At 4pm on Sunday next week, October 29, the Philippine Trade and Investment Center – Hong Kong (PTIC-HK) will hold a webinar titled "Trabaho Negosyo Kabuhayan Series 10: Paano Magsimula ng Negosyo" to give tips to Filipinos residing in Hong Kong on how to start their own business.

According to Philippine trade attaché Robert Mabalot the seminar will include a basic instruction on how to manage one’s finances before embarking on a business, as well as a lecture by a lawyer at the Department of Trade and Industry on how to get financing for an enterprise in the Philippines.

Mabalot said an informal study showed that investing in agri business holds the best prospect for Filipinos overseas, especially migrant workers.

23 people arrested in anti-illegal work operations

A suspected illegal worker is led away by Immigration officers

A total of 23 people have been arrested in several raids carried out by the police and the Immigration Department across the city in the past four days to flush out suspected illegal workers and their accomplices.

The biggest group comprised 14 people who were arrested after police were tipped off about an apparent fake HKID syndicate that placed illegal workers as packers at the Tseung Kwan O headquarters of Hong Kong Technology Venture (mother company of HKTV Mall).

The group was uncovered after an alert security guard at the site noticed something wrong with the HKID cards which a male and female worker had presented to him for registration. The guard suspected that the IDs were forged, and decided to call the police.

Officers who arrived at the scene immediately arrested the two for possessing forged ID cards, breaching conditions of stay and overstaying.

In a follow-up investigation conducted over the next two days, police and officers from the Immigration Department seized a total of 13 forged ID cards from packers in the company, who were immediately arrested.

Another person who appeared to be the subcontractor who hired the illegal workers, was also arrested.

HKTV said in a statement that it won’t tolerate any illegal activities, and will provide full assistance to the authorities during the investigation into the case. It has also cut ties with the subcontractor.

Meanwhile, 9 people were also arrested in several anti-illegal work operations carried out by the police and Immigration officers over four days, from October 16 (Monday) to yesterday, Oct 19 (Thursday).

Among those targeted were 47 locations in Central district, which resulted in two suspected illegal workers being arrested – a 31-year-old man and a 56-year-old woman. The man holds a recognizance form, which prohibits him from taking up work.

In raids on 17 other locations, three suspected illegal workers, all women aged 28 to 46, were arrested. One of them was on recognizance.

Three people, one man and two women aged 38 to 55, were arrested on suspicion of employing the illegal workers.

The ninth person to be rounded up was a male Mainland visitor, aged 56, who was found selling clothes in Sheung Shui and was arrested on suspicion of engaging in parallel trading.

Immigration again reminded that illegal work is a serious offence that carries a maximum penalty of three years’ imprisonment and fine of up to $50,000.

Employers face a much stiffer penalty of up to $500,000 in fine and 10 years in jail.

18 months' jail for elderly Filipino jeweler who stole gems from clients

A 73-year-old Filipino jeweller who pawned about $1 million worth of jewelry entrusted to him by two of his loyal clients was sent to 18 months in prison at Eastern Court yesterday, Oct 19.

Celso E. Alejo, Jr.’s fall from grace began some seven years ago when his jewelry business which he ran from an office in On Hing Building in Central started having financial problems.

At the time two sisters, M.K. Seen kay Kay and Mak Seen Wah, Sylvia, who had bought a number of items from him worth well over a million dollars, entrusted a number of mostly gold jewelry to him for appraisal and safekeeping.

These were itemized as: 82 gold pendants, 75 gold coins, 16 gold bracelets, 8 gold rings, 7 gold disks, 6 gold ingots, 5 gold bangles, 5 gold figurines, 4 gold peaches, 3 gold ring bands, 2 gold peanuts, 2 gold balls, 2 gold chains, 1 gold Chinese zodiac wheel, 1 wedge shape gold piece, 1 gold earring, 1 gold clip, 1 gold frame, 1 gold bar and 1 platinum ring

To save his business from going under, Alejo pawned his clients’ jewelry sometime in 2016 until October 2017. However, he was unable to redeem the jewelry nor pay back the sisters, so he was charged with theft.

The second count of theft involves his taking of a diamond necklace from a pawnshop in Central, also belonging to the Seen sisters, on Jan. 17, 2017.

No other details of the alleged offences were disclosed, but court records show that Sylvia Mak had filed a civil case in a bid to recover her jewels from Alejo in 2018.

Alejo was arrested and investigated on the two theft charges only on March 9 this year. The hearing of his case was postponed at one point because his defense lawyer indicated his withdrawal from the case.

He subsequently pleaded guilty to the charges on August 3 this year, and Principal Magistrate Ivy Chui set his sentencing on August 17.

Further delays ensued when Alejo failed to appear in court twice. First, he sent word that he was in hospital, but for the second his whereabouts were unknown so Magistrate Chui cancelled his bail of $40,000 and ordered his arrest.

In court on Wednesday the duty lawyer representing Alejo asked for maximum leniency, saying his client had retired and lived alone after his wife passed, and his son who is in the United States hardly kept touch.

Although he was well educated he now has to rely on social welfare assistance after his business collapsed.

The lawyer also said Alejo was remorseful, had a clear record and before he committed the offences to save his business he was a law-abiding citizen.

He also tried to use Alejo’s advanced age in appealing for a lenient sentence, but Magistrate Chui said “old age is not a strong ground for mitigation.”

In sentencing, Magistrate Chui said that Alejo committed a serious breach of trust and was in no position to pay compensation to the victims.

She said that the prescribed sentence for thefts where the amount involved is between $250,000 and $ 1million is from two to three years in jail.

Given the amount involved, she said the correct starting point should be around 36 months, but decided to cap it at 27 months because of the unusual circumstances of the case and Alejo’s age. She whittled it down further by 1/3 because of Alejo’s guilty plea, leaving a final jail term of 18 months.

Driver gets 6 weeks' jail for wounding fellow Filipino in gang fight

A Filipino driver who came to the rescue of a friend who got into a brawl in Wanchai last year was jailed for six weeks on Wednesday, Oct. 18 after being found guilty of wounding.

Delfin Villaremo, 55, was meted the sentence after trial at Eastern Court. He has been in jail since Oct. 3 when he was adjudged guilty after trial by Eastern Magistrate Tsang Chung-yiu.

Villaremo was found to have wounded fellow Filipino, William L. Maun, during a  melee inside the Tai Wo Street Playground in Wanchai on Oct. 9 last year.

The defendant was first brought to court along with his co-accused and friend, Romeo Miranda, who was charged separately of slashing another Filipino, Benson Jy Mateo, in the face.

The court heard that Villaremo had rushed to the playground to help Miranda who was then being ganged up on by a group of Filipino and Chinese males.

Initially, Villaremo had indicated to the court that he wanted to plead guilty to the charge but Magistrate Jason Wan told him to seek help from the Duty Lawyer Service as he was not assisted by counsel.

On the advice of the lawyer who assisted him, Villaremo changed his mind and pleaded not guilty to the charge, resulting in him being put on trial in September.

Wounding is an offence punishable with up to three years in jail.

Kasong sabwatan sa panloloko sa Immigration, lumalaki

Lumalaki ang kasong kinakaharap ng Pilipinang si Kathleen Vizcarra, na humarap sa Shatin Court kanina bilang akusado sa sabwatan para lokohin ang Immigration Director upang aprubahan ang kontrata ng isang domestic helper na hindi naman pala nagtrabaho sa nakalistang amo.

Ayon sa tagausig, kailangang ipagpaliban ang pagdinig dahil lima na ang ganitong kaso na inilapit sa kanila, at bawa’t isa ay kailangang imbestigahan at hingan ng legal na payo mula sa Department of Justice.

Itinakda ni Magistrate Gary Chu ang susunod na pagdinig sa Dec. 14. Samantala, pinakawalang pansamantala si Vizacarra, 34 taong gulang, sa piyansang $2,000.

Pinayuhan siya ni Magistrate Gary Chu na makipag-usap agad sa libreng abogado ng Duty Lawyer Service ng korte upang maayos niyang madepensahan ang sarili.

Kaso ng Pilipina na nanloob daw sa amo matapos i-terminate, iaakyat sa District Court

Iaakyat sa District Court mula sa Eastern Court ang kaso ng panloloob (o burglary) laban sa isang Pilipinang domestic helper na bumalik daw ng walang paalam sa bahay ng amo matapos ma-terminate at nagnakaw.

Kinasuhan din si Mishell Cornelio, 36 taong gulang, ng pagnanakaw ng mga alahas ng amo, na siyag dahilan diumano kung bakit siya tinanggal sa trabaho isang araw bago ang sinasabing panloloob.

Sa pagdinig kahapon (Oct. 18), hiningi ng tagausig na ipagpaliban ang kaso ni Cornelio upang maihanda nila ang mga dokumento para sa paglilitis sa mas mataas na korte.

Dahil hindi humiling ng piyansa si Cornelio, inutos ni Principal Magistrate Ivy Chui na ibalik siya sa kulungan hanggang sa susunod na pagdinig sa Jan. 15 para sa pormal na paglilipat ng kaso sa mas mataas na hukuman.

Ayon sa report ng pulis, ang unang pagnanakaw ay naganap noong June 8 sa bahay ng kanyang amo sa Connaught Road West sa Sai Ying Pun. Nagreklamo sa pulis ang among si Lau Tsz-yan na nawalan siya ng isang gintong kuwintas.

Makalipas ang halos isang buwan, o noong July 6, ay nagreklamo ulit ang amo na nawalan naman siya ng gintong pulseras at isang pendant, dahilan para i-terminate niya si Cornelio.

Tatlong araw makalipas ito, o noong July 9 ay bumalik umano si Cornelio sa bahay ng amo at pumasok nang walang paalam.

Dito nawala ang 2,300 Taiwan dollar, 490,000 Vietnam Dong, 381,000 Korean won, 104 Singapore dollar, $1,400 Thai bath, at 9,000 Hong Kong dollar na ang kabuuang halaga ay halos HK$12,000. 

Nagnakaw din daw siya ng tatlong gold chain, dalawang CCTV camera at isang kurtina sa pinto, ayon sa report ng pulis.
