DMW chief says OFW Pass & OEC are both valid exit passes

OFWs can use either the OFW Pass or OEC to leave the Philippines, says DMW

The Department of Migrant Workers has clarified that all overseas Filipino workers who can secure the OFW Pass through the DMW app may already use it as an exit pass in the Philippines instead of the OEC, or overseas employment certificate.

DWC Officer-in-Charge Hans Leo J. Cacdac made the clarification amid questions sparked by his advisory on Oct. 15 that the OEC “will continue to be a valid exit clearance for OFWs until further notice.”

But at the same time, he said the OFW Pass “will continue to be available to the ten (10) pilot countries and the Philippines through the DMW app.”

Hong Kong was one of the pilot sites for the OFW Pass, along Saudi Arabia, United Arab Emirates,  Singapore, Qatar, Oman, Malaysia, Taiwan, Japan and the United Kingdom.

The test run for the OFW Pass ended on September 29, but OIC Cacdac said its implementation in other territories abroad was being put on hold pending an evaluation of the functionality and performance of the DMW App.

He assured it would be made available to other places abroad in future, after consultations with the Migrant Workers Office and Filipino communities there/

In response to a query from The SUN on whether this meant that an OFW leaving the Philippines may use the OFW Pass if available, OIC Cacdac said, “Yes, they can use it in place of OECs. Kindly endorse anyone who may need help securing the OFW Pass.”

Despite the assurance, many Filipino migrants seem to prefer getting the OEC still, apparently because of fear they could get held up on their way to their job sites in case the OFW Pass is not recognized by DMW staff at the airport.

This is despite the OEC having a validity of just 90 days while the OFW Pass remains valid for the duration of the OFW’s contract.

Marites Nuval, president of Global Alliance and a longtime volunteer at the Migrant Workers Office, says her group continues to receive requests for help from OFWs in securing the OEC instead of the OFW Pass.

She herself has yet to acquire the OFW Pass because she recently changed employers and was still waiting for her new work visa to be issued. She wants to wait until all her documents are available before she starts downloading them into the app.

Nuval also  says many users of the DMW app have experienced difficulty logging in, or acquiring the OFW Pass despite uploading all the required documents.

But she says she has  seen many OFWs managing to secure the  blue-colored OFW Pass, mostly because the MWO staff helped them navigate through the DMW app when they had their new contracts verified.

As to whether anyone she knows managed to get past the DMW and immigration counters in the Philippines using just the OFW Pass, Nuval says she will know only early next month, when a friend who secured the digitized exit clearance goes home for a vacation.

Meanwhile, Unifil-Migrante Hong Kong chair Dolores Balladares says a member of her group was told to get both passes before going home to ensure a trouble-free return to Hong Kong.

“If they were confident that the OFW Pass was enough for her to get out of the country, why was she advised to secure the OEC as well?,” she asked.

The better alternative to getting rid of the queuing and other problems linked to the OEC is to junk it altogether, instead of replacing it with another pass which is equally, if not more, problematic to secure, Balladares said.

Indigenous Philippine art show on at PCG

The exhibit will open at Sentro Rizal of the Consulate at 3pm Sunday

A unique collection of indigenous Philippine art will be launched at the Philippine Consulate’s Sentro Rizal on Sunday, Oct. 29, 3:30pm, in celebration of National Indigenous People’s Month.

The show titled Mula-T: Likhang Sining, Alay sa mga Katutubong Pilipino will feature various art works of members of the all-Filipina domestic workers’ art group, Guhit Kulay. 

The exhibit highlights the beauty and rich culture of native Filipinos and will run for a week, or until Nov. 5.

The project is a joint collaboration between the Consulate and Guhit Kulay, which conducted a basic sketching workshop also at the Consulate last Sunday, Oct. 22.

A talented group of FDWs took part in the sketching exercise which was facilitated by Guhit Kulay artists Rochelle Dulay Razon and Jonnalyn Macalalad Molina.

The group now headed by Lyn Lopez is continuing Guhit Kulay’s mission of sharing the artistic skills and talents of members with their fellow migrant workers.

The month of October was decreed as Indigenous People’s Month under Presidential Proclamation no 1906 issued in 2009.

Airline ditches bag with boiled chicken, offers compensation

A Filipino domestic worker is feeling aggrieved because after her luggage went missing for 10 days on her arrival in Hong Kong from Tuguegarao and Manila, she was told by the airline that it had been thrown away as it contained boiled chicken, which is not allowed to be brought it.

The Filipina said Cebu Pacific sent her a message on October 24 that a “tagless center company” had disposed of her luggage after they found a prohibited food item inside. Nevertheless, the airline offered her a compensation of HK$1,000.

(I did not agree so they raised the offer to $1,300 but I still want to inform Senator Raffy Tulfo about this because I feel sorry for those who might suffer the same fate).

Mylene, the passenger, admitted that she had put a piece of boiled chicken in her luggage, along with some smoked fish before she left Tuguegarao en route to Hong Kong. But, she hastened to add they would not have gone bad if her suitcase did not go missing.

(I immediately told the airline when I reported my bag as missing that something would rot inside but it took them awhile to locate it. I was emailing them almost every day, even my employer, so why did they have to throw it away? I could have at least saved my sister’s clothes sent to her by her friend, which were all branded).

Mylene said she also lost two rings and some shampoo and perfume which were all in her luggage.

As for the half-cooked chicken which she had strangely chosen to bring all the way from her hometown in Cagayan, she said it would have been still edible if her suitcase arrived with her in Hong Kong on Oct. 15.

At saka yung manok hindi naman agad-agad masisira kasi boil ko lang, then pinatuyo. Hindi naman po basa,” Mylene argued. (The chicken would not have gone bad quickly because I boiled it, then let it dry. It was not wet).

She also said airline staff did not warn her about the chicken when she was forced to repack her bags at Tuguegarao airport in front of them because she had exceeded her weight allowance.

The least they could have done after misplacing her bag was to call her first so she would have time to check it, said Mylene.

Compared to many overseas destinations, Hong Kong has far more relaxed restrictions on food that can be brought in, so it is not uncommon for newly arrived travelers to carry all sorts of food items in their bags.

However, Hong Kong customs regulations do restrict the entry of the following items into the city, either for security or health reasons: dangerous drugs, psychotropic substances, controlled chemicals, antibiotics, arms, ammunition, weapons, fireworks, strategic commodities, rough diamonds, animals, plants, endangered species, telecommunication equipment, game, meat, poultry, eggs and powdered formula.

Medicines not covered by prescriptions, including antibiotics; as well as alternative smoking products such as vapes and e-cigarettes, are also prohibited.

All the said items were included in a government statement issued in January this year, in anticipation of a huge number of travellers flying into Hong Kong after it lifted all pandemic-related restrictions,

The government in particular warned people against bringing into Hong Kong any “game, meat, poultry or eggs without a health certificate, adding that this is an offence punishable with imprisonment for up to six months and a fine of $50,000.

The prohibition against the importation of unlicensed poultry and egg is largely due to a fear of salmonella, which the Center for Disease Control says causes more foodborne illnesses than any other bacteria. Chicken is said to be a major source of these illnesses.

But while a violation may have been committed by travelers who flew in with any one of these prohibited items, law enforcers at the airport are the ones who would normally seize the luggage, inspect its contents and carry out an arrest if necessary.

In this case, the airline, which was in the wrong in the first place for not transporting the bag as scheduled, should not have disposed of it without even giving any notice or warning to the owner. This was probably why an offer of compensation was made.

But as Mylene was told, her streak of bad luck could have been worse had she been stopped at the airport because of the prohibited food items in her bag. At best they would just be confiscated, but she could also be possibly charged in court for violating customs regulations.

5 overstayers among 18 people arrested in latest anti-illegal worker operations

The Immigration Department has kept up its territory-wide crackdown on illegal work, with 18 more arrests being reported over the past three days until yesterday, Oct. 26.

In the latest round, five overstayers were among those detained, along with 10 suspected illegal workers and three employers.

In a series of operations codenamed “Twilight,” 17 locations were targeted, including industrial and residential buildings, restaurants and retail shops.

Five suspected illegal workers and three employers were arrested. The workers comprised one man and four women, age 37 to 46, and included a woman holding a recognizance form which prohibits her from taking employment.

Two men and one woman, aged 35 to 54, were suspected of employing the illegal workers and were also arrested.

In a separate operation named “Champion,” police and Immigration officers raided 52 locations in New Territories North and Western District, including recycling yards and warehouses.

This was where the five overstayers were found, comprising three males and two females, aged 34 to 46.

Arrested along with them were five suspected illegal workers made up of four men and one woman aged 32 to 64.

Immigration reiterated its warning that violating any of the conditions granted to those entering Hong Kong such as overstaying or taking up prohibited work is a serious offence that is punishable by up to two years in jail and a maximum fine of $50,000.

The penalty is more severe if the illegal work is done by an overstayer, or those on recognizance who are not allowed to take up work. The maximum sentence is three years’ imprisonment and $50,000 fine.

Test run on OFW Pass ends, but OEC remains valid as exit clearance

The Department of Migrant Workers has announced that overseas Filipino workers will still have to continue using the Overseas Employment Certificate (OEC) as the valid exit clearance from the Philippines, although the pilot test run for the OFW pass has been completed.

In an advisory issued on October 15, DMW Officer-in-Charge Hans Leo J. Cacdac announced that the pilot test for the DMW Mobile App and the OFW Pass ended on September 29 but further evaluation as to the app's functionality and performance will still have to be carried out.

As such, the OEC "will continue to be a valid exit clearance for OFWs until further notice," said the advisory.

This means, the OFW Pass which was conceived to eliminate long queues at the Migrant Workers' Office by OFWs about to go home, is still on hold. 

The faster and more comprehensive system of keeping track of all OFWs was .supposed to have come into effect on September 1

Aa before,  OECs can be obtained through the Balik-Manggagawa processing system of the Philippine Overseas Employment Administration (POEA), where they need to be registered if they are first-time OFWs. 

The OEC which used to cost $20 and has a validity of 60 days after issuance has been issued free to all OFWs as of last month. Before this, only those who were registered in Balik-Manggagawa were exempted from paying for the OEC if they were returning to the same employer. 

OECs serve as travel clearance for OFWs departing the Philippines, and exempt them from paying for travel tax and the airport terminal fee. 

Had the shift to OFW Pass happened as scheduled, migrant workers would not have to keep applying for an exit pass each time they go home as the OFW Pass is meant to be valid for as long as they continue working abroad.

In his advisory, Cacdac said the OFW Pass will remain available to users from the 10 pilot areas where it was tested – Hong Kong, Saudi Arabia, United Arab Emirates, Singapore, Qatar, Oman, Malaysia, Taiwan, Japan and the United Kingdom. 

However, they will still be unable to use this in lieu of the OEC unless the new system gets the all-clear from the DMW.

Cacdac said the OFW Pass will be made available to other countries and territories in the future, following consultations with MWOs and OFWs in these locations.

The decision to use the OFW Pass, which is built into the DMW App, will be made after evaluating the app’s functionality and performance, and fixes had been added to improve it, said Cacdac. Also to be evaluated will be DMW’s capacity to manage the app.

As of this writing, the DMW mobile app on the Apple App Store has only one-star reviews from users, who mainly complained about technical bugs and the difficulty of registering and logging in to their accounts.
