Employer rejects $113k claim of Pinay she took to China to work for friend

An employer who fired her Filipina helper in 2015 for refusing to return to China and work for another person has refused to pay the maid’s claim for damages amounting to $113,000.

The employer, Wong San-wing, said on the second and final day of hearing of Rowena Obaldo’s claim in the Labour Tribunal today, May 21, that she would not pay up because the maid  had found a new employer after her dismissal.

But Obaldo was also terminated by her new employer after one month, Wong said.
Presiding Officer PC Lai reserved her judgment until Jun 11.

Obaldo’s damages claim is based largely on her loss of income in the four years that various authorities were investigating her complaints against Wong, employment agent C.K. Chan and mainland employer D.Z. Huang.
Huang was earlier described in court as Wong’s sister but this turned out to be untrue. Wong said in her testimony that Huang was her cousin but Obaldo said they were just friends.

Wong, Chan and Huang were convicted in 2017 in a “conspiracy to defraud” case filed against them by Immigration, and were each sentenced to six months in jail, suspended for two years. They appealed their conviction in the High Court last September but lost.
During this period, Obaldo was largely unable to work while incurring expenses, so she raised her original claim of  $70,000 to $113,000.

At the continuation of her testimony earlier in the day, Obaldo was asked by Lai what she was doing during the period July 2016 to July 1017.
The Filipina said she did nothing except go to the police to help in the investigation of Wong, Chan and Huang. She also went to court to give evidence as a prosecution witness against them.

But during cross-examination by Wong, the Filipina admitted that she went job-hunting in the United Arab Emirates on Jan 28 last year but returned to Hong Kong after a month.
Then she found an employer in the New Territories on Jul 27 but was terminated after one month following an argument with her male employer.

Wong also tried to bring up Obaldo’s travel to China with her new employers, but Lai cut her short, telling her not to bring up issues that were not relevant to the present case.



Lai chided both Obaldo and Wong a number of times during the trial for unclear statements or irrelevant issues.

The four years since the China episode seemed to have taken it toll on the memory of Obaldo, 48.

In her testimony, she said she returned on a day in September and went to the boarding house of her employment agency.

The next day, she went to the Consulate to report her ordeal, then got a call from the agent who set a meeting at a McDonald’s shop with Wong, during which she was given notice of termination.

When Lai asked her again when she arrived from China, she said at first that she could not recall, but then gave the date as Sept 25.

But a document she submitted in court showed that she was given until Nov 1, 2015 on her job.

If that was so, said Lai, there would have been a six-day lapse between her return from China and the McDonald’s meeting and not just a day.

Obaldo was assisted in her case by the Consulate’s assistance to nationals section.

Ex-Philippine Ombudsman barred from entering HK

The Philippines’ former Ombudsman, Conchita Carpio-Morales, returned to Manila late tonight, May 21, after being initially barred from entering Hong Kong earlier in the day with no explanation being given by Immigration officers.

Morales, along with former Foreign Affairs Secretary Albert del Rosario, filed a case in March against Chinese President Xi Jinping before the International Criminal Court over China’s perceived maritime violations in the West Philippine Sea.
But in a tweet, Foreign Affairs Secretary Teodoro Locsin said all that the airport officers said was “This is an instruction.”

After about three hours of being held in an isolation room, the 78-year-old official, who also served as Supreme Court justice, was reportedly allowed to enter Hong Kong, but she declined, and opted to take a 6pm flight back to Manila.
Her daughter, son-in-law and two grandchildren who were not stopped from entering Hong Kong, chose to fly back with her. Their plane arrived in Manila at 9:20pm, and they were met at the airport by Del Rosario and Morales’ lawyer Anne Marie Corominas.

That was exactly nine hours since Morales and her family arrived in Hong Kong aboard a Philippine Airlines flight.
Shortly after Morales was separated from her family and put in a detention room, Corominas released a statement to Philippine media decrying the incident. She asked, "How is a 78-year old former anti-corruption Ombudswoman a security threat in HK-China?"

At about 3pm, the Philippine Consulate in Hong Kong was alerted about the problem, and Consul Paul Saret was dispatched to the airport to assist Morales.
According to Locsin, Saret asked “if he could sponsor or guarantee her stay but HK refused.”
Locsin further said the ATN (assistance to nationals) head brought Morales food because “she refuse (sic) to eat the food offered by airport officials,” before derisively adding “CLASS! I can see her sneer.”

At about 5pm, Deputy Consul General Germinia Aguilar-Usudan said in an interview that Morales had already checked in her luggage and was on her way to a restaurant to eat before taking her flight back home.

“We will be inquiring officially to the immigration office why she was not allowed immediate entry to Hong Kong," said Usudan, who is acting head of post in the absence of Consul General Antonio Morales.

A statement later issued by Presidential Spokesman Salvador S. Panelo said Morales was refused entry to Hong Kong “and was subject to deportation as she is considered a ‘security risk’ by Chinese immigration authorities.

The statement added, “We will defer to the immigration laws and rules of other countries much as we expect foreign nations to respect our country's internal rules”.

While Morales and her family were assisted by the DFA through the Consulate, Panelo said “the same government assistance shall be given to each and every Filipino in distress abroad, and this is regardless of political persuasion or affinity.”

Asked to comment, Del Rosario said what happened to Carpio-Morales was similar to how China has been bullying the Philippines in places where the two countries have overlapping claims.

"One of the reasons we had filed our case in the ICC is to be able to push back against the bullying and harassment that we have been encountering from our goliath of a neighbor," he said.

"Today, with the holding of Former Ombudswoman Conchita Carpio-Carpio-Morales by immigration authorities in Hong Kong as a security risk presumably due to the ICC case that we had filed, we are experiencing more of the same," he said. – with reports from Manila

Pero matapos siyang kausapin ng amo, pati ng mga anak ng matanda ay nagdesisyon siyang pumirma na lang ulit. Sinabihan siyang sa kanila sumunod at huwag pansinin ang matanda.

Ito ay sa kabila ng payo ng kanyang mga kaibigan na humanap na lang ng iba.

Sa tingin kasi ni Mena ay maswerte na siya dahil maluwag siya sa trabaho. Lagi sa opisina ang kanyang amo at pati si lola ay mahilig lumabas kapag maganda ang panahon. – George Manalansan
