Immigration renews warning against illegal work; 18 arrested in latest raids

The Immigration Department today renewed its warning against working illegally as it reported the arrest of 18 people in raids conducted across Hong Kong on July 18-20.

“The ImmD will continue to take resolute enforcement action to combat such offences,” it aid in a press statement.

In operations codenamed "Lightshadow" and "Twilight", Immigration officers arrested suspected illegal workers and three suspected employers during raids on 58 target locations, including a car park, a garage, industrial buildings, premises under renovation, a residential building and restaurants.

The arrested workers comprised eight men and seven women, aged 25 to 61. Among them, one man and two women were holders of recognisance forms, which prohibit them from taking any employment.

Two men and one woman, aged 43 to 64, were arrested for employing the workers.

"Any person who contravenes a condition of stay shall be guilty of an offence,” Immigration said. “Also, visitors are not allowed to take up employment in Hong Kong, whether paid or unpaid, without the permission of the Director of Immigration.”

It added: “Offenders are liable to prosecution and upon conviction face a maximum fine of $50,000 and up to two years' imprisonment. Aiders and abettors are also liable to prosecution and penalties."

Immigration also warned that “an illegal immigrant, a person who is the subject of a removal order or a deportation order, an overstayer or a person who was refused permission to land is prohibited from taking any employment, whether paid or unpaid, or establishing or joining in any business. Offenders are liable upon conviction to a maximum fine of $50,000 and up to three years' imprisonment."

The penalties for employers of these people are even harsher, it said.

Employing people who are not lawfully employable is punishable by a fine of up to $500,000 and up to 10 years' imprisonment.

“The director, manager, secretary, partner, etc, of the company concerned may also bear criminal liability. The High Court has laid down sentencing guidelines that the employer of an illegal worker should be given an immediate custodial sentence,” Immigration added.

“… employers must take all practicable steps to determine whether a person is lawfully employable prior to employment,” it said.

“Apart from inspecting a prospective employee's identity card, the employer has the explicit duty to make enquiries regarding the person and ensure that the answers would not cast any reasonable doubt concerning the lawful employability of the person. The court will not accept failure to do so as a defence in proceedings,” it added.  

“It is also an offence if an employer fails to inspect the job seeker's valid travel document if the job seeker does not have a Hong Kong permanent identity card. Offenders are liable upon conviction to a maximum fine of $150,000 and to imprisonment for one year.”

CHP warns against spread of dengue fever

Dengue is spread by the aedes moosquito.

The Centre for Health Protection (CHP) has warned of an upsurge in dengue fever in Asian countries such as Taiwan, Malaysia and Thailand as well as in South America, and has called on the public to help prevent its spread in Hong Kong by preventing mosquitos from thriving.

CHP said 19 dengue fever cases have been reported so far this year, all of them arriving from abroad, compared with 26 for the whole of last year.

The latest cases were two arrivals from Thailand, recorded during the week ending yesterday (July 20).

“Members of the public, while travelling abroad, should stay vigilant and carry out effective mosquito prevention and control measures,” it said. Detailed information on the latest DF situation in Hong Kong, as well as neighboring and overseas countries and areas, has been uploaded to the CHP's website (www.chp.gov.hk/files/pdf/df_imported_cases_and_overseas_figures_eng.pdf).

     "Apart from general measures, travellers returning from areas affected by DF should apply insect repellent for 14 days upon arrival in Hong Kong. If feeling unwell, seek medical advice promptly and provide travel details to the doctor," a spokesman for the CHP said.

Dengue can spread when female Aedes mosquitos bite infected persons and then bite others.

CHP issued the following tips on mosquito control:

  • Thoroughly check all gully traps, roof gutters, surface channels and drains to prevent blockage;

  • Scrub and clean drains and surface channels with an alkaline detergent compound at least once a week to remove any deposited mosquito eggs;
  • Properly dispose of refuse, such as soft drink cans, empty bottles and boxes, in covered litter containers;

  • Completely change the water of flowers and plants at least once a week. The use of saucers should be avoided if possible;
  • Level irregular ground surfaces before the rainy season;

DMW warns, illegal recruiters offering student visas abroad on the rise

USec Cacdac says illegal recruiters use the student visa pathway abroad to fool jobseekers

There has been a rise in the number of recruiters enticing Filipinos who are in search of work to apply for student visas abroad instead, then charge them exorbitant fees, according to Undersecretary Hans Cacdac of the Department of Migrant Workers.

A report in Philippines-based media group Rappler said Cacdac made the statement during a press conference on Wednesday.

Without mentioning names or figures, Cacdac said a number of immigration consultancy agencies had been closed down in the past because of this “modus.”

“I think it’s safe to say that there are increasing reports of this modus. When I say modus, I mean to say the illegitimate forms of those arrangements,” said Cacdac.

He explained that there were still “honest-to-goodness” offers of help for those who really intend to study overseas, but there are also those who exploit this route for illicit purpose. These are the ones who sell the idea of being able to work or obtain residency abroad using the student visa pathway.

“So there’s something wrong there, ‘di ba? Wala ka naman planong mag-aral talaga, pero ‘yan ang sinabing kaparaanan para magtrabaho, and worse, tatagain ka ng malaking halaga,” Cacdac said.”

Cacdac’s statements sparked hope among a number of Filipinos in the Philippines and abroad who have filed complaints against a visa consultancy firm, PinoyCare Visa Center and its affiliate, Opportunities Abroad, for allegedly fleecing them of hundreds of thousands of pesos in “processing fees” for student visas to Canada, which did not materialize.

They include 11 overseas Filipino workers in Hong Kong who called the police on June 18 to stop a second recruitment drive by the PCVC-Opportunities Abroad officers led by former Cebu City councilor Prisca Nina Mabatid and her partner, lawyer Russ Mark Gamallo, as well as OFW driver Bryan Calagui, so they could get back their money.

USec Cacdac was personally designated by Secretary Susan Ople to head the investigation of the complaints in Hong Kong.

The complainants said they paid a total of about $184,000 (Php1.28 million) to the group between February 19 and 26 this year, after Mabatid and company enticed them to apply for student visas to Canada. Most paid the full processing fee of $18,731 while two only paid the $3,000 reservation fee.

But after collecting their money, Mabatid's group sent them a list of requirements that were far too many and difficult to comply with, or failed to connect them to suitable schools, or told them to pay a lot more money to complete the process.

They were also made to sign a memorandum of agreement which prevents them from asking for a refund or from suing the company, even if they failed to secure the promised visa.

When they demanded a refund, they were warned they could face counter-suits because of the "agreement" which they were not warned about before they paid the processing fee.

After the police intervened, Mabatid promised to refund the claimants’ money a week later at the Philippine Consulate, but did not show up.

At the police’s instruction, the complainants reported Mabatid’s failure to abide by her promise and provided more information to pursue their claims. They also filed a complaint with the Department of Migrant Workers and the National Bureau of Investigation, through the Consulate.

Separately, Migrante International staged a protest outside the DMW office on July 14 to press a complaint by 12 alleged victims of PCVC-Opportunities Abroad, who each paid Php104,000 but never got close to obtaining the student visa promised them.

The group also filed sworn statements to the NBI, in which they accused PCVC, OA and Mabatid of large-scale illegal recruitment and/or syndicated estafa.

Concepcion said later more victims of the group have stepped forward, including two who have managed to get to Canada with help from other people.

Kinumpirma ng taga-usig na nagpasabi sa kanila ang abogado ni Celso Alejo Jr., 72 taong gulang na negosyante, na hindi na siya ipagtatanggol nito.

Si Alejo ay isa sa tatlong Pilipinong humarap sa magkakahiwalay na korte ngayon sa kasong pagnanakaw.

Sa Kowloon City Courts, humarap si Cheryl de Vera, 39 taong gulang, bilang isa sa tatlong asylum seeker na akusado sa pagnanakaw.

Kasama niya sa kaso ang dalawang Indian – sina Gursewak Singh, 29, at Gurmuki Singh, 29 -- na kinasuhan ng pagnanakaw ng $600 cash at isang Octopus card na may lamang $100 mula sa isang sasakyan na nakaparada sa harap ng Showboat Mansion sa Quarry Bay noong Aug. 28, 2022.

Ang dalawang Indian ay inakusahan din ng mas mabigat na kasong robbery dahil sa pagnanakaw sa isang matandang babae ng isang waist bag na may lamang HKID, isang ID para sa mga senior, isang susi sa bahay, isang Octopus card, isang mobile phone at cash na $16,000.

Nangyari ang sinasabing krimen noong Aug 22, 2022 sa tapat ng Kowloon City Plaza sa Kowloon City.

Ibinalik ang tatlo sa kulungan upang hintayin ang susunod na pagdinig para pag-usapan ang pag-akyat ang kaso sa District Court.

Sa District Court naman, si Elvin Ramon Zuniga, 48 taong gulang, ay ibinalik sa kulungan matapos ipagpaliban ang pagdinig ng kasong isinampa sa kanya, ang pangangalakal ng nakaw na brilyanteng singsing na pag-aari ni Chan Tsz-ting.

Pwede na sa e-Channel ang mga FDH simula bukas

Mapapabilis na ang paglabas-masok ng mga FDH na nakarehistro sa e-Channel

Simula bukas, July 31, ay maari nang dumaan sa mga e-Channel gates ang mga foreign domestic helpers, estudyante mula sa ibang bansa na 11 taong gulang pataas, at imported workers.

Ito ay ayon sa pahayag na ipinalabas ng Immigration Department ngayong araw ng Huwebes.

Ang e-Channel ay yung mga gates na ginagamitan lang ng HK ID cards para magbukas sa una, at sa pangalawa naman ay fingerprints at face recognition o pagkilala sa mukha ng mayhawak.

Dati rati ay kailangang dumaan sa mga immigration counter ang mga FDH, estudyante at imported worker ang hawak na visa. Ang mga permanent resident lamang, mga may regular employment visa at dependant lang ang maaaring gumamit ng e-Channel.

Para magamit ang pribilehiyong ito ay kailangan lang mag download ng libreng mobile application ng “Contactless e-Channels” ng Immigration Department gamit ang isang smart phone na may “biometric authentication technology" o yung maaring magrehistro ng face o fingerprint identification.

Pagkatapos mag-enrol gamit ang mobile app, maaring gamitin ang QR code na makukuha mula dito o ang smart HKID card para lumabas ng HK gamit ang e-Channel kung saan tanging ang mukha na lang ang pagkikilanlan para magbukas ang pinto papasok sa baggage check.

Para sa mga papasok sa Hong Kong, may “landing slip” kung saan nakalagay ang mga kundisyon o haba ng pananatili sa siyudad na lalabas sa e-Channel. Kapag nakuha na ng biyaherong papasok ang landing slip ay bubukas na ang pinto, tanda na kumpleto na ang pagrerehistro sa Immigration.

Sabi ng Immigration, maaari nang gamitin ng lahat ng mga residente na edad 11 taong gulang pataas ang lahat ng mga lagusan ng e-Channel, kabilang yung ginagamit ng mga lumalabas papunta ng Macau at Mainland.

Pero yung hindi nakarehistro o ayaw gamitin ang e-channel ay maari pa ring dumaan sa mga service counter.

Tinatayang may 500,000 na dagdag-katao ang makikinabang sa pinabilis na paglabas-pasok gamit ang e-channel, kabilang ang 380,000 na mga FDH.
