5 days’ hotel quarantine for inbound travelers likely, say reports

A 5+2 hotel and home quarantine scheme for new arrivals is being planned, reports say (FILE)

Various reports say the seven-day hotel quarantine required of all travelers arriving in Hong Kong from abroad will be eased, by cutting the hotel stay to five days, with the remaining two days being spent at home.

No names were mentioned in the reports, which did not mention a specific date when the new scheme will be implemented. They just said the government is in the process of doing preparatory works, including improving the speed and accuracy of PCR tests.

The reports are a bit of a step-back from statements made in a radio interview earlier by the incoming health secretary, Lo Chung-mau, who had indicated that the new government was considering cutting the hotel quarantine period to five days or less, but supplemented with home quarantine.

Lo also said in the interview that arriving passengers will be asked to specify their itinerary before boarding their flight to Hong Kong.

The Chief Executive-elect, John Lee, has also said he is keen to reopen borders to international travel and minimize the impact on inbound travelers by local anti-pandemic restrictions.

Meanwhile, health officials say a Covid outbreak at a restaurant in Mong Kok could be linked to a cluster of cases in Victoria Harbour Restaurant in Tuen Mun.

Two of those who dined at Jade Garden Restaurant in MOKO, Mong Kok on Jun 19 had also eaten at Victoria Harbour on Jun 16, when 41 other diners and four close contacts subsequently came down with the virus.

Two other patrons of Jade Garden also tested caught the virus, making a total of four infections from that cluster.

One more infection was linked to the Victoria Harbour restaurant today, taking the total tally there to 46.

Following the outbreak, the Food and Environmental Hygiene Department announced that it had prosecuted the restaurant for failing to comply with the requirements of the  vaccine pass scheme and violating government regulations on ventilation and air flow.

Starting last Friday, the restaurant was also stopped from providing dine-in services after 6pm and to sit only a maximum of two people per table for 14 days.

Dr Albert Au of the Centre for Health Protection said that apart from the Jade Garden cluster, an outbreak at Fu Tai elderly home could also be linked to Victoria Harbour.

He said two staff of the care home had also dined at the Tuen Mun restaurant on Jun 16, inadvertently bringing the virus to their workplace.

“Initial investigations showed the three clusters are related,” he said.

In total, Au reported 1,533 new local and 152 imported Covid-19 infections, with one related death.

An 88-year-old woman who received two vaccine jabs and had tested positive at the AsiaWorld Expo isolation facility where she was transferred from an elderly care home passed away yesterday.

She became the 9,186th patient to die in the fifth wave of the pandemic.

Asked about an expert’s comment that residents in care homes who are identified as close contacts should not be sent to AWE, Dr Lau Ka-hin of the Hospital Authority said this arrangement remains necessary.

“There’s a medical post there. We can provide medical services, including the prescription of oral antivirals to the patients as soon as possible order to prevent the further deterioration, as well as the death of the patients," Lau said.

Nilitis ang kaso ng Pilipina sa Labour Tribunal

Isang Pilipina ang dumulog sa Labour Tribunal kanina upang singilin ng dobleng suweldo ang dating amo dahil dalawang pamilya daw ang pinagsilbihan niya bago siya sinisante nito.

Ikatlo ito sa pitong reklamo ni Yhelen Grace Butac laban sa dating amo na si Vyas Nikunj Jagdishbhai, pero ito ang unang binigyang pansin ng presiding officer na si Ifan Chan.

“Bakit?” ang unang tanong ni Chan sa Inggles, na isinalin kay Butac ng isang interpreter sa Tagalog.

Nang sumagot si Butac na masyadong marami ang pinagsilbihan niya kumpara sa pinirmahan niyang kontrata, tinanong naman siya ng presiding officer: “Kung 10 pamilya ba ang pinagsilbihan mo, dapat bang 10 patong din ang dapat na ibayad sa iyo?”

Nang hindi ito masagot ng Pilipina, sinabi ng hukom na labag sa batas ang hinihingi niya. Kung ilegal ang pagpapatrabaho sa kanya para sa dalawang pamilya, ilegal din ang hinihingi niyang dobleng suweldo.

Hindi sakop ng Labour Tribunal ang isyung ganito at kailangang i-report ito sa pulis, dagdag niya.

Dahil may natisod siyang posibleng ilegal sa pagtatrabaho ni Butac sa amo, pinasumpa niya ang dalawang panig na magsasabi ng katotohanan sa kanilang pahayag. 

“Pinasumpa ko kayo dahil gusto kong maging responsable kayo sa inyong mga sasabihin dito,” paliwanag niya.

Nang tanungin ni Chan si Butac kung pumayag siya o may usapan sila ng amo sa ganitong sistema ng trabaho, sinabi nito na wala.

Ang dapat na ginawa ni Butac, ika ni Chan, ay nagreklamo siya sa pulis noong pinapagawa sa kanya ito.

Sa huli ay ipinaliwanang ni Chan na mahinang isyu ito kung makarating ang kaso sa korte, at iminungkahing iatras na lang ni Butac ang hiling. Pumayag naman ito. 

Siningil din ni Butac ang dating amo ng isang buwang suweldo kapalit ng abiso, dahil hindi daw siya sinabihan na tinerminate na siya noong October 2021 pero pinapagtrabaho pa rin siya hanggang noong kasunod na Pebrero.

Pero iginiit ng amo na sinabihan siya.          

Nang buksan ang ebidensiya, lumabas na inaresto ng Immigration si Butac at nadetine nang dalawang araw matapos mahuling nagtatrabaho nang ilegal sa isang restaurant.

Kahit walang nakasulat na abisong sinisante si Butac, ang pangyayaring ito ay hindi maikakaila at natural na ayaw ng employer ang kasambahay na inaresto, ayon kay Chan.

Hinabol din ni Butac ang suweldong hindi raw binayaran ng amo noong Hunyo, Hulyo at Agosto, 2020, na pinabulaanan ng amo.

Sinabi ni Chan na noong kasunod na Nobyembre, inamin ng Pilipina na natanggap na niya ang suweldo niya para sa Disyembre. Kung may ganitong pag-amin, dagdag ni Chan, imposibleng may utang pa ang amo.

Siningil din ni Butac ang meal allowance.

Ang problema, ayon kay Chan, ay kailangang mapatunayan ni Butac na sya nga ang bumili ng kanyang kinain noong nagtatrabaho sya sa amo. Nang inamin ni Batac na minsan ay siya ang nagbabayad kung kakain siya ng fast food, sinabi ni Chan: “Ang ebidensiya ay laban sa iyo.”

Ibinigay kay Butac ang hinahabol niyang holiday pay na $1,736.96 dahil walang maipakita ang amo nang tanungin ito kung may ebidensiya siya na binigyan niya ng bakasyon ang Pilipina.

Pero humadlang ang amo sa hinihingi ni Butac na pambili ng air ticket, sa dahilan niyang sobra-sobra ang naibigay niya dito bilang cash advance at dapat iawas na lang dito ang hinihingi niya.

Pero sinabi ni Chan na ang sobrang bayad ay hindi sakop ng Labor Tribunal, at hindi ito pwedeng kilalaning pambayad sa air ticket. “Ito ang polisiya ng gobyerno,” paliwanag ni Chan.

Nang tanungin ni Chan kung hanggang magkano ang payag niyang bayaran para sa air ticket, sumagot ang amo ng $3,000.

Hindi na rin niya hinarang ang hinihingi ni Butac na $200 para sa gastos habang naglalakbay pauwi sa Pilipinas.

Ang kabuuang natanggap ni Butac ay $4,936.99.

Social distancing measures to continue until Jul 13

It's still 4 to a group in public places, but up to 8 people may eat together in restaurants

The government announced today, Jun 27, that the existing social distancing measures aimed at curbing the spread of the coronavirus will be extended for two more weeks from Thursday, Jun 30, until Jul 13.

Separately, health officials reported 1,719 local cases and 154 imported ones on Monday, for a total tally of 1,873. This is a slight decrease from yesterday’s caseload of 1,917.

The government said in a statement that the decision to continue the gathering restrictions was taken given the stable infection situation, and after consultation with the incoming administration of the Chief Executive-elect John Lee.

With more people out in public and increased social interactions, the number of cases has continued its upward trend and a number of infection clusters have emerged, said the statement. There has also been an increase in the viral load found in sewage samples.

However, the number of patients requiring hospitalization has remained low and there is no sign of a significant increase in severe cases or deaths.

The extension of the anti-pandemic restrictions means the recent rule requiring all patrons of bars, clubs and party houses to present a negative result for a rapid test done within 24 hours before being allowed entry remains in force.

Bars are also allowed to sit only a maximum of four people to a table, and must not allow live performances or dancing. But they can remain open until 2am the next day.

Restaurants, on the other hand, are allowed to offer dine-in services only until midnight, but can sit up to eight people to a table. They can also sell food for take-out until 6am the following day.

In both places, patrons are allowed to take off their masks while eating or drinking at their table during specified times, but not when they get up to go elsewhere.

The government also reminded the public that three doses of a vaccine are required before they can enter premises where a vaccine pass is required.

All existing arrangements for using the LeaveHomeSafe mobile application in various premises will remain in place.

Unless exempted, group gatherings of more than four persons in public places will remain prohibited.

Masks should be worn by everyone when in public places, including public transportation.

The maximum penalty for violating the restrictions is a fine of $10,000 which can be dispensed by paying a fixed penalty of $5,000.

Organizers of prohibited group gatherings are subject to a maximum fine of $25,000 and imprisonment for six months.

Au says Victoria Harbour Restaurant in Tuen Mun has been closed for failing to meet air flow requirements

Meanwhile, the Centre for Health Protection said at today’s press briefing that four more infections have been traced to an outbreak at the Victoria Harbour Restaurant in Tuen Mun, bringing the total number of infections there to 41.

Dr Albert Au said an investigation showed that the restaurant had failed to comply with ventilation requirements set out by the government, meaning the amount of fresh air supply pumped into the premises per hour was below standard.

The restaurant has been closed and will be allowed to reopen only once the authorities are assured that it has initiated the necessary changes to comply with the ventilation requirements.

Au said experts are still unable to determine who or what had caused the outbreak in the restaurant which affected people who had dined there starting at 6pm on Jun 16.

At the schools, a total of 464 cases were reported from 335 different campuses, of which only about a quarter came from positive test results this morning. The rest were detected starting on Friday afternoon and during the weekend.

Seven schools were asked to suspend for seven days certain classes where a number of infections had been detected.

Au said the total infection tally in the fifth wave has now reached 1,227,190 cases.

No new death was reported so the tally remains at 9,185.

Immigration again allows 6-month extension of FDH contracts, exit deferrals

Expiring FDH contracts may again be extened for a maximum of 6 months

All foreign domestic helper contracts that are expiring on or before Sept 30 this year will be allowed an extension of up to six months, according to an advisory issued by the government today.

This is meant to allow a replacement FDH enough time to get to Hong Kong amid continuing border restrictions, including the seven-day hotel quarantine requirement for all inbound travelers.

If the replacement helper is still unable to come during that six-month contract extension period, the employer is advised to renew the contract of the current helper, or release her.

All these arrangements should be mutually agreed upon between the employer and the helper, said the government. That means a helper whose contract is expiring is not obliged to agree to the extension period if she does not want to.

At the same time, the Immigration Department said it will extend the “flexibility arrangement” for FDHs who are unable to return to their place of origin within the one-year period stipulated in their new or newly extended employment contract.

“If an FDH is unable to return to his/her place of origin within the aforementioned one-year period, he/she may, upon agreement with the employer, apply to the ImmD for a further extension of the limit of stay until the end of his/her contract such that he/she may return to the place of origin within that period,” said the government statement.

This is the latest relaxation of the previous policy of requiring all FDHs to exit Hong Kong after each contract, subject only to a one-year extension at the employer’s request.

Due to this initiative first taken in early 2020 after the pandemic made traveling to other countries difficult, if not impossible because of travel bans, long quarantine periods and other border restrictions, most FDHs have been stuck in Hong Kong for the past three years.

While some see this as an advantage because of the additional income from accumulated leave credits or unspent holidays, others feel trapped because they can no longer spend their annual holiday back home as a matter of right.

Instead of paying for costly and often difficult-to-book hotel quarantine stays, many employers have opted to just pay for the unspent annual leave of their helpers

Previously, or under normal circumstances, FDHs on a renewed contract or due to start working for a new employer could only apply to extend their mandatory home leave for  a maximum period of one year, subject to the agreement of their employers.

As with the other flexibility arrangement, the application to defer the FDH’s home leave should always be with the consent of the worker.

The government also reminded employers that the requirement to make the FDHs return to their place of origin after each contract remains in place

“Employers should arrange for their FDHs to return to their place of origin within the extended limit of stay,” said the statement.

“The government will continue to closely monitor the situation and review the above measures and flexibility arrangements as and when necessary.”

The government also appealed to the parties concerned to submit visa applications for FDHs online as much as possible. This could be done through mobile application or through the dedicated webpage for online services fo FDHs:   www.immd.gov.hk/fdh.

Electronic visa application services that have been in place since Dec 28 last year allows visa payments to be made through various means and for supporting documents and notification of premature termination of contracts to be made online.

Employers and their FDHs are also reminded to take note of the limit of stay and  passport validity of the FDHs so they can arrange for renewing them in advance.
