Pinay files instant appeal against RMB theft conviction

Berbana is accused of stealing 17 pcs of RMB100 bills

A Filipina who was found guilty at Eastern Court of stealing 1,700 renminbi from her employer has immediately gone to the High Court to appeal her conviction.

Ana Liezel Berbana, 33, was sentenced to six weeks in jail on May 16 by Magistrate Lam Tsz-kan after finding her guilty of theft.
The magistrate said Berbana’s frame-up claim was unreasonable, as her employer had already given her a one-month termination notice.

Defense lawyer Philip Ross immediately applied for bail for her client so she could file an appeal.
Lam granted the application but raised the bail money to $10,000 from the previous $6,000, and ordered the helper to file an appeal within 14 days.

But Ross said his client would go to the High Court right after the sentencing to file the appeal, and she did.
In his verdict, Lam rejected Berbana’s claim that her employer Wong Man-nga had made up the theft charge.

Berbana had told the court that she knew nothing about the money that police found in her jacket’s pocket. She also said her employer had always told her not to enter her bedroom, but broke this rule on the day in question when she asked the helper to go inside the room and clean her toilet.
The Filipina claimed that the accusation and her eventual arrest on Dec 21 came a day after she complained to Wong about having to use her own money to buy extra food for the employer’s household.
But the magistrate said Wong was a credible and reliable witness. He said he believed the employer’s claim that she had left her bag containing 40 bills denominated at 100 renminbi each, in her bedroom on the afternoon of Dec 21.



Wong had said that after ordering her helper to clean the bathroom in her bedroom, she discovered 1,700 renminbi was missing from her bag and called the police.

An officer said in his testimony that he found the missing notes stuffed in a sanitary napkin placed in a plastic bag, and hidden in the pocket of Berbana’s jacket.

Know more about your rights as a migrant worker by visiting a consultation booth to be set up on Chater Road on May 19, as part of the Mission for Migrant Workers’ 38th anniversary.

The booth is just one of several to be set up in line with the Mission’s regular Care to Caregivers services fair. The event is held 3 to 4 times a year to provide free services and information for the whole day to migrant domestic workers, hoping to give back the care they give to Hong Kong families for six days in a week.

The Mission partners with different service providers in providing free blood pressure check, Chinese medicine consultation, reflexology, massage, dental care, financial literacy education, expressive art therapy, as well as free drinks and information material on labor-related matters.

At the same time, an awarding ceremony for the winning “good employers” under the Happy Homes program will be held. This is a social advocacy which promotes (1) respect, (2) recognition, (3) mutual understanding and (4) fair-treatment between employer and worker.

Polo, DWC hold two more outreach medical missions

Hundreds of Filipino migrant workers in two churches have availed of the free medical and employment consultations during an outreach mission by the Philippine Overseas Labor Office, with help from Domestic Workers Corner.

The latest outreach was held on May 12 at St Alfred Parish in Tai Wai, New Territories, where about 350 Filipino domestic workers received free basic medical check-up and more than 100 received help with securing overseas employment certificates.

About the same number lined up for services at Holy Cross Parish in Sai Wan Ho on Hong Kong island on May 5.

Both missions were led by Labor Attache Jalilo dela Torre who conceived the project of providing medical check-ups to FDWs in the wake of findings that a higher-than-normal number of the Hong Kong-based workers suffer from high blood pressure and diabetes.

Labatt dela Torre also provides information to the parishioners on the projects and services that Polo offers for free to Filipino workers.

Catholic chaplain for Filipinos, Fr. Jay Flandez, helps coordinate the outreach missions with the parishes across Hong Kong, especially in far-flung areas where the workers don’t have easy access to most service providers.

As part of the outreach, speakers are invited to give talks on employment-related matters and other issues concerning migrant workers.

At Holy Cross parish, The SUN editor and lawyer Daisy CL Mandap spoke on the rights of the accused, and how a migrant worker could get help when subjected to a criminal act like physical abuse.

She said an accused can refuse to make a statement, much less agree to sign any document the contents of which she disputes, or are not made clear to her. When they are harmed, they should leave the employer’s house immediately and seek professional help.

If possible, gather evidence like photos or medical reports and other documents that could be used should the filing of a case become necessary.

In Tai Wai, Gellin Byatt, program officer of PathFinders Hong Kong spoke on the rights of a pregnant migrant worker, and those of her child after she gives birth.

The mission was headed by Maan Tomagan of POLO, with help from volunteers, some of them registered nurses, midwives or therapists.
