FDHs warned joining, recruiting for MLMs could be illegal

Hong Kong authorities are calling on people who have been asked to put huge sums of money in a network marketing scheme to report to police, saying these could be classified as pyramiding, which are illegal in the city.

The advice came as a Filipina domestic helper complained in a social media site about how she was lured into the Wanchai offices of a networking group on false pretenses, before being offered help to take out a loan so she could pay their hefty joining fee.

Sources from Immigration and Customs departments said sec 3 of Cap 617 of the Crimes Ordinance provides that a networking scheme may be classified as a pyramid even if it involves, among other things, the marketing of goods or services or both; and if a participation payment that is not commensurate to the goods received in exchange is required of a new recruit.

Moreover, art 5 of the same law provides that both the operators and investors in a pyramid network are criminally liable. A person who commits an offence under subsection (1) referring to operators; or (2) which pertains to investors, is liable on conviction to a fine of $1,000,000 and to imprisonment for 7 years.

It is often hard to distinguish between a straightforward multi-level marketing (MLM) company and one that is a pyramid scam, so it's best to avoid both.

The FDH related in a post on the Facebook group of DWC Help that the incident happened on Oct 17, when she asked an older woman for help in looking for a shop in Wanchai that sold mobile phones

She said the woman whom she called “ate”, offered enthusiastically to take her to a phone vendor in the area. Instead, the older woman took her to the office of a Filipino networking company.

Although she did not name the company that was introduced to her, saying she did not lose money there anyway, some of those who commented identified it as UNO (Unlimited Network of Opportunities).

That prompted promoters from UNO to immediately come out in the open to defend the networking business.

The complainant said the recruiter explained what the group was and promised her big weekly income if she paid a $9,600 joining fee. When she said she was broke due to obligations at home, the recruiter suggested she take out a loan from a lending company.

Ang gusto niyang mangyari ay maglo-loan ako ng $25,000. Tapos yung $15,000 daw ipadala ko sa amin at yung $10,000 ipang-member ko. May sukli akong $400,” she said.

(What she wanted me to do was to take out a loan for $25,000. From that, I was supposed to send $15,000 to my family in the Philippines, while $10,000 should go to my membership fee. I get to keep the $400 change).

The recruiter reportedly told her she could earn up to $2.8 million because there was already a “downline” for her, that is, a member that would go under her in the networking ladder.

But the worker said she refused as she had already felt victimized because she lost precious time listening to the sales spiel.

Sana kung gusto nyong tumulong sa kapwa OFW, huwag kayong magsulsol na mangutang yung mga tao. Kasi lalo nyo silang ibinabaon para lang mag-member sa inyo,” she said.

(I hope that if you really want to help your fellow OFWs you wouldn’t push them to borrow money (to put in your network). You’re forcing the person to get mired in debt just to join you).

The worker said the multilevel networking scheme looked good, but she disliked the “kidnap-style” tactic used by some of its members to recruit others. “Sa Pinas, kidnap-style na nga, ganun pa rin dito,” she said.

(They already do it kidnap-style in the Philippines, they shouldn’t do the same thing here).

Many readers came to her side, alleging similar experiences with the group.

They decried how they were lured to the firm’s office by inviting them in for coffee or offering them part-time work. Once inside, they were all promised help in getting a loan if they didn’t have money to invest in the scheme.

Some of those who posted comments claimed they were not allowed to leave until the recruiter had finished their talk.

Many of those who came out in support of the whistle-blower said they had lost money through the same group or by joining other pyramid-style networking operations and regretted their mistake.

One worker said the recruiters would ask, “Matagal ka na dito sa Hong Kong? May pamilya ka ba sa Pinas. May utang ka ba? Gusto mong mabayaran kaagad?”

(Have you been in Hong Kong for a long time? Do you have a family in the Philippines? Do you owe money? Do you want to pay it back quickly).

It turned out the recruiter just wanted her to take out a loan so she could repay her debt in the Philippines, and use the rest of the money to invest in the networking scheme.

The network promoters were quick to respond, saying they were just offering the helpers a way out of their tight financial situation. They claimed the business they offered was legitimate and had made millionaires out of hard-working members.

They also invited the whistle-blower to their office and identify who the recruiter was.

But their spirited defense of the networking scheme failed to convince their detractors, who insisted it was a scam as only those at the top of the pyramid got rich. They accused the group of driving the workers deeper into debt.

One critic backed this up, saying she had lost money from one such scheme.

Mga downline abutin man ng dekada downline pa rin sila at never na maging millionaire circle po ayon sa payo ng ng mga upliners na magre-recuit po. 100% tama ang mga linya ko kasi galing na ako diyan sa networking ng mga yan. Huwag pauuto sa mga freebies kuno nila,” she said.

(Those downlines will remain downlines even after a decade, and will never become a millionaire as promised by the upliners that recruited them. I am 100% sure because I used to be with those networking groups. Don’t get fooled by their promises of freebies)

Migrant moms and babes’ refuge turns to hiking and selling wine to boost funds

The challenge is for various groups to walk 7,600 km collectively to celebrate PathFinders' 12th year

PathFinders Hong Kong Ltd, a charity organization that helps protect the rights of migrant mothers and their children, is taking to hiking and popping the bottle to raise funds for the needs of its clients.

The NGO has launched its PathFinders Hiking Challenge to various groups that collectively, could trek 7,600 kilometers, which represent the number of babies and mothers that it has helped for the past 12 years.

“As we’re unable to mark the occasion with our annual FUNdraiser – which was set to raise $3 million – we’ve launched a few exciting initiatives to celebrate the lives of over 7,600 babies, children and women we’ve helped since 2008,” said PathFinders fundraising director Harriet Beavis in an emailed invitation.

She said the initiatives are aimed at raising "much-needed funds to ensure we can continue to protect all those who seek our help.”

Participants are encouraged to form a team, agree on the date and time of their route, and set a fundraising target. Those who want to meet fellow hikers for their team should join PathFinders’ Facebook group and share ideas, keeping in mind the current social distancing restrictions.

PathFinders is currently managing 180 cases involving over 200 children, apart from taking calls to its crisis hotline and taking in new cases every week.

“Although we’re unable to go ahead with our annual FUNdraiser, the babies, children and women we protect still need your help,” Beavis said.

PathFinders said the annual dinner should be able to raise $3 million but the economic impact of Hong Kong’s socio-political and pandemic crises has affected its traditional sponsors and supporters.

The NGO was included in the BridgeTheGap crowdfunding effort and money raised from it had reached 58% of its target, Pathfinders said.

PathFinders, in cooperation with Eden Rift Vineyards, is also boosting its fundraising via a California wine sale announced on Oct 9 and will last until Nov 12.

Those who want to help can choose from two types of wines that Eden Rift markets in Hong Kong – 2017 Estate Chardonnay, Cienega Valley for $3,800 per case of 12 bottles and 2017 Estates Pinot Noir, Cienega Valley for $4,200 per case.

PathFinders said $2,000 from the sale of each case would be donated by Eden Rift to the charity.

Wine orders can be placed on online by completing an order form or before Nov 12 and delivery will be between Dec 17 and 11 via SF Express, the NGO said. Interested buyers can email events@pathfinders.org.hk for details.

Beavis said supporters can also donate to the BridgeTheGapHK campaign or spread the word as the group needs to reach 100% of its target to cover its funding gaps and safeguard critical services.

She said all public donations until Nov 30 will be matched dollar for dollar by the Fu Tak Iam Foundation Ltd as part of the BridgeTheGapHK initiative.

Filipino DH population rises after 6-month slide

OFW numbers rose by more than 2,300 last month alone

After six months of a continuous decline, the number of Filipino domestic helpers in Hong Kong rose by 2,372 as of last month.

Statistics from the Immigration Department show that the Filipino DH population rose to 206,395 by the end of September, up 1.16% percent from 204,023 recorded in August.

An agency union head attributed the turnaround to workers recruited before the pandemic who finally arrived last month, and vacationing helpers who returned after being stranded by emergency measures in the Philippines.

This was despite the stringent new measures imposed on new arrivals from the country, including the negative test result for Covid-19, and a14-day hotel booking for the mandatory quarantine.

“The [new] arrivals from Manila were those hired before February or even last year,” said Thomas Chan, chairman of the Hong Kong Union of Employment Agencies.

“Perhaps, those on vacation who tried to return to Hong Kong contributed to the increase in arrivals.”

But despite the rebound, there were still 13,333 job losses since January, when the coronavirus outbreak began in Hong Kong.

The September data was a reversal of six months of slide that began in February, excluding March, and led to a 5,489 plunge in August due to lockdowns, cancelled flights and Hong Kong’s decision to restrict the entry of FDHs amid infection fears.

Some Hong Kong employers who could not wait for their helpers stranded in the Philippines due to lockdowns reportedly decided against hiring them and replaced them with those already here.

Chan said most local employers preferred hiring workers who were already in the city to save them time and money. Immigration has helped push this thinking by allowing even terminated workers to move to new employers without leaving Hong Kong.

Severe lockdown measures in the Philippines also prevented many FDHs from traveling to Manila where all flights to Hong Kong originate.

Chan said his agency partners in Manila reported that transportation between the capital and the provinces had nearly halted, workers lacked money to travel to the city and go for medical checkups, and most agency staff had been cut down to half.

Some of the agencies even had to close down because of lack of funds.

The rise in the number of FDHs was across the board, with Indonesian helpers, the second biggest group, also growing in number. Their population rose by 536 in September, to 157,873.

Filipina in quarantine one of 8 new Covid-19 cases

The Filipina DH tested negative for the virus at the airport

A Filipina domestic helper who arrived on Oct 10 and was found to have the coronavirus on her second test, was among the eight new Covid-19 cases reported today by the Department of Health.

According to an information officer at DH, the 33-year-old Filipina flew in via Philippine Airlines Flight PR 300. She did not have any symptoms, but was found positive for the virus when tested while in quarantine at Mini Hotel in Causeway Bay two days ago.

She was one of seven imported cases reported today. The lone local patient is a 66-year-old resident of Home of Treasure in Kwai Chung, a facility for disabled people, where 20 confirmed cases have now been recorded.

The six other imported cases included three returnees from Belgium, and one each from the United States, Ethiopia, and India.

They brought the total tally of infections in Hong Kong to 5,269. Of these, 116 remain in hospital, including 12 who are in critical condition, five who are seriously ill, and 99 in stable condition.

Infectious disease expert Ho Pak-leung has noted that the third wave of the outbreak seems to be easing with only a single-digit increase most days recently.

But he warned against complacency, saying there are still cases with unknown sources. He again said infections could surge anew when the weather becomes cold and dry.

15,600 more people lose jobs as HK unemployment nears 16-year high

The unemployment rate is likely to rise with Cathay's move to cut 5,000 jobs
 

Some 15,600 people in Hong Kong lost their jobs in the third quarter of this year, as the unemployment rate rose to a nearly 16-year high of 6.4% due to the continuing impact of the pandemic on the local economy.

Data released by the government on Oct 20 showed the unemployment rate growing by 0.3 percentage point from July to September, compared with the previous quarter.

The jobless rate is expected to rise even more by the next quarter, after Cathay Pacific announced today, Oct 21, that it would cut the jobs of more than 5,000 staff in Hong Kong, including about 2,000 cabin crew, many of whom are Filipinos.

According to officers of Cathay’s Flight Attendants Union, those who were sacked will get an extra month’s pay and will be compensated for the unpaid leave they were forced to take earlier. The company will also not charge their MPF for their severance pay.

The union said the redundancy package was “not overly generous,” and feared more jobs would be cut because of the continuing decline in the economy brought on by the pandemic.

Lawmakers immediately expressed over the mass layoff at Cathay, saying the government must take steps to minimize the impact of the job cuts.

Civic Party legislator Jeremy Tan that as the government had already injected $30 billion to bail Cathay out earlier this year, it should ask the company to do its best to retain staff.

Federation of Trade Unions lawmaker Alice Mak said, on the other hand, that it is time for the government to give unemployment subsidies to help those affected.

She also feared the mass layoff would further push up the city’s unemployment rate by another 0.2 percent.

Starry Lee, chairwoman of the pro-establishment party Democratic Alliance for the Betterment of Hong Kong, said the job cuts at Cathay could lead other big companies to make a similar move.

"I am very much afraid that Cathay Pacific’s plan is just the beginning and other large-scale companies will follow suit,” said Lee.

Total employment decreased by about 15,600 from 3,640,400 in June-August to 3,624,800 in July-September.

The impact of the job losses reverberated in the ranks of foreign domestic helpers, thousands of whom were laid off by employers who also lost their employment.

In June-August alone, nearly 9,000 Filipino domestic helpers lost their jobs, with many employers citing job loss as the reason for terminating contracts. From January this year, the drop has been more than 15,000.

Secretary for Labour and Welfare, Dr Law Chi-kwong said the labor market deteriorated as a whole during the past quarter amid the third wave of the local epidemic, particularly in July and August.

However, he said, there were signs the pressure faced by the labor market stabilized towards the end of the quarter with support from the Employment Support Scheme, which helped beleaguered companies pay the salary of their workers.

The unemployment rate increased across almost all the major economic sectors, with more distinct increases in the retail, accommodation and food services sector; and arts, entertainment and recreation sector.

Underemployment decreases were mainly seen in the transportation and education sectors, while increases were mainly seen in the food and beverage service activities, and arts, entertainment and recreation sectors.

“As the overall economic situation remains weak and the global pandemic is still evolving, the labor market will remain under pressure in the near term…The government will continue to monitor the situation closely,” Law said.
