Isang 40-anyos na Pilipinang dating kasambahay ang napatawan sa Kowloon City Court ngayong umaga, Mayo 4, ng 5 buwan sa kulungan matapos aminin na nanatili siya sa Hong Kong kahit wala nang visa,  mula pa noong 2017.

Ipinataw ni Acting Principal Magistrate Peony Wong ang parusa kay Chymbelin Cadelina sa sakdal na “breach of condition of stay – overstay” upang maisara ang kasong ito.

Pero may kinakaharap pa siyang mas malalang kaso kasama ang isang Bangladeshi na si Amir Foysal, at ito ay drug trafficking o pagbebenta ng droga.

Nauna rito ay ipinabatid ng tagausig na si Melinda Tong, sa korte na binabawi na nila ang tig-dalawang kaso ng drug trafficking at possession of part 1 poison laban sa dalawang akusado.

Ayon sa kanyang abogado, si Cadelina ay hiwalay sa asawa, at siyang tanging sumusuporta sa kanyang ina at dalawang nakababatang kapatid, bukod pa sa kanyang dalawang anak na 15 at 16 na taong gulang.

2 Filipinas jailed 12 & 15 months for money laundering

Two Filipinas convicted on two separate charges of money laundering were sentenced to 12 months and 15 months, respectively, in Eastern Court this afternoon, May 4.

Magistrate Vivian Ho said the duo’s offenses of money laundering was a serious crime that calls for a custodial sentence, as she ignored mitigation submitted by the defense lawyers who were seeking a lenient sentence for their clients.

Defendants Hazel V. Gepulgani and Marissa C. Mesa were convicted of three counts of “Dealing with property known or believed to represent proceeds of an indictable offense,” or money laundering, after a trial that ended on April 19.

Gepulgani was arrested in November 2021 after a total of $281,400 was deposited in her HSBC ATM account from June 13, 2020 to June 18, 2020.

Mesa was arrested later as police acted on a growing number of “love scams” that involved using foreign domestic workers’ bank accounts to “wash” money obtained via deception.

The Hong Kong Police said in March that scams reached a record high of almost 28,000 cases in 2022, up 45% year on year, with victims’ losses totaling $4.8 billion.

A total of $1.35 million was found in the individual HSBC bank accounts of Gepulgani and Mesa.

A key prosecution witness said during the trial it was part of some $2 million she was told to deposit to various accounts by a man who claimed to have sent her a valuable parcel for which she had to pay customs and other duties. 

In mitigation, the two defense lawyers said the defendants both had clear records and had family to support back in the Philippines.

Gepulgani, jobless since June 2020, is married to a fellow overseas Filipino worker based in Oman. They have three children who are being looked after by her mother.

Mesa is a single mother to three grown-up children who are in the care of her parents. Her lawyer said Mesa’s offense was totally out of character, as attested to by her employers who said they want to retain her as a helper. The lawyer asked for a “compassionate sentence”.

But Ho was unmoved, saying the offences that the two women committed were serious crimes.

She said Gepulgani had opened an HSBC bank account that was later used to launder more than $280,000 within days. Ho said the Filipina claimed she lost her ATM card shortly after opening the account but did not bother to report it to the bank. The magistrate gave Gepulgani a 12-month jail sentence.

For Mesa, the magistrate said her HSBC bank account received deposits of more than $1 million that came from a scam victim. She sentenced Mesa to 15 months in jail.      

Three other Filipinas implicated in the scam had earlier pleaded guilty to the same offense and were sentenced to between two and eight months in jail.

Mesa was acquitted of conspiracy to deal with ill-gotten money, but was found guilty on the alternative charge of directly committing money laundering.

Sinimulan nitong Miyerkules, Mayo 3, ang paglilitis sa Kwun Tong Law Courts ng sakdal na pagnanakaw laban sa isang Pilipinang kasambahay na diumano’y  kumuha ng iba’t-ibang gamit ng kanyang among babae noong pagitan ng Disyembre 22, 2022 at Pebrero 22. 

Nakatakda para sa maghapon ang paglilitis kay S. Bagasina sa hukuman ni Mahistrado Lau Suk-han, ngunit hindi natapos ang madramang pagbibigay-pahayag ng pangunahing testigo, si Chan S.M. na amo ng nasasakdal.

Ayon sa tagausig, dinakip ng mga pulis si Bagasina noong Pebrero 22 matapos tumawag sa 999 si Chan, isang dating make-up artist, dahil umano nakita niya sa Facebook na suot ng Pilipina ang mga gamit niya.

Noon pa man daw ay nahalata na niyang nawawala ang mga gamit sa taguan niya sa loob ng silid na tinutulugan ng katulong at ng kanyang alagang sanggol na lalaki.

Sa talaan ng tagausig, ang mga gamit ni Chan na natagpuan sa maleta at drawer ng Pilipina ay: anim na  damit-pang-itaas, isang pares na pantalon, isang kulay berdeng pantalong panlalaki na pag-aari ng boyfriend ni Chan, isang pares na sapatos, isang puting sombrero, tatlong bestida, isang bra at isang itim na shorts.

Ang pinakamahal sa mga ninakaw diumano na gamit ay isang gown na nagkakahalaga ng $800, pero ang karamihan ay prinesyuhan ng mula $150 hanggang $300, at ang pinakamura ay ang shorts na nabili ng $30.

Sinabi ni Chan na 14 sa mga bagay na kinuha diumano ng Pilipina ay mga damit na isinilid niya sa isang plastic bag at ibinilin sa kasambahay na iabot sa anak ng isa niyang kaibigan. Nagulat na lang daw siya nang makita sa mga larawan ni Bagasina sa Facebook na suot-suot niya ang mga ito.

Sa cross-examination, ilang ulit na tinanong ni Lo si Chan kung ibinigay niya sa katulong ang mga gamit at hindi nito ninakaw, pero iginiit ng amo na matagal nang nawawala ang mga iyon. Hindi na lang daw siya kumikibo kapag napapansin niyang wala sa drawer sa kuwarto ng katulong ng mga gamit niya.

“Just answer yes or no,” sabi ni Lo sa testigo.

“Unfortunately, No! And please stop asking such questions?” sigaw niya.

Hindi apektado ang ga HKG flights sa pagsasara ng himpapawid ng Pilipinas

Walang flight sa pagitan ng Manila at Hong Kong ang apektado ng pagsasara ng kalangitan ng Pilipinas kanina ( May 3) dahil sa pagkabit ng bagong automatic voltage regulator (AVR) na lumilinis sa daloy ng kuryente sa mga computer na bumubuo ng Air Traffic Management system (ATMS) ng bansa.

Hindi rin inaasahang maaapektuhan ang mga flights sa May 17, kung saan papalitan ang uninterruptible power source (UPS) ng ATMS.

Ang dahilan ay walang naka-schedule na Hong Kong flight sa oras ng paggawa sa parehong araw: mula 2:00 am hanggang 4:am. 

Ang dating plano ay isara ang lahat ng paliparan ng Pilipinas mula 12 midnight hanggang 6am ng May 17.

Ginawa ng Civil Aviation Authority of the Philippines (CAAP) ang tinawag nilang “corrective maintenance activity” upang maiwasan ang nangyari noong nakaraang New Year’s Day, nang isara ang himpapawid ng Pilipinas sa lahat ng eroplano at naka-apekto ng 78,000 pasahero.

Ang trabaho ay katuparan sa pangako ng mga opisyal ng CAAP, matapos ang imbestigasyong ginawa sa Kongreso, na maglalagay sila ng backup sa AVR at UPS na syang naging sanhi ng aberya noong Enero.

Maliban sa New Year’s Day fiasco, apektado rin ang mga pasahero papunta at paalis ng Hong Kong nang magka-blackout sa Terminal 3 noong Labor Day (May 1), na nagpatigil ng operasyon sa  domestic flights ng pitong oras.

Dahil napaandar naman agad ang mga generator, natuloy pa rin ang mga flight papunta ng Hong Kong ng mga airline na gumagamit sa Terminal 3,gaya ng Cebu Pacific, Cathay Pacific at Air Asia.

Pero dahil hindi kaya ng mga generator ang mga air conditioner, naging mainit sa terminal hanggang tuluyang naibalik ang daloy mg kuryente mula sa Meralco kinabukasan na ng 8:46pm.

Flights in and out of Phl to halt for 6 hrs on May 17

The 7-hour power outage at NAIA Terminal 3 shut down even the automatic doors 

The entire Philippine airspace will be shut down for six hours, or from midnight to 6am on May 17, for maintenance for the country’s air traffic management control system, according to airport officials.

This comes in the wake of another power outage at the Ninoy Aquino International Airport Terminal 3 on Monday, May 1, which lasted for seven hours and affected 46 domestic flights and about 9,000 passengers.

Exactly four months earlier the entire NAIA came to a standstill, stranding about 50,000 passengers due to the unexpected shutdown of the country’s airspace because of equipment malfunctions at the ATMCs.

Manila International Airport Authority (MIAA) General Manager Cesar Chiong announced yesterday the shutdown of the entire Philippine airspace due to a “major activity.”

Asked to elaborate, MIAA senior assistant general manager Bryan Co said that it was for a scheduled maintenance or replacement of the ATMC.

Co said the closure on May 17 is being scheduled in the early hours as the airport operations will have the least disruptions during that time.

He urged the airlines to inform passengers who might be affected early.

The Civil Aviation Authority of the Philippines (CAAP) yesterday also issued a public advisory, saying a maintenance activity would be conducted today, May 3, and on May 17.

Migrants push for living wage, OEC scrapping, in MayDay protest

The all-Filipino protesters show their demands through placards

Despite police restrictions, a big number of Filipino migrant workers took turns staging a protest action outside the Philippine Consulate General offices to mark May Day.

 

The protesters grouped themselves into three so they could all have a chance to call for a living wage and other long-standing demands for equality and greater protection under Hong Kong laws.

 

 

“We are workers! We are not slaves,” was the resounding call from the migrant workers.

 

The first group of protesters included the Abra Tinguian Ilocano Society, Cordillera Alliance, Gabriela HK and Bayan HK and Macau.

 

The protest was kicked off with a dance by the Likha Cultural Migrants Organization to the tune of “Manggagawa”.

Protesters then hit out at what they called as the Philippine government’s labor export program, which they said has resulted in the commodification of women migrants.

 

They also assailed the impending visit to the United States of President Ferdinand Marcos, Jr which they said seeks to reaffirm the US’ foothold in the Philippines.

 

Further, they called on the Marcos government to stop its attack on militant organizations and prioritize the creation of jobs in the Philippines that pay a living wage, so families are not forced to separate because of financial needs.

The second group made up of the Hong Kong For Justice and Peace led by the Liberal Party HK Chapter, The Silent Majority HK Chapter, Tropang Angat, Magdalo, Sandigan HK and United Filipinos in HK focused on the “severe” economic crisis in the country.

 

They also spoke out against the government exactions on overseas Filipino workers, as well as the difficulty they are forced to endure in acquiring the overseas employment certificate (OEC) which serves as an exit pass each time they go home for a vacation.

 

The protesters tore up sample copies of the OEC and threw them into a black trash bag, to signify their call for its scrapping, along with the government fees being linked to it, like the mandatory Pag-IBIG and SSS membership and the national health insurance, or PhilHealth.

Trailing the groups were the various organizations under the umbrella of the Filipino Migrant Workers Union or FMWU.

 

The protesters called for a living wage for Filipino workers, both in Hong Kong and the Philippines. They also reiterated a call for the Consulate to make a clear stand against the “job-hopping” allegation leveled against migrant workers whose contracts are prematurely terminated.

 

Wrapping up, the protesters announced that they would join the biggest Labour Day rally scheduled on May 7, organized by Asian migrants Coordinating Body.
