Filipina DH, agency owner deny illegal recruitment, money laundering charges

A Filipina who used to work as a domestic helper and a local resident have denied charges that they had accepted payments for non-existent jobs and for laundering more than $700,000 they got from applicants.

Marijane Biscocho, 44, and Lennis Ebrahim, 55, pleaded not guilty to each of the charges read to them at the opening of their 15-day District Court trial that was held in West Kowloon Court on Monday, Aug 2.

Customs and Excise investigators arrested Biscocho and Ebrahim on Nov 7, 2019 and charged them with wrongly accepting payment for a product, contrary to the Trade Description Ordinance.

Later in the investigation, an additional charge for money laundering was filed against them.

Biscocho faced 20 charges, mostly for allegedly receiving payments of $6,000 each from job applicants between Oct 1, 2018 and Jun 16, 2019.

Most of the charges involved recruitment in 2018 by Biscocho for Ebrahim’s WHT Consultant Company for supposed jobs such as factory worker, waiter, housekeeper, welder, printer, and caregivers in Hong Kong and Macau.

The purported jobs, which promised a high salary and residency, attracted scores of Filipino domestic worker applicants who swarmed WHT’s office in Kwun Tong, and later to the renamed agency’s office in To Kwa Wan, Kowloon City.

Among the complainants are Rosalina Agcalis, Jocelyn Domingo, Nena Castro, Maria Aurora Lagura, Jovelyn Villaflor, Mary Joy Liggayu and Precisosa Abellera, who applied mostly for two jobs for relatives as waiters, housekeeper, printer, caregiver and welder in Hong Kong and Macau.  

When the applicants chased WHT for the promised jobs after five to six months of waiting, the agency moved out of its Kwun Tong office.

Angry applicants tracked them down in 2019 to the Tung Nam Factory Building in To Kwa Wan, Kowloon, with WHT changing its name to Remy Consultant Company and with Ebrahim as its owner. They reported to the police, who later handed the investigation to Customs.

Biscocho was also charged with alleged breach of condition of stay for working in Ebrahim’s two employment agencies between Oct 1, 2018 and Jun 16, 2019.

This was despite being contracted to work as a domestic helper for Peter Chan Hin-man, with a visa issued on Sept 27, 2017 and valid until Nov 12, 2019.

Biscocho additionally faced two counts of money laundering, after Customs investigators alleged that she had handled a total of $299,745 in a Hang Seng Bank account between Jun 17, 2018 and Sept 30, 2019.

She was hit with a second money laundering charge after investigators discovered that she had allegedly dealt with $110,500 deposited in a Hong Kong and Shanghai Banking Corp account between Sept 23, 2018 and Jun 16, 2019. The fund was believed to have come from payments by job applicants.

Ebrahim faces only two charges. First, she was jointly charged with Biscocho for allegedly accepting $6,000 from Mary Joy Liggayu on Nov 13, 2018 as agency fee for her brother Mario Liggayu, for a promised job as a printer in Hong Kong.

Ebrahim was also charged with money laundering for allegedly dealing with a total of $331,216 between Sept 23, 2018 and Jun 16, 2019 in a Hong Kong and Shanghai Banking Corp account that she and Biscocho held jointly.

The two defendants are out on bail.

Hong Kong to allow vaccinated FDHs to come in

Law says the first to be allowed back are FDHs who have been vaccinated in HK

The government has announced that foreign domestic helpers who were vaccinated in Hong Kong and are stuck in their home countries because of the flight ban on places designated as extremely high risk will be allowed to return and assume their work here.

This was announced today by Labour Secretary Law Chi-kwong at a press conference led by Chief Executive Carrie Lam.

Law, however, did not mention any date as to when the first batch of FDHs from countries like the Philippines and Indonesia will take place. 

The only other category of FDHs he mentioned that could qualify for the partial lifting of the ban are those who have finished their two-year contracts and would like to take a home leave after completing their vaccination here.

But he said these workers are still being encouraged to remain in Hong Kong by giving them further visa extensions, given the uncertainties caused by the pandemic.

He did not mention the thousands of FDHs who have been issued work visas but have been unable to leave since the imposition of the flight ban. For the Philippines, the suspension has been in effect since Apr 20 and for Indonesia, since Jun 25.

But he said that those who were vaccinated outside of Hong Kong will still have to wait until after their vaccination records can be validated with their home countries.

“We will still discuss with the consulates general – of the Philippines and Indonesia - to see how we can confirm with their governments the authenticity of their vaccination records,” said Law.

He also said all qualified FDHs who will enter Hong Kong will still have to undergo 21 days of compulsory quarantine at one or two designated hotels.

Law said that the full details of the plan to allow FDHs back into Hong Kong will be relayed to interested parties, including employment agencies, as soon as the Labour Department has worked them out.

He added that as of yesterday, 222,911 FDHs have received the first dose of vaccine, accounting for 61% percent of all FDHs in the city.

Unvaccinated govt employees to pay for regular Covid-19 tests from Sept 1

Get vaccinated or pay for your regular Covid-19 tests.

This was the message that the government sent out today, Aug 2, to all of its staff, “regardless of their duties, work nature and work place,” whether full time or part-time.

In a press statement, the Civil Service Bureau said all government employees who have not received the first dose of a vaccine must undergo a polymerase chain reaction-based (PCR) tests for Covid-19 using combined nasal and throat swabs at Community Testing Centres every other week.

From Sept. 1, they will have to pay for these tests themselves, and have it done after office hours if they still haven’t taken a single vaccine jab. The only ones exempted from the order are those who are able to present a medical certificate showing they are unfit to receive a vaccine because of medical conditions.

CVCs charge $240 for each PCR test for Covid-19.

“All government employees have an obligation to get vaccinated. It is also their responsibility of contributing to a healthy working environment and not posing themselves as a risk to co-workers and the public," the statement said.

But, it added government staff can still choose whether to get vaccinated or not.

“The claim that government employees are forced to receive vaccination is misleading and unfounded,” added the statement.

The statement said 70% of all government employees have received at least one dose of a coronavirus vaccine.

The vaccination in lieu of tests has been implemented since May 31 for frontline staff who are regularly involved in enforcement, inspection and investigation duties and have frequent and close contact with members of the public, or are involved in high risk duties. It was expanded to cover all frontline government employees from July 19.

But on several occasions recently, the government had said it was considering requesting staff who who have not received vaccination on non-medical reasons to undertake regular testing at their own expense.

"Ample time has been provided for government employees to receive vaccination and the arrangement of vaccination leave has also been introduced a few months ago,” said the statement.

"If individual government employees choose not to receive vaccination out of personal choice but not medical reasons, it is unreasonable for the government to expend public money on their PCR tests for a long period of time,” added the statement. “It is neither justifiable nor in line with the principle of effective use of resources.”

“Moreover, it is not fair to those who have been vaccinated to have to shoulder the work of those who choose not to do so when the latter leave the office during the office hours to undergo PCR tests."
 
Government employees who are unfit to receive a vaccine due to medical conditions may still avail of free Covid-19 tests and have these done during work house, provided that departmental operations are not affected.

58% of FDHs have taken at least one vaccine jab, says Labour Secretary

More than half of all foreign domestic helpers in Hong Kong have had at least one dose of a coronavirus vaccine, Labour Secretary Law Chi-kwong said today, Aug. 1.

That’s far higher than the 47% of all qualified residents who had taken their first jab, according to yesterday’s statistics published by the government.

Law made the disclosure as he and Civil Secretary Patrick Nip observed the vaccination of 266 Indonesian migrant workers in a Causeway Bay hotel this morning. The outreach service was arranged by Indonesian Consul General Ricky Suhendar.

“Up till now, more than 219,000 (foreign domestic helpers) have already taken the first dose of vaccination, accounting for nearly 58% of the FDH population in Hong Kong,” Law said.

“I urge all FDHs in Hong Kong to receive vaccination as soon as possible to protect themselves, their employers’ families and others. The vaccination will also give them better protection when they need to proceed on home leave,” he said.

As of Sunday night,  the total number of people who have had their first vaccine dose across Hong Kong was 3,227,400. That’s 47.46% of the 6.8 million people qualified to take the jab in the city.

Nip, who heads Hong Kong's vaccination program, echoed the call for migrants to get inoculated, saying it is important that they help create a protective barrier for households with children and unvaccinated elderly persons.

“I encourage foreign domestic helpers who have not yet been vaccinated to do so as soon as possible,” he said.

Nip said it was very important to have the support of Indonesian residents and other ethnic minorities in Hong Kong to enhance the city’s overall anti-epidemic capability.

He also appealed to those who came for the inoculation to tell their friends about the channels and benefits of receiving the vaccines, to maintain personal hygiene and to keep up social distancing to reduce the risk of virus transmission in Hong Kong.

The two officials escorted by ConGen Suhendar took the chance to visit Victoria Park, a favorite haunt of Indonesian migrants, to encourage them and other members of ethnic minority groups who were there to get vaccinated as soon as possible.

On its own, the Philippine Consulate General led by Consul General Raly Tejada launched its own vaccination drive early to encourage Filipinos in Hong Kong to get inoculated.

Officers and staff at the Consulate had their first dose of Sinovac on Mar 18, after which they called on members of the Filipino community to also protect themselves against Covid-19 by getting vaccinated.

An information campaign about coronavirus vaccines was also held by the Consulate in cooperation with the University of the Philippines Alumni Association in Hong Kong on Apr. 27.

Guest speaker, Dr. Gerardo Legaspi, director of UP-Philippine General Hospital in Manila, spoke of how vaccines help protect people from deadly viruses like the coronavirus.

In Hong Kong, the Civil Service Bureau has been conducting outreach vaccination service to various sectors to help boost the inoculation rate.

The Hong Kong Sports Institute, global professional services firms, property developers, financial institutions, a TV broadcaster, the construction sector, public utilities, a theme park, universities, insurance firms and a district group have all benefited from the service.

The campaign to get Hong Kong’s vaccination rate to go up is expected escalate starting this week, as all community vaccination centers in the city are scheduled to close by the end of the month.

After that time, vaccination will only be done at public hospitals and designated private clinics.

Vaccinated Cambodian DH and US woman among 3 new imported cases

The three arrived early yesterday in HK and were confirmed to have Covid-19 on their first test

Two fully vaccinated women, a Cambodian domestic helper and a 19-year-old traveler from the United States, were among three imported cases of Covid-19 infection reported today, Aug. 1. The third is another female helper from Cambodia.

The staff said the first Cambodian helper was confirmed to be a carrier of the N501Y and E484K mutated strains of the coronavirus variant first detected in South Africa. Test results on the two others are still pending.

All three are asymptomatic.

In a press statement, the Centre for Health Protection said the first Cambodian helper, aged 41, received two doses of the Sinovac anti-Covid-19 vaccine in her country on Jun 4 and Jun 19.

The two Cambodian workers both came via Cathay Pacific flight CX 600 which left Phnom Penh late on Friday, and arrived at about 2am Saturday in Hong Kong.

The returnee from the US, on the other hand, received two doses of the Pfizer-BioNTech vaccine in the US on May 1 and May 22, the CHP said.  

She flew in aboard Air Canada flight AC015 from Toronto which arrived in Hong Kong at about 5am Saturday.

A total of 28 cases have been reported in the past 14 days, and all of them are imported cases, the CHP said.

Meanwhile, the CHP said it had been notified of a confirmed case in the United Kingdom, a 52-year-old female patient, who departed Hong Kong on Jul 15 to London via flight CX251.

Her specimen collected on Jul 18 tested positive for Covid-19 and she remains asymptomatic. The CHP said it is following up the case with the UK health authority, which is still making epidemiological investigations.

As a precaution, the building where she had resided during the incubation period - Lok Yuen, at 24 College Road, Kowloon City - will be put under a compulsory testing notice.
