Drug trafficking cases like Quejada's are dealt with at the High Court

A Filipina torture claimant on recognizance who appeared at the Court of First Instance today, Friday, for a scheduled sentencing on a drug trafficking charge, will have to wait until Jan 31 next year to know her fate.

Prosecutors in the case against Maricris Q. Quejada, 38, asked Judge Susana D’Almada Remedios to postpone the sentencing until that day so they can make further inquiries about certain matters that could mitigate her offence.

The judge agreed to the request, and remanded Quejada in custody until then.

Quejada pleaded guilty to the drug trafficking charge at Eastern Court on Aug. 22 this year, saying she was tempted to accept a package for a “friend” in May last year, which turned out to contain about 1.9 kilos of ecstacy tablets, in exchange for $5,000.

The value of the drugs was estimated to be around $310,000.

Following her plea, Magistrate Jason Wan ordered the case transferred to the Court of First Instance for sentencing. 

Drug trafficking is a serious offence in Hong Kong, which carries a maximum penalty of life imprisonment and up to $5 million in fines.

In her statement to the police, Quejada said she was lured into the illicit deal by a man called Emeca who contacted her through WhatsApp in May last year, and a woman called Megan whom the man introduced as his girlfriend.

The pair offered $5,000 to the unemployed former domestic worker if she would agree to accept a parcel for their friend Jack.

Although she found the offer suspicious, Quejada said she agreed to the deal as she was enticed by the big payment that was offered.

What she didn’t know was that the parcel she was meant to receive had already been intercepted by customs officers at the airport, as they found it suspicious.

The shipment from Germany was listed to contain “materials for a wedding gown,” but officers who opened it for inspection found 1,862 grams of tablets containing 531.6 grams of methylenedioxymethamphetamine, a hallucinogenic substance found in the drug  commonly known as “ecstacy”, hidden inside.

Quejada was arrested after accepting the package, and was confirmed by Megan who was the original consignee, as someone authorized to accept delivery.

Following her arrest, Emeka and Megan disconnected the phone numbers they gave her. Jack initially sent her a message telling her where to take the drug parcel, but stopped communicating after apparently being tipped off by the two.

Customs reminds the public to stay alert, and not take part in drug trafficking activities in exchange for money. They must not agree to accept, carry or transact in illicit goods on behalf of others; or to allow others to use their name or home address for receiving mailed packages. Maari na ring magtanggal ng mask para magpakuha ng litrato ang mga bisita sa handaan, pero kailangan nila itong ibalik pagkatapos.

Ito ang mga binagong patakaran na inanunsyo ng mga opisyal ng gobyerno ngayon, kung kailan tumaas muli sa mahigit 6,062 ang bilang ng mga bagong kaso ng Covid-19 sa Hong Kong, kabilang ang 375 na mula sa ibang bansa.

Travelers now have the option of filling out the e-arrival card when they land in Manila  

Starting on Nov. 1, passengers bound for the Philippines are no longer required to fill out the electronic arrival card (e-arrival card) before boarding their flights, Malacanang said yesterday (Wednesday).

The Office of the Press Secretary said in a statement that lanes will be set up in all ports of entry for those who have yet to complete the e-arrival card registration.

Filling out the numerous information required in the e-arrival card and its predecessor, the OneHealthPass, has prompted widespread complaints among inbound travelers.

In Hong Kong, at least two returning overseas Filipino workers were unable to board their Manila-bound flight because they failed to complete the OneHealthPass before the departure gates were closed.

“Hindi na ito mandatory; lanes will be set up in airports for this system,” said an officer of the Press Office.

The use of the e-arrival cards for all incoming travelers was made mandatory for all new arrivals starting on Tuesday, Nov.1. The entry pass could be filled out within 72 hours before flying to Manila.

However, in a press briefing Tuesday, Tourism Secretary Christina Frasco said all Cabinet secretaries agreed to a proposal to that filling out the e-arrival card would no longer be required during check-in. 

Instead, travelers can now fill out the said card at their own convenience, either before departure, or upon arrival where they can get help. 

Frasco said special lanes will be set up at all ports of entry for those who did not have the chance to fill out the e-arrival card.

She also announced the decision to do away totally with requiring RT-PCR tests for arriving passengers who did not receive a booster dose of a Covid vaccine.

Under the new rules, even unvaccinated foreigners need only present a negative result for a rapid antigen test taken before their flight, or on arrival in the Philippines.

“The overarching direction of the Marcos administration is to allow our country to convey an openness and a readiness to the world to receive tourists and investments so that we would give our fellow Filipinos an opportunity to regain all the livelihood and losses that were incurred during the pandemic,” she said.

Separately, the Philippine government has also made the wearing of face mask voluntary in all indoor public places. Previously, mask-off was allowed only in outdoor spaces.

However, people will still be required to wear a mask when taking public transportation, medical transportation and medical facilities.

Frasco said in the earlier press briefing that persons who are unvaccinated and those with co-morbities or are senior citizens are still “highly encouraged” to wear masks.

But the Department of Health appears to be not as enthusiastic about allowing more people to take off their masks in public.

In a separate statement, the DOH said people will be more protected against Covid-19 if they use more layers of protection.

Filipina admits $92k jewelry theft; says employer declined to pay for long service

The theft happened inside the employer's flat in The Belcher's in Pokfulam

A Filipina domestic helper was ordered jailed for four months at Eastern Court earlier today, Thursday, after pleading guilty to stealing several pieces of jewelry worth a total of $92,000 from her employer of eight years. 

Rosalia C. Jacinto, 53, said through her lawyer that she stole because her employer declined her request for long service pay after her nephew met a traffic accident last year and she needed to send money home to pay for his hospitalization. Her nephew subsequently died.

Jacinto’s employer, Manisha Kamad, instead gave her $1,000 but the helper said it was not enough to cover his nephew’s medical expenses. At the time, Jacinto was being paid $5,750 a month and she sent $4,000 of this to her family back in the Philippines.

According to the charge she admitted, Jacinto stole 23 pieces of gold jewelry from an unlocked suitcase inside the employer’s bedroom in her house on 33/F, Tower 5, The Belcher’s in Pokfulam, between an unknown day in November last year and Sept. 15 this year.

The stolen jewelry consisted of six gold necklaces, 13 gold bangles, three gold earrings and one gold bracelet.

Sometime this month, the employer checked her hiding place and discovered that several pieces of jewelry had gone missing. Confronted about this, Jacinto admitted stealing the missing items and then showed three pawn tickets for them.

Police who investigated the pawnshop on Des Voeux Road West found all of the missing jewelry and the employer went to redeem them for a total of $57,000.

Prosecution said in court that the employer wanted to be compensated in the amount she spent redeeming the stolen jewelry.

To this, the defense lawyer said Jacinto had no money on hand, but offered to offset the compensation demanded against what she was owed for long service pay.

But he immediately agreed when Magistrate Yim said she didn’t think Jacinto was entitled to the gratuity because of what she had done.

According to the Labour Ordinance, a worker should be paid for long service if he/she has been in continuous employment for not less than 5 years prior to the termination of service by reason of: (i) dismissal for reasons other than redundancy or for cause (summary dismissal); or (ii) not renewing an employment contract; (iii) death or (iv) resignation on ground of ill health; or (v) resignation at the age of 65 or above on ground of old age.

In sentencing, the magistrate said the crime involved was serious because it involved a breach of trust, and a number of valuable jewelry worth more than $90,000 had been stolen.

She also pointed out that to recover her lost property the employer had to spend more than $50,000 – an amount that the helper was in no position to repay to compensate for what she had done.

The magistrate said she was using six months’ imprisonment as a starting point in sentencing, but would take off a third because of the defendant’s guilty plea, leaving four months in jail as penalty.

She also said she was not making any order for compensation, but this should not stop the employer from filing a civil claim against the helper if she so wishes.


Filipina appears in court charged with $384k theft

The theft case was heard in Kwun Tong court

A Filipina domestic worker appeared in Kwun Tong court on Wednesday, Oct 27, charged with stealing an assortment of jewelry from her employer said to be worth a total of $384,000.

Ligaya Ao-wat Banisal, 42, did not enter any plea and was remanded in custody until her next court appearance on Dec. 13.

According to the charge sheet, Banisal stole the following pieces of jewelry from the flat of her employer, Hui Sau-ling on 38th floor, Tower 2, Hemera, Lohas Park, between January 2021 and Oct 16, 2022, when she was arrested - 18 gold bangles, 2 gold necklaces, 5 gold bracelets, 2 rings, 4 gold rings and 9 necklaces.

Inamin ni Ginalyn Malcat sa pagdinig ng kanyang kaso sa Shatin Magistracy, ang dalawang kasong isinampa laban sa kanya pero hindi ito binigyang halaga ni Acting Principal Magistrate David Cheung nang ipataw nito ang karaniwang parusa nang walang bawas.

Para sa paggamit ng pekeng Hong Kong ID na nakapangalan sa kanya bilang permanent resident, na paglabag sa Registration of Persons Ordinance, pinatawan si Malcat ng 12 buwan sa kulungan.

Para sa illegal na pagtatrabaho, dahil ang isang asylum seeker na gaya niya ay bawal magtrabaho sa Hong Kong, may bayad man o wala, sa ilalim ng Immigration Ordinance, pinatawan siya ng 15 buwan.

Ang tanging pagluluwag na ibinigay kay Malcat, 38 taong gulang at hiwalay sa asawa, ay ang utos ni Magistrate Cheung na sabay niyang pagsilbihan ang dalawang sentensya.

Kasabay ni Malcat na humarap sa korte si Sally Gelotin, 42 taong gulang na domestic helper, na humingi na ipagpaliban ang pagdinig sa kanyang kaso upang magkonsulta sa abugado tungkol sa kaso niyang ilegal na pagtatrabaho sa naturan ding restaurant.

Samantala, sa hiwalay na pagdinig, pinatawan ng walong linggong pagkabilanggo si Roxan Siwao, 40 taong gulang, dahil sa pag-overstay niya nang tatlong taon at isang buwan.

Nagpaumanhin  ito sabay pulot nila sa nahulog na mga pinamili. Pagkatapos iabot sa kaniya ay nagpakilala ito at napansin niyang napahigpit ang hawak nito sa kaniyang kamay. Nang umabot na sa 5th floor ang lift nagpaalam ito ay hinawakan muli ang kaniyang kamay sabay ginawaran ng halik. Nakaramdam siya ng kiliti at ligaya sapagkat sa wakas napansin siya nito. Mula noon ay palagi na silang magkasamang namamasyal at kalaunan ay naging magkasintahan.
