Migrant workers are overworked, underfed, says study

Nearly all migrant workers in Hong Kong are overworked, with nearly half working more than 16 hours a day.

This is according to the annual “Service Report” published on Apr 11 by the Mission for Migrant Workers. The result was gathered from a total of 5,188 migrant workers who sought help from the Mission in the past year, made up largely of Filipino women.

A whopping 99% of those assisted by the Mission complained of long working hours, with the majority (56%) saying they worked between 11 to 16 hours each day. The rest (43%) said they worked more than 16 hours, twice as long as office workers.

Most of them sought help over labor problems, and more than half (59%) of the cases were over termination issues.

Cynthia Abdon, general manager of the Mission, said the results showed that much work still needs to be done.

“While it is alarming that there is a 9% increase in those who report that they work more than 16 hours a day, 8% increase in those who report that they have labour issues, let us not be disheartened. This only proves that we have much work to do,” she said.

A quarter of the respondents said they had no room of their own, but Abdon said this was already a reason for hope because it represented a 20% decline in the number of those dealing with the issue.

“While the process of making the Hong Kong accommodation policy respectful of migrant domestic workers rights seems slow, we can at least see that at the household level, there are changes. This we can see, since the launching of the Mission’s Pictures from the Inside research two years ago. We hope that our social advocacy is helping to establish better mutual understanding and recognition of domestic workers rights and needs among well-meaning households,” Abdon said.

But she cautioned against concluding that the work conditions of migrant workers are improving.

She cited the rise in the number of those who complained about insufficient food (28% of the respondents), those with no regular days off (15%); and the same number who did not have statutory holidays (12%) , and those whose passports were illegally taken away by employment agencies (13%).

 More alarming was the number of workers who were physically assaulted by their employers, which doubled from 5% to 10%. A big number, or 22%, also complained of ill-treatment.

The illegal collection of fees from the workers appeared to continue as well, with the Mission recovering more than $2 million for its clients.

“All this shows how just the workers’ demands for working hours regulation, wages, and workers’ rights,” said Abdon. “The data also shows how urgent these demands are. We hope that in the near future, more meaningful and long-lasting changes will be enacted that will lead to MDWs (being) treated fairly. If the other positive results are an indication, then we have hope.”

Pinay reportedly killed by live-in partner

A Filipina former domestic helper was reportedly killed on Apr 10 by her boyfriend, a Gambian national, in their flat in Tokwawan, Kowloon.

The victim was identified by her friends, and confirmed by the Consulate, as 40-year-old Adele Cuyacot, from Bicol. She was reportedly a single mother to a grown-up daughter due to graduate from college this month.

A press statement issued by the police early this morning said they received a call from a 37-year-old NEC (non ethnic Chinese) man who said that he had killed his 40-year-old wife inside a unit on Pang Ching street.

Officers who rushed to the flat reportedly found the woman lying unconscious on a bed, with injuries to her head and hands. She was certified dead at the scene. The cause of her death is still being ascertained.


But initial reports quoted the police as saying that the woman could have been dead for 12 to 20 hours.

The man reportedly said he and his wife had fought early that morning.

Police said they arrested the man, who was then turned over to the District Crime Squad of the Kowloon City District for further questioning.


The case has been classified as murder.
Cuyacot’s friends say she had been going out with her boyfriend they described as a “black guy” for some time.

They knew her as a domestic worker whose employer lived in Hunghom.
But according to Danny Baldon, staff at the Consulate’s assistance to nationals section, the report they got from the police indicated she was a “former domestic helper”. They could not immediately determine what status she had at the time of her death. – with a report from Merly Bunda

Pinay to stand trial for indecent assault on young ward

A Filipina domestic worker accused of hurting and indecently assaulting her six-year-old ward pleaded not guilty to the charges on Apr 8.

Angela Vivo, who is out on bail, is facing three charges of assault, and two of indecent assault, on the child, on separate occasions spanning four years.

The alleged victim, identified only as “X”, is the son of her employers.

Vivo’s made her plea before Kowloon City Magistrate Woo Huey-fang.

The prosecution states that the first assault on the alleged victim took place on an unknown day in Jun 2016 outside the Yaumatei Fire Station in Kowloon.

The two other assaults allegedly happened between July 2016 and on Sept 7, 2018, also in Yaumatei.

The charge sheet said the assaults had caused hurt that interfered with the health of the child. 

The prosecution also accused Vivo of indecently assaulting the boy on a day between 2015 and 2016, and repeated it on an unknown day last year inside her employers’ flat in Yaumatei.

The prosecution has lined up four witnesses during the two-day trial, including the alleged victim, who will give evidence via CCTV.

Vivo has chosen not to give evidence.

Labatt to lead medical outreach to more Filcom hubs

The extension of Labor Attache Jalilo dela Torre’s term in Hong Kong has brought more positive news to Filipino workers in Hong Kong

Following the success of his outreach to two churches in the New Territories and Kowloon, Labatt dela Torre is set to provide free medical health checks under his HealthWise program and other services to more Filipino hubs in the city.

The third outreach has been set for May 5 at the Holy Cross church in Sai Wan Ho, while tentative dates have been set for St Alfred’s Church in Lam Tin, and parishes on Lamma and Cheung Chau islands.
Previously, Labatt dela Torre and his team provided off-site services at the Immaculate Heart of Mary Parish in Taipo, New Territories on Mar.17, and at St Edward’s Parish in Lam Tin, Kowloon on Apr 7.

At the Lam Tin outreach, 154 Filipino migrant workers availed of the free medical check up, while dozens more asked for help in signing up with the BM Online site to get their overseas employment certificates (OEC).
More overseas Filipino workers were provided service during the Taipo outreach, where more than half of those who submitted to the health checks were found to have high blood pressure, suspected to be linked to their high-pressure jobs.

According to Rodelia Villar, founder of the Domestic Workers Corner, who is coordinating the outreach missions, members of the Filipino community at both parishes expressed gratitude to Labatt dela Torre for visiting them and extending services.

She said the communities were happy to see the labor official himself attending to their needs and responding to their queries, while overseeing a team of nurses and other volunteer medical staff provide free blood, glucose, cholesterol and uric acid tests on OFWs.

Villar is given help in reaching out to the various congregations by Fr. Jay Flandez, chaplain to Filipinos in Hong Kong.
She said more Filipino groups in far-flung places have requested for the service, but everything depends on how long Labatt will be allowed to remain in Hong Kong.

Dela Torre’s three-year term was supposed to have expired on Mar 31, but under laws banning the movement of government personnel during an election period, he will not likely to be pulled out of Hong Kong until August 13 this year.
