Consul Saret advises Filipino workers who get fired after getting Covid to see them if they want redress

All Filipinos, migrant workers or not, should consult the Philippine Consulate for remedies if they were fired from their jobs because of Covid-19 infection.

This was the advice given by Consul Paul Saret when informed that a Filipina who was terminated on the spot after contracting Covid last Feb 26 had agreed to settle her labour claim against her employer for $20,000 on May 31.

Hazel Garces had originally asked for $65,000 from her former employer Enoch Chen – for one month’s salary in lieu of notice, cost of air ticket and travel allowance, unpaid salary and pay for the unserved 13 months in their employment contract.

What she eventually received was less than what she would have been paid for the three months that she had to wait before her case was heard in court, but Garces she just wanted to put the whole incident behind her and go home.

Consul Saret said it was good that the Filipina had decided to pursue a case over her illegal dismissal but it would have been better if she explored additional options, like filing a complaint with the Equal Opportunities Commission for disability discrimination.

Under the Disability Discrimination Ordinance, persons with a disability such as an illness are protected against discrimination, harassment and vilification. As such, it is unlawful for an employer to dismiss a worker or treat him or her any less favorably because of this disability.

In two recent cases, the EOC itself has begun legal proceedings in the District Court against employers who were allegedly discriminated against after they contracted Covid-19.

In the first case reported on April 21, the worker involved had just been accepted to work in a new company when he was diagnosed with Covid-19. After being hospitalized for two weeks, he was told by the respondent company that his job had been filled up by somebody else.

In the second case reported on May 23, the claimant had just started working as a project manager when he contracted Covid-19 and was hospitalized. While still in hospital, he received a message via WhatsApp that he had been dismissed because of his infection.

In taking the two cases to court, the EOC said it hoped “to reinforce public awareness and remind employers that disability discrimination in the workplace is unlawful and it is important to refrain from taking unnecessary measures against people who have Covid-19 infection.”

The EOC further said that the actions are meant “to reiterate the fundamentality of principles against discrimination even in times of changing public health landscape posed by Covid-19.”

Even Hong Kong’s Labour Department did not mince words when it warned employers against terminating their foreign domestic workers who contract Covid.

As early as Feb. 24 or two days before Garces was fired by her employer as soon as she tested positive for Covid, Labour had already warned that dismissing a sick FDH violated both the Employment Ordinance (EO) and the Standard Employment Contract (SEC).

“Under the EO, an employer is prohibited from terminating the contract of employment of an employee on his/her paid sickness day, except in cases of summary dismissal due to the latter's serious misconduct,” the statement said.

“An employer who contravenes relevant provisions of the EO commits an offence and is liable to prosecution and, upon conviction, to a maximum fine of $100,000. Besides, if an employer has breached the EO, he/she will not be considered eligible to employ an FDH for a period of time and his/her visa applications for FDHs will be refused.

“Employers are also reminded of possible violation of the Disability Discrimination Ordinance (DDO) if they treat their FDHs less favorably (e.g. by dismissing them) because the FDHs have been infected with or recovered from COVID-19," it added.

This was followed by another statement issued on Mar 5, in which the Hong Kong government said it does not and will not tolerate the illegal dismissal of FDHs who catch Covid-19.

“The Government will stay vigilant in taking enforcement action against any violation of law in liaison and collaboration with the relevant consulates general,” the statement said.

Two days later, Labour Secretary Law Chi-kwong wrote in his blog that he had written to the Philippine Consulate to assure that the government would do its outmost to help sick FDHs who were either sacked, driven away from their boarding houses or left stranded after testing positive at the airport on their way home.

He also called on local employers to treat their helpers with kindness.

 “I hope everybody can treat others as they wish to be treated. Be kind to domestic workers, see them as families and go through this pandemic together,” he wrote.

Given all these, Saret said all Filipino migrant workers who get dismissed or are treated unfairly after contracting the virus should not be disheartened, and seek redress.

They can ask help, if not from the Consulate, from the HK Labour Department, EOC and non-government organizations which have all spoken out against such illegal acts.

If they choose to go to the Consulate first, Saret said the first stop should be the office of labour attaché, Mel Dizon.

"Naghihintay lang po sila na sumangguni kayo sa kanila para maghain ng reklamo laban sa mga employer na nag-terminate ng kanilang mga kasambahay dahil sa Covid," he said.

On its own, the Philippine Overseas Labor Office can put offending employers on a watchlist, meaning they would not be allowed to hire another Filipino domestic worker in future.

543 new Covid-19 cases reported, 204 of them from schools

A total of 204 Covid-19 cases were reported from 147 schools today, but health officials say they did not indicate any outbreak.

Speaking at the daily press briefing, Dr Chuang Shuk-kwan of the Centre for Health Protection said, "Each school may have one or two cases mostly, and a few of them have more than two or three cases, so this reflects the situation in the community. This may not reflect there is an outbreak in those schools.”

Still, the CHP ordered the partial suspension of classes in two schools that were hit by the infections.

At Kowloon Tong Funful English Primary School three classes have been suspended for a few days after a dozen students were stricken with the virus. Four of them had joined a basketball training on Friday, despite the holiday.

One class was also suspended at Fuk Wing Street Government Primary School in Sham Shui Po after four students tested positive for Covid.

A total of 543 new infections were reported for the day, of which 211 were confirmed via PCR test and the remaining 332 were self-declared positive results from rapid antigen tests.

An unusually high 86 imported cases were reported, including 42 that were detected on arrival at the airport and 39 during the seven-day hotel quarantine. The five others were found after the newly arrived travelers had finished their isolation.

They took the overall tally from the fifth wave of the infection to 1,215,696. No deaths were recorded for the day, so the tally in the same period remained at 9,173.

Of the RAT positive results reported on Friday, only 75 percent were confirmed in follow-up PCR tests. The remaining 25 percent of the cases either tested negative or the people involved refused to provide specimens for checks.

Chuang reiterated that if they suspect that people had deliberately provided false positive results they could be referred to the authorities for investigation and possible prosecution.

Those found guilty of the offence face up to $10,000 in fines and six months in jail.

Meanwhile the number of cases linked to two bars in Central has risen. An additional 15 infections were found among customers at LINQ bar, pushing the total tally to 93; while at Shuffle, 16 cases were added, driving up the total count to 85.

No new cases were reported for Zentral and Iron Fairies, the two other bars where outbreaks were discovered two weekends ago.

Chuang said their investigations showed the clusters of cases there were likely local infections.

Two more cases of Omicron sub-variant BA.2.12.1 were found, including a staff member of Café Crepe on Wellington Street in Central where a family linked to the cluster at McDonald’s in Cityplaza had eaten.

The second case is a family member of a previously identified case living in Taikoo Shing.

Dr Lau Ka-hin of the Hospital Authority said 367 patients are receiving treatment at public hospitals and medical facilities, including 20 who were newly admitted.

Among them, 11 are in critical condition, including six who are in intensive care, while seven are in serious condition.

A total of 50,146 have been discharged from the hospitals since the outbreak of the fifth wave early this year.

This is due to a trough of low pressure over southern China that will gradually edge closer to the coast of Guangdong on Monday, bringing unsettled weather to the region, including Hong Kong.

Thus, there is a “high” probability of significant rain over the next five days – or even longer depending on the development of the “Meiyu trough.”

The forecast for Monday is mainly cloudy with a few showers and thunderstorms. Showers will be more frequent later in the day and on Tuesday, when thunderstorms are also expected.

The outlook for the next couple of days is for unsettled weather with occasional heavy rains and squally thunderstorms.

The Observatory has advised everyone to check the weather forecast before going out to work or to school, and give enough time for travel as the situation could deteriorate at any time.

Covid cases rise to 515 as bar clusters continue to grow

Health authorities reported 515 new Covid-19 infections on Sunday, amid studies showing the reproductive rate of the coronavirus has risen in the wake of relaxed social distancing measures.

Dr Chuang Shuk-kwan of the Centre for Health Protection said that while the number of false positive results from rapid tests is still high, a study conducted by the University of Hong Kong showed an upward trend in infections.

"The proportion of RAT-positive cases is much higher than those tested positive by PCR, and we noted that at least a proportion of them have tested negative after we checked with their PCR [tests]. But all in all, even we added those who tested positive [through] PCR and RAT, we noted that the actual number seems to be increasing a bit over the few days," Chuang said.

The HKU study showed the reproductive rate of the virus on May 28 was 1.353 which was slightly higher than the 1 recorded on previous days.

But other indicators such as the number of hospital admission, severe cases and deaths, have not risen significantly so there is not much cause for worry.

Despite the assurance, four new Covid-related deaths were reported today, involving patients three men and a woman aged 68 to 98. The city's death tally now stands at 9,173.

The infection tally from the fifth wave, on the other hand, has risen to 1.202 million.

Chuang said that of those who reported positive results from rapid tests last Thursday, 44 or 14 percent, tested negative on confirmatory PCR tests. The cases will be deleted from the overall tally.

Among the new cases were 45 linked to four bars in Central.

Shuffle on Lan Kwai Fong recorded 27 additional cases, pushing up the tally there to 69 while LINQ on Pottinger added 13 more infections, for a total tally of 78.

Zentral on D’Aguilar Street where the first outbreak was reported, now has 37 total infections after two more were added; while Iron Fairies on Hollywood Road has a total of 56 cases after three more customers tested positive.

As for school clusters, Chuang reported another case being added to an outbreak at Holy Trinity College in Shek Kip Mei, raising the tally there to 10.

She also disclosed one new case of the Omicron BA.2.12.1 sub-variant involving a 38-year-old woman who lives at Kwun Tak Court in Kowloon City. The building has been under a compulsory testing notice.

Two of the woman’s family members were earlier found infected, but the source of their infection is still unknown. Initial inquiries showed the family had not gone out to eat during the incubation period.

Chuang said there may be hidden transmissions in Kowloon City.

Separately, the Hospital Authority said three doctors working at the intensive care unit in North District Hospital tested positive.

They are awaiting further testing, as they reported not having come into contact with any confirmed cases in the past 14 days.

Also, a nurse at Queen Mary Hospital's orthopaedics and trauma department has been infected, and one of the patients in the ward where she works also tested positive with a low viral load.

Hospital Authority’s Dr Gladys Kwan said that 349 patients are receiving treatment in various public hospitals and medical facilities.

Among them, 11 are in critical condition, five of whom are in intensive care; while six are in serious condition.

MFMW marks 41st year with plaudits for helping needy workers amid surge in Covid cases

The Mission's 41st anniversary celebration was held online via Zoom.


The Mission for Migrant Workers celebrated its 41st anniversary today, having been tested by a deluge of workers thrown out of jobs by the fifth wave of the Covid-19 pandemic.

In an online anniversary celebration via Zoom, speakers paid tribute to MFMW, and its partners, donors and volunteers for their efforts in serving the migrant workers in need.

“The Mission never left us during the pandemic while other service providers limited their services. You made Covid-19 protection paraphernalia and necessary information always available to us. Most importantly, you opened your shelters for infected migrant workers,” said Dolores Balladares, who spoke for the Asian Migrants Coordinating Body, which has member organizations from Indonesia, Nepal, the Philippines and Thailand.

“We are grateful for your counseling services as we face the difficulties with our employers. We thank you for the paralegal and legal assistance you have provided whenever and wherever we need you,” she added.

Explained the Mission's general manager, Cynthia Tellez: “Our service during the pandemic, especially during the fifth wave, tested the mettle of the MFMW. New crisis situations, new and effective responses to abandoned workers, stranded workers at the airport, support to those who were quarantined in dormitories and those who were still employed but were infected.”

She said they were faced with the problem of how to best serve when they were themselves infected.

“We were lucky to have set up quick response teams with our partners Bethune House, the Asia Pacific Mission for Migrants and the grassroots, that is, the Asian Migrants Coordinating Body. We coordinated with different coalitions of service providers, mobilized a pool of migrants whose employers were happy that they delivered food packs to their co-migrants in different areas up to 12 midnight. We were also lucky to have mobilized more than 50 non-migrant workers who drove their own cars to deliver care packs to several areas in their districts. Lest we forget, our donors in cash and in kind. And last, but not least, was our emergency response online that ran 24 hours non-stop,” she added.

Rocky, who was fired after Covid-19 cases soared in February, said in her testimony: “Masakit pong isipin kung saan kami mag-uumpisa ulit kasi nawalan kami ng trabaho. Pero dahil sa Mission nakita namin ang pagkakaroon ng second chance sa aming buhay. (It hurts to think where we could start again after losing our jobs. But because of the Mission, we saw a second chance in our lives.)”

 She added; “Kung hindi dahil sa kanila, hindi namin alam kung saan kami pupunta, kung ano ang gagawin namin. (If not for them, we wouldn’t know where we would go, what we would do.)”

Daniel Feldman, chairman of MFMW’s advisory board, said: “Although we successfully operated the MFMW for 41 years, the first half of 2022 overshadowed by the terrifying impact of Covid-19 has one more time proven the vulnerability of the society.”

But with generous donors, he added, the Mission was able to offer shelter, food, as well as financial and medical support for those in need.

He praised the staff and staff and volunteers: “Each and every one of you is adding tremendous amount of social work and it makes the society a better place in this world.”

Philip Wickery, a member of the MFMW board of directors, said: “The MFMW and the sister organizations and the people who come to work with us as volunteers, the people that we serve, the people at St. John’s Cathedral who host the MFMW -- all of you ought to be thanked but also congratulated that we can still continue and that we are still continuing with the commitment to serve migrants, something that we may have to do for a long time to come.”

He said that in MFMW’s fifth anniversary, “our dear director Cynthia (Tellez) said, ‘Well, I would like to say that we’ll be back here for the 10th anniversary but maybe the problem we are facing will be solved by then. And so we won’t have to have the MFMW.’

“Well,” Wickery added, “these 41 years have shown us that the problems have not been solved  and given the nature of our capitalist society, they are unlikely to be solved anywhere in the near future. So for that reason, the work of the MFMW will continue, maybe  another 41 years.”

Philippines-bound travelers warned not to pay for ‘One Health Pass’

Registering with the One Health Pass is a must for all travelers to the Philippines

 
“One Health Pass is free!” This was emphasized by Consul Paul Saret during a Facebook Live interview with The SUN on Wednesday, June 1, saying the Consulate had received reports that some travelers bound for the Philippines were being charged a fee to obtain the QR code needed to gain entry to the country.

His advice came just in time to save Nita, a Manila-bound overseas Filipino worker from paying USD75 through a site that first popped up when she searched for “One Health Pass” on google.

Luckily, after registering with the platform, Nita was stumped when she was told in an email that she needed to pay by credit card before she could get the QR code that she needed to board her flight.

The email read, “Additional steps are required to finalize your Philippines One Health Pass application. The final review and the payment only takes a moment to complete.”

The next page had the payment instruction, along with the reminder that the standard processing time for her application is between one to two business days.

The reminder made the Filipina panic even more as she was due to fly home tomorrow, June 5, and there was hardly a day left for her to register with the health declaration platform and obtain the all-important QR code so she could board her flight.

But after being repeatedly told by The SUN that the registration and the entry pass should be free, she finally managed to find the correct website and get the QR code without paying anything.

Consul Saret said the correct website is https://www.onehealthpass.com.ph. The online platform is directly linked to the Bureau of Quarantine website so it guarantees privacy to travelers registering their personal information, including their vaccination status and medical condition.

He said that despite widespread clamor for the online registration to be scrapped it remains a pre-condition for all those entering the Philippines from overseas, whether they be Filipino nationals or tourists.

He said the online form replaced the paper health declaration that used to be given to arriving passengers which they could complete at leisure on board the aircraft, or just before going through immigration at Philippine airports.

Registering their own details online saved health authorities in the Philippines the trouble of ensuring the information supplied by the travelers were accurate, as well as the time needed to encode all the written declarations from thousands of people who arrive in the country each day.

To safely ensure that they get to complete the registration process well ahead of their boarding time, Saret said travelers should log on and fill out the form at the earliest opportunity.

He said all travelers are given up to 72 hours or three days to register and obtain the QR code and print it for presentation at the boarding gates, so they should have enough time to complete the process.

Meanwhile, they should avoid going through any websites other than the official one so they are not charged any fee for doing what they could easily do on their own.

In Nita’s case, the website she entered was www.ph-entranceform.com, which purports to be a “professional travel agency that aims to help individuals and companies complete the necessary document requests for short-term stays.”

It does say that it charges a fee, but adds erroneously that an application can also be submitted “for a lower cost” through the government’s website, and even adds a link to the site.

Curiously, the site asks for exactly the same information that the government platform requires, begging the question of why a fee is being charged for a non-existent service.
