Filipina jailed 2 months for stealing $9,000 from employer

A 30-year-old Filipina domestic helper has been sentenced to two months in jail for stealing a total of $9,000 from her employer in Chi Fu Fa Yuen, Aberdeen.

Jilliane Andrada pleaded guilty in Eastern Court on Jun 26 to three charges of stealing money belonging to her 65-year-old employer Alice Cheung on three occasions between February and Jun 23 this year.

Andrada, who had been working for Cheung since Jan 14, 2017, first took $4,000 from a locked drawer in the bedroom where the employer kept her money. Cheung kept the key in another drawer inside the bedroom.
On Jun 10, Andrada again entered Cheung’s bedroom and stole another $1,500.
She did the same thing on Jun 23, this time taking $3,500.

Cheung told police that on Jun 14 she put $30,000 cash she had withdrawn in the drawer, but when she checked the money on Jun 23, she noticed some was missing.

The employer asked her husband if he took the money but he said no. Cheung then asked the helper and she readily admitted the theft. The police were called and Andrada was arrested.
During a police interview, the helper confessed stealing money from her employer’s drawer on three occasions. She even wrote a confession detailing the dates when she took the money.

Andrada said of the total amount that she had stolen, she remitted $7,500 to her family and kept $1,500 for herself to buy food.

In mitigation, the defense lawyer said Andrada had just renewed her employment contract with Cheung in January this year. She was supporting her parents and a child.
The lawyer asked for leniency, pointing out that the helper had admitted the charges at the first instance and was remorseful.

Magistrate Peter Law told Andrada her crime was a serious breach of her employer’s trust committed on three occasions. He imposed a sentence of two months for each offense, to be served concurrently, after giving a one-third discount for her guilty plea.

Fake Longchamp bags being sold online

Here’s a warning to foreign domestic workers in Hong Kong: If you are planning to sell fake branded goods for extra income, think twice. You will be in double trouble.

Such is the case of Filipina helper Digna G. Calagui, who was caught by a Hong Kong Customs agent in possession a substantial number of fake branded sport shoes, bags, wallets watches and lipsticks, among other items, on Sept 23 last year in Central.

On Jun 26, Calagui pleaded guilty in Eastern Court to a charge of “breach of condition of stay” for engaging in an activity that violated the condition of her permit to work only in Hong Kong as a domestic helper.

The defendant also pleaded guilty to a charge of “possession for sale for any purpose of trade or manufacture goods to which a forged trademark was applied”. Possessing such goods is an offense under Section 18 (1) if the Trade Descriptions Ordinance, Cap 362, Laws of Hong Kong.

After admitting both offenses, Calagui, 41, was sentenced to a total of seven weeks in jail, suspended for 12 months. She was meted a suspended sentence of one week in jail for breach of condition and six weeks for possessing the fake goods.

Calagui was warned that both sentences will be enforced if she commits any offense within a year, but she still looked relieved when the interpreter explained the outcome to her.
The prosecution said the Customs undercover officer saw a big bag lying on the pavement at the Exchange Square bus terminus in Central around 1pm on Sept 23, 2018 and waited until someone came to take it.

When the Filipina arrived and took the bag at 1:15pm, the officer accosted her and asked to check the contents of the bag.

The bag yielded a haul of counterfeit goods, including 19 pairs of shoes bearing the brands Nike, Under Armour, and Adidas; 5 bags labeled Longchamp, Lacoste and Michael Kors; 3 Longchamp wallets, 3 Hello Kitty caps, 1 Hello Kitty mini brush kit, 83 MAC lipsticks, and 6 Casio watches.

Calagui was in a sense lucky as she was let off with a suspended sentence, and for having a supportive employer who has allowed her to continue working in Hong Kong. But Immigration authorities will still have to decide later whether to extend her work visa.
The defense lawyer said in mitigation that the defendant’s husband, a former driver in Hong Kong, had undergone a kidney transplant here but returned home to continue his medication there.
Outside the courtroom, Calagui said she was relieved because she needed to work to earn money for her husband’s treatment. She was also glad that her employer who lives in Aberdeen has been supportive.

She has two children, a son aged 18 who is in first year of a maritime course, and a 17-year-old daughter who is in senior high.

Ang mag-asawang dating kalahok lang sa seminar ng Card Hong Kong Foundation ay handa na ngayong isakatuparan ang kanilang mga natutunan tungkol sa tamang paghawak ng pera at pagpapalago ng kanilang kita.

Sa susunod na buwan ay uuwi na si Nanette, maybahay ni Val Bernabe, para alagaan ang kanilang tatlong anak na ang edad ay 9, 8 at 7 taong gulang, at pawang nag-aaral na.

Sila ang pangunahing dahilan kung bakit naisip ng mag-asawa na mag for good na si Nanette, at iatang kay Val ang pagpapanatili ng kanilang regular na kita.
Ngunit hindi ito nangangahulugan na maglalagi na lang sa bahay si Nanette, dahil balak niyang ituloy ang kanilang pangarap na magtayo ng boarding house at grocery sa kanilang lugar sa Roxas City sa Capiz.

Sa ngayon ang pangunahing pakay niya ay matututukan ang paglaki at pag-aaral ng mga anak. Sila naman daw talaga ang dahilan kaya pati si Val ay nagdesisyon na magtrabaho sa ibang bayan.

Nasa pagitan ng nag-uumpugang bato si Nanette dahil iiwan niya ang kanyang mahal na asawa sa Hong Kong, pero mas mahalaga daw sa kanilang mag-asawa na makakasama  na niya at mahuhubog sa tama ang kanilang tatlong anak.
May dalawang dekada nang OFW si Nanette, pero ang lahat ng kinita niya sa unang 10 taon niya sa Hong Kong, noong dalaga pa siya, ay ginugol niya sa pagpapaaral sa kanyang mga kapatid.

Ayon kay Nanette, magaan naman ang pasok ng pera sa kanya noon pero laging nadaan lang. Ang ibig sabihin, hindi siya nakapag-ipon ng para sa sarili.

Nang matapos ang mga obligasyon sa mga kapatid ay bumalik siya sa Pilipinas para mag-asawa, pero hindi naglaon ay nagdesisyong umalis muli. Nalugi daw kasi ang ipinundar nilang ihawan ni Val na noong una sana ay kumikita, pero bumagsak nang ipaubaya nila sa isang kamag-anak dahil nanganak siya.

Ngayon, sa tulong ng mga natutunan nilang mag-asawa sa Card, mas kumpiyansa sila na mapupunta sa tama ang mga perang inipon nila, at mas uunlad ang kanilang buhay-pamilya.

Consulate swamped after agreeing to replace passports of OFC borrowers

About 1,400 Philippine passports were seized by police during a raid on lending company OFC

The Consulate has been swamped with requests for new passports after announcing on Sunday, Jun 23, that it will replace all the travel documents seized from a lending company raided by the police earlier this month, but with restrictions.

Previously, all holders of passports lost to money lenders were issued only one-way travel documents, and were told to apply for a replacement at the Department of Foreign Affairs in Manila.

According to Consul Paulo Saret, head of the assistance to nationals section, clients of  OFC, from where 1,400 Philippine passports were seized by the police during a raid on Jun 5, have been coming in droves in a rush to apply for renewal or replacement.
“Ang dami nilang pumupunta, puno lagi ang ATN,” said Saret in a text message.

So far, he said around 500 of the passports seized have been turned over to ATN. But even those whose passports are not yet with them have been pressing them to issue replacements.

“After receiving guidance from the DFA that all pawned passports are automatically cancelled, we started processing the application for renewal (for those whose passports have been turned over to us) or replacement for lost passport (for those whose passports are not yet with us but insisting on new passport) after they issue an Affidavit of Undertaking that for the 1st offense, they will be placed under the DFA Watchlist, but for the 2nd offense they will be denied issuance of new passport,” said Saret.

According to ATN officer Danilo Baldon, those who apply for renewal are required to pay the regular fee of $480 plus $200 for the affidavit; but those who declare their passports as lost will have to pay penalties, resulting to a fee of more than $1,000.
The record haul from OFC and the potential loss of job or other problems that could be faced by their holders prompted the Consulate to ask for permission from the DFA to process requests for replacements in Hong Kong.

At least two of the borrowers had already been sacked by their employers for pawning their passports with a lending company, according to Baldon. They were issued one-way travel documents so they could return to the Philippines.

Those who needed to renew their working visas were also issued travel documents pending the release of their new passports. ATN has been giving them letters attesting to the loss after Immigration officers reportedly demanded a police report from them before agreeing to process a new visa.
During a briefing with the OFC borrowers on Jun 23, Baldon emphasized that the borrowers were not going to be let off easily because their new passports will have the following restrictions:

1)      They will be valid only for 5 years, instead of the usual 10 years;

2)      The holder will not be able to get the cancelled passport back because it will be sent to the DFA which will put them on a watch list;

3)      Those found to have pawned their passports at least once previously will be issued a replacement just to allow them to continue with their work, but will not be allowed to process a new employment contract.

Baldon also advised the 30 or so OFC borrowers who managed to get their passports back from the police to surrender them either to the Consulate or the DFA as they are deemed cancelled.

Told that some of them managed to leave Hong Kong using the redeemed passports, Baldon said they should be advised that they can no longer use them again. “Huhulihin sila sa airport,” he warned.

The same practice was enforced with about two similar incidents in the past, when hundreds of passports were seized by the police from illegal money lenders in two separate incidents, one in Hung Hom, and another in North Point.
 
OFC was besieged by borrowers after the raid
The Police Public Relations Branch disclosed the number of seized passports from the raid on OFC in response to an emailed query from The SUN earlier this month.

The police also said a 35-year-old local man was arrested for “breach of money lenders license conditions” in an office on 206-210 Des Voeux Road Central.”

According to the police statement, an initial investigation revealed that the arrested man had offered loans totaling more than $4 million to more than 1,400 victims, who were asked to surrender their passports and employment contracts as collateral.

The police, however, did not respond to a query on why at least 30 of the passports were returned to the holders, instead of turning them over to the Consulate in line with the standard operational procedure.

The suspect, a man surnamed Wong, part owner of OFC and Cheers Holding Company Limited, was reportedly released on police bail and required to report back in mid-July.

The District Crime Squad of the Wan Chai Police Station is investigating the case.

The arrest was apparently over the failure of Wong to register the Sheung Wan address in the license issued to Cheers Holding. Its license shows addresses in Shamshuipo and Wanchai.

Cheer Holding also operates Cheers Employment Limited, with which it shares the  Wanchai address.

Cheers Employment recently had its accreditation with the Philippine Overseas Labor Office suspended after being found to have collected the passports and Hong Kong ID cards of its recruits from the Philippines, unless they paid certain fees.
