Nagpalabas ng babala nitong Lunes ang Konsulado laban sa mga pekeng ahente na naniningil ng mula $7,000 hanggang $10,000 kapalit ng pagkuha ng electronic working visa (o e-visa) sa mga Pilipino na naghahanap ng trabaho bilang domestic helper.

Ang isa pang paraan ay ang paggamit sa mobile application o mobile app ng Immigration Department. Maaring i-scan ang QR code na nasa e-visa o ilagay ang reference number na nakalagay dito at ang araw ng kapanganakan ng aplikante.

Kapag hindi ma-scan ang QR code o hindi tanggapin ng app ang reference number ay malamang na peke ang e-visa. Pumunta na agad sa Immigration Department para mag-report tungkol ditto.

Hindi pa tapos ang kaso ng Pilipina.

Isang Pilipina ang nakipag-ayos kanina sa halagang $2,775.39 na babayaran ng dating amo na nilayasan niya matapos siyang suntukin ng asawa nito, pero itutuloy ang kaso sa Labour Tribunal para sa danyos at iba pa niyang hinahabol.

Ipinagpaliban ni Presiding Officer Charmaine Lo ang susunod na pagdinig, na magtatakda sa paglilitis, upang hintayin ang resulta ng imbestigasyon ng pulis sa pananakit kay Sharon Moreno.

Ayon kay Lo, dito nakasalalay ang iba pang hinahabol ni Moreno laban sa among si Wong Chi Sing.

Nag kontra-demanda naman si Wong para habulin ang $4 million na nawala umano sa kanyang negosyo dahil kalahating araw na lang siyang nakakapasok mula nang umalis si Moreno, isang buwang sahod dahil lumayas ito nang walang pasabi, at tatlong buwang pamasahe sa taxi na $80 araw-araw dahil siya na ngayo ang naghahatid sa kanyang mga anak sa paaralan.

Pero ayon kay Lo hindi pwedeng singilin ang isang helper sa pagbagsak ng negosyo ng amo.

Sinabi rin ni Lo na hindi makatarungang sumakay si Wong sa taxi upang ihatid ang mga anak niya, samantalang may sasakyang pampubliko gaya ng minibus, at pagbayarin si Moreno dito. Ayon kay Moreno, naglalakad lang siya at mga bata mula bahay hanggang paaralan.

Pero depende rin sa resulta ng imbestigasyon ng pulis kung pananagutin si Moreno sa pag-alis niya, dagdag ni Lo.

Sa pinirmahan ng dalawang panig, ang matatanggap ni Moreno ay ang hindi nabayarang araw na pinagtrabahuan niya, air ticket na $1,132.92, allowance para sa paglalakbay na $200, at refund sa binayaran niyang OEC (overseas employment certificate) na $65.50.

Ang nakabinbin pa sa sinisingil ni Moreno ay ang danyos na $107,335, na dapat ay suwelduhin niya sa 22 buwan at 21 araw na natitira pa sa kanyang kontrata sa amo, ang isang buwang sahod ($4,730) na kapalit ng abiso.

Sinabi ni Lo na may karapatan si Moreno na lumayas sa illalim ng Section 10 ng Employment Ordinance, kung totoo na siya nga ay sinaktan.

Pero idinagdag niya na wala sa batas na may karapatan siyang sumingil ng isang buwang sahod bilang kapalit ang abiso.

Nang imungkahi ni Lo na gawin itong bayad-pinsala, tumutol si Moreno dahil mabubura nito ang danyos na hinahabol niya -- ang halos 23 buwang suweldo, na ayon kay Lo ay wala rin siyang karapatang singilin.

Dahil mauuwi sa paglilitis ang usapin, pinayuhan ni Lo ang dalawang panig na magsumite ng mga dokumento at ebidensiyang kailangan nila.

Ayon sa kanya, sa isang kaso ay may panalo at may talo, at ang talo ang mananagot hindi lang sa mga dapat ibigay sa nanalong naghahabol kundi sa mga gagastusin din sa paglilitis.

HK bids Twin Ducks goodbye

Hundreds of people rushed to Victoria Harbor on Sunday amid heavy intermittent rain to catch a final glimpse of the two giant rubber ducks that had been drawing crowds since being set up across Tamar in Central on June 9.

One of the yellow ducks left its place to “swim” towards Causeway Bay, Fortress Hill and Tsim Sha Tsui, before ending its two-hour journey in Wanchai, where it was deflated and taken ashore.

The other duck will remain in place until Monday morning.

The two 18-meter ducks, created by Dutch artist Florentijn Hofman and brought to Hong Kong by AllRightsReserved, helped bring joy back to Hong Kong after three years of near-isolation due to the Covid-19 pandemic.

Hofman first brought his endearing yellow artwork to Hong Kong in 2013,  and stationed it off Ocean Terminal in Tsim Sha Tsui where it became an instant hit.

The twin ducks sparked a renewed craze, with entire walls of the Central MTR being decorated with news of their visit, and four cable cars on Ngong Ping 360 being plastered with their photos.

Organisers earlier announced the twin ducks would leave Hong Kong a week earlier than planned because of “unexpected challenges” during their stay.

These included Hong Kong’s unseasonably hot weather, which led to one of the ducks being deflated at one point because the rubber material covering it was melting in the heat.

In contrast, overcast skies hung over the harbour on Sunday and there was heavy rain throughout, but it did not stop a number of people taking to the promenade to have a final glimpse of the ducks and take pictures.

Police called to stop Filipino tourists recruiting OFWs for Canada

Police were called Sunday morning by a group of Filipino domestic workers who asked that an ongoing Canada recruitment seminar at the Sunbeam Theater in North Point be stopped, as it was being conducted illegally by a group of tourists from the Philippines.

The eight FDWs also said they had been victimized by the people behind PCVC-Opportunities Abroad in February this year, when they were convinced to pay a total of $18,700 each as processing fee for their student visa applications to Canada, which they learned later on was not realizable.

Responding to the complaint, the police interviewed Prisca Nina Mabatid, head of the PCVC (or Pinoy Care Visa Center)-Opportunities Abroad, who initially claimed that she was there only as a guest speaker, but eventually agreed to return the money of the complainants.

This was after the police were shown a video of Mabatid’s staff collecting money from applicants in Harcourt Garden in Admiralty on Feb 26, despite being told initially that the transactions were made in the Philippines.

Mabatid told the police that she did not know tourists were not allowed to carry out a business or do any kind of job in Hong Kong, as she had conducted the same activities in other places abroad like the Middle East, but was not stopped.

The police asked both sides to sign a statement in which the investigation would be halted as of that time, as Mabatid had agreed to return the money paid by the complainants.

However, the complainants reserved their right to file individual complaints later on, as there were other people they wanted investigated for alleged illegal work.

The police said they would forward the case to the Immigration Department, which is in a better position to decide if prosecution is in order.

Among the people the complainants pointed out as having taken part in the alleged illegal activity is fellow domestic worker, Bryan Apostol Calagui, who promoted the two seminars by PCVC-OA in his social media blogs, and even gave the welcome remarks at both events.

All of the complainants said they were enticed to attend the briefing in February because of Calagui’s frequent plugging of the “orientation” in his blogs and social media posts. To their dismay, they saw Calagui hastily leaving the venue after his speech on Sunday, so they were not able to get the police to question him as well.

However, Mabatid, on being questioned by the police, said that Calagui was the only one with a HKID in her group.

The talks between the two sides dragged on for about two hours as the complainants wanted to go to the police station with Mabatid so they could file separate complaints. But Mabatid instead offered to return their money on Tuesday, which was met with immediate resistance by the domestic workers who are only able to go out on Sundays.

Her insistence that they give her all their names, addresses in the Philippines, and the amount they were claiming, also rattled some of the complainants, who claimed that Mabatid had repeatedly warned them earlier that they would face legal consequences on their return home.

Both sides eventually agreed to do it next Sunday, June 25, but the question of venue again sparked disagreement. Mabatid wanted to meet them at the Conrad’s lobby, but the workers balked, saying they wanted a more neutral place.

The problem was settled after the two sides learned that Consul General Raly Tejada himself gave permission for them to meet at the Consulate at 10am on June 25.

Earlier, Mabatid’s remarks that “Para naman kayong di Pinoy, tumawag pa kayo ng pulis” or “Pera lang naman yan, bayaran ko na lang” (It's like you're not fellow Filipinos, you even got the police involved" or "That's just money, I can just pay it all back") sparked resentment among the complainants.

One was so irked she told the police, “Just arrest them, never mind if I don’t get my money back.”

Most of the complainants said they did ask for a refund earlier but were harshly told by Mabatid’s staff that this could not be done.

They were reminded that they signed a memorandum of agreement (MOA) stating that they would not file any case against Opportunities Abroad whatever the outcome of their visa application, and that the processing fee collected from them was not refundable.

This was reportedly the same thing that Mabatid cited on Sunday when she warned the complainants that she would file cases against them in the Philippines for reneging on their undertaking under the MOA.

What the applicants didn’t realize was that it would be a long, hard climb for them from that time on.

Despite being assured by Mabatid that she would lend Php1 million to each of the about 500 people who attended her first seminar to support their visa applications, her staff told a worker that she should produce her own “alibi” or reason why she had that much money in her account all of a sudden.

The worker said in reply, “Di pwede mag alibi sir, kasi ma-question kami ng IO (immigration officer) at after that ma-refuse ang student visa namin.” (We should not attempt to give a wrong alibi because the immigration officer might question us, and as a consequence reject our visa application).

Another applicant said he was thrown off by the long list of requirements he was meant to comply with, when during the orientation when they were convinced to pay money on the spot, Mabatid and her people kept assuring them that everything would be taken care of.

One other complainant said she had thought that they would have access to the Php1 million “loan” that would be transferred to their accounts, but was shocked to learn that the money will appear in their bank accounts for just a month once they start their visa application.

Despite this, they will be charged Php49,500 in “bank processing fees” for the month that the money that they will never get to touch, is parked in their accounts. They will also have to pay an additional Php100,000 as downpayment for their tuition, or they cannot move to the next stage.

Another applicant who decided to direct her query to Calagui claimed to have been shocked when he told her through chat that she needed to pay the Php100,000 first before the promised Php1 million “loan” would be transferred to her account through him.

Even if this tuition fee installment was included in the list of payables shown them during the orientation, the claimants said it did not set off alarm bells as they were assured that getting a student’s visa to Canada was a breeze, and that the Php1M "loan" to them would pay for future expenses. 

After hearing about the complaints Mabatid said there was a misunderstanding, and would tell her staff to go back to the applicants and correct the misinformation.

In a video taken during the February 19 seminar, Mabatid’s partner, lawyer Mark Russ Gamallo, could be seen telling applicants that the tuition fee in the schools where they would be applying with was between Php400,000 to Php800,000.

But he quickly brushed aside the OFWs’ qualms, saying they should be able to pay this off with the money they would make working on the side while studying fulltime, with more to spare.

Gamallo later told The SUN that the previous requirement that those on student visa in Canada could work no longer than 20 hours per week was no longer applicable. He later shared a Canada news report saying that the relaxed policy will last until the end of 2023.

However, a cursory check of the Canadian government’s website shows that the new rule, which took effect on Nov 15, 2022 and will last until Dec 31, 2023, applies only those who applied for a study permit (or extension) before Oct 7, 2022. After this date, only those who applied for a study permit extension can qualify for the privilege.

This means that even if the Hong Kong applicants manage to hurdle all the difficulties and secure a student visa, they will still have to worry about where to get the money to pay for their school fees, rent and food, not to mention what they normally send to the Philippines to support family members.

Twenty hours of working each week will barely sustain them during their stay in the country.

There is also the question of whether using money that is not theirs to support their visa application amounts to misrepresentation, even fraud, and as rightfully argued by one of the complainants, could land them in serious trouble.

Asked whether PCVC-OA was licensed with the Philippines Overseas Employment Authority, both Mabatid and Gamallo said that they need not get the accreditation as they were into visa consultancy and not recruitment.

Mabatid even flashed a signed certificate from the Department of Migrant Workers stating that her company was free to advertise its services in all media outlets. She said the one who issued the certificate was a DMW regional director.

However, this appears contrary to a memorandum titled “Policy on Immigration Consultants” (Memorandum Circular 10, series of 2003) which is posted on the DMW website. 

It states that:  “Immigration consultancy agencies and similar entities which are based locally, are required to obtain a license in accordance with the guidelines as provided for in Part II, Rule I, secs 1 and 2 and Rule 2, secs 1 to 5 of the 2002 POEA Rules and Regulations, before they may engage in recruitment and placement activities, regardless of the visa under which deployment shall be made eventually.”

The MC also states that official receipts should be issued to applicants, who should be charged only after they have obtained the EB3 visa.

This appears to be a grey area in the law, however, as visa assistance centers for tourists and other visa categories are able to freely operate in the Philippines. But the crucial difference is, if the student visa is promoted, as it was here, to gain backdoor entry to working in a foreign place, then regulation should be imposed.

US says HK should do more to combat 'exploitation' of FDWs

FDWs do not get enough protection against exploitation, says the US report on trafficking

 The United States State Department has raised Hong Kong’s standing to Tier 2 in its 2023 Trafficking in Persons Report, but says the city has to do more to eliminate trafficking, particularly of foreign domestic workers.

Hong Kong, which was previously relegated to the Tier 2 Watchlist, immediately issued a statement, “vehemently” refuting the assessment, which came out late on Thursday.

“Trafficking in persons (TIP) is never a prevalent problem in Hong Kong, and there has never been any sign that Hong Kong is being actively used by syndicates as a destination or transit point for TIP,” the government said in its statement.

According to the US report, the HK government “does not fully meet the minimum standards for the elimination of trafficking” but has shown increasing efforts to do so compared with the previous year, and even amid the Covid-19 pandemic.

Such efforts include increasing investigations and prosecutions of traffickers, identifying more victims, and in particular, designating a cyber hotline for receiving information about overseas employment scams.

However, the government was seen as having failed to meet minimum standards in key areas like failing to convict labor traffickers for the fourth consecutive year and imposing “inadequate penalties for those convicted of crimes related to sex trafficking.

As a result, FDWs and other vulnerable people remained at high risk of being trafficked, and authorities did not take adequate measures to protect them.

The report said no FDW or persons engaged in commercial sex was identified as a trafficking victim despite government screening, which indicated that the victim identification process remained inadequate.

Forced labour, which is another form of trafficking, left FDWs vulnerable because employers and employment agencies recruiters were allowed to charge recruitment fees to migrant workers, retain passports, and do other actions that increased trafficking risks, said the report.

Worse, the victims themselves were “likely penalized” through arrest and deportation for immigration and sex offences, instead of being identified as trafficking victims and given protection.

The US government said that among the steps that Hong Kong should take is to criminalize all forms of trafficking and improve the quality of screenings to properly identify victims, including FDWs and those in commercial sex.

The report also urged Hong Kong to allow victims to work and study here, while taking part in judicial proceedings so they can be encouraged to go after the perpetrators.

To better protect FDWs from traffickers, the US urged Hong Kong to prohibit agencies from charging recruitment fees, eliminate the two-week rule for those whose contracts are terminated, allow them to live outside their place of employment, and limit their working hours.

Responding to the allegations about the lack of adequate protection for FDWs, the Hong Kong government pointed that as early as December 2019 it had established a special investigation section in the Immigration Department that stepped up scrutiny of FDW visa applications, to identify those who are potentially trafficked or exploited.

Once they are identified, Immigration will provide them assistance and for those who need to stay in Hong Kong to act as a witness in legal proceedings, the fee for his/her extension of stay is waived, said the statement. Employers who are found to have abused or exploited their helpers will not be allowed to hire another FDW.

“In 2022, the HKSAR Government spared no effort as before to conduct initial screenings of all persons vulnerable to TIP risks, including illegal immigrants, sex workers, illegal workers, FDHs, and imported workers and other suspected victims, who came to the attention of the departments concerned,” said the government statement.

The government also took exception to the mention of the two-week rule as a cause for exploitation of FDWs, saying such cases are never tolerated in Hong Kong. Those who have been abused or exploited could apply to change their employer without first returning to their places of origin.

Migrant workers who are made to go home after being terminated are also not prohibited from returning to Hong Kong to work, said the statement.

As for the live-in requirement for FDWs, the government said this has been the policy since foreign workers were allowed to come in since the 1970s to meet the shortage of local live-in domestic helper.

Hong Kong also slammed the report for saying the city has failed to prosecute and jail traffickers. The government statement said more than 300 persons were arrested for sex-related offences in 2022, representing a 10 % increase year-on-year on the number of such apprehensions.

At the same time, 38 FDW employers were said to have been prosecuted for aiding and abetting their helpers to breach their conditions of stay, and five employers were prosecuted for other offences such as common assault, wounding, indecent assault and rape.
