Sa kabila ng biglang pagpapababa sa kanya ng amo noong Lunes at pagdala sa kanya sa Hong Kong Airport ay nagawa pa rin ng Pilipinang si Brenda na makahingi ng tulong kaya hindi siya napilit na sumakay pauwi sa Pilipinas na $200 lang ang perang dala.

Sa tulong ng Social Justice for Migrant Workers, Overseas Workers Welfare Administration at ng kanyang employment agency ay nakatanggap si Brenda ng $7,399 bilang bayad sa sweldo at isang buwang pasabi. Nakunan din sya ng bagong air ticket kaya panatag na siyang umuwi kahapon.

Ayon kay Brenda, naka 17 araw pa lang siya sa employer na taga Chung Hom Kok nang bigla siyang papirmahin ng sulat na pinuputol na niya ang kanyang kontrata, at agad-agad na dinala sa airport ng kanilang driver.

Bago ito ay ilang beses na daw siyang nagreklamo sa kanyang agency dahil dalawang malalaking bahay ang nililinis niya at dalawa niyang kasamahan na Indonesian. Bale may apat na palapag daw ang mga bahay, at may mga tatlong gusali ang pagitan kaya araw-araw ay panhik-baba sila, bukod pa sa lakad.

Nag-abot lang sila ng kanyang mga amo ng tatlong araw bago umalis ito papuntang ibang bansa kaya nitong huli ay wala nang nakatira sa mga bahay kundi sila ng mga kasamahang Indonesian, at limang aso.

Sa kabila nito ay walang tigil daw ang kanilang paglilinis, at hindi puwedeng magpahinga bukod sa oras ng pagkain, hanggang matulog sila ng 8:30 ng gabi.

“Binigyan man lang kami sana ng kahit 30 minutong pahinga,” sabi ni Brenda. Pero hindi daw ito nangyari dahil laging nakabantay ang sekretarya ng kanilang amo, at agad silang hinahanap kapag hindi sila nakita sa camera.

Kapag sinabi nya daw sa sekretarya ang “I am so tired,” ay sasagutin lang siya ng “I know, I know,”pero tuloy pa rin ang pagbabantay sa kanila.

May mahigit na 200 na CCTV daw sa mga bahay, kaya nakikita ng sekretarya ang kanilang bawat galaw. Dahil dito ay napansin ng sekretarya na madalas na kumuha ng litrato sa buong kabahayan si Brenda kaya sinita siya.

Sa utos ng amo ay pinabura ng sekretarya ang mga kuha ni Brenda, at sinabing labag ito sa privacy ng kanyang mga pinagsisilbihan. Ang hindi niya alam ay pinadala na ni Brenda sa kanyang pamilya sa Pilipinas ang mga kuha para may magamit na patunay sakaling magkaroon siya ng problema sa trabaho.

Ang hindi niya inakala ay agad siyang papababain matapos palabasin na siya ang pumutol sa kanyang kontrata, at agad dalhin sa airport ng hindi binabayaran kundi ng $200 na pamasahe daw para sa kanyang pag-uwi.

Kahit nakabantay ang driver para masigurong nag check-in sya sa kanyang flight papuntang Maynila ay nakatawag pa rin si Brenda kay Marites Palma, founder ng Social Justice, na agad namang ipinarating ang kayang kalagayan sa OWWA.

Sa loob lang ng ilang minuto ay natawagan ng OWWA ang kanyang ahensya, na dali-dali namang sinabihan ang employer na kailangan niyang bayaran si Brenda ng sweldo para sa 17 na araw at isang buwang pasabi dahil sila naman talaga ang may gustong umalis na siya.

Pinagsabihan din ang amo na hindi nila dapat dinadala sa airport ang isang domestic worker kahit ito pa ang nag terminate dahil binibigyan ito ng batas ng 14 na araw para maghanda para sa pag-uwi,  maghabol sa mga dapat ibayad, o magsampa ng kaso o reklamo kung kinakailangan.

Pinayuhan din ng OWWA si Brenda na magpunta sa Department of Migrant Workers pag-uwi kung gusto niyang maisama sa watchlist ang kanyang amo dahil sa ginawa sa kanya.

Pagkatapos makuha ang pagsang-ayon ng amo ay ang ahensya na mismo ang nag desisyong tumakbo sa airport para abonohan ang napagkasunduang bayad na $7,339. Kinuha din si Brenda ng bagong ticket bagamat kinabukasan na siya makakaalis.

Kahit medyo naiiyak pa rin ay nagawa pa rin ni Brenda na magpasalamat sa mga tumulong sa kanya, lalo na ang kanyang ahente na nangako pa daw na bibigyan siya ng bagong amo sa pagbisita nito sa Pilipinas sa darating na buwan.

Gusto pa rin naman daw niyang bumalik sa Hong Kong, kaya lang ay “sana ay hindi na ganoon kalaki ang bahay, kahit mag-alaga pa ako ng bata at magsilbi sa mag-asawang amo,” sabi ni Brenda.

Hindi naman daw siya bago sa  pangangamuhan kahit ito ang unang kontrata niya sa Hong Kong. Nakapagtrabaho na din siya sa Taiwan at sa Singapore, kung saan maganda ang trato as kanya ng mga amo na parehong doktor.

Sayang nga lang daw at nagdesisyon ang mga ito na manirahan na sa Amerika kaya naisipan niyang sa Hong Kong naman makipagsapalaran.

Kalayaan Ball, bakit biglang naging business seminar?

Nakatakdang pulungin ng Konsulado ang mga pasimuno sa “Kalayaan Ball” noong nakaraang Linggo, June 25, sa Tao Heung Restaurant sa Causeway Bay, matapos maglabasan sa social media ang reklamo ng mga dumalo dahil sa lantarang pagnenegosyo ng isang sponsor sa pagtitipon.

Napalitan ng panghihinayang at sama ng loob ang dapat  sanang masayang kuwentuhan, kainan, kantahan at sayawan dahil tatlong taon ding walang naganap na Kalayaan Ball dahil Sa Covid-19.

Ayon kay Consul General Raly Tejada, "The Consulate will meet the organizers next weekend to find out what happened. We understand that many felt disappointed as expectations were not met. This is indeed unfortunate."

Ayon kay Guevarra na isa sa mga naatasang mangolekta ng bayad mula sa mga dumalo, napahiya daw siya sa nangyari dahil marami ang gumastos pa para sa makeup at espesyal na damit na sinuot sa okasyon, pero natali lang sa kani-kanilang mga upuan para makinig sa seminar.

Marami din daw ang ginutom, kaya nagpuntahan sila sa kalapit na McDonald’s pagkatapos ng salo-salo.

Dagdag niya, kung business presentation o seminar ang isasagawa, dapat libre na ang dadalo dahil mahihirapan silang manghatak ng mga tao. Nakakasama daw ng loob na ginawa ito sa mismong Kalayaan Ball para masiguro na maraming tao.

Mapapansin din sa mga litrato na sa halip na "Kalayaan Ball" ang nasa backdrop ng entablado ay pangalan ng Elite Club ang makikita.

Dahil $250 ang pinakamurang singil ng mga napagtanungan nilang mga restaurant ay minabuti nilang maningil nang tig $220 para may ekstrang perang pambayad para sa mga espesyal nilang panauhin.

Ang usapan daw nila ng Elite ay ipakilala lang nila ang kanilang grupo at magdadala ng mga entertainers (bukod kay Boobsie ay dumalo sina Cesar Montano at Jay Manalo) kaya binigyan sila ng oras na 11am-12:30pm.

“Pero ang nangyari from 12 to 2 pm nag promote sila at hindi na pumasok mga performers. Ang mga artista hindi naman nag perform kundi nag promote na rin,” himutok niya.

Dagdag pa niya, hindi naman nakuhanan ng pera ang mga dumalo para masabi nilang na-scam sila.

Hindi na rin daw nila kasalanan kung naunsyami ang pagrarampa ng ilan sa mga dumalo nang naka ball gown dahil “semi-formal” lang ang nakalagay na dress code.

Gayunpaman, nakaugalian na ng mga OFW na dumadalo sa “Kalayaan Ball” na magpabongga nang husto dahil ito lang sa buong isang taon na nagkakaroon sila ng pagkakataon na ipakita ang kanilang pinaka magarang Filipiniana na kasuotan.

Ang “Kalayaan Ball” ay inumpisahan ng grupong Philippine Alliance ilang taon na ang nakakaraan para magkaroon ng pagkakataon ang mga OFW na magsalo-salo at pumorma sa isang araw ng Linggo para ipagdiwang ang Araw ng Kalayaan ng Pilipinas.

Ginaganap ito pagkatapos ng Independence Day Ball na ilang dekada nang isinasagawa ng Philippine Association of Hong Kong, na binubuo ng mga Pilipinong residente dito; at ang kasunod na maghapong pagdiriwang sa Chater Road sa Central.

Unifil-Migrante calls for prosecution of Canada recruiters

A global migrants organization has called on the Philippine government to file human trafficking charges against a group led by the chief executive officer of a visa consultancy company, for recruiting overseas Filipino workers in Hong Kong to go to Canada as students. 

In a statement issued earlier today, Dolores Balladares of United Filipinos in Hong Kong, an affiliate of Migrante International, also called on the Philippine government to order Prisca Nina Mabatid to pay compensation to the OFWs who were each charged $18,700 (Php131,000) before realizing they could not qualify for the student visa.

Balladares accused Mabatid of carrying out human trafficking in other places where there are OFWs, citing statements she made in a live Facebook interview on June 19 with OFW blogger Bryan A. Calagui, who has been promoting her recruitment activities.

In the interview, Mabatid reportedly said her group had been to Singapore, the Middle East and other places, but were not reported to the police, only in Hong Kong.

Mabatid, who is also the current barangay captain of Mabolo, Cebu, is listed in her social media accounts as the CEO of PinoyCare Visa Center – Opportunities Abroad, which is not accredited with the Philippine Overseas Employment Administration.

We condemn Calagui and Mabatid's exploitation of OFWs, especially since Calagui is using his influence as a supporter of President Marcos Jr to promote this scam. His involvement in this scam is evident on his social media (pages),” said Balladares.

At least 11 of the applicants said in a police complaint that they tried to ask Mabatid’s group for a refund but were rejected, and reminded of a memorandum of agreement they were made to sign after payment that barred them from filing a case, or asking for a refund.

“Any scheme that results in victimization of OFWs should be denounced. We will not tolerate this scam, and we are one with the workers in pursuing justice,” said Balladares.

“Unifil will exhaust all necessary efforts to push the Philippine government to go after and punish the illegal recruiters and traffickers.”

Mabatid and her group conducted two “orientation” seminars in Hong Kong this year which were both promoted on social media by Calagui.

A number of those who attended the first seminar on February 19 paid the “discounted” processing fee of $18,700 within days, but said that they were dismayed to find out later that there was a long list of requirements that they must comply with to get to the next round.

Some also realized that the Php1million that Mabatid had promised to transfer to their bank accounts as a loan was actually only “show money” in support of their visa application and could not be used to pay for their tuition fee and other expenses.

At least three of the applicants persisted and subsequently got a letter of acceptance from the schools they applied with, but also backtracked when told they needed to pay Php100,000 more as first installment for their tuition fee.

Eight of the applicants went to the police to complain on June 18, just as Mabatid and her group were carrying out another recruitment at Sunbeam Theater in North Point. After the police intervened, Mabatid promised to return the fee paid by the complainants.

However, she did not appear as promised at the Philippine Consulate on Sunday, June 25, so the complainants who were by then joined by three more applicants, immediately informed the police so the case could be elevated to the Immigration Department.

Also named in their complaint apart from Mabatid and Calagui were lawyer Russ Mark Gamallo and two female staff members of PCVC-Opportunities Abroad who all came to Hong Kong and took part in the two recruitment activities.

Consul Paulo Saret and Assistant Labor Attache Antonio Villafuerte who met with the complainants, said the Department of Migrant Workers in the Philippines had taken notice of their case, and a report on what transpired would be communicated directly to the office.

Apart from the police, the OFW complainants also took their grievance to Hong Kong’s Immigration and Labour Departments.

Isang babaeng akusado ng panloloko sa kapwa Pilipina ang hindi pinayagang magpiyansa kanina sa Eastern Courts nang hadlangan ng taga-usig ang kanyang hiling.

Sumang-ayon naman si Principal Magistrate Ivy Chui sa paghadlang sa pansamantalang paglaya ni Lerma Larosa, 32 taong gulang, pero itinakda pa rin niya ang isang bail review sa July 4 upang ito ay pag-usapang muli.

Canada recruiters no-show, DMW takes over

The Department of Migrant Workers has started looking into the complaint of a group of Filipino domestic workers in Hong Kong who claimed to have been duped by a group of tourists from the Philippines who offered to help them secure study visas in Canada.

The FDWs went to the Philippine Consulate on Sunday morning, hoping to get back the $18,700 (Php131,000) they each paid to the Opportunities Abroad team after an orientation seminar at Sunbeam Theatre in North Point on Feb 19 this year, but left empty-handed.

This was despite a promise made to Hong Kong Police on June 18 by Prisca Nina Mabatid, introduced during the seminar as the Chief Executive Officer of PCVC(PinoyCare Visa Center)-Opportunities Abroad, that she would go to the PCG to return the “processing fee” collected from the complainants.

After waiting for more than two hours for Mabatid or any of her officers to show up, the complainants, assisted by Mission for Migrant Workers case officer Edwina Antonio, called the police to report that the promised refund did not materialize.

The Police had given specific instructions to the group after they personally filed a complaint at the North Point Police Station on June 22, to call them if Mabatid would renege on her promise so they could forward the case to the Immigration Department.

The case began on June 18, when the complainants called the police to Sunbeam Theater. after hearing that Mabatid was back in town for another seminar. They demanded a refund, and asserted that Mabatid and her team should not be doing any work or business during their visit in Hong Kong as that violated their visa conditions.

To avoid being taken to the police station, Mabatid readily promised the complainants she would give back their money, but at a later date, saying she needed to check their records first. 

After some discussions as to the date and venue of the refund, the two sides agreed to meet at the Consulate on Sunday, June 25.

Apart from Mabatid, named as repondents in the complaint that the FDWs filed with the Hong Kong Police, Immigration and Labour Departments as well as the Philippine Consulate General, were her partner, lawyer Russ Mark Gamallo; two unnamed female staff of PCVC-OA who collected their money, and FDW-driver Bryan A. Calagui, who acted as the recruiters’ representative in Hong Kong.

The complainants said they did not know each other initially, but all of them learned about the recruitment seminars of PCVC-OA from the Facebook posts and blogs of Calagui, whom they followed regularly because of his political leanings.

Gamallo, on the other hand, acted with Mabatid as the main presentors at the recruitment seminars, during which they encouraged all the OFWs to apply for student visas to Canada and not worry about the requirements as they would be the ones to take care of them.

During the Feb 19 recruitment drive which was recorded on video, the two also told the audience that Mabatid would deposit a Php1 million “loan” to each applicant's bank account to fulfill the Canadian government’s requirement that they must have enough funds to pay for their studies and expenses for at least a year. 

But after being given the long list of the documents they needed to start their visa application, some immediately backed down, saying they should have been told all these before making them pay as there was no way they could comply with the requirements.

One balked in particular when told she needed to give an alibi or reason as to why she came to have Php1million in the bank, saying she did not want to tell a lie just to get the visa.

Another recalled being told by an “analyst” at PCVC-OA that she could say it was from a property sale, and to just get someone to sign on a fake sales contract.

The others quit when told that the Php1 million “loan” from Mabatid could only be used to convince Canada’s immigration office that they have the means to support their study and stay in the country, and could not be spent for their needs.

At the Consulate, the eight original complainants were joined by three others who also paid the visa processing fee to PCVC-OA. One also coughed up about $18,700 while the two others each paid the reservation fee of $3,000, and had planned to pay the balance on June 18.

Presiding over the meeting were Consul Paulo Saret, head of the Consulate’s Assistance to Nationals Section; and Assistant Labor Attache Antonio Villafuerte of the Office of Migrant Workers, on the instruction of Consul General Raly Tejada who earlier said they had no objection to the Consulate being used as venue for the promised refund.

Consul Saret told the claimants that DMW Secretary Susan “Toots” Ople had taken notice of the case even before the meeting, and had personally asked the Consulate to look into it.

He promised the FDWs that their complaints would be given due attention, and that reports on the outcome of the meeting would be relayed immediately to both the DMW and the Department of Foreign Affairs.

Saret also took the time to tell the complainants that they need not worry about being taken to court on the basis of the MOA they were made to sign, which stipulated that they could not sue or demand a refund of their money from the respondents. Since they said the documents were notarized in their absence in Cebu, they should not be legally binding.

No agreement that prevents someone from taking action on an illegal act could also be held legal or enforceable.

There is also the question of whether PCVC-OA could validly entice OFWs to move to another country, even on student visa, more so because it is not accredited with the Philippine Overseas Employment Administration.

Antonio said she was glad the DMW had taken the initiative to investigate the case, and appreciated that the ATN and MWO had spent ample time listening to the complainants’ grievances.

But she urged quick, top-level action on the matter, saying the complainants fear for their safety after being warned by Mabatid on June 18 that she would take action against them for calling the police and ruining her business and reputation.

They also want their money back  All except one of them had taken out a loan to pay the costly processing fee which is four times their monthly salary  

Further fueling their fear was the recruiters’ claim that they are backed by important personalities like former President Rodrigo Duterte, Senator Raffy Tulfo, actor and business magnate Willie Revillame and showbiz personality Boy Abunda.

In the days before, and even during the Sunday meeting at the Consulate, the OFWs also began receiving calls from people connected with the recruiters, when they had all been ignored since March, when they started asking for refunds.

Most of the complainants ignored the calls, but one did pick up on seeing that it came from a number listed in Mabatid’s name. But to her dismay, a different woman spoke on the other line, and said Mabatid would not show up on her lawyers’ advice, as the promise she had given before the police was made “under duress.”

The woman the complainant recognized as the staff who collected their money, identified herself as Al Lagradilla. She said that while the complainants have the right to go after their company, they will have to file suit in Mabatid’s hometown of Cebu, as that was where their MOA or undertaking was notarized.

Further, she said Mabatid’s lawyers were already preparing to file charges against The SUN and its editor, Daisy Mandap, for supposedly spreading false information and ruining their business.

This was the same claim made by Gamallo in a Facebook message sent to Mandap, but said this could still be averted if The SUN took down its story on the June 18 incident. In exchange, he said Calagui would also delete his post where he and Mabatid ranted against Mandap and The SUN.

Mandap told him they should just comply with their promise to go to the Consulate and return the complainants’ money, then blocked his account.
