DMW, NBI take up complaints against Mabatid’s ‘illegal’ recruitment drive

About a dozen people claiming to be victims of large-scale illegal recruitment by PinoyCare Visa Centre and its chief executive officer Prisca Nina Mabatid trooped to the Department of Migrant Workers (DMW) and the National Bureau of Investigation (NBI) on Wednesday to file complaints.

The group, accompanied by Migrante International representatives, said they paid at least Php104,000 each as processing fee for the Canadian student visa that Mabatid, through PCVC and another company she controls called Opportunities Abroad, had promised to secure for them within three months.

They claimed the recruiters have been luring and deceiving Filipinos throughout the Philippines, as well as overseas Filipino workers in Hong Kong, United Arab Emirates, Japan, Singapore and other countries, into paying the processing fee before disclosing conditions that are difficult, even impossible, to meet.

This was contrary to the group’s initial promise to provide them help throughout the recruitment process, and their repeated assurances that they need not worry about having the right qualifications or financial capability to secure the visa.

When they asked for a refund, Mabatid and her staff reportedly turned hostile, and even threatened to sue them in court, using as an excuse the no-refund, no-lawsuit “memorandum of agreement” that they were forced to sign after they had paid for the processing fee in full.

“Nina Mabatid and her company have stolen millions of pesos from hard-working Filipinos and OFWS who dream of a better life and economic security. These amounts should be returned immediately to her victims. What she and her associates did is blatant illegal recruitment, if not human trafficking.” said Migrante International chairperson Joanna Concepcion.

 “Mabatid peddled false and unrealistic promises. Despite the huge fees paid by the victims, their applications to Canada were never fully processed. The government should do something to protect our kababayans from such frauds,” Concepcion added. 

Staff at DMW’s legal division said they would go over the complainants’ statements and arrange a full hearing later, while NBI promised quick action, said Concepcion.

The Migrante chair said it was surprising that despite countless complaints against Mabatid and her companies, they continue to openly organize and hold seminars throughout the country, often with help from local government officials and local PESO offices.

OFWs who mostly had to borrow the money they used to pay the processing fee said they were enticed by the promise personally made by Mabatid of an interest-free “loan” of P1 million which they were meant to present as proof to Canadian authorities of their financial capability.

All the disgruntled applicants said the open endorsements of Mabatid and PCVC-Opportunities Abroad by well-known personalities like Senator Raffy Tulfo, Atty. Gareth Tungol, and celebrity host Boy Abunda, also helped convince them that they were dealing with a legitimate group.

In Hong Kong, 11 applicants who had earlier filed complaints with the HK Police and the Philippine Consulate General said the aggressive promotion of OFW blogger Bryan Calagui encouraged them to pay Php131,000 each to PCVC-OA in just three days in February this year.

The complainants called the police after hearing that the group was holding another recruitment activity at Sunbeam Theater in North Point last June 18, but Mabatid was let off after she promised to return their money a week later at the Philippine Consulate.

When Mabatid failed to show up as promised, the complainants went back to the police, who said they would elevate the case to criminal investigators, and possibly the Immigration Department.

Meanwhile, the Consulate has begun its own inquiry after DMW Secretary Susan Ople asked for a thorough investigation of the complaint. She also named DMW Undersecretary Hans Cacdac as the officer in charge of the case.

Separately, Consul General Raly Tejada has denied meeting with Mabatid at the Consulate in April, saying she just happened to be in the company of former Presidential Spokesperson Harry Roque who asked to drop by for a courtesy call.

2 Pilipina, humarap sa korte sa kasong pagnanakaw

Dalawang Pilipina ang humarap sa Eastern Courts kanina sa kasong pagnanakaw, pero isa sa kanila ang nakalaya sa bisa ng piyansa at ang ikalawa ay nanatiling nakapiit dahil tumutol ang taga-usig na siya ay pakawalan.

Itinuloy ni Principal Magistrate Ivy Chui ang bisa ng piyansang $2,000 ni Ofelia Isabel Flores Jeans, 35 taong gulang na residente, matapos humingi ang taga-usig ng dagdag na panahon upang mag-imbestiga ang mga pulis. Itinakda niya ang susunod na pagdinig sa Aug. 9.

Pero nang mag-alok ang abogado ni Mishell Cornelio, 36 taong gulang na domestic helper, ng $2,000 bilang piyansa at iba pang kondisyon -- gaya ng hindi pag-alis sa Hong Kong at regular na pag-report sa pulis -- tumutol ang taga-usig na pakawalan siya.

Ang dahilan: Isa sa tatlong kasong isinampa laban kay Cornelio ay robbery, o panloloob, na mas mabigat na krimen kesa sa simpleng pagnanakaw, ayon sa batas ng Hong Kong.

Malakas ang ebidensiya at nasisante na ng amo si Cornelio kaya wala siyang matutuluyan, dagdag ng taga-usig.

Sumang-ayon si Magistrate Chui at inutos na ibalik sa kulungan si Cornelio, pero itinakda niya sa July 18 ang susunod na pagdinig upang tingnan kung pwede na itong mag-piyansa.

Ang unang kaso ni Cornelio ay ang pagpasok nang walang paalam sa bahay ng anak ng amo niya sa Sai Ying Pun noong July 9, at pagtangay ng 2,300 Taiwan dollar, 490,000 Vietnamese dong, 381,000 South Korean won, 104 Singapore dollar, 1,400 Thai baht, 9,000 Hong Kong dollar, tatlong gintong kwintas, dalawang CCTV camera, at isang kurtina sa pinto.

Kinasuhan din siya ng pagnanakaw nang dalawang beses sa nasabing bahay – ng isang gintong kwintas noong June 8, at ng isang gintong pulseras noong July 6.

Ang residenteng si Jeans  (kaliwa) matapos ang pagdinig.

Samantala, si Jeans ay akusado sa pagnanakaw ng cash na $83,976.60 mula sa Le Colonial, isang Vietnamese restaurant, sa Paterson St, Causeway Bay.

Nangyari umano ang pagnanakaw sa pagitan ng  March 15, 2021 at Sept. 13, 2022.

Pilipina, kinasuhan ng pagpasa ng pekeng dokumento para ma-extend ang visa

Sa Aug. 1 ang balik ng Pilipinang turista sa korte

Isang Pilipina na gumamit ng mga pekeng dokumento para makakuha ng visa extension sa Immigration Department ang nahaharap ngayon sa dalawang kaso nang mabisto na ang support letter na ipinasok niya ay gawa-gawa lang.

Si Vivian Solis, 35 taong gulang, ay pinakawalan sa bisa ng piyansang $1,000 matapos binasahan ng dalawang kaso sa Shatin Courts kahapon (July 11).

Itinakda ni Acting Principal Magistrate Cheang Kei-hong ang susunod na pagdinig sa kanyang kaso sa  Aug. 1.

Inakusahan si Solis ng pagsisinungaling sa Immigration officer nang sabihin niya rito, nang mag-apply siya ng extension of stay noong Jan. 10, 2022, na magtatrabaho siya bilang domestic helper ng isang Iris May Chaves.

Ayon sa Immigration Ordinance, ang pagsisinungaling sa isang Immigration officer ay may parusang multa na aabot sa $100,000 at pagkabilanggo na aabot sa dalawang taon.

At dahil nag-sumite siya ng isang pekeng kopya ng sulat mula kay Chaves bilang suporta sa kanyang hinihinging visa extension, kinasuhan din siya ng paggamit ng pekeng dokumento at pagtatangkang kumbinsihin ang isang opisyal ng gobyerno na ito ay totoo.

 Ayon sa Crimes Ordinance, ito ay may parusang aabot sa 14 na taon.

3 buwang kulong dahil sa dalang shabu

Isang Pilipinong nahulihan ng methamphetamine hydrochloride o shabu habang naglalakad sa Wanchai MTR station ang nahatulan kanina ng tatlong buwang pagkabilanggo.

Sinabi ni Principal Magistrate Ivy Chui ng Eastern Courts na hindi maiiwasang ipakulong si Ronald Peher, 37 taong gulang at walang trabaho, dahil ang drogang sangkot ay lubhang mapanganib at ang nakita sa kanya ay halos isang gramo.

Dapat nga, ika ni Chui, ay dinidinig ang kaso niya sa District Court.

Umamin si Peher sa naunang pagdinig ng pagkakaroon ng 0.95 gramo ng shabu na nakasilid sa isang plastic bag, nang mahuli siya sa loob ng Wanchai MTR station noong May 28.

Pilipinong nabaril ng sinaktang pulis, kulong ng 4 na buwan

Nasentensyahan si Arimas sa Eastern court kanina

Apat na buwang kulong ang ipinataw na parusa ng Eastern Court kanina sa Pilipinong nabaril ng isang pulis matapos niya itong saktan sa Peng Chau noong gabi ng Jan. 24.

Umamin si Oliver Arimas, 43 taong gulang, sa dalawang kasong pananakit ng dalawang pulis na rumeresponde para patigilin ang pag-iingay ng kanyang grupong nag-iinuman sa isang bahay sa Wing On St., Peng Chau.

Ang kanyang kapwa akusado na si Cione Chris Sacdalan, 33 taong gulang, ay pinalaya matapos iurong ang dalawang kaso ng pananakit sa isang pulis laban sa kanya, kapalit ng pangakong hindi siya muling lalabag sa batas sa loob ng 36 buwan. Kapag lumabag siya sa pangako ay magbabayad siya ng multang $2,000.

Pinagbayad din si Sacdalan ng $1,000 bilang gastos ng korte.

“Ang pananakit ng pulis habang ginagawa ang kanilang tungkulin ay isang mabigat na pagkakasala,” wika ni Principal Magistrate Ivy Chui sa Ingles. “Hindi lang sila gumagawa ng tungkulin, pinapanatili rin nila ang kapayapaan.”

Para sa unang kaso -- ang pananakit sa isang senior police constable  -- ipinataw ni Chui kay Arimas ang apat at kalahating buwang pagkabilanggo. Dahil sa pag-amin ni Arimas, binawasan ang sentensiya ng 1/3 kaya naging tatlong buwan.

Sa ikalawang kaso – ang pananakit sa isa pang pulis – ang naging parusa ni Arimas ay anim na linggong kulong. Pero dahil sa pag-amin, binawasan ito ng 1/3 kaya naging apat na linggo.

Nangyari ang krimen noong gabi ng Jan 24. Isang tao ang tumawag sa emergency line na 999 at inireklamo ang ingay na nanggagaling sa ikalawang palapag ng isang gusali sa Wing On St., Peng Chau.

Dalawang pulis ang kumatok sa apartment na may nag-iinuman at sinabihan ang nasa loob na huwag mag-ingay.

Sandaling natigil ang ingay, pero maya-maya ay may tumawag ulit sa 999 upang magreklamo na maingay na naman sa bahay.

Kumatok ang senior police constable sa pinto at pinagbukasan ni Sacdalan. Hinatak ni Arimas ang pulis papasok, sa pamamagitan ng paghawak sa kanyang kuwelyo.

Nang gamitan ng pulis ng pepper spray si Arimas ay sinakal siya nito at itinulak pababa sa hagdanan.

Sumunod pa si Arimas pababa, at nang harangin siya ng ikalawang pulis ay sinuntok niya ito.

Inilabas ng unang pulis ang kanyang baril at nagbantang magpapaputok. Nang patuloy pa ring sumugod si Arimas ay tatlong bala ang sumalubong sa kanya.

Pareho silang dinala sa ospital, kung saan nag-agaw-buhay si Arimas.

Ayon sa abugado ni Arimas ay pinagdusahan nito ang kanyang nagawa, dahil ang pagkabaril niya ay nagsanhi ng pamamanhid ng kaliwa niyang braso. Nagawa lang daw nito ang manlaban dahil sa kalasingan.

Hiniling ng abugado na kung maari ay gawing community service na lang ang parusa kay Arimas o kaya ay maiksing pagkabilanggo, pero isinantabi ng hukom ang pakiusap.

Ayon kay Magistrate Chui, hindi tamang ikatwiran na nagawa ni Arimas ang manakit dahil siya ay lasing.

Sabi ni Chui: “Ang pagiging lasing ay hindi katanggap-taggap na palusot. Sa halip, ito ay dapat magpalubha ng isang pagkakasala.”

HK tightens entry rules for FDH with criminal records

People who get arrested for illegal work or overstaying are among those in the watchlist

If you are a foreign domestic worker who was sentenced after conviction for a criminal case committed in Hong Kong, think twice before attempting to apply for work again here.

This is not just because of Hong Kong’s new policy requiring all new entrants, including FDHs, to declare their criminal past starting on July 19, although this in itself is making those who had a previous brush with the law nervous. It is more because Immigration has started restricting the re-entry of those who had been sent home after being sentenced for an infraction, no matter how slight.

Consul Paulo Saret, head of the assistance to nationals section of the Philippine Consulate, said it would be better for those who had been sent home after being found guilty of a crime to carefully consider if it is worth risking an attempt to come back.

Marami po kasi ang mga na A to A (airport to airport) ngayon,” said Saret. (There’s been quite a number of people who ended up traveling from one airport to another recently).

He made the statement when asked if a Filipina who was sent home last December after being meted a suspended four-month jail term for lying to an immigration officer and giving false particulars, could come back as there is an employer willing to sign her up.

The strict new policy appears to apply even for those who were sentenced for a slight misdemeanor.

In the case of M, the Filipina, Immigration recognized that she had been a victim of a rogue employment agency owner who tricked her into coming to Hong Kong despite knowing that the employer who signed the contract had already left the city.

This was compounded when the agent told M to apply for a Hong Kong ID card using the fake contract, and then making her go back to Immigration to present a termination letter from the supposed employer.

The agent was subsequently jailed for six months but M was convicted as well of three charges of violating her visa condition and lying to an immigration officer as she pleaded guilty to them early on, thinking it would hasten her return home. Little did she know that her conviction would stick with her, and prevent her from re-applying for a domestic helper job in Hong Kong.

Recently, M applied to work in Taiwan as a caregiver, but after her papers were processed, the elderly woman she was supposed to look after died, leading to the cancellation of her contract, and leaving her hopes of going abroad to work dashed yet again.

The apparent crackdown by Immigration on FDWs with a criminal record was first noted by solicitors Arthur Chan and Jasmine Kwong of Boase, Cohen and Collins, in an article published in November 2021.

In the article, the authors cited the case of an Indonesian domestic worker whose application for a renewal of her work contract was denied in January of the same year, after Immigration noted she had been convicted of theft in September 2020 for which she was fined $800.

In its decision rejecting the application for contract renewal, the Director said the helper failed to meet the criteria given in the ‘Guidebook for Employment of Domestic Helpers from Aboard.’

The helper and employer appealed to the Director to reconsider, stating that the conviction was “very insignificant” and should have been spent in two years. The helper was also said to have shown remorse for what she did. In addition, the letter said the employer had a medical condition that made her vulnerable during the pandemic, and that the helper had already developed a bond with the family she was serving.

But the Director stood firm in his decision, so the case was taken to the High Court, where it was again rejected. In his decision, Justice Russel Coleman said the Director of Immigration was within his rights to refuse the application based on the criteria cited in the Guidebook, and that internal memos in the Department showed he had considered the employer’s circumstances.

While the solicitors conceded that the court merely reiterated the long-standing policy of allowing the Director discretion in the granting of FDH visas, its decision opened the door wide open to questions such as, if a non-recordable offence such as careless driving could be held against a helper with driving duties.

“Further, there remains uncertainty over spent convictions, since the objective of these is to allow an offender to put a past mistake behind them. In the highlighted case, can the helper re-apply once her conviction is spent?,” asked the solicitors.

They also suggested that adopting such stringent rules could lead helpers with a minor conviction to  consider overstaying because of the possibility that their employment visa will not be renewed.

Pilipinang overstay pinaaresto dahil hindi sumipot sa korte

Hindi sumipot sa pagdinig ng kanyang kaso sa Shatin courts ang Pilipina

Ipinaaresto kanina ang isang Pilipinang nakademanda dahil sa pag-overstay, matapos na hindi siya  sumipot sa pagdinig ng kaso sa Shatin Courts.

Inutos ni Acting Principal Magistrate Cheang Kei-hong na isantabi ang dating piyansa ni Lyria Garillo, 39 taong gulang, at hindi na siya payagang magpiyansang muli kapag hindi niya maipaliwanag kung bakit  hindi siya nakarating.

Unang nakalista ang kaso ni Garillo sa Court 3, pero dahil para sa “paper disposal” ang pitong kaso dito, mabilis na natapos ang sesyon.

Inilipat ang kaso ni Garillo sa Court 1, marahil sa pagbabaka-sakaling naantala lang siya at hindi umabot sa Court 3, pero nang tawagin ang kaso niya bandang 11:40 ng umaga, ay wala pa rin siya kahit sa labas ng korte.

Ayon sa mga dokumento ng korte, nagpasabi siya noong March 3 na lilipat ng tirahan sa Tok Wa Wan, mula sa Tsim Sha Tsui.

Domestic helper si Garillo nang dumating sa Hong Kong, pero siya ay nasisante ng amo noong  April 24, 2019. May 14 na araw siya upang humanap ng bagong amo, pero nabigo at nagtago na lang.

Nahuli siya noong April 14, 2020, matapos ang halos isang taong pag-overstay.

Upang hindi siya agad pauwiin, nag-apply siya ng non-refoulement, na kung ibibigay sa kanya ay magbabawal sa gobyerno ng Hong Kong na pwersahan siyang pauwiin sa Pilipinas. Bilang tanda na may hinihintay siyang ganitong desisyon ng gobyerno, may hawak siyang “recognizance form”.

Sa isang hiwalay na kasong dininig din ni Magistrate Cheang kanina, isa pang Pilipinang kinasuhan dahil nag-overstay at may hawak ding recognizance form, ang binigyan ng mahabang pagpapaliban ng pagdinig ng kanyang kaso.

Ipinagpatuloy ang bisa ng piyansang $500 ni Ma. Luna Siva, 45 taong gulang, hanggang sa susunod na pagdinig sa Nov. 22.

Si Siva, na dumating bilang turista, ay dumating noong March 2008 at naaresto matapos ang 13 taong pag-overstay, noong January 2021.
