HK keeps $4,630 minimum wage for FDHs

FDHs' minimum salary will remain at $4,630

The Hong Kong government announced today, Sept 30, that the minimum allowable wage for foreign domestic helpers will remain at $4,630 a month. It's the second consecutive year that FDH wages have been frozen at this level.

The minimum food allowance will rise by a nominal $52 dollars, to $1,173 per month. This only applies, as before, to employers who do not provide their helpers with free food.

The new food allowance will apply to all FDH contracts signed on or after tomorrow, Oct 1.

The announcement is likely to be met with disappointment by migrant worker support groups which have called for a monthly salary of $6,014 a month, and the food allowance to go up to $2,600 a month.

Employers, on the other hand, have urged for the current minimum salary to be reduced from between 10 to 20%, citing the rising cost of hiring FDHs from abroad.

In the years before the pandemic, the government would normally grant FDHs a raise of about $100 each time.

In explaining its decision to retain the minimum wage, the government said that it reviews the MAW regularly based on market forces. This year, it included the effects of the pandemic, and the ability of employers to pay the mandated salary for domestic helpers.

"In accordance with the established practice, we have carefully considered Hong Kong's general economic and labour market conditions over the past year, as well as Hong Kong's near-term economic outlook, including the impact of the Covid-19 pandemic in this year's review. Taking into account the above, the affordability of employers and the livelihood of FDHs, the Government has decided that the MAW level for FDHs should remain unchanged."

Overseas voter registration extended until Oct 14

The lucky ones who finally got into the Consulate's public hall after queuing for hours

The Philippines’ Commission on Elections has allowed overseas voter registration to be extended until Oct. 14, while nationwide, the registration will resume on Oct 11 and last until Oct 30, except during the weekend.

The last-minute reprieve came as hundreds of Filipinos continued to pour into the Consulate offices at United Centre in Admiralty today, Sept 29, which should have been the penultimate day for registering to vote in next year’s presidential election.

The original deadline for voter registration in the country and in all overseas posts was Sept. 30.

People who had lined up for as long as five hours today to get to the final stage of filling out forms in the public area of the Consulate all said there should be an extension, as many Filipino workers who have yet to register can only take a day off on Sunday.

On Sept 26, which should have been the last Sunday for OVR under the old schedule, more than 900, or twice people had queued up way past midnight just to beat the deadline.

There should have been more, but stressed-out Consulate officers and staff set a cut-off time of 4pm for those already inside the United Centre building. Despite this, the list-up continued until the wee hours, to accommodate all those who were already inside the Consulate.

Consul General Raly Tejada said the voters’ determination to stay put until they could register had inspired OVR lead, Consul Robert Quintin, and other Consulate staff, to keep working.

(When I asked them if they found the work difficult, Consul Bob said it’s just OK because actually, he and the rest of the OV team were inspired by the determination of our fellow Filipinos to get themselves registered).

With the extension, Filipinos overseas will now have two more Sundays to register during the Consulate’s office hours, which are 9am to 4pm. As before, those who meet the cut-off time will all be registered, no matter how long it takes.

If the old schedule is followed during the extended period, Saturday registration will likewise continue, even if the Consulate is closed for other services on this day.

This means, the Consulate will remain open for registration from Saturday until Thursday for the next two weeks, except on Fridays. However, Oct 14 is a public holiday, which means the Consulate should be closed as well.

Meanwhile, Consul Quintin is asking those who have registered previously to check if their names are not in the de-activated list of voters which can be found on the Consulate’s Facebook page.

He said about 16,000 names had been stricken off the list of voters, either for failing to vote in two consecutive elections, or for having a double registration.

As far as he knew, only a few people who were included in this list had showed up to apply for reactivation of their registration, he said.

Quintin said that the certified list of overseas voters (CLOV) could also be checked, but it is not an accurate record of those who could vote in the 2022 election because it was compiled before the last national election in 2019.

“After the 2019 election, the deactivated list was drawn up, so it should be a better reference for those who are in doubt about the status of their registration,” said Quintin. “If they have been omitted by mistake, we will rectify the error.”

But at the same time, he said those who had registered previously should check both records first before queuing up for hours just to find out if they are still in the voters’ list in Hong Kong.

Comelec’s decision to extend voter registration was unanimously approved during an en banc meeting this morning.

"Extension is from October 11 to 30; Monday-Friday, no Saturdays, except for the last day (October 30), 8 am to 5 pm. All registration services offered," Comelec spokesperson James Jimenez said after the meeting.

The poll body said no voter registration will be conducted from Oct 1 to 10 so that election personnel could concentrate on attending to the filing of certificates of candidacy (COC).

There are 2 more Sundays left for OVR after the extension

Since the filing of COCs is not an issue for overseas voting, the extension of voter registration abroad could start immediately.

Comelec hedged until the last minute on extending voter registration, saying it could allow only a one-week extension at most, citing a tight deadline for its administrative preparations which are dependent on the final number of voters.

But it was forced to give in after legislators in both the House of Representatives and the Senate fast-tracked a bill that allows the extension, and would have submitted it to President Rodrigo Duterte for approval by tomorrow.

For good measure, senators deferred action on Comelec’s proposed 2022 budget, forcing the electoral body to capitulate.

Indon DH cleared of working illegally in employer’s restaurant

An Indonesian female domestic helper walked free from Shatin Court yesterday, Sept 28, after the magistrate ordered the case of illegal work against her dropped due to a lack of evidence.

At the start of the two-day trial on Monday, Sept 27, the prosecution told Magistrate Wong Heung-yung that the defendant, Nurul, and another Indonesian woman were arrested on Feb 28 when Immigration officers raided her employer’s restaurant.

Nurul was charged with working illegally in the restaurant, in violation of the terms of her employment contract that forbids her from working other than as a domestic helper.

Her co-accused, who was not identified, was charged with using a forged Hong Kong ID card of a permanent resident. She pleaded guilty and was sentenced to 13 months in jail.

Nurul, however, denied the charge against her earlier this year, prompting the court to set a trial.

The court heard that the ground-floor space the restaurant occupied was part of the unit where the owner and his household lived. The family and the business shared the kitchen. To get into the house, one has to pass through the restaurant and kitchen.

But when the defense lawyer asked her to point to the women in the photos who the defendant was, the witness could not identify her with certainty. 

The defense counsel from the Duty Lawyer Service said that his client prepared food for the family in the shared kitchen and played in the restaurant with the employer’s children because it was air-conditioned.

The lawyer then showed the officer photos of three adjacent doors in the kitchen, one of which connected to the employer’s house. When he asked which door the women emerged from and exited when they allegedly worked in the eatery, the witness could not tell, either.

On the second day of the trial yesterday, Wong ordered the prosecution to withdraw the charge against Nurul for lack of evidence.

Nurul was accompanied to court by Esther Bangcawayan, case officer for the Mission for Migrant Workers, which has been assisting the worker in her case. Bangcawayan said Nurul still has a pending labour claim against her employer.

2 Filipina DHs in Penny’s Bay among 5 new Covid-19 cases

The 2 Filipinas moved to Penny's Bay after arriving via Cebu Pacific a day apart

Two Filipina domestic helpers who were quarantined in Penny’s Bay and had both flown in via Cebu Pacific flight 5J272 are among five new Covid-19 infections reported in Hong Kong today, Sept 29.

The three others are also women – two came from Jordan via Doha, and the other, from Japan.

All are asymptomatic and fully vaccinated. The first four patients were found to carry the L452R mutant strain, while the traveler from Japan tested positive for N501Y.

The two women from Jordan both took QR 818 on Sept 27, the day before the flight was suspended from flying into Hong Kong for two weeks. That was due to six of its passengers testing positive for a coronavirus variant on Sept 26.

Another airline, Turkish Air, was banned from flying to Hong Kong for two weeks starting today after one of its passengers who came on Sept 26 also tested positive on his arrival test, while two others failed to comply with anti-epidemic regulations.

The two Filipinas came on two different days, but took the same flight. One is 35 years old, and flew in on Sept 24 via 5J272. She received two doses of Sinovac in the Philippine on Jun 28 and Jul 30.

The other Filipina is aged 37, and came on Sept 23 via the same flight from Manila. She also received the Sinovac vaccine in the Philippines on Jul 25 and Aug 22.

The two women from Jordan are aged 23 and 24, and they both had BioNTech jabs in Hong Kong beween July and August. They also tested positive for antibodies on Sept 1 and 4, respectively. Both were found infected on their arrival tests.

The 24-year-old traveler from Japan came via CX521 on Sept 25 and tested positive on her third day of quarantine at Regal Oriental Hotel in Kowloon. She had two doses of the Moderna vaccine in Japan on Jun 22 and Jul 23.

The new cases took Hong Kong’s total Covid-19 tally to 12,214. Fewer than five preliminary positive cases have been detected.

The suspected re-positive patient moved to Island Place after ending his quarantine

Earlier, an overnight lockdown of Two Island Place in North Point where a suspected re-positive patient from India had stayed after his release from quarantine yielded no new cases.

A statement from the government said the compulsory testing of residents of the place ended at 9:30am today, after 400 residents were tested and checked for compliance. No one was found to have violated the order.

He finished his quarantine on Sept 26 and went home to Island Place. The next day, he had himself tested again in line with government regulations, and he was found positive, but with a low viral load.

The patient who remains asymptomatic, said he tested positive for Covid-19 in India in April this year.
