DH, employer in dismissed shampoo theft case settle dispute

A Filipina domestic helper cleared of charges she had stolen a small shampoo set has agreed to settle her labor case against her former employer for $5,800, almost half her original claim.

The agreement came after a two-hour hearing at the Labour Tribunal today, Jun 20, during which Presiding Officer Jo Siu told Damiago and defendant Jennifer Wong they could both lose if the case dragged on.
Damiago was claiming from Wong a total of $11,504.37, broken down as follows: $734.37 for five days’ wages, $7,640 in damages for alleged loss of income, $1,700 for a one-way air ticket, $1,330 for visa extension costs and a $100 travel allowance. 

She had insisted on pursuing the case after the last hearing on Mar 29 during which Wong had refused to pay the claim for unpaid wages and return air ticket with a 20-kilo baggage allowance.
It was the  first time the two had faced each other at the Tribunal after Damiago was acquitted in Eastern Court on Feb 13 of a theft charge which arose from Wong’s claim that the maid had stolen a small travel set of toiletries, along with a pack of dried plums.

In her labor claim, Damiago had alleged constructive dismissal, saying Wong’s husband had abused her, physically and verbally, in their Repulse Bay flat.

But Wong countered that she fired the helper on Oct 15 last year because of her “dishonest acts.”
After examining the helper’s claims, Siu said Damiago should have stated “wrongful dismissal” instead of “constructive dismissal” because she was fired based on false accusations after she had given Wong a one-month notice of resignation.    

“In constructive dismissal, you leave right away because of abuse. You don’t have to give the employer one month’s notice,” Siu said.

Then, seeing that both sides were not ready to settle, Siu explained the rigors and risks of going to trial, starting from gathering evidence, calling witnesses, waiting for months to get a trial date, and the risk of costs.

Then, if the Tribunal’s ruling is appealed or a review is sought, a hearing in the High Court could take months to schedule. Getting a lawyer could also entail costs of about $50,000 each hearing, she said.

In the case of Damiago, Siu said she could apply for Legal Aid, but she could still face a long wait as a court case could go on for years if both parties stood their ground.
Also, if Damiago loses, she could be ordered to pay costs.

For Wong, money may not be a problem, but her family’s reputation could be ruined, and dragging her children to the trial as witnesses may also be traumatic for them.

“Why not just settle to avoid all the troubles?” Siu asked the parties. Then she gave them 10 minutes to try to reach a settlement.

When Wong and Damiago returned, there was still no agreement. The employer offered to settle for $4,000 plus $1,500 for the air ticket, while Damiago insisted on $4,500 plus the ticket.

Siu suggested raising the total amount to $5,750, then fixed it at $5,800. The two agreed.

Ilang buwan pa lamang si Lovie sa kanyang mga amo ay ramdam na niya ang hirap. Napakalaki kasi ang bahay ng amo na may tatlong palapag, at may kasamahan siya sa bahay na iba ang lahi at parang amo na rin umasta dahil matagal nang naninilbihan doon.

Bukod sa madami ang trabaho ay hindi din siya binibigyan ng sapat na pagkain, na madalas ay laging wala sa oras.

Minsan, ang almusal niya at tanghalian ay pinagsasabay na niya dahil alas 2 ng hapon na siya binibigyan ng pagkain. Dahil dito ay bumagsak agad ang katawan ni Lovie.

Lagi din kasi siyang pagod dahil kahit tanghaling tapat ay pinapalinis siya ng bubong, mga bintana at balkonahe ng bahay na may tatlong palapag. Samantala ang kasama niya ay papetik-petik lang sa trabaho.

Dahil dito ay naisipan niyang isangguni sa isang kaibigan ang planong magbitiw sa trabaho. Pinayuhan naman siya ng kaibigan na maghanap muna ng kapalit bago magpaalam sa amo. Agad namang sinunod ni Lovie ang payo sa kanya, at suwerte niya dahil may nagkagusto kaagad sa kanya na mukhang mabait.

Nakapagtrabaho na siya sa Gitnang Silangan at sa Singapore kaya madali siyang nakahanap ng bagong amo.

Pagkatapos niyang makipagpirmahan sa bagong amo ay kaagad siyang nagbigay ng isang buwang pasabi. Ngunit isang araw pagkatapos niyang magpaalam ay pinababa na si Lovie, at inutusan ng amo na umuwi na agad sa Pilipinas.

Hindi naman siya pumayag sa gustong mangyari ng kanyang amo, kaya binigyan din siya ng ilang araw na makapaghanda at makapamili ng maiiuwi niya sa Pinas.

Ayaw pa siyang bayaran noong una dahil siya daw ang umayaw, pero nangtawiran siya na may pasabi siya, at sila dapat ang magbayad sa kanya dahil pinapababa na siya agad.

Natakot namang di magbayad ang kanyang amo noong pinuntahan si Lovie  ng kanyang kaibigan para tulungan siyang maghakot ng mga gamit niya.

Sa bandang huli ay nakuha naman niya ang mga dapat niyang kabayaran kaya masaya na siyang uuwi, lalo at may babalikan naman siyang amo na pakiramdam niya ay mabait at makakasundo niya.

Ayon kay Lovie mainam din na humingi ng payo sa mga kaibigan para lumakas ang iyong loob para ipaglaban ang karapatan. Si Lovie ay 35 taong gulang, may asawa at anak at tubong Cagayan Valley. – Marites Palma

10 taon na walang susi

Hindi lang minsan na nakipagtalo si Lucing sa kanyang amo noong bagong dating pa lang siya sa Hong Kong dahil gusto nito na kunin ang kanyang pasaporte at kontrata para iwas utang daw.

Pero ang mas masaklap ay hindi siya binigyan ng susi ng kanilang bahay.

Pero pumayag na lang din si Lucing sa mga gusto ng amo dahil ayaw niyang mawalan ng trabaho. Imbes magreklamo ay pinaghusayan niya ang pagtatrabaho.

Pero hindi naging ganoon kadali ang pakikisama ni Lucing sa amo.

Naalala pa niya na noong minsan ay naghintay siya ng hanggang ala una ng madaling araw sa labas ng kanilang bahay dahil late nang nakabalik ang mga amo niya, samantalang ang curfew niya ay 8pm lamang.

Hindi man lamang daw siya sinabihan na gabi na silang makakauwi, pero hindi pa rin siya nagreklamo.

Tuloy pa rin ang kanyang paninilbihan sa napakalaking bahay ng mga amo na umaabot sa 3,000sq ft, may tatlong kotseng nililinis at may dalawang alagang bata.

Overstayer fails to get leave to stop looming deportation

Judge said the Philippines has no pattern or mass violation of human rights

A Filipino tourist has failed in his attempt to get the High Court to grant him leave for a judicial review of the Hong Kong government’s decision to reject his application for non-refoulement, or against being sent back home.

Manuel Doctor was the latest in a long list of Filipino applicants who failed to convince the court to allow a review of the Immigration Director’s decision denying them permission to stay.

Judge K.W. Lung said in his decision dated Jul 17 that the application had no reasonable prospect of success.
Doctor had argued that the Director failed to give credence to his claim that he would be harmed or killed by a drug trafficker if he was sent back home.

The applicant came to Hong Kong on Jun 27, 2016 as a visitor did not leave at the end of his two-week permit to stay. On Jul 14, 2016, or three days after he overstayed he surrendered to Immigration then filed for non-refoulement.

In statements he submitted to Immigration and the Torture Claims Appeal Board, Doctor said he met a certain drug trafficker named Jonjon Andrada who allegedly threatened to kill him if then candidate Rodrigo Duterte won the presidential election.
Since Duterte was elected President in May that year, Doctor said he decided to come to Hong Kong out of fear that the drug dealer would make good his threat.


But the Immigration Director found that the legal provisions that allow the granting of non-refoulement were not met in Doctor’s case, including risk of torture or cruel, inhuman or degrading punishment, or persecution.

The Director refused Doctor’s claim on Feb 13 last year. On Jun 22 of the same year, he appealed the decision to the TCAB, However, the board affirmed the Director’s decision.
The board said it accepted the facts cited in Doctor’s claim but found that state protection was available to him; that there was insufficient evidence to show that the state was involved; and that the harm he feared was not among those cited in the Immigration Ordinance.

Further, there was no evidence that the Philippines had a pattern of gross, flagrant or mass violation of human rights.

“This is a clear case that the applicant brought the fear upon himself without any facts or evidence in support of it,” said Lung.

He said four of the grounds Doctor had cited were not supported by evidence, a fifth was inconsistent with what he said before the CFI.
