4 torture claimants among 21 arrested for suspected illegal work

The Lunar New Year markets were targeted by Immigration officers in a four-day sweep against suspected illegal workers that lasted from Feb 7 to 10.

A total of 16 suspected illegal workers, including four torture claimants; four suspected of having hired them; and a suspected abettor were arrested in the continuation of operation “Twilight”.

A press statement released by Immigration on Feb.11 said officers raided 22 target locations including a car washing company, a garbage collection depot, an industrial building, a logistics centre, a residential flat, restaurants, a store and vegetable stalls.

The suspected illegal workers comprised 12 men and four women, aged 25 to 68. Among them, four men were holders of recognizance forms (or those granted temporary liberty while appealing deportation cases) which prohibit them from taking any employment.

In addition, two men and two women were found in possession of forged Hong Kong identity cards, while another man and one woman were suspected of using HKIDs belonging to other people.

Also arrested were one man and three women, aged 37 to 59, on suspicion of employing the suspected illegal workers. A woman suspected of aiding and abetting a person who breached his condition of stay was also arrested.

The raids also targeted stalls at seven Lunar New Year markets in Causeway Bay, Kwai Chung, Sha Tin, Sheung Shui, Sham Shui Po, Tsuen Wan and Yuen Long. Stall keepers were given leaflets reminding them against employing illegal workers.

The press statement said visitors who contravene a condition of stay, including taking up unapproved employment, whether paid or unpaid, is guilty of an offence. Offenders may be prosecuted and upon conviction, fined a maximum of $50,000 and up to two years’ imprisonment. Aiders and abettors are likewise liable to prosecution.

Illegal immigrants or those subject of a removal or deportation order are likewise prohibited from taking up any kind of employment. If convicted of violating this prohibition, they can be fined a maximum of $50,000 and a jail term of up to three years. The statement said the Court of Appeal has already issued a guideline of 15 months’ imprisonment for violators.

Those who use forged HKID cards or those belonging to another person face even more severe penalties. They could be prosecuted and upon conviction, fined a maximum of $100,000 and jailed for up to 10 years.

Equally severe are the penalties imposed on those who employ people who are not allowed to work in Hong Kong. They could be fined up to $350,000 and jailed for up to three years. The statement said the High Court has ruled that immediate custodial sentence should be imposed on those found guilty of these offences.

The court has also said employers must take all practicable steps to determine whether a person is lawfully employable prior to employment. Apart from inspecting the job applicant’s identity card, the employer must also conduct inquiries that would dispel any reasonable doubt about the applicant’s lawful employability. Failure to do this will not be acceptable as a defense in court proceedings.

Employers may also be prosecuted if they don’t inspect a job seeker's valid travel document if the applicant does not have a Hong Kong permanent identity card. The maximum penalty for failing to inspect such a document is imprisonment for one year and a fine of $150,000.

When conducting anti-illegal work operations, Immigration officers are obliged as part of standard procedure to conduct an initial screening to determine whether vulnerable persons such as illegal workers, illegal immigrants, sex workers and foreign domestic helpers are victims of human trafficking.

Two Thai DHs jailed 6 weeks for working in massage parlor

Two Thai female domestic workers were jailed for six weeks on Feb 10, by a Kowloon City magistrate for working part-time as masseuses in a salon in the district.

Defendants Natthaya Wetcharat, 30, and Nichaphat Khanhuathon, 25, were meted the discounted sentences by Magistrate Cheng Lim-chi after they each pleaded guilty to a count “breach of condition of stay.”

The Thai salon manager who employed the two women was also prosecuted for hiring illegal workers and running a business establishment in violation of anti-Covid 19 restrictions. But her case was adjourned to Mar 25 as her lawyer was still awaiting documents from the prosecution.

The two helpers and the salon manager were arrested during a raid by a police special duties team at 6:20pm on Feb 8 on the “Enjoy Thai Massage” establishment in Shun King Bldg at 33-35 TaK Ku Ling Road, Kowloon City.

The prosecution said two officers posing as customers went to the salon and asked for a body massage. They were told a one-hour service cost $200, so both officers agreed and Wetcharat and Khanhuathon began servicing them.

 

The first officer suddenly identified himself and asked to check the passport of Wetcharat. He discovered she had a domestic worker visa issued by Immigration on Dec 16 last year.

The other officer also checked the passport of Khanhuathon and found out she was also a domestic helper with a visa issued by Immigration on Dec 30 last year.

Both helpers and the salon manager, Suphanni Hongprasoet, taken to the Kowloon City Police Station for questioning after their arrest. The manager was later released on police bail but the two masseuses were held without bail.

The prosecutor said the two women had clear records.

The duty lawyer assigned to the two defendants told the magistrate his clients admitted working part-time as masseuses because they wanted to augment their monthly salary of $4,520 as domestic helpers.

24 new Covid-19 cases today, including 3 newly arrived FDHs

The Filipina DH tested positive at the airport and the Indons, while in quarantine

Three newly arrived foreign domestic workers, two from Indonesia and one from the Philippines, were among 24 new Covid-19 cases reported today, Feb 12. 

The three were among six imported cases, with the others returning residents from United Arab Emirates, Russia and India.

The Filipina DH is 40 years old and arrived in Hong Kong on Feb 10, and was found infected at the airport.

The Indonesians are aged 30 and 38 years old, and both tested on their 12th day in hotel quarantine.

The 18 local cases were equally divided into those that were linked to previous cases, and those that were untraceable. They all brought Hong Kong’s total infection tally to 10,756 cases.

Around 10 preliminary cases were detected, in a further sign of a decline in the number of cases.

Secretary for Health Dr Sophia Chan said the social distancing restrictions will be relaxed as announced if (1) there is no significant change in the epidemic situation and (2) there is no large outbreak or cluster of cases.

In addition, she said catering businesses will be required to improve the ventilation in their premises. Staff will also be tested for Covid-19 every two weeks, with the first three months of tests to be administered free by the government.

Chan also appealed to the public to use the LeaveHomeSafe app, especially when dining in restaurants, for more efficient contact tracing in case infections are detected within the premises.

“We have been hearing comments that it’s difficult to order customers to use it. We urge the restaurants and premises owners to abide by the regulation and we hope customers will follow suit,” she said.

She said the app will not be used for purposes other than contact tracing, assuring people that “all the information will be left in your mobile phones.”

Dr Lau Ka-hin of the Hospital Authority reported one more confirmed patient succumbing to the disease, raising the death toll in public hospitals to 186. The 85-year-old male patient passed away at 6:08am today in Yan Chai Hospital.

There are a total of 373 confirmed patients still being treated in 23 public hospitals and the treatment facility at AsiaWorld Expo. Among them, 32 are in critical condition, 17 are seriously ill and 324 are stable.

Meanwhile, Dr Chuang Shuk-kwan from the Centre for Health Protection said the nine patients with unknown sources live in Mirador Mansion in Tsim Sha Tsui, Fung Fat Heung in Pat Heung, Kam Lam House in Ma On Shan, Far East Consortium Building in Yuen Long, Mei Ying Building in Shek Kip Mei, Moonbeam Terrace in Beacon Hill, Whampoa Garden in Hung Hom, Kwong Chi House in Tai Po and Sam Mun Tsai in Tai Po.

All residents in these buildings (except the ones in Pat Heung and Sam Mun Tsai which are standalone houses) will undergo compulsory testing, as well as in three other designated residences: Century Link in Tung Chung, Provident Villas in Sandy Bay, Pokfulam and Le Billionaire in Kowloon City.

Fine, warm Lunar New Year weather perfect for outdoor fun

The weather over the next four days will be perfect for many outdoor activities, including fishing

Hong Kong and the rest of eastern Guangdong province will be mainly fine and warm over the Lunar New Year, with temperatures forecast to hover between 15ºC and 25 ºC on Friday and Monday, the last day of the holidays.

The Hong Kong Observatory said tomorrow, the first day of the Lunar New Year, will be the coolest with a minimum of 15ºC in the morning and a maximum of 21ºC as the day will be mostly cloudy.

The Observatory said mainly fine and warm daytime weather will prevail due to the moderating northeast monsoon over Guangdong in the next few days. But another dry northeast monsoon will affect the south near the end of next week, making for cooler mornings.

Nearly all offices and businesses remain closed from Friday to Monday in observance of the city’s most festive season, including the Philippine Consulate General.

The weather will be perfect for outdoor activity among Hong Kong’s residents, including Filipino workers. But the Labour Department again reminded foreign domestic helpers to comply with social distancing measures.

FDHs are again urged to keep social distancing, as they enjoy HK's longest holiday 

An LD spokesman said a person who participates in a prohibited group gathering of more than two persons in public places or fails to wear a mask may be charged a fixed penalty of $5,000.

He said during the holidays, the LD will collaborate with the Hong Kong Police, Food and Environmental Hygiene Department, Home Affairs Department and Leisure and Cultural Services Department to conduct mobile broadcasts for four consecutive days at popular FDH gathering places to urge them to comply with the requirements.

He said relevant departments will take action against those who ignore the regulations after repeated reminders. LD officers have been authorized by the Director of Health to help enforce the mass gathering and mask-wearing regulations.

Several Filipino workers have laid out plans for hikes on some of Hong Kong’s more than 300 peaks, including those that are not on the official hiking trails. Some do it for fun and to ease their stress, while other go on trail clean-up sorties.

Among their most popular hikes are on the Tai Mo Shan, Hong Kong’s highest peak at 957 meters; Lantau Peak, the second-highest at 934 meters, and the 468-meter-tall Sharp Peak in Saikung, which is described as the most precipitous hill in Hong Kong.

For the legion of foreign domestic helpers who may choose to go out during the long break, their consulates, the Immigration Department and the Labour Department where they usually transact business on their day off, will be closed.

These government offices will reopen on Feb 15, and will resume full service starting Feb 18, as the government relaxes its social distancing rules amid a steady decline in the number of Covid-19 cases.

The only government establishments that will remain open as usual are the Hong Kong police, fire services and public hospitals, including community testing centers for Covid-19.

Among the venues that will open on some days is the Kennedy Town Community Centre Dental Clinic, where many OFWs go for free dental extraction. It will open this Friday and next Monday, but will operate on limited hours.

The Leisure LCSD announced it will open 10 sports grounds for jogging from 9am to 5pm during the Lunar New Year as a special arrangement this year to let the public relax while maintaining social distancing.

FDW found with coronavirus after elderly ward dies, then also tests positive

A foreign domestic worker tested preliminary positive for Covid-19 yesterday, two days after her 84-year-old male ward passed away at Queen Elizabeth Hospital, and was moved to the mortuary where he was subsequently found infected as well. 

The helper’s deceased ward among the 21 new Covid-19 cases reported today, Feb 11.

According to Dr Lau Ka-hin a chief manager at the Hospital Authority, the test result of the helper, who was seen at the accident and emergency unit of QE Hospital at 1am on Feb 10, promoted the HA to alert Kwai Chung mortuary. A test on samples taken from the deceased showed he also had the disease.

Lau said the elderly patient fainted at home on Feb 9, and was rushed to QE where he was intubated and CPR was conducted.  He died at 12:15 on the same day, and his body was sent to the mortuary.

“In this particular case, the doctor made an assessment after resuscitation. He (patient)  had fever, and she (doctor) did not tell us that there were upper respiratory tract symptoms earlier. So according to the assessment, no test for Covid-19 was made,” said Lau.

A statement released by the HA tonight said antibodies were present in the blood specimens taken from the elderly patient on Feb.8, "hence no staff or patients were idenfitied as close contacts."

No medical staff was classified as close contact because everyone who attended to the patient wore proper PPE.

Another confirmed patient who died in the past 24 hours was a 75-year-old woman who succumbed to the illness at Caritas Medical Centre where she had been confined since Jan 22. 

Lau said the patient was found infected after being identified as a close contact of a family member who tested positive for Covid-19 earlier. Her death brought the fatality toll in public hospitals to 185.

Dr Chuang Shuk-kwan from the Centre for Health Protection said of the new cases, four were imported, comprising two FDWs from the Philippines, and two returnees from Albania (via Turkey), and India.

One Filipina tested positive on arrival, the other on her 12th day in quarantine

One of the Filipinas, who is 39 years old, tested positive on arrival in Hong Kong after flying in aboard a Cebu Pacific flight 5J 272 on Jan. 9. The other, who is 40, arrived via Philippine Airlines flight PR 300 on Jan 28 and tested positive on her second test on the 12th day of her quarantine.

Of the 17 local cases, seven were untraceable. All residents in the buildings where they live were immediately ordered to undergo tests, except for those in one which was already under compulsory testing.

More than 10 preliminary positive cases were also recorded.

Chuang was asked by reporters about two patients who were found to have gone to the flower market before being confirmed as positive cases yesterday. The reporters wanted to know if the CHP had done contact tracing and whether the other visitors at the flower market were put at risk by the patients’ visit.

Chuang said the two patients had links to previous infections, so it was not likely they caught the virus in the flower market, or had contaminated other people there. Still, she said the CHP had already told people they had come into contact with to get tested if they feel unwell.

Hong Kong’s overall Covid-19 tally is now 10,732. Of these patients, 413 are still being treated in 22 public hospitals and the facility at AsiaWorld-Expo. Among them, 21 are in critical condition, 19 are serious, and 373 are stable.
