15 months for holding someone else’s HKID

Having someone elses’s Hong Kong ID card has landed a Filipina overstayer in jail for 15 months.

Lowela de la Cruz, 39 years old, was also sentenced at West Kowloon Court to two months in prison for having overstayed for two years, but this will run at the same time as the first sentence.

De la Cruz, who is unemployed and has no fixed abode in Hong Kong, received the two sentences Friday (Jan. 24) when she appeared before Acting Principal Magistrate Cheng Lim-chi, and pleaded guilty to the two charges against her.

She was sentenced to 15 months for having in her possession another Filipina’s HKID “without lawful authority or reasonable excuse”.

She was found to have violated the Registration of Persons Ordinance after she was accosted by police officers to verify her identity, as she was walking on the corner of Pei Ho and Fuk Wa St. in Sham Shui Po on Nov. 13 last year.

She was also sentenced to two months for breach of condition of stay, after pleading guilty to remaining in Hong Kong two years after the two-month grace period given to her, following her termination as a domestic helper on Aug. 7, 2022.

Boardwalk completes 11-km Kennedy Town-North Point walkway

View from East Coast Park Precinct

Starting today (Jan. 25), one can walk the northern coast of Hong Kong island facing the scenic Victoria Harbor, through an 11-kilometer walkway that spans from Kennedy Town to North Point.

This is made possible by the formal opening today of the western section of the East Coast Boardwalk underneath the Island Eastern Corridor (IEC) in North Point. The western section was inaugurated in ceremonies last Jan. 23.

It completes the boardwalk that connects the East Coast Park Precinct (ECP, otherwise known to Filipinos as Little Dubai because of the MTR ventilation shaft that juts out at its end) and the North Point Promenade (NPP).

Today’s opening follows the inauguration of the Boardwalk’s western section last Jan. 23.

Present in those ceremonies were acting Financial Secretary Michael Wong, Secretary for Development Bernadette Linn, Harbourfront Commission Chairman Ivan Ho; Civil Engineering and Development Director Michael Fong; the project panager (South) of the Civil Engineering and Development Department, Victor Chan; and the District Officer (Eastern), Simon Chan/

Wong said the Boardwalk is a signature harborfront enhancement project of the Government and is expected to become a new landmark for the public and visitors to enjoy a variety of activities and appreciate Victoria Harbor.

Ho said construction of the Boardwalk was not a simple process but a success of concerted discussions among the government, the HC and the public over a decade, balancing the views expressed by sectors of the community.

He described it as the final piece of the puzzle to link up the harborfront on the northern shore of Hong Kong Island and provides more possibilities for harborfront development in future.

Fong said that to overcome technical difficulties such as height restrictions, narrow waterways, and lack of land access, the engineering team introduced a number of innovative elements to construct the Boardwalk, including adopting prefabricated boardwalk decks, thereby reducing the construction period and costs, and effectively enhancing construction safety.

The Boardwalk will be a “harborfront shared space”, with a shared path where the public may carry out various activities such as walking, jogging and cycling. In addition, an exclusive pedestrian walkway is available side-by-side to provide an additional option for pedestrians.

Another feature of the Boardwalk is the movable bascule bridge and the movable swing bridge, introduced for the first time in Victoria Harbour. These bridges allow vessels to access the coastal waters bounded by the Boardwalk when necessary, maintaining accessibility of the Boardwalk while accommodating operational needs.

Other facilities along the Boardwalk include cascade seating for watching the sunset, a play area, fitness equipment, and a fishing platform. The Tong Shui Road Public Pier has also been preserved and revitalized, while the NPP has been enhanced to include more open areas and leisure facilities.

The western section of the East Coast Boardwalk will open 24 hours a day, except for the movable swing bridge, which will open from 6am to 11pm.

The three access points to the western section of the Boardwalk are through Tong Shui Road (about a 3-minute walk from Exit A1 of North Point MTR Station), through Provident Garden and the movable swing bridge and through the Watson Road entrance to the ECP and the passageway (about a 15-minute walk from Exit A of Fortress Hill MTR Station).  

15 months’ jail for tourist who worked illegally as masseuse

The illegal worker was found to have overstayed her visa for 14 months (File)

If you enter Hong Kong as a tourist, you can never take up any work, paid or unpaid. If you get caught doing illegal work, you will most likely serve time in prison.

This was the lesson learned by a 49-year-old woman from the mainland  who got into Hong Kong as a tourist in November 2023, but took the chance to work as a masseuse.

After the woman was arrested for overstaying for 14 months, police noticed during questioning that she had a large amount of cash with her. Subsequent investigations revealed she had worked as a masseuse at various  massage parlors during her overstay, for which she received $50 to $100 each session.

The suspect was taken to the Shatin Magistracy on Jan. 23, and was formally charged with doing illegal work, breaching her limit of stay, and overstaying her visa.

She pleaded guilty to all charges, and was immediately sentenced to 15 months in jail.

A statement issued by Immigration said the suspect’s employer is still being investigation, and that it cannot rule out the possibility of further arrests.

 

 


15 persons arrested in pre-CNY campaign vs illegal work

Immigration officers distribute leaflets warning people at CNY fairs against illegal work

A total of 15 people were arrested during raids conducted by the Immigration Department over four days as part of its campaign to combat illegal employment activities at Lunar New Year fairs.
 
Those arrested from Jan 20 to 14 comprised 10 suspected illegal workers, four employers and one suspected aider and abettor.

The first phase of the raids targeted various premises, including residential buildings, restaurants and retail shops. Four suspected illegal workers and two suspected employers were arrested.
 
The arrested suspected illegal workers comprised one man and three women, aged 39 to 52. Among them, one woman was a holder of recognisance form, which prohibits her from taking any employment.

In a separate operation, 15 locations in Central were targeted. Four suspected illegal workers and one suspected employer were arrested.
 
The arrested suspected illegal workers comprised four women, aged 36 to 42. One man, aged 54, was suspected of employing them was also arrested.

Separately, several stalls at various Lunar New Year fairs were raided, leading to the arrest of two suspected illegal workers, one employer and one aider and abettor.
 
The suspected illegal workers comprised two women, aged 30 and 34 while another woman aged 37, was arrested on suspicion of hiring the two.

One woman, aged 35, who was suspected of breaching the condition of her stay was also arrested.
 
Apart from the arrests, Immigration officers on board a promotional vehicle distributed leaflets to stall owners warning them against hiring illegal workers.
 
Illegal work is a serious crime in Hong Kong, for which the maximum penalty is two months in jail plus a fine of $50,000. The maximum jail term goes up to three months if the offender is an illegal immigrant, an overstayer, or is subject to non-refoulement.
 
     


DH’s jail sentence raised from 2 to 6 months

(Update) A Filipina domestic helper who was jailed for two months after she pleaded guilty at Eastern Court to stealing a diamond ring and two platinum rings from her employer, had her sentence raised to six months.

In a review hearing requested by the prosecutors, Principal Magistrate Don So increased on Thursday (Jan. 23)  three-fold the penalty for Sheila Mae Bajar, 42 years old, who confessed to theft in violation of section 9 of the Theft Ordinance.

Magistrate So agreed with the prosecution’s argument that the two-month imprisonment handed to her earlier was not an appropriate penalty for the crime Bajar committed.

Last Wednesday (Jan. 22), she pleaded guilty to the charge of stealing a diamond ring and two platinum rings with a total value of $192,800, between March 1 and July 15 last year at her employer’s home in Residence Bel-Ai in Pokfulam.

Meanwhile, unemployed Chanda B., 44 years old, was fined $50 after she pleaded guilty to shoplifting chocolates from a BestMart 360 shop on King’s Road in North Point.

A Filipina domestic helper was jailed for two months yesterday after she pleaded guilty at Eastern Court to stealing a diamond ring and two platinum rings from her employer.

But a review hearing is scheduled today for Sheila Mae Bajar, 42 years old, who confessed to theft in violation of section 9 of the Theft Ordinance, in a hearing before Principal Magistrate Don So.

She admitted stealing the jewelry, with a total value of $192,800, between  March 1 and July 15 last year at her employer’s home in Residence Bel-Ai in Pokfulam.

Meanwhile, Armando Molina, a Filipino who is facing a charge of breach of condition of stay for for not leaving Hong Kong after arriving as a tourist on Oct. 30, 2006, has worsened his case by not showing up in a hearing at the Shatin Court.

Molina, 47 years old, is charged with violation of the Immigration Ordinance after he stayed in Hong Kong after his 14-day visa expired on Nov. 13, 2006, until he was arrested on Sept. 23, 2011.

Acting Principal Magistrate Cheang Kei-hong issued a warrant for his arrest, froze his existing bail and ordered police not to release him on bail.

Comelec under fire for alleged failure to ensure seamless online voting

The protesters are calling on Comelec to conduct urgent voter education

Militant Filipino migrant organizations have hit out at the Commission on Elections for its alleged failure to conduct comprehensive voter education, which could lead to massive voter disenfranchisement in this year’s mid-term election.

About 50 members of Bayan Muna HK and its affiliate organizations picketed the Consulate on Sunday, Jan. 19, to condemn Comelec’s alleged negligence in holding immediate voter education on the new online voting system.

""It is unacceptable that many voters are at risk of losing their right to vote due to a cumbersome process burdened by excessive requirements,” said Lai Besana, convenor of Bayan Muna HK.

Besana noted that the OVS requires voters to verify their email addresses and undergo a preparatory registration process before they can participate in the online voting, which is being held for the first time in most overseas countries hosting Filipino migrants.

Voters who encounter difficulties trying to vote online are required to go to the Consulate to cast their ballots, a prospect that could lead to long queues and massive disenfranchisement.

“The OVS imposes burdensome requirements that could prevent people from voting. This process will discourage voters, especially those who can only participate on weekends," Besana warned.

She said that if Comelec really wants more overseas Filipinos to vote they must immediately hold a training session for voters so they will know how the online voting system works.”

Comelec officials who came to Hong Kong last July took a select group of Filipino community members through the process of first, enrolling as a registered voter; then accessing the voting portal where they will be asked to first present their credentials before being allowed to vote.

Comelec commissioner in charge of the OVS, Marlon Casquejo, told the audience that there will be a pro-enrolment period 60 days before the start of voting period, which is from Apr 13, 2025 to May 12, 2025.

The pre-enrolment will then take place from Feb. 12 to Apr 12, 2025.

At this stage, the voter will be asked to ad the required documents and provide an email address, then wait for verification from the Consulate (or other overseas posts).

During verification, the Consulate will check against the National Registry of Overseas Voters whether the applicant is a registered voter. If confirmed, a link to the election portal will be sent to the voter. Once done, the voter will receive a digital print of the cast ballot.

15 Lunar New Year fairs set to open

Fifteen Lunar New Year fairs, the biggest at Victoria Park with 395 stalls, will open tomorrow (Jan. 23), offering a variety of goods, flowers and street food to thousands who want to go strolling during the holidays.

The fairs will last until Jan.29.

The Food & Environmental Hygiene Department, which is organizing the fairs, said about 1,500 wet goods, dry goods and fast food stalls will be set up in these fairs, which will open at 7am daily. Admission will stop 15 minutes prior to the closing time, which could be as late as 1 am the next day.

The department said that the fair venues will be monitored using innovative technological measures, and crowd control will be implemented as necessary.

For example, footfall at the 15 fairs will be displayed on the department’s website, at https://www.fehd.gov.hk/english/events/lnyf2025/lnyf2025.html -- a green light indicates that just a few people are at a fair site, an amber light signals that a venue is slightly crowded, while a red light shows the venue is very crowded.

In addition to general recyclables, the department will arrange for contractors to collect bamboo sticks, wooden pallets, polyfoam and wilted or unsold flowers. Unsold pots of flowers and plants donated by vendors will also be sent to elderly homes, care homes and public hospitals.

2 DHs charged with Immigration offenses, get off lightly

The two Filipinas were charged at Shatin court 

Two Filipina domestic helpers accused of violating the Immigration Ordinance, got off lightly today at Shatin Court after they agreed to be bound over in return for charges against them being dropped.

G. Perez, 47 years old, was accused of breach of condition of stay by allegedly doing business selling socks and lipsticks on Aug. 11, 2024.

Magistrate Andrew Mok granted the prosecution motion to drop charges against her after she accepted the bind-over agreement in which she would promise not to reoffend for 24 months, with a penalty of $1,000 if she does.

Magistrate Mok charged her $300 for court costs.      

L. Sonyo, on the other hand, was cleared of the charge of “making a false statement to an Immigration Officer lawfully acting under or in the execution of Part III of the Immigration Ordinance.”

Sonyo, 34 years old, was accused of lying when she declared to an Immigration officer that she would work for an employer who signed her work contract registered with the Immigration Department.

Charges against her were withdrawn after she agreed to a bind-over agreement in which she promised not to reoffend in the next 12 months, with a penalty of $1,000 if she does.

Magistrate Mok also charged her $100 for court costs and cancelled her next hearing scheduled for Feb. 3.

Another DH found guilty of money laundering; sentencing set

Another domestic helper tricked into lending her bank card that ended up being used for laundering money that came from crime, was found guilty today at Eastern Court after trial.

Marjorie Tayaoa, 44 years old, will be sentenced on Feb. 5 for “dealing with property known or believed to represent proceeds of indictable offense.”

She was taken to jail immediately after the verdict handed down by Deputy Magistrate Paul Yip, as this violation of the Organized and Serious Crimes Ordinance calls for a mandatory jail sentence.

Tayaoa had earlier denied having a role in the handling of $1,136,868 of deposits in and withdrawals from her Mox Bank account from July 20, 2023 to Aug. 1, 2023.

But Magistrate Yip gave more weight to the evidence presented by the prosecution that she was guilty of handling the money “knowing or having reasonable grounds to believe that property … directly or indirectly represented any person’s proceeds of an indictable offense….”

Hong Kong’s current spell of fair weather will last for only a few more days before temperatures start falling again ahead of the Lunar New Year, according to the HK Observatory.

The coldest day in the upcoming holidays will be on Tuesday, Jan. 28, the eve of the Year of the Snake, when the temperature in the urban areas will fall back to 11 degrees, and a few degrees lower in some parts of the New Territories.

The mercury is forecast to start dropping from Sunday, the last day of the Year of the Dragon, when a minimum temperature of 15 degrees is expected, falling further to 12 degrees the next day.

Monday will be noticeably colder, with temperatures ranging between 11 and 17 degrees.

The next day, Jan. 29, which is the first day of the Lunar New Year, the Observatory forecasts a dry and cold day with sunny periods. Temperatures will range between 13 and 17 degrees.

The Observatory says a cold front that will move across southern China on Sunday will cause the weather shift.

The current weather is relatively mild, with temperatures forecast to range between 16 and 22 degrees from today to Saturday.
