Shatin Law Court, kung saan idinaos ang pagdinig sa dalawang kaso

Isang babae at isang lalaking Pilipino na nag-overstay sa Hong Kong ang nahatulan ng pagkakakulong ng 10 at anim na buwan matapos umamin sa pagkakasala nitong Biyernes (June 10) sa Shatin Magistrates’ Court.

Si Virgie Bugayong, 54, ay nahuli pagkatapos mag-overstay ng mahigit 17 taon sa isang operasyon ng Immigration Department sa Quarry Bay noong May 11, 2022. Nang i-check ang kanyang HKID, nabistong paso na ang kanyang visa mula pa noong July 10, 2005.

Si Josefino Cantos, 62, ay sumuko naman sa Immigration noong May 10, 2022, para tapusin na ang kanyang ilegal na pananatili sa Hong Kong sa loob ng mahigit 12 taon. Dapat kasi ay noong Sept. 15, 2010 pa siya umalis.

Ayon sa record ng kaso, si Bugayong ay dumating sa Hong Kong bilang domestic helper noong July 10, 2003, at nag-expire ang kanyang kontrata noong July 18, 2005. Simula noon ay hindi na siya nag-renew ng kanyang visa.

Sinabi ng kanyang abogado na nawala ang kanyang pasaporte at natakot na siyang magpakita sa Immigration upang ayusin ang kanyang sitwasyon.

Pero idinagdag ng abugado na malinis ang record ni Bugayong at nagsisisi siya na hindi niya inayos ang ilegal niyang katayuan sa Hong Kong.

Sa huli ay pinatawan siya ni Acting Principal Magistrate David Cheung ng 15 buwang pagkakakulong, na binawasan ng 1/3 kaya naging 10 buwan.

Si Cantos naman ay nagtrabaho bilang domestic helper hanggang Sept 15, 2010 nang matapos ang kanyang kontrata.

Hindi na siya nakakuha ng bagong employer, nguni't pinili na manatili nang ilegal sa  Hong Kong.

Ayon sa kanyang abugado, sumuko si Cantos dahil gusto na niyang makapiling ang kanyang asawa at dalawang anak na nasa Pilipinas.

Humingi ito sa hukom ng kaluwagan sa pagpaparusa kay Cantos dahil sa kanyang malinis na record, sa kanyang pag-amin at pagsuko.

Binigyan siya ni Magistrate Cheung ng 12 buwang sentensiya, na binawasan ng 1/3 kaya naging walong buwan. At dahil sumuko siya, dinagdagan pa ng hukom ang diskwento ng dalawang buwan, kaya ang natira ay anim na buwan.

Nakahanda nang makulong si Cantos nang humarap sa korte dahil may dala siyang itim na bag, at bitbit niya ito habang sya ay itinuro ng mga guwardiya papunta sa pinto para sa mga ikukulong.

Covid infections jump to 851, but most cases mild

Health officials reported 851 new Covid-19 infections on Saturday - a jump of nearly 180 from the day before - but assured that the rebound in cases has not led to more people getting hospitalized.

"Fortunately, we have not observed any increase so far in the [hospital] admission figures and the number of serious and death cases," Dr Chuang Shuk-kwan of the Centre for Health Protection said at the daily press conference.

"So we'll closely monitor the situation to see whether there's any increase in the burden on the health care system."

Chuang said other indicators of the pandemic like the positive rates for sewage and lockdowns and the reproductive rate of the virus have seen a slight increase recently, so they will continue to monitor the situation.

She declined to give an opinion on whether social distancing measures ought to be tightened anew because of the increase in the number of cases.

Of the new cases, 491 were confirmed through PCR tests and the remaining 360 were self-reported rapid test results that were confirmed by laboratories.

Imported cases made up 74 of the total, and of these, 30 were detected at the airport on Jun 9 and 10; 31 were found at quarantine hotels; and the remaining 13 after the patients had left isolation.

Two outbreaks were again found in bars in Central and Sheung Wan – Racks City on Wyndham Street where 18 cases have been detected, and FLM on Jervois Street where 12 customers have tested positive.

Chuang said the one of those linked to FLM had earlier visited LINQ on Pottinger Street, another Covid-hit bar, and health officials are still looking if there is a link between the two clusters.

Another bar, Shuffle at Lan Kwai Fong, added five more infections, raising the total number in the cluster there to 118, comprising 112 customers and six staff.

Despite it being a weekend, some Covid-19 cases were reported by schools, including another student at class 4B of Po Leung Kuk English Primary School in To Kwa Wan. To date, 14 infections have been reported in this class.

Two more unlinked cases involving the Omicron sub-variant, BA.2.12.1, have been detected. These are a 57-year-old woman who works as a dishwasher at Cathay Pacific’s lounge at the airport and a 61-year-old woman who lives in Wo Che estate in Shatin.

The total infection tally from the fifth wave now stands at 1,205,703 while the death toll remains at 9,177 since no new death was reported yesterday.

There are 373 patients receiving treatment in public hospitals and the North Lantau infection 
control centre. Among them, 12 are in critical condition and seven are in serious condition.

In the past 24 hours, 55 patients have recovered and 50 have been discharged.

CE says HK’s status as intl hub hurt by strict quarantine rules

Outgoing Chief Executive Carrie Lam has blamed the recent mass emigration of people in Hong Kong on Covid-19 quarantine controls than on the national security law.

She made her statement during an interview with CNBC earlier on Friday, when asked whether Hong Kong's recent brain drain can be attributed to both the Covid restrictions and national security law.

The CE, who will be stepping down from Hong Kong’s top post at the end of the month, said the security law is not so much the reason, as the strict rules imposed on all inbound travelers.

"The border control measures have really made people very impatient, and of course undermined Hong Kong's status as a hub," Lam said.

"Because if you couldn't travel freely to other places and into the mainland, how could you be a hub?"

She said that if the seven-day hotel quarantine is replaced with home quarantine, many more people will come to Hong Kong to visit, either for business or for leisure. Consequently, the continuing exodus could also be averted.

Just a day earlier, she ruled out relaxing the border restrictions before her term ends at the end of the month.

She told lawmakers Hong Kong is caught between Beijing's zero-infection policy towards Covid and the rest of the world's decision to live with the virus.

Meanwhile, health authorities reported 672 new Covid-19 cases, which they admitted was a sign that the infection tally has rebounded in recent days. From a daily tally of between 200 to 300, the infection numbers now range between 500 and 600.

Of today’s new infections, 291 were found via PCR tests, while the remaining 381 were confirmed results from rapid tests.

The daily tally included 59 imported cases, 27 of which were detected at the airport, 25 during hotel quarantine and seven post-isolation.

Dr Chuang Shuk-kwan of the Centre for Health Protection said there have been silent transmissions of Omicron sub-variants in various districts, but “fortunately, most of the cases are asymptomatic.”

She said no case had led to severe symptoms or death likely because a big number of people here have been fully vaccinated.

Still, she said authorities are keeping a close eye on whether the rise in infections could strain the city’s health system.

"We hope to monitor how this will weigh on our healthcare system," she said.

Chuang reported 11 cases involving the BA.2.12.1 sub-variant where the source could not be identified.

They include a 10-year-old boy and a 68-year-old female who live in separate buildings in Homantin; a couple aged 84 and 86, and a 49-year-old man who all live in Tseung Kwan O; a family of three and a 47-year-old man who reside in Tuen Mun; as well as a 33-year-old woman who lives in Wan Chai.

As for schools, 106 additional infections from 93 campuses were reported, involving 84 students and 22 teachers. Chuang said 32 schools have had two or more cases in the past week.

The new cases include three students attending the same class at Po Leung Kuk school in To Kwa Wan. As a result, face-to-face lessons have been suspended for a week for this class, the second in the school.

Another teacher at the international section of Kiangsu & Chekiang Primary School in North Point has also tested positive, resulting in the suspension of face-to-face lessons for class P5R. 

Also suspended was the morning class of Joyful World Kindergarten in Tsuen Wan after two students and two teachers there were infected. T

Likewise, class 5S of Bradbury School in Wan Chai has been suspended after two students and a teacher tested positive.

As for the bars, Shuffle on Lan Kwai Fong had three more infections, pushing the tally there to 113. Six of the cases involved staff members while the rest were patrons.

Chuang said the outbreaks in three of the four bars where case clusters emerged appear to be linked.

The virus appears to have  broken out first at Iron Fairies on Hollywood Road and then spread to LINQ on Pottinger and Shuffle, as customers went to all three bars repeatedly.

Dr Lau Ka-hin of the Hospital Authority said there were no new Covid-related deaths, so the tally from the fifth wave remains at 9,177.

A total of 374 patients are still receiving treatments at public hospitals and the North Lantau infection control centre. Twelve of them are in critical condition and six are in serious condition.

2 Pinay na nag-overstay, naligtas sa kulong

Ang Shatin Court, kung saan nilitis ang kaso ng dalawang Pinay.

Dalawang Pilipinang nag-overstay ang nakaligtas sa kulong kanina dahil masyadong maiksi ang panahong inilagi nila nang ilegal sa Hong Kong. Ang isa ay ni hindi na rin kinasuhan.

Ang duminig sa parehong kaso ay si Acting Principal Magistrate David Cheung Chi-wai ng Shatin Magistracy.

Iniurong ng mga taga-usig ang kasong inihain laban kay J. Paine, 36, na nahuling overstay na nang 28 na araw noong May 11, kaya hindi na tinalakay sa korte ang mga akusasyon sa kanya.

Ayon sa record, dapat ay nakaalis na si Paine noon pang April 8, 2022 matapos materminate ang kanyang kontrata bilang domestic helper at nabigyan ng palugit upang maghanap ng panibagong amo.

Dahil sa pag-urong ng kaso, makakauwi si Paine sa Pilipinas na malinis ang record at pwedeng makabalik sa Hong Kong upang magtrabaho kung gugustuhin niya.

Si L. Ocampo naman ay naharang ng nagpapatrulyang pulis nito lang May 7 at inaresto nang itawag nila sa Immigration ang HKID number niya at malamang paso na ang kanyang visa noon pang April 7.

Dinala si Ocampo, 36, sa Immigration Department upang imbestigahan at sampahan ng kaso.

Nang iharap siya sa hukom kanina, inamin niya na nag-overstay siya nang isang buwan.

Hiniling ng kanyang abugado sa huwes na magaang na parusa lamang ang ipataw sa kanya dahil malinis naman ang kanyang record.

Sa huli ay binigyan siya ng sentensiyang siyam na araw na kulong, na binawasan  ng 1/3 kaya naging anim na araw.

Pero hindi makukulong si Ocampo dahil ang ibinigay sa kanya ni Magistrate Cheung ay isang suspended sentence na tatagal ng 12 buwan. Ang kondisyon lamang ay huwag siyang magkakasala sa loob ng isang taon, kundi ay pagsisilbihan niya ang kanyang orihinal na sentensiya at ang parusa oara sa bago niyang kasalanan.

Covid cases rise to 674, highest since late April

The daily caseload has risen to a new high in less than two months

Health authorities reported 674 new Covid-19 infections on Thursday, the highest since Apr 27, when the cases dropped to just over 300 after record surges that started in early February.

The day’s total tally, which comprised 332 via PCR tests and 341 confirmed rapid self-tests, was 20% more than the previous day’s 558 infections.

The new cases included 73 brought in from abroad, including 38 detected at the airport 28 at quarantine hotels, and seven post-isolation.

Health authorities also reported 90 cases from 81 schools, involving 68 students and 22 teachers.

Dr Chuang Shuk-kwan of the Centre for Health Protection said they have asked 25 students in Po Leung Kuk English Primary School in To Kwa Wan to stop going to class for a week after a cluster of infections was found there.

Three students and a teacher in one class at the school had tested positive for Covid.

Two more students at Funful English Primary School in Kowloon Tong have also tested positive, taking the number of cases in the cluster there to 17.

At the bars, LINQ on Pottinger Street added four infections, taking the tally there to 99 so far. Shuffle on Lan Kwai Fong had 13 more cases, pushing the total infection tally there to 110.

Chuang also said eight additional cases of the BA.2.12.1 Omicron sub-variant have been found, taking the total tally to 112, of which 62 were local.

On the other hand, a 46-year-old woman working parttime at quarantine hotel Regala Skycity in Tung Chung had contacted another sub-variant, which Chuang said was either BA.4 or BA.5.

Dr Lau Ka-hin of the Hospital Authority reported that one more Covid patient has died, raising the death toll from the fifth wave to 9,177. The 89-year-old patient passed away two days ago.

The number of Covid patients in public hospitals and other treatment facilities total 375. The patients include 13 who are in critical condition and six in serious condition.
