Employers of Indo DH shouldn’t pay more, labour chief says

Indonesian domestic workers say the no-fee policy has failed to benefit them (FILE)

Ask for more and we will consider hiring foreign domestic helpers elsewhere.

This seemed to be the message of Secretary for Labour Chris Sun when asked for his reaction to the reported plan of Indonesia to pass on to employers all fees incurred in hiring its FDWs.

Sun said Hong Kong employers of Indonesian helpers should not be asked to pay more.

He also said the SAR government has repeatedly told Indonesian authorities not to let any changes in its domestic workers policy burden local employers  or reduce the Indonesian helpers’ employment opportunities in Hong Kong.

Sun said he would meet with the Indonesian consul general to Hong Kong to hopefully resolve the matter.

“We hope that the Indonesian side can find a proper solution,” he said.

At the same time, he said Hong Kong has been actively looking for new source countries of FDWs, and will soon meet with officials of Cambodia and Bangladesh in this regard.

However, this is not the first time Hong Kong has tapped the two Southeast Asian countries to fill its growing demand for domestic workers, especially caregivers. But its previous attempts were not so successful as the workers’ religious practices served as hindrance.

According to an Indonesian recruiters delegation that visited Hong Kong recently, the plan is to enforce a no-placement fee policy towards it migrant workers, and pass on all the recruitment costs to employers, including training and medical examination fees.

The new regulation is bound to affect nearly half of all employers in Hong Kong, as 41% of all of the city’s 338,000 domestic helpers are from Indonesia.

Indonesian domestic workers are themselves not impressed with the plan to step up the implementation of  the zero-placement  fee policy. Despite the scheme being announced by their government in 2020, it has failed to provide them relief from the steep fees charged them by agents.

A group organized by JBM, a network of Indonesian migrant workers, is set to stage a protest outside the Indonesian consulate this Sunday to denounce the failure of their government to protect them from having to pay illegal fees to agents.

“The zero agency fee rule is ideal on paper, but is impractical in reality, said a statement from the JBM.

Currently, Indonesian migrant workers  are still charged between $12,000 to $20,000 in recruitment fees, despite the new rule being passed over the pandemic, said the group.

“If the IMWs (Indonesian migrant worker) experience layoffs, they can be charged a new fee of $4,000-$6,000,” said JBM.

The group also pointed out that although the Philippines has long touted a no-placement fee policy for its workers in Hong Kong, they are still charged by agents between $5,000 to $8,000 before they can leave the country.

8 arrested in latest operations against illegal work

Seven workers and one employer were arrested in the latest operations of the Immigration Department (ImmD) against illegal work, which involved raids on various establishments in the four days ending Aug. 3.

The arrests were made in the ImmD’s territory-wide operations codenamed "Greenlane" and "Twilight", and a joint operation with the Hong Kong Police Force codenamed "Windsand".

The biggest haul was made by ImmD Task Force officers in the "Greenlane" and "Twilight”operations, who raided 36 target locations including industrial buildings, premises under renovation, residential buildings, restaurants, retail stops, a salon and warehouses.

They arrested three men and three women for working illegally and one man, aged 85, who employed them.

Among the arrested workers, two men and one woman were holders of recognisance forms, which prohibit them from taking any employment.

During operation "Windsand", one female Mainland visitor, aged 36, was arrested for breaching her condition of stay by being involved in suspected illegal parallel trading activities at San Wan Road in Sheung Shui. The goods mainly included health products.

All the arrested workers were made to go through initial screening to find out if they were trafficking in persons (TIP) victims.

Under an existing mechanism, the ImmD conducts the screening of vulnerable persons, including illegal workers, illegal immigrants, sex workers and foreign domestic helpers, who are arrested during any operation.

“When any TIP indicator is revealed in the initial screening, the ImmD officers will conduct a full debriefing and identification by using a standardized checklist to ascertain the presence of TIP elements, such as threats and coercion in the recruitment phase and the nature of exploitation,” ImmD said.

“Identified TIP victims will be provided with various forms of support and assistance, including urgent intervention, medical services, counselling, shelter or temporary accommodation and other supporting services,” it added.

Hindi pa rin matapos-tapos ang mga balita tungkol sa mga Pilipinang nasa Hong Kong na nawawala, o bigla na lang hindi nagpapakita o nagpaparamdam sa mga amo, kaanak o kaibigan.

Sa ikaapat na pagkakataon sa nakaraang buwan ay ibinalita namang nawawal si Jolina Romulo Danting, na mas kilala sa palayaw niyang Jen. Isa siyang dalagan g 42 taong gulang at isang taon nang nagtatrabaho sa kasalukuyang amo.

“Stay out” si Jen at huling nakita sa bahay ng amo noong Linggo, July 30, kung kailan niya kinuha ang kanyang suweldo para sa nakaraang buwan.

Noong Lunes ay nag day-off si Jen, pero hindi na nag-report sa bahay ng kanyang amo kinabukasan.

Ayon sa kanyang kasamahan sa trabaho na si Ghie Torre ay wala silang alam na dahilan kung bakit bigla na lang hindi nagpakita si Jen sa kanila, kabilang ang kanilang among Indian na nakatira sa Kowloon.

Sa katunayan ay kahihingi  lang daw nito ng “supporting letter” mula sa kanilang amo para ma-extend ang kanyang visa ng isa pang taon. Sa kanyang pagkakaalam ay wala din daw itong planong umuwi sa Pilipinas sa nalalapit na panahon.

Nang hindi pumasok sa trabaho si Jen ay agad na kinunsulta ng amo si Ghie tungkol sa dapat nitong gawin.

 “Do you think we need to report it now or should we wait for a few more days?” tanong ng amo, na sinagot naman ni Ghie na dapat muna silang magpalipas ng 24 oras bago pumunta sa pulis.

Kapag hindi na daw ito nagparamdam ay pwede na silang magpunta sa Konsulado para ipaalam ang pagkawala ni Jen, at pati sa Immigration para ipakansela ang visa nito dahil sa pag-iwan sa trabaho nang walang pasabi.

Nang tanungin si Ghie kung possible na lumipad na papuntang ibang bansa si Jen ay sinabi nito ang “Sana nga ay nagpunta na lang ito sa ibang lugatr.”

Ang mas kinakatakutan daw nila ay kung may masamang nangyari sa kanya.

Isang Pilipina ang malayang umalis sa Eastern Courts kanina matapos iurong ng taga-usig ang paratang na sinaktan niya ang kanyang alagang lalaki na limang taong gulang.

Nakahinga nang maluwag si A. Lucas, 44 na taong gulang, nang basahin ni Principal Magistrate Ivy Chui ang kanyang hatol matapos sabihin ng taga-usig na hindi na nila uusigin ang Pilipina.

Si Lucas, isang domestic helper, ay inakusahang nanakit ng kanyang alaga noong Nov. 8, 2023 sa bahay ng kanyang amo sa Stanley.

Ang kasong isinampa sa kanya ay “willful assault by those in charge of a child” na isinampa ng West District Police.

Ito ay paglabag ng Section 27 (1) ng Offenses Against the Person Ordinance.

Filipino DH slashes throat in suspected suicide

A 30-year-old Filipino man working as a gardener in a palatial home in Shek-O is fighting for his life in hospital after he apparently cut his throat with a meat cleaver this morning.

According to the police, they received a call at 9:43 this morning (Friday) from a co-worker of the suspected suicide victim, saying the victim was found lying in his bed at their employer’s house at No 10 Big Wave Bay Road, Shek-O.

Officers who arrived at the scene found the victim half-conscious, and immediately rushed him to Pamela Youde Nethersole Eastern Hospital in Chai Wan for treatment.

A police report said it was a suspected suicide, although no suicide note was found at the scene.

A Filipina domestic worker who said she is acquainted with the three Filipinos working as gardeners at the same house said the victim was likely J., a soft-spoken young man who did not at all appear troubled.

She said she had been trying to reach out to the other Filipino workers in the house to check on J’s condition, but has been told that they are still consulting their employer about the case.
