2 Filipinas found guilty of money laundering

This is how a bank account used for money laundering looks like

Two Filipinas broke down in tears after they were found guilty on two separate charges of money laundering by Magistrate Vivian Ho at Eastern Court this afternoon.

Hazel V. Gepulgani, 33, sobbed as she heard the verdict while her fellow defendant, Marissa C. Mesa, 46, cried quietly.

Both were immediately taken into custody to await their respective sentences on May 4 at 2:30pm.

Gepulgani managed to hug her tearful sister who was in court, while Mesa was comforted by her employers who had stood by her side throughout her trial and had cried with her before the hearing started, apparently prepared for the worst.

About $1.35 million was found in both their HSBC bank accounts, which a key prosecution witness said was part of some $2 million that she was told to deposit to various accounts by a man who claimed to have sent her a valuable parcel for which she had to pay customs and other duties.

Three other Filipinas implicated in the scam had earlier pleaded guilty to the same offence and were sentenced to between two and eight months in jail.

Gepulgani who did not give evidence, was found guilty of one count ot “dealing with property known or believed to be proceeds of an indictable offense,” as a result of $281,400 being deposited in her HSBC ATM account from June 13, 2020 to June 18, 2020.

She had claimed she lost her ATM card in Wanchai market, shortly after she opened a savings account at HSBC. She said she rolled up her ATM along with a piece of paper with her PIN on it, and stuffed them inside a shopping bag from which they must have fallen.

She said she never bothered reporting the loss to the bank as she no longer felt the need to have an account, or checked if any transactions were made using it.

Mesa was acquitted of conspiracy to deal with ill-gotten money, but was found guilty on the alternative charge of dealing directly with proceeds of a crime.

A total of $1,075,781 was found to have gone through her HSBC savings account between Apr 21, 2020 and May 25, 2020.

Mesa’s defence was that a longtime friend called Elsa had asked her to open the said account, and had asked for her ATM card without paying her anything.

However, Mesa said in court that she did borrow $1,000 from Elsa two days later to pay for services she had at a beauty parlor.

She contested a statement she gave to the police earlier, in which she admitted accepting $1,000 from Elsa in exchange for surrendering her ATM card. She said she had been tired, hungry and scared when she made the confession.

Her female employer gave testimony to vouch for Mesa’s honesty, and also said the helper and Elsa, who could no longer be found, were longtime friends.

In dismissing their claims, Magistrate Ho said she found both defendants untruthful and unreliable.

In Gepulgani’s case, the magistrate said she found it incredible that the Filipina did not notice the thick rolled-up documents faling from her bag while she did her marketing.

Ho also noted that Gepulgani had said that she opened a bank account to keep her money safe as she was sharing a room with a co-worker. Thus, it was “contradictory and unbelievable” that after she lost her ATM card she suddenly thought she no longer needed a bank account.

It also did not sound right that she never bothered to check her account when she was physically in Hong Kong and was given an email address and phone number that she could call to report the loss.

In Mesa’s case, the magistrate noted that she had displayed “unbelievable and unreasonable behavior,” particularly when she said she and Elsa never talked about money and bank accounts, yet she readily gave in to a request for her to open an account with HSBC.

Her claim that it took her three days to hand over the ATM to Elsa also sounded incredible, given that they were seeing each other six times a week, said the magistrate.

She also noted that during cross-examination Mesa often said she was confused or her mind had blanked when asked difficult questions.

In contrast, the two prosecution witnesses were described by the magistrate as reliable. PW2, a police officer, testified in a “simple, straightforward manner” and the procedure he described as having been taken after Mesa was arrested was fair.

In mitigation, the two defense lawyers said the defendants both had clear records and had family to support back in the Philippines.

Gepulgani, who has been jobless since June 2020, is married to a fellow overseas worker who is based in Oman. They have three children who are being looked after her mother.

Mesa, on the other hand, is a single mother to three grown-up children who are in the care of her parents. Her lawyer said what the defendant did was totally out of character, as was attested to by her employers.

He asked for “maximum leniency” in sentencing her.

In response, the magistrate said the offences called for an immediate custodial sentence, but ordered for background reports on the defendants prior to sentencing.

Napuno ang Konsulado sa kauna-unahang pulong dito pagkatapos ng pandemya

Kaisa ng mga migranteng manggagawa ang Department of Migrant Workers sa kagustuhan na tanggalin na ang overseas employment certificate o OEC.

Ito ang sinabi ng mga opisyal ng DMW na nakipulong sa mga lider ng Filipino community sa Hong Kong nitong Linggo, ika-16 ng Abril.

Ayon kay Undersecretary for Finance and Internal Affairs Anthonette Allones, mismong si Secretary Susan “Toots” Ople ay gustong tanggalin ang OEC, lalo na nung makita niya ang mahabang pilahan para dito noong bago mag Pasko.

“Nightmare ito (OEC), sabi ni Allones, dahil kinailangan pang papuntahin pa dito ni Secretary Ople ang ilan niyang opisyal sa Hong Kong noon para humanap ng paraan na mas mapadali ang pagkuha nito ng mga OFW (overseas Filipino workers).

Pero sa kanilang pagtanong-tanong ay nalaman daw nila na inumpisahan ang OEC dahil may mga OFW na madaling mabiktima ng illegal recruitment o human trafficking kaya kailangan na siguraduhin na ang bawat lumalabas na manggagawa sa bansa ay may kontrata ay visa.

Nang tanungin naman ni Allones ang mga lider sa pulong kung paano mapoprote

ktahan ang bawat OFW na lumalabas kung walang OEC, sinabihan siya ng mga lider na may pasaporte naman at kontrata na pwedeng tingnan bago sila umalis.

Ayon naman kay USec Patricia Yvonne Caunan, layon ng DMW na pagaanin ang mga pasanin ng mga OFW kaya naghahanap sila ng mga paraan para masuri ang estado ng bawat paalis na manggagawa nang hindi na dadaanin sa OEC.

Kaya daw pumunta silang mga opisyal sa HK ay para makipag-usap sa mga OFW na nandito at makuha ang kanilang mga opinyon at suhestiyon kung paano mapapahusay ang serbisyo ng gobyerno sa kanila.

Sinabi din niya na laging bukas ang DMW sa mga OFW para pag-usapan ang mga isyu na may kinalaman sa kanilang pagtatrabaho, at nag-alok pa siya ng buwanang pakikipag-usap online sa mga Filcom lider dito para sa mas agarang mahanapan ng solusyon ang anumang problema.

Sinagot ng dalawang opisyal ang mga tanong na inilatag ni Dolores Balladares, tagapangulo ng United Filipinos in Hong Kong, tungkol sa pagtatanggal sa OEC na aniya ay siyang pinakaasam-asam ng mga OFW ngayon.

Kasama din dito ang pagpapatigil ng koleksyon ng sapilitang bayarin sa mga OFW katulad ng PhilHealth, Pag-IBIG, SSS at mandatory insurance, na pilit ikinakabit sa OEC.

Ayon naman kina Allones at Caunan, suspendido pa rin ang pangongolekta para sa PhilHealth at iba pang bayarin dahil naiintindihan ni Secretary Ople ang saloobin ng mga OFW tungkol dito.

Pero nang sabihin ni Allones na voluntary lang ang pagbabayad ng membership sa Overseas Workers Welfare Administration ay naging madiin ang pagtanggi ng mga lider.

Hindi raw ito totoo dahil hindi pumapayag ang Office for Migrant Workers (dating Polo) na i-verify ang mga kontrata ng mga OFW dito nang hindi muna sila nagbabayad ng membership sa OWWA, kaya ang labas ay nadodoble pa ang pangongolekta para dito.

Karamihan naman ng mga tanong at reklamo ay patungkol sa OWWA, mula sa ipinangakong ayuda para sa mga nagka Covid-19 na hanggang ngayon ay hindi pa rin nabibigay, hanggang sa hindi maayos na pamamahagi ng tulong sa mga taga Abra na nasalanta ng bagyo noong nakaraang taon.

Nangako naman si Deputy Administrator Honey Quino na pag-aaralan kung paano maibibigay pa rin ang mga ipinangakong ayuda sa mga naimpeksyon ng Covid-19.

Yun naman daw nangyaring pagbagal ng serbisyo nila sa mga tinamaan ng bagyo sa Abra ay dahil nagkaroon sila ng problema sa koneksyon noon. Matatandaan na mismong si Usec Hans Cacdac ang bumisita sa Abra noon para pangasiwaan ang pamamahagi ng ayuda.

50-year-old OFW declared dead at hospital after collapsing

Chona was dead on arrival at the hospital

A Filipina working as a domestic helper in Hong Kong suddenly died this morning, shocking her friends who say she had no known illness.

Friends identified the deceased as Mechona Abad Lachica, 50 years old, and a resident of Dipolog City in the Philippines. She was married with a 15-year-old daughter.

She had been working in Hong Kong for 10 years, and was on her second contract with her current employer in Tai Po when she passed on.

Police say they received a report at about 8 am today about a Filipina who collapsed outside Fu Shin Estate, Shin Lau House in Tai Po.

Paramedics who rushed to the scene tried to resuscitate her but failed. She was declared dead on arrival at the Nethersole Hospital in Tai Po.

Police said the cause of her death is still being investigated. Her close friends, however, say they were not aware of her being ill.

Her death comes just 10 days after another OFW also collapsed from heart failure. Mary Grace Perater is still fighting for her life in hospital after undergoing surgery.

Paramedics scramble to revive Chona on site

Several friends of Lachica posted and reposted pictures and videos of her undergoing CPR (cardio pulmonary resuscitation) on site, but she did not look responsive.

One friend said she had just taken her ward to school when she collapsed. Some said it must have been from heatstroke although the weather today was not too hot.

Her employer has already reported the death to the Consulate and a screen capture of a conversation she had with Lachica’s friend said the remains of the deceased have already been moved to the Fu Shan Public Mortuary in Shatin.

Babalik ang Pilipina sa korte sa May 29 para sentensiyahan

Isang Pilipina ang nakatakdang sentensiyahan matapos mapatunayang nakipagsabwatan sa dalawang iba pa upang palabasin na nagtrabaho siya sa kanila bilang domestic helper.

Itinakda sa May 29 ni Cheng Lim-chi, Acting Principal Magistrate sa Shatin Courts, ang pagpataw ng sentensiya kay Jingle Bautista, 47 taong gulang. Ibinalik sya sa kulungan hanggang sa susunod na pagdinig.

Nauna rito, umamin si Bautista sa tatlong kaso ng paglabag sa Immigration Ordinance at Crimes Ordinance. Kanina sana siya babasahan ng sentensiya, pero hindi natuloy

Ang unang sabwatan sa pagitan ni Bautista at nina  Adelia T. Wong at Warwick Wong Wai-ki ay nangyari noong  Oct. 25, 2018 hanggang Dec. 6, 2020.

Naulit ang sabwatan noong Dec. 3, 2020 hanggang Dec. 30, 2021, matapos mag-renew ng visa si Bautista para sa ikalawa niyang kontrata bilang pekeng katulong ni Wong.

‘Arcturus’ already in HK, say experts

Experts say the high vaccination rate in HK will keep the new Omicron subvariant at bay

A highly infectious subvariant of Omicron has been detected in a number of Covid-19 positive patients in Hong Kong, health experts say.

However, people should not be alarmed as the cases involving Arcturus, also known as the XBB.1.16 sub-variant, tend to be less severe than other strains.

Professor David Hui of Chinese University said that while the subvariant which has caused a spike in cases in India starting early this year is highly transmissible, it has not led to an increase in the number of severe cases.

 “The transmissibility is quite high but the severity has not gone up. In the countries that have reported cases with this subvariant, there has been no increase in patients admitted to intensive care units or deaths … We do not need to be too worried,” Hui said in a radio interview.

Hui said those who had been vaccinated or infected could produce enough T-cells, a type of white blood cells that ward off infection, to fight the sub variant. He also noted that Covid-19 drugs have been found effective in treating Arcturus.

About 40 percent of all Covid samples collected by Hong Kong authorities are said to be linked to subvariants from the XBB strain, but no outbreaks have been detected.

But Hui noted that a number of children in India who were infected with Arcturus had developed keratitis, or inflammation of the cornea, or acute conjunctivitis, or  what is commonly known as the red eye.

He said parents should take their children to doctors if their eyes begin to tear up.

However, respiratory expert Dr Leung Chi-chiu said the keratitis spread appears to be merely anectodal or not based on reality.

Leung also said it was uncertain if the subvariant would become the dominant strain in Hong Kong as there are several hundred Covid-19 subvariantss found here.

Even if it does become the dominant strain it will not lead to a surge in cases as the city has a high level of herd immunity due to its high vaccination rate, he added.

Pilipino, ‘guilty’ sa panloloob at pagtangay ng $3k

Naganap ang paglilitis ng kaso sa District Court 

Tinanggihan ng hukom ang paliwanag ng isang Pilipinong residente na tinakot lang siya ng mga pulis kaya siya umamin sa panloloob sa isang restaurant sa Central kung saan siya dating nagtrabaho mahigit apat na taon na ang nakakaraan, at tumangay ng $3,000.

Ayon sa binasang desisyon ng hukom kanina sa Eastern courts, hindi kapani-paniwala ang sinabi ni Melvin A. F. Zuniga na tinakot siya, ginutom at ikinulong sa napakalamig na kuwarto ng mga pulis kaya niya inamin ang paratang na pagnanakaw.

Sabi ni Judge Daniel Tang ng District Court, mas kapani-paniwala sa lahat ng bagay ang kuwento ng dalawang pulis na humuli kay Zuniga at tumestigo sa korte.

Inutusan nitong agad ikulong ang 28-taong-gulang na binata hanggang sa pagsentensya sa kanya sa May 5 para sa isang kaso ng possession of dangerous drug, at burglary. Nauna nang inamin ng akusado ang unang paratang.

Nahuli si Zuniga noong Set. 27, 2018, sa may Arbuthnot Road sa Central matapos patigilin ng mga pulis dahil sa kahina-hinala nitong galaw. Nakita nila sa kanyag mga gamit ang 7.88 gramo ng cannabis o marijuana, at 0.83 gramo ng cannabis resin.

Nang malaman ang kanyang pangalan ay naalala ng isa sa mga pulis na iniugnay din siya sa kaso ng panloob sa unang palapag ng 53 Peel Street sa Central tatlong araw pa lang ang nakakalipas, at tumangay ng $3,000.

Sa kanyang paglalahad sa mga pulis, sinabi ni Zuniga na kasalukuyan siyang nagtatrabaho noon sa bar na dragon-I, pero  bago ito ay namasukan siya sa Chi Chi Cham restaurant na nasa Peel Street. Madali niya itong napasukan dahil alam niyang hindi nila-lock ang likod na pintuan nito.

Sinabi din niya sa kanyang pahayag na may galit siya sa dating opisina dahil ang pakiramdam niya ay dinaya siya doon.

Para hindi siya makilala sa CCTV ay gumamit siya ng napkin para pantakip sa kanyang mukha.

Noon na dinala sa Central Police si Zuniga at kinuhanan ng ilang pahayag. Bagamat alam nila na nakakaintindi ng Ingles ang akusado ay kumuha pa sila ng Pilipinong tagasalin para mas maintindihan niya ang akusasyon laban sa kanya.

Ganun pa man, sinabi ng abugado ni Zuniga na hindi dapat tanggapin ang mga pinahayag nito sa pulis dahil sa ilang kadahilanan.

Ang isa pang dahilan na binanggit ng tagapagtanggol ay hindi masyadong bihasa si Zuniga sa salitang Ingles, na pinabulaanan naman ng huwes sa kanyang desisyon. Nag-aral daw kasi ito sa isang English school kaya malabong hindi niya naintindihan ang pinirmahan niya.

Dagdag pa ni Judge Tang, ni hindi hiniling ni Zuniga na ipatawag ang kanyang mga magulang at abugado habang siya ay iniimbestighahan. Ang nung ng tanungin siya kung mayroon pa siyang gustong idagdag sa kanyang salaysay ay sumagot siya ng “No.”

“In short, I did not believe the defendant’s stories. He is not an honest witness,” sabi ni Tang. (Sa madaling sabi, hindi ko pinaniwalaan ang mga kuwento ng akusado. Hindi siya matapat na testigo).

Ang burglary o sapilitang panloloob ay may kaparusahan na pagkakakulong ng hanggang 14 taon sa ilalim ng Theft Ordinance ng Hong Kong.

Ang possession o pagdadala naman ng droga ay maaring parusahan ng hanggang pitong taong pagkakakulong at multa ng hanggang $1 million.
