A Filipino construction worker was sentenced today in Eastern Court to a suspended jail sentence for gambling. However, instead of being released, he was locked up for four months because his conviction activated a suspended sentence in a previous case.
Cloyd De Vera, 42 years old, had pleaded guilty before Principal
Magistrate David Cheung to gambling in a gambling establishment, contrary to
section 6 of the Gambling Ordinance which outlaws all gambling in Hong Kong.
For this, he received a sentence of 10 days, which was left
after a one-third discount was deducted from the starting point of 15 days. This
is his 16th criminal conviction, and the sentence will run at the same time as
the four-month sentence for a minor drug possession charge.

De Vera was charged, along with 12 locals and a Filipina, Rosalinda
Harabay, 67 years old, with illegal gambling after police raided a gambling joint on the first floor of 83 Chun Yêung Street, North Point on March 1 this year.
One of the locals, Wong Siu Fung Herbert, was charged with
managing the gambling establishment.
De Vera, who is currently on remand under another pending case
of possession of dangerous drugs, was earlier asked by Magistrate Cheung if he
needs a lawyer.
“No need. I plead guilty,” he said.

When asked if he had anything to say in mitigation, he said,
“I want to change my life. Please give me a chance.”
De Vera is a construction worker earning $29,000 a month,
half of which he said he sends to his wife and three children in the
Philippines.
