Posted on No comments

CFA issues landmark ruling protecting transgender rights

The CFA says it is unconstitutional to require transgenders to undergo full sex reassignment surgery

In a decision that has far-reaching implications for transgenders in Hong Kong, the Court of Final Appeal has ruled that full sex reassignment surgery is not necessary before one can have their new gender recorded in their identity cards.

Hong Kong’s highest court issued the ruling Monday in the appeal filed by Henry Edward Tse and another man called Q, who both lost their cases in the Court of First Instance and the Court of Appeal.

The two sought to convince the lower courts that the commissioner of registration was wrong in refusing to change their gender in their identity cards as they had only undergone hormone treatment and had their breasts removed.

In deciding against their application, the commissioner cited a policy saying transgenders must first undergo full sex reassignment surgery before being granted an amendment to the gender markers on their ID card.

This means removing or altering their genitals to conform with the new gender identity they want stated in their ID cards.

However, many transgenders opt not to undergo full reassignment as there are risks involved and they do not see it as necessary.

PINDUTIN PARA SA DETALYE

In its decision that was handed down, the CFA declared that requiring the appellants to undergo full SRS before any alteration could be made in their gender markers, was a violation of their rights under the Bill of Rights, and was unconstitutional.

The court also said that “the policy’s consequence is to place persons like the appellants in the dilemma of having to choose whether to suffer regular violations of their privacy rights or to undergo highly invasive and medically unnecessary surgery, infringing their right to bodily integrity. Clearly this does not reflect a reasonable balance. The policy imposes an unacceptably harsh burden on the individuals concerned.

All five justices of the court led by Chief Justice Andrew Cheung concurred in the decision.

MTR to give fare discounts to compensate for service disruptions

Posted on 05 February 2023 No comments

The MTR will give you a discount on the fare you usually pay.

How much the discount will be has not been announced, but it can be expected soon because MTR is required to give fare cuts totalling $65.5 million, as compensation for last year’s eight serious service disruptions, which caused train delays that lasted more than 30 minutes.

PINDUTIN PARA SA DETALYE

The discounts kick in automatically as part of MTR’s fare adjustment mechanism, which is tied to its performance in providing service.

In a report it submitted to the Legislative  Council’s subcommittee on railways, MTR said that of the 1.35 million train trips it made last year, 99.9% were on time.

However, it had 152 service disruptions, mostly minor, down 24% from the previous year’s 194.

PINDUTIN PARA SA DETALYE

The number of serious disruptions that caused delays of more than 30 minutes also fell by half from 16 in 2021 to eight last year.

But the increase in the back pay, which more than tripled from $19 million in 2021 to $65.5 million last year, indicates that the service disruptions in 2022 were more serious, since the amount MTR has to pay depends on how long a disruption lasts.

PINDUTIN PARA SA DETALYE

Two of these disruptions were noted by the Legco subcommittee – the  Tsuen Wan Line Train incident last Nov. 13 and the Tseung Kwan O Line incident on Dec. 5 December.

“Members expressed grave concern on the spate of serious MTR train incidents that have occurred in less than a month,” it said in a report.

The November incident involved a Central-bound Tsuen Wan Line train.

It was entering the Yau Ma Tei Station when two pairs of doors were dislodged after colliding with a barrier that detached from the platform because its screws had corroded -- resulting in the front carriage jumping off the rail.

The line was back in service after 15 hours. Based on the fare adjustment formula, this incident cost the MTR $17.5 million.

PINDUTIN PARA SA DETALYE

In the December incident, coupling components between the sixth and the seventh carriages failed, triggering the emergency brake and causing a blackout in the train.

Some 1,500 passengers had to leave the train and to walk through the tunnel to the Tseung Kwan O Station platform.

Service was disrupted by four hours, costing the MTR $5 million.

The SUN has retained its 10th place in the list of the Top 15 Hong Kong News Websites ranked by independent website content reader, Feedspot.

The website says in a post on Jan 24, 2023 that “the best Hong Kong news websites” were chosen from thousands of news websites and ranked according to “traffic, social media followers, domain authority and freshness.”

PINDUTIN PARA SA DETALYE
As before, The SUN is the lone publication in the list with a niche following, as it mainly targets Filipino migrants and residents in Hong Kong.

It again placed higher than media giants like Ming Pao, Al Jazeera Hong Kong and BBC News Hong Kong.

The SUN publisher Leo A. Deocadiz again welcomed what he described as an “unsolicited ranking” from Feedspot, and said it reflects the kind of committed journalism that the media group has espoused in the past 28 years.

Founded in 1995, The SUN is the oldest and most widely read Filipino community publication in Hong Kong. It has a following of more than 163,000 on Facebook and publishes at least two stories a day, which are shared by dozens of readers on a regular basis.

The SUN started out as a printed publication, with its monthly print run reaching a high of 55,000 copies up until 2020, when the Covid-19 pandemic forced the company to go fully online.

It used to print separate editions in Macau and Toronto.

The list for 2023 is nearly the same as last year’s, except that The Star Hong Kong, which is based in Toronto, Canada, went up to the 12th slot, from the previous 15th,  replacing Al Jazeera Hong Kong.
