin ang nangyari sa ibinalita dito sa The SUN noong isang araw, kung saan ang isang Pilipinang residente ay nakuhanan ng halos $700,000 ng mga scammer sa loob lang ng isang araw.

Dalawa sa naglahad ng kanilang kuwento ay parehong domestic helper. Ang isa ay nawalan ng $3,000 samantalang ang pangalawa naman ay $5,000 ang tinangay ng sindikato.

Pera itong pinaghirapan nila, at dapat ay nagastos nila para sa kanilang pagkain o  pangangailangan ng pamilya sa Pilipinas.

Mabuti na lang at ang pangalawa na umaasa pang maibalik ang kanyang $5,000 pagkatapos niyang kumpletuhin ang ipinangakong huling "task" niya kapalit ng pagpapadala niya muli ng $12,000 sa sindikato, ay nabasa ang istorya ng The SUN, kaya natigilan.

“3,000 HKD ang nawala sa akin. Sa tagal ko na dito sa Hong Kong ay very aware ako sa mga ganitong scheme pero nung nangyari ito sa akin in two days lang para akong na hipnotismo,” sabi ni Lita (hindi tunay na pangalan) na nabiktima noong nakaraang buwan.

Pero bukod sa gusto nilang ilabas ang kanilang sama ng loob ay mas gusto ding iparating ang dalawa. Sana naman daw ay tigilan na ang paninisi at pangungutya sa kanila dahil sila ay mga biktima, hindi kriminal.

Ayon kay Lita nagdesisyon siyang sarilinin na lang ang problema dahil ayaw nyang madagdagan pa ang kanyang sama ng loob.

“Kaya ako nanahimik nung nangyari sa akin yun kasi ayaw kong mahusgahan ang pagkatao ko. Pag nasa sitwasyo ka na di mo na kilala pati sarili mo, magigising ka na lang kapag wala ka nang ma transfer na pera,” ani Lita.

“Mahirap husgahan ang mga biktima tulad ko kasi parang na hypnotize ako talaga noong dalawang araw na iyon.”

Malinaw kung sino ang tumanggap ng huling inilipat na pera ni Lita sa sindikato 

Naeengganyo daw siyang sagutin ang isang survey tungkol sa mga paboritong lugar panturismo ng mga taga Hong Kong dahil sa pangakong pabuya na dalawang libreng ticket sa Disneyland.

Pero hindi naibigay sa kanya ang premyo dahil inalok naman siyang mag “like” sa ilang page sa social media na ang bawat isa ay may kapalit na puntos, na maaaring papalitan ng cash kapag natapos na niya lahat ng mga pinapagawa sa kanyang utos.

Pagkatapos ay nakumbinsi na siyang pumasok sa crypto currency investment naman daw kung saan ang una niyang ipinasok na $200 ay agad tumubo ng $300, base sa pinalalabas nilang halaga sa website kung saan siya inutusang pumasok.

Noong sumunod ay pinalipatan siya ng $800, tapos ay $500, isa pang $500 at ang huli ay $1,000. Ang lahat ng mga ito ay inutos sa kanyang ilipat sa account ng isang Chau Kwok Chung sa CMB Wing Lung Bank sa loob ng dalawang araw, mula March 3 hanggang 5.

Tuwing pinapaglipat siya ng pera ay sinasabihan siyang may mali kasi siyang ginawa, mula sa dapat ay combination ang dalawang hulog nya o hindi nya agad nagawa ang inutos sa kanya.

Sinabihan sya na ang hinulog nyang $3,000 ay maibabalik sa kanya ng doble, pero gayon na lang ang gulat niya nang sabihan siyang may ka miyembro daw siya sa grupo na gumamit ng “black money” kaya kailangang maglipat siyang muli ng $1,500 para ma unfreeze yung pera niya.

Doon na siya nagising sa katotohanan na na-scam sya, at hindi na kailanman babalik ang pera niya.

Sa panahon daw na naging sunud-sunuran sya sa utos ng scammer na maglipat ng pera ay parang sila na lang daw ang natitira sa mundo, na parang wala siyang matatakbuhan para humingi ng tulong.

Mas malala ang naramdaman niya nang makapag-isip isip muli dahil nalaman niyang nagawa ng mga manloloko na pasukin ang isip niya para maging sunud-sunuran na lang siya.

“Tatlong araw akong lutang sa stress. Hindi naman ako bata at newbie dito sa Hong Kong para maloko nang ganito pero nangyari sa akin,” dagdag ni Lita.

Naisip niya daw na ibahagi ang kanyang kuwento para maging listo ang mga kapwa niya domestic worker sa mga ganitong panloloko, lalo at perang pinaghirapan nila nang husto ang bigla na lang natatangay sa kanila.

Ayaw na rin daw niyang isumbong pa sa pulis ang nangyari kahit naitago din niya ang mga litrato ng paglilipat niya ng pera sa bangko at pati screenshot ng usapan nila sa Telegram app.

“Lesson learned na lang talaga,” sabi pa niya.

Iba naman ang survey na pinasagot kay Kate

Ang pangalawa naman ay naniwala hanggang kahapon na totoong kumikita ang perang pinapasok sa kanya ng sindikato sa account ng isang Pilipina sa Mox online bank na ang pangalan ay Carmelita Tangalin Villaraza.

Mabuti na lang at pagkatapos niyang makapaglipat ng $7,000 sa loob ng tatlong araw noong nakaraang linggo lang ay wala na talagang mapagkukunan ng pera si Kate (di tunay na pangalan).

Tiyempo din na nabasa niya sa The SUN ang tungkol sa Pilipinang residente na na-scam ng $700,000 kaya napatigil siya at nakapag-isip isip.

Gusto kasi ni “Teacher Austin” na siyang nagtuturo kunyari sa kanya kung paano mag-invest na magpasok siya ulit ng $12,000 para daw makuha na niya ang pera niya na nagkakahalaga na noon ng $25,000.

Kahit anong pakiusap ni Kate na babaaan ang pinapahulog na namang pera sa kanya dahil wala na siyang mailabas ay nanatiling matigas ang kanyang “teacher.”

“You can find a solution for the fund problem yourself, and you can withdraw the money after this is completed,” ang mariing sabi nito sa kanya sa chat.

Bandang huli ay nagsabi ito na pwedeng babaan sa $7,000 ang kailangang maipasok ni Kate. At nang makiusap ang huli na payagan siyang bawiin kahit ang kalahati ng perang naipasok na niya ay tinawanan pa siya.

“You didn’t finish it and you want to withdraw money, isn’t it a joke,” ang sabi ng di kilalang tao.

Mabuti na lang at hindi tumulad si Kate sa iba pang nabiktima na nangutang sa financing company at kung saan-saan sa kagustuhan na hindi mapagalitan ng mga tao sa sindikato, at maibalik ang kanilang pera, kasama ang pinangakong malaking interes.

Ayon kay Kate, iniisip na lang niya ngayon na may kinalagyang mabuti ang perang tinangay sa kanya. Gusto din daw niya na mailahad ang kanyang sariling karanasan para maiwasan ng iba pang Pilipina ang mahulog sa ganitong klase ng patibong.

Pero masakit pa din na ang isang buwang suweldo niya ay naipatalo niya sa transaksyon na ang buong akala niya ay tunay.

“Hay, kaya ako ngayon hindi makatulog. Daming bayarin, tapos na scam pa,” sabi niya.
