Filipino who ignored order to pay $5k fixed penalty told to pay double

A Filipino man who ignored an order to pay a $5k fixed penalty for an illegal gathering on the second floor of Fai Man Building on Li Yuen Street West in March last year was today, Jan. 28,  ordered to pay double the amount, plus costs.

J.P. Castro, 35, was told to pay a total fine of $10,000 plus $300 costs when he appeared in Eastern Magistracy today.

He was charged with taking part in an illegal gathering which happened on Mar 12, 2021. 

Under section 4(2) in part 2 of Schedule 2 of Cap.599G that was in force at the time, the gathering of more than four people in public or in scheduled premises was prohibited.

He was served notice dated May 4, 2021 to pay a $5,000 fixed penalty for the violation, but he failed to comply with the order, or served notice that he wished to dispute liability.

As a result, an order was issued in the name of the Secretary of Justice for Castro to pay, aside from the fixed penalty, an additional penalty equal to the amount of the fixed penalty, and costs.

On Oct 5, 2021 the court ordered Castro to pay a total of $10,300 within 14 days, or face arrest.

As he again failed to comply with the order, Castro was ordered arrested, but was subsequently allowed to post bail.

During today’s proceedings when he finally appeared, the $10,300 was ordered deducted from his bail money, with the balance being returned to him.

Filipina jailed for 3 months after 4th theft conviction

A 38-year-old Filipina permanent resident with a string of criminal convictions was sentenced to three months in jail on Thursday for stealing 17 packs of chocolates and a bottle each of shampoo and conditioner from a Wellcome Supermarket in Central.

But Gladys de Vera, a single mother with a history of drug dependence, was acquitted after trial in Eastern Court of another count of theft that allegedly happened a few hours before she was caught red-handed on Jun 22 last year.

The stolen items amounting to $1,095 in total were found in an blue eco bag that she was carrying when she left the supermarket located in the basement of Regent Centre in Central.

In the morning of that day, the manager of the shop called Mr So told the court he noticed that a lot of chocolate packs were missing from the shelves. The CCTV footage taken from the shop showed a woman had taken them after lingering just outside the store

So told the staff to watch out for the woman, and at 2:30pm of the same day the assistant manager, Mr Ho, saw someone resembling her enter the store.

Ho said he saw the woman take chocolates and some shampoo and conditioner, and put them in her trolley. She left without paying for the items.

When stopped just outside the store, the defendant was speaking on the phone, and said she had had been distracted by the phone call that she forgot to pay for the goods. She offered to pay for them but the staff called the police and she was arrested.

For the first charge, the prosecution said 29 packs of chocolates were stolen as well as shampoo and conditioner. It was also alleged that the woman shown on CCTV that morning was the defendant.

De Vera pleaded not guilty to both theft charges, saying there was no evidence that it was she who took the goods in the first count. She did not dispute the CCTV footage of her taking items from the shelves in the second count, but claimed she had not intended to steal them.

In his verdict, Magistrate Gary Chu ruled that in the first count there was doubt as to the identity of the woman in the CCTV as it did not show her face, nor of how much was taken from the shelves. The CCTV also showed the woman taking away some hair gel, but there was no allegation about this against the defendant.

Thus, he ruled that the prosecution had failed to prove beyond reasonable doubt that De Vera was the one who committed the alleged theft in count number one.

But for the second charge, the defendant was said to have been caught red-handed, with two staff at the store testifying that they saw her take the items which were found in her bag after she left without paying.

Magistrate Chu said he found the two witnesses honest and reliable, and were not shaken during cross-examination. He convicted the defendant based on their testimonies and the other evidence.

In mitigation, the defense lawyer asked for a lenient sentence for De Vera, saying her drug dependence was what made her steal.

De Vera was said to have 10 previous convictions. Three of them were for theft, while the rest were all drug-related, except for the most recent one, where she was fined $500 in Kowloon City Court for unlawful gathering.

According to the defense lawyer, De Vera used to work as a bartender and was earning between $16,000 and $17,000 a month.

“She worked in bars, maybe that was where she came into contact with drugs,” said the defense lawyer, who called De Vera a “victim” because of her drug dependence.

Recently, the defendant reportedly finished four months in a drug detention facility, and is now said to be drug-free. Her lawyer asked the magistrate to consider that she was in some sort of detention recently in coming up with the appropriate sentence.

He also told the court that De Vera’s 17-year-old son had recently figured in a motorcycle accident in the Philippines, and the defendant wanted to be able to go home soon to be with him.

Magistrate Chu said that for repeat offenders a prison sentence was inevitable. He also said that judging from the quantity of goods that was stolen it was obvious that the defendant had intended to sell them.

He said the sentence of three months is prescribed for cases of thefts where the amount involved is $100 or more.

“Having regard to all the circumstances I will impose three months’ imprisonment,” he said.

HK reports 164 new Covid-19 cases, highest on record

Hong Kong health authorities have reported a record number of 164 new Covid-19 cases today, Jan. 27.

This is the highest number reported since the pandemic swept across the city two years ago, and beats the previous record set in July last year, when 149 cases were reported.

Dr Edwin Tsui, controller of the Centre for Health Protection said the infection rate in the community is getting higher by the day. “Our assessment is the risk of transmission is extremely high,” he said, pointing out to about 30 cases whose sources remain unknown.

"Despite our tracing effort, more than 30 cases are still untraceable. It shows that in the community there are still scores of silent transmissions so the risk is still very high."

Dr Tsui appealed to the public to avoid large gatherings, including those among family members belonging to different households. “During the Chinese New Year, please avoid cross-family gatherings,” he said.

According to CHP’s Dr Chuang Shuk-kwan, the new cases include 116 which were locally acquired, 12 of which are unlinked.

The 48 others are all imported, including the 40 preliminary cases reported yesterday, which were all new arrivals from Kathmandu and Dubai.

At the time of the press briefing, about 100 preliminary positive cases had been reported, but “they are still coming in,” said Dr Chuang.

The unlinked cases, which have always been a cause for concern among experts as they suggest hidden transmission chains, were found across several districts, mainly in Kowloon and New Territories.

Dr Chuang said the patients come from various sectors, including students, domestic helpers, parttime staff and retirees.

In an overview, Dr Tsui said the surge in cases which occurred on Jan 23 involves two major transmissions, the Omicron spread which started from the Silka Seaview Hotel and spread to Kwai Chung estate; and the Delta cluster first detected among hamsters.

He said the number of cases reported from the Kwai Chung housing blocks has dropped considerably, from the 76 reported on Jan 22 to single digits today.

“We believe we are at the end of the transmission period, especially for Yat Kwai House,” he said.

For Yat Kwai House, he said a total of 251 residents have tested positive so far, but only six new cases were found overnight.

For Ying Kwai House, a total of 81 residents have been infected, but only three new cases were reported overnight.

The other affected blocks are:

-  Nga Kwai House, 9 total, 3 tested positive overnight;

-  Hiu Kwai House - 4 total, 1 new case overnight

-  Chun Kwai House - 4 total, 1 new case overnight

-  Chau Kwai House - 1 previous, 1 more overnight

But giving a cause for concern is the Delta spread at Cheung Bor House in Choi Hung, which has been locked down for another day after authorities found more residents there who have infected.

The building was placed under lockdown Wednesday night after a security guard and two residents tested positive for the coronavirus. Earlier today, the authorities announced that the lockdown will be extended until Friday morning because of the high risk of infection within the building.

Tsui today said 18 more cases were detected from the residential block yesterday, and authorities suspect both vertical and horizontal transmission has occurred. He said 62 flats in the building were being evacuated as they spoke.

Also among the speakers at the press briefing was Dr. Samuel Chui of the Environmental Protection Department. He said the EPD has been monitoring the sewage of over 5 million people in Hong Kong for Covid-19 since 2020.

The waste water samples are tested for both Omicron and Delta, and because of this, the invisible transmission of the Delta variant in Aberdeen and Wong Tai Sin have been detected.

Meanwhile, Dr Sara Ho of the Hospital Authority said 32 patients have been discharged from various hospitals since yesterday.

A total of 662 patients remain hospitalized in North Lantau Hospital Infection Control Centre, the HA Infectious Disease Centre, the Asia World Expo and 12 public hospitals. All are stable.

Quarantine shortened to 14 days but flight ban on 8 countries stay

CE Lam says the decision to cut the quarantine period is based on science

In a major policy shift, the Hong Kong government has announced that its 21-day quarantine for arriving travelers from abroad will be cut to 14 days starting on Feb 5 but they must remain under medical observation for seven more days.

The change was announced by Chief Executive Carrie Lam in an unannounced press conference late this afternoon, Jan. 27.

CE Lam said the decision to cut the quarantine period is “not because of pressure from anyone but because of science.”

She said according to government experts, the incubation period for the Omicron variant which is fueling a surge in Covid-19 is between four to five days, “so it will look very illogical for us to continue putting new arrivals on 21-day quarantine.”

Currently, Hong Kong residents returning from 147 countries are required to undergo 21 days of quarantine at designated hotels. A handful of countries are categorized as medium risk, for which the required quarantine period is 14 days. 

Under the new guidelines, all overseas countries will now be classified under Group A. Thus, no non-resident will be allowed to board a flight for Hong Kong, and they must be fully vaccinated and hold a recognized vaccination record.

The CE also said that flights from eight major countries including the Philippines will be extended for another two weeks to Feb. 18. Also included in the ban are Australia, Canada, France, India, Pakistan, Britain and the United States.

The CE also said that because of large-scale outbreaks in the community, the government could not relax, even fine-tune social distancing measures.

The Centre for Health Protection earlier reported a record 164 new Covid-19 infections, 116 of them local, including 12 with unknown sources.

Thus, all restrictions including the no dine-in at restaurants after 6pm and the closure of most entertainment venues will be extended for two weeks or until Feb 17. Face-to-face classes will remain suspended until Feb 21.

Mrs Lam also said that the listed premises under Cap599F will be expanded from Feb 24, so more venues will be included in the “vaccine bubble” which will allow entry only to vaccinated people.

But she assured those who are not fully vaccinated will be given ample time to comply with the requirement under the vaccine bubble arrangement.

“There are many invisible transmissions in the community and we have raced to cut down these links,” she said. “That’s why we have resorted to quick and tough measures.”

Asked if her decision to shorten quarantine was due to pressure from the business community, she said, “Of course not, because they want seven days or no quarantine.”

For Hong Kong, she said this is dangerous because of the low vaccination rate among elderly people. In care homes for the elderly and the disabled, she said the vaccination rate is just 30%.

She again appealed to the elderly to get vaccinated, saying she did not want to put them at risk by further relaxing social distancing measures.

Mrs Lam also pointed out that the reason all 600 plus Covid-19 patients who are in hospital are in stable condition is because almost all are fully vaccinated.

During the upcoming Lunar New Year, she said the government will make a general mobilisation to get as many people tested for Covid-19 as possible.

She called on retired civil servants to help in the effort to increase the daily testing capacity, which she hope to raise to 100,000 or more within one to two weeks.

Earlier, Health Secretary Sophia Chan hinted at the shortened quarantine period during a TV interview, saying that Omicron’s short incubation period was being reviewed.

Apart from the shortened quarantine, she said that if Penny’s Bay Quarantine Centre got filled up, home quarantine for close contacts could be considered, However, there should first be a risk assessment of each case, and support operations such as food supplies must be worked out.

2 more hotels designated for FDH quarantine

Two more hotels have been named as designated quarantine facilities (DQFs) for  incoming foreign domestic helpers (FDHs)  who were not vaccinated in Hong Kong, the Labour Department (LD) announced today.

O'Hotel (www.ohotel.hk/en-hk) and iclub Ma Tau Wai Hotel (www.regalhotel.com/regal-hotels-international/en/promotions/DQF-foreign-domestic-helpers.html) will start accepting bookings through their websites from February 6 and March 1, at daily rates of $650 and $750, which include three meals a day.

Their 491 rooms will bring to 2,779 the number of rooms available for FDH quarantine. The other hotels that accept new FDHs are Courtyard by Marriott Hong Kong in Shatin, Regala SkyCity Hotel in Tung Chung, and Rambler Garden Hotel in Tsing Yi. 

Only FDHs who have confirmed bookings in a DQF will be allowed to board a flight for Hong Kong and enter Hong Kong upon arrival, it added.

Under the rules, payment will be refunded to the person who made the booking if an FDH tested positive for COVID-19 before arrival in Hong Kong, if the flight is cancelled by the airline, or a lockdown is ordered in the place of origin, provided that supporting documents are submitted in advance.

The Department also said more hotels may be designated as quarantine facilities for FDHs, depending on the need.

"The Government understands the need of local families for FDHs. However, the local epidemic situation is evolving rapidly, and the Government must vigilantly uphold the policy of guarding against importation of cases," said the announcement.

"The Government will consider whether more DQFs can be provided having regard to the global and local epidemic situation. The hotels will adjust the number of rooms open for reservation each day having regard to the overall booking situation."

The news, however, is of little use for FDHs from the Philippines which was included among eight countries from where passenger flights have been banned. The flight ban was initially set for Jan 8 to 21, but has since been extended twice. 

Today, in a press conference, Lam again extended the flight ban another two weeks, to Feb. 18.

Also still banned are passenger flights from Australia, Canada, France, India, Pakistan, Britain, and the United States.
