Migrants call for free dorms, resting place for FDWs amid pandemic

Migrants need free living space in-between jobs and during their days off, say activists

Foreign domestic workers must be given free accommodation in-between jobs, and also a venue where they can rest during their off days to protect them from the coronavirus spread.

This was the call of several migrant support groups during an online press conference held today, Dec 18, to mark International Migrant Workers Day.

Sringatin, chair of the Asian Migrants Coordinating Body, said Hong Kong’s decision to offer free testing for all FDWs in the wake of an outbreak in a boarding house in Tai Po, is not really meant to protect them.

“We are asking the government for free accommodation, but instead, it’s just giving us free tests,” said Sringatin.

The free tests being offered by the government started today and will last until end of January next year. Many FDWs posting comments online say they will not submit to the test, unless their employers insist.

Sringatin also said the migrant domestic workers (MDWs) need to be given a venue where they can rest on their days off so they don’t stay in cramped dormitories, or forced to gather in open areas where they can be fined for breaking social distancing rules.

She said the MDWs’ fight is not just against the virus, but against overwork and discrimination during the time of the pandemic.

Fifi Ng, a spokesperson for the Autonomous 8A Migrants Committee, also said Hong Kong should extend financial support for MDWs, as do other countries.

“The Hong Kong government is not giving any emergency financial support to MDWs if we compare to Japan and Korea, where financial support is given for those who have been there for some time,” Ng said.

This is the same call that all other support organizations like the Mission for Migrant Workers have been making since the coronavirus outbreak started in Hong Kong in late January.


Mission’s community relations officer Johannie Tong said the exclusion of MDWs from financial aid, as well as discriminatory policies by the government, such as telling them to stay at home on their days off, have made life more difficult for them during the pandemic.

“With long-standing issues of migrant domestic workers such as long-working hours, insufficient food and problematic accommodation and sleeping arrangements not being addressed nor relieved, migrant workers have been experiencing more difficult situations and more serious rights violation during this pandemic,” said a statement read out by Tong.

She said that for the past months since the coronavirus outbreak, the Mission has been asked for help by MDWs for various reasons.

More than 70 who were undergoing quarantine asked for food donations because they were provided very little sustenance by their employers or agencies. More than 100 others whose contracts were terminated or in-between jobs also sought food assistance.

From Dec 9 to 17 alone, she said 22 workers asked to be given shelter because they had difficulties paying for accommodations in-between jobs.

Worse, she said MDWs are being unfairly labeled as virus carriers whenever positive cases are reported among their community of more than 400,000 members.

Alleged DH predator in TKO said to be on the prowl again

'Gordon' is said to have lured several Filipinas into his trap over the years with fake job offers

A Hong Kong man who has allegedly been luring foreign domestic helpers into his flat in Tsueng Kwan O for a job interview, then talking or forcing them to bed, is said to be on the prowl again, with at least nine women claiming to be his latest victims.

The nine helpers who had responded to a recent job offer reportedly fell into the trap laid by the alleged predator, who uses various names, but employs the same modus. Victims say he has used the names Gordon, Martin, Achilles, Mr Poon, Yarra and Kenny, but has given the same telephone number to all of them.

The informants, who confided their predicament to the Facebook group Domestic Workers Corner, said they separately met the man in Tseung Kwan O’s shopping malls.

Others who had complained about him previously said he often hung out at the Hang Hau MTR station to look for prey.

The glib-tongued, short but chubby fellow who has reportedly been targeting domestic workers for years, was reportedly able to convince them to go for an interview and an ocular inspection of his flat.

They said he sometimes advertised his supposed need for a domestic helper to look after his two children. In at least one offer he made last year, the salary was $5,500. For part-timers, he offered $300 per hour just for babysitting.

Once inside the flat, he would then tell them his intention is to find a girlfriend. Unfortunately, some of the women fell for the suspected predator’s sweet talk, got hooked up with him and ended up pregnant.

Others resisted but said they found the man too physically strong to fight off and ended being raped, they confided to friends and support groups.

But they did not have the courage to file a formal complaint with the police reportedly because of the scandal and stigma that came with coming out in the open.

PathFinders Limited, a nongovernmental group championing the rights of migrant domestic workers who had fallen prey to predatory men, brought up with police the sinister activity of the Hang Hau man in April, said its chief executive, Catherine Gurtin.

Gurtin said the NGO met with the Anti-Deception Coordination Centre of the Hong Kong Police about the alleged rape cases.

The authorities could not act as there were no witnesses as the alleged offenses took place in the confines of a private home, Gurtin said.

She said police could not build a case based on a "he said, she said" situation without any hard evidence to prove that rape indeed took place.

“It is very difficult to prove what we know about what he is doing,” Gurtin said about the alleged rape incidents. She said it would have been easier to pin down man had the offenses been financial, as there would be a paper trail that the police could follow.

In one case, the alleged victim said she loved the man and believed he loved her, too. He sired a child who he did not acknowledge as his, so, PathFinders found it difficult to file for child support. Both mother and child are now in the Philippines, Gurtin said.

The Consulate said it was approached by three alleged victims of the man several months ago, but the women have not returned since, according to Consul Paulo Saret, head of the assistance to nationals section.

The women had told him they had reported to the police before they came to see him and he said it was the right thing to do.

But Saret admitted that, as the women were alleging a private crime, it would be their word against the suspect’s word, and it would be difficult for the police to build a case.

“What we can only do so far is to warn our women to avoid men who invite them to their homes because when a man and a woman are together, anything is possible,” he said.

He said that, in fact, before he was posted in Hong Kong, the ATN had already issued a warning about the same man and his modus but the police could not grab him because the police reportedly said the women had agreed to go with him to his house.

Many Filipinas living in Tseung Kwan O district who are very familiar with the alleged predator have warned their friends and fellow migrant workers to beware of him.

They commented on a DWC post carrying his photos and screenshots of his messages that he would approach Filipinas in the malls, saying he had businesses in Cebu. His yarn was, he was in need of a helper, as the current one had finished her contract.

Hala! Na-meet ko yan one time sa escalator, nasundan nya ako tapos sabi uuwi daw helper nya, medyo nasa 30-plus pa edad nya, medyo chubby,” said one helper.

(Whoa! I met him one time on the escalator. He followed me, then said that his helper was about to go home. He’s in his 30s, a bit chubby.)

Naibigay ko ang number ko sa kanya, ire-refer ko sana ang kaibigan kong nasa Pinas, kaso nanligaw at nagmamayabang pa na madami daw siyang business. Sabi ko, ‘Well, good luck sa business mo,’ tapos block ko na siya sa aking phone,” she said.

(I gave him my number as I wanted to refer a friend who was in the Philippines. But he started courting me, and bragged that he had a lot of businesses. So I said, good luck with your businesses, then blocked him on my phone).

One suggested that whoever encounters that guy should take his photo so they could see if he is one and the same man and find out why he was preying only on Filipinas.

However, another commenter said the alleged culprit was also preying on Indonesian women.

Another helper said she had encountered the suspect twice in Tseung Kwan O and she was able to warn a would-be target of his evil deeds before they could meet up.

Free Covid-19 tests offered to FDHs as no new case linked to boarding house cluster

Bethune House has made all its clients take two Covid-19 tests so far

Hong Kong health officials have announced that free coronavirus tests will be offered to all foreign domestic helpers from this Friday, Dec 18, until the end of January.

The move was announced today, Dec 16, even though no new cases were detected from a Tai Po boarding house for FDHS, where a total of 12 infections were linked the past two days.

Eight of the patients from the cluster are FDHs (seven Filipinas and one Indonesian) while four are an employer’s family members.

The announcement was welcomed by Filipino community members who either run or stay in boarding houses, saying they had been encouraging everyone who lives with them to get tested to ensure they all remain safe.

Edwina Antonio, who runs the Bethune House Migrant Women's Refuge which has a shelter in Sheung Wan and Jordan, said all their clients have had two Covid-19 tests so far. 

She said everyone would be asked to get tested anew because all of them go out on Sundays.

As a further precaution, everyone who goes out has to take a shower as soon as they arrive in the shelter, and are prevented from going near the beds until they have done so.

Since the third outbreak of infections in early July, Bethune House has also stopped taking in new clients, referring those who seek shelter to other boarding houses.

"Binibigyan naman namin sila ng masks at sanitizers, parang nakatira din sila sa BH," said Antonio. "Kung ano ang benefits ng nasa BH ganoon din yung nasa dormitories o hostels. (We also give them masks and sanitizers, as if they were also staying in BH. Whatever benefits BH clients get, this is also given to those in the dormitories or hostels).

Baby Jean de Leon, who just moved in with a new employer after staying in a boarding house in Sheung Wan for months, said all the boarders there are told to maintain cleanliness and practice hygiene at all times.

All of them also submitted themselves to the free Covid-19 tests twice in the past, she said.

Chuang says FDHs with symptoms should not take the free test but seek medical help immediately

Dr Chuang Shuk-kwan from the Centre for Health Protection made the announcement at today’s press briefing on the coronavirus situation, where she reported 82 new cases, all but three of them locally acquired. More than 80 preliminary positive cases were also detected.

Chuang said any one of the nearly 400,000 FDHs in the city can take the free test, unless they have symptoms, in which case they should go straight to a doctor.

“If any of the foreign domestic helpers have any symptoms, they should seek medical advice as soon as possible. This scheme is for the asymptomatic ones or those who foresee they have risks or they went out during weekends and had some gatherings, they are especially called for testing,” she said.

She dismissed suggestions of FDHs gathering in large numbers for the free tests, especially on Sundays when they have their day off, saying online registration is required before anyone can be tested in a community testing centre.

FDHs may also ask for a specimen collection kit from designated MTR stations or from post offices, and return these with their saliva samples to the 47 general outpatient clinics of the Hospital Authority of 13 clinics of the Department of Health. Meanwhile, Dr Linda Yu from the Hospital Authority warned the public not to delay getting medical treatment if they experience any symptoms, citing the significant rise in the number of patients who are critically or seriously ill.

Yu said that of the 1,127 confirmed patients who are being treated in 22 public hospitals and the AsiaWorld-Expo treatment facility, 59 are in critical condition, 69 are seriously ill, and 999 are in stable condition.

She said of those admitted to hospital yesterday, four were in critical condition, and three were serious.

Usually, she said patients would experience only mild symptoms in the first week, but would deteriorate rapidly in the second week. Some were so sick on being admitted to hospital they had to be intubated.

“So we advise the public, if they feel unwell, they should get tested immediately,” Yu said.

Chuang also reported new infections in some public housing blocks.

Six cases were found in separate flats of Ming Lai House in Choi Wan Estate in Ngau Chi Wan so officials will inspect the building, Chuang said five of the infected units face the same direction and are located on different floors.

Three cases were also detected were also detected on the 32nd floor of Jat Min Chuen in Sha Tin. Residents at units 1-12- 14 and 16 on that floor will be quarantined.

One resident of Lung San House, Lung Poon Court in Wong Tai Sin tested positive. Sample bottles will be distributed to residents and compulsory testing notice will be issued this evening to all residents of Lung San House.

Chuang said it was too early to say that the peak of the fourth wave had been reached, as the number of new cases remain high. She called on everyone to remain vigilant.

“We have not seen the numbers going down. Whether it’s the peak or not... whether it will further increase depends on the coming situation, whether there are any abnormal events, abnormal gatherings or abnormal spread in the community. Any one event may result in large number of cases as happened previously,” she said..

The three imported cases reported today included two sea crew who each arrived from Ukraine  and Russia, and a returnee from Pakistan

PathFinders survey sees negative impact of longer MDW maternity leave

A new four-week increase in maternity leave for Hong Kong’s working women is likely to add to the dilemma and challenges employers face when their pregnant domestic worker goes on maternity leave, a nongovernmental organization says.

The Employment (Amendment) Ordinance 2020 that came into effect on Dec 11, increased the statutory maternity leave from 10 to 14 weeks.

Working mothers are likely to welcome the new law, but a public opinion survey conducted recently by PathFinders Limited showed apprehensions about migrant workers getting pregnant in Hong Kong continue.

The NGO said the survey results published on Dec 9 validate the need for practical solutions to ensure pregnant migrant domestic workers (MDWs) do not get fired illegally and left homeless instantly, making their children among the most vulnerable and unsupported in Hong Kong.

The survey results with 341 respondents show:

·       73.8% of the respondents believe MDWs should receive equal maternity leave

·       64.8% considered MDW pregnancy unacceptable

·       74.4% of the respondents thought a MDW should not live with their employer during maternity leave, and

·       Most respondents like hiring of a temporary helper when their worker goes on maternity leave.

“The survey confirms the long-standing dilemma for many in Hong Kong who rely heavily on the help and support of a MDW. While the majority believe, like all working women in Hong Kong, a pregnant MDW should be entitled to maternity protection, most consider an MDW pregnancy unacceptable,” Catherine Gurtin, chief executive of PathFinders, said in a review of the survey results.

Gurtin said 50.4% of the respondents dislike the idea of their helper getting pregnant because of the inconvenience it causes the employer and their household.

“Adding to the complexity, MDWs are not legally allowed to live out and yet employers are not obligated to provide accommodation for the worker’s newborn baby,” she said.

Three quarters of the respondents did not find it feasible for MDWs to live with their employers while on maternity leave due to limited living space, Gurtin said.

Since its founding 12 years ago, PathFinders has all too often witnessed pregnant MDWs being illegally fired or pressured to resign because the worker and employer simply didn’t know what else to do, Gurtin said.

This led to many migrant mothers and children becoming unsupported and extremely vulnerable, and in need of PathFinders’ assistance, she said.

Gurtin said most respondents indicated the most desirable option to help employers overcome challenges would be to hire a temporary helper while their MDW is on maternity leave.

However, this potential solution would require changes to the existing MDW visa policy and contractual terms before it could become a reality, Gurtin said.

Labour Department guidance confirms all employers, including employers of MDWs, may apply to the government for reimbursement of the extra four weeks of maternity leave pay. The scheme will be implemented in the first half of 2021 .

“While a welcome development for employers, PathFinders fears it will do little to mitigate the ongoing risk of a pregnant MDW being dismissed from employment,” Gurtin said.

“For many employers, the financial stress of the remaining 10 weeks of maternity leave payments and expensive temporary support solutions, now for 14 weeks, will continue to be a very real concern – especially for those from lower-income households with limited alternative care options for young children and/or elderly parents,” she said.

“Recognising the ongoing challenges and need for solutions, PathFinders will continue to engage different stakeholders, including employers of MDWs and members of the public, to discuss possible win-win solutions via an online forum in 2021,” Gurtin added.

She said PathFinders plans to consolidate, present and discuss these solutions with all concerned stakeholders, including the Hong Kong government. She urged the public to submit their views and recommendations to info@pathfinders.org.hk.

Online court hearings now allowed in Phl, says lawyer

Relief from spousal abuse under VAWC Law are among those that can now be filed from abroad 

 If you’re an overseas Filipino worker who has long planned to file a case in the Philippines, including a petition for a declaration of nullity of your marriage, you now have the chance to do it without having to go home.

This was disclosed by lawyer June Ambrosio, a legal consultant of the Department of Social Welfare and Development and vice president of UP Women Lawyers’ Circle (Wiloci) during The SUN Interviews which aired via Facebook Live on Dec. 9. (Link is here: /sunwebhk/videos/3476704765778572/

Ambrosio cited a recent case of a Filipina in France who sought her help in filing a case for nullity of her marriage. After being sent a declaration form, the applicant had it verified at the Philippine Embassy in Paris, along with a “certificate of non-forum shopping,” then forwarded the same back to the lawyer.

The case is now ongoing, says Ambrosio, and her client has been allowed to testify from France during the hearing held in Manila.

”We are doing online hearings now, although there are still some judges who are very traditional, and still insist on face-to-face interaction.”

She suggested overseas Filipino workers lobby for a more widespread use of online hearings so the Supreme Court can be forced to improve on the current practice.

Shiela Bonifacio, chair of Gabriela Hong Kong, said that this was a welcome development, since most OFWs are being held back by the requirement for personal appearance if they wanted to pursue a case in the Philippines.

The cases are not just for a declaration of the nullity (or annulment, in cases where the marriage was void from the beginning), but also on matters relating to child custody and support, which often fall under the Anti-Violence Against Women and Children Act (VAWC), or RA 9262, which was the focus of the interview.

Ambrosio says the law punishes “any act or a series of acts committed by any person against a woman who is his wife, former wife, or against a woman with whom the person has or had a sexual or dating relationship, or with whom he has a common child, or against her child whether legitimate or illegitimate.”

Such act may happen inside or outside the family abode, “which result in or is likely to result in physical, sexual, psychological harm or suffering, or economic abuse including threats of such acts, battery, assault, coercion, harassment or arbitrary deprivation of liberty.”

For immediate relief, the woman could apply for  a temporary protection order against her aggressor with the barangay nearest her, says Ambrosio. But she should file a case in court if she wants the protection order to become permanent.

According to Ambrosio, the law protects only the woman and her children, and not the husband or partner, “kasi wala pa tayong kaso ng battered husband.” (We don’t have any case of a battered husband).

She suggested that men who think they must have the same kind of protection should look for people who would be willing to support their quest in the form of legislation.

Some of the examples Ambrosio cited as falling under the protection of the VAWC law is when the woman is subjected to sexual violence such as rape (which could also happen between married couples), psychological or mental abuse such as when the man commits infidelity, harasses his partner, or blackmails her with threats of posting their sexually explicit photos together.

Also actionable are cases of economic abuse, such as when the husband or partner of the woman refuses to provide financial support to her or their children.

Apart from the woman, also protected under the law are her minor children, or those who, even after attaining the age of majority, are unable to take care of themselves.

As for custody, Ambrosio said the mother gets sole custody for legitimate children who are under seven years old, and for all illegitimate children, no matter how old they may be.

If the legitimate child is above 7 years old, the court decides who gets the custody, often consulting the child himself or herself.

Bonifacio said it was good to know about the laws that protect women who are in an abusive situation. It thus devolves upon the women to speak out and fight for their eights.

This become more urgent if the woman has a child, Bonifacio said, because “hindi lang ikaw ang mapapahamak kundi pati anak mo.” (you won’t be the only one who will be put in harm’s way, but also your child).

Ambrosio said there are many venues for women who want to seek redress if they are in abusive situations.

For those seeking protection under VAWC, they can go to the barangays or a police station, each of which has a women and child desk. They can also go directly to the National Bureau of Investigation, which has a VAWC division, and a separate one for victims of cybercrimes and human trafficking.

Victims may also go to the Department of Social Welfare and Development, which has social workers deployed in various local government units under the supervision of the Department of Interior and Local Government.

The other groups that can help are the Philippine Attorney’s Office (PAO) which is specially mandated to assist VAWC victims; the Integrated Bar of the Philippines, whose various chapters all over the country offer free legal aid; the UP Women’s Lawyer’s Circle, the Women Crisis Centre at East Avenue Hospital, the women’s section at the Philippine General Hospital, and various groups that offer counseling like Gabriela, Ateneo de Manila University and Commission on Human Rights.

The interview was held during the 18-day national campaign to end violence against women and children, which lasted from Nov 25 to Dec 12.
