DH jailed 2 months for starting a business

Shatin Magistrates Court

The Shatin Court today sentenced a Filipina to two months in prison for starting a business while on a domestic helper’s visa.

Joyce Biggayan, 40 years old, pleaded guilty to breach of condition of stay, contrary to section 41 of the Immigration Ordinance, and by virtue of Regulation 2 of the Immigration Regulations.

Acting Principal Magistrate Cheang Kei-hong convicted her after she admitted establishing a business in selling beverages in Causeway Bay, for which she was arrested last June 14.

A condition of stay imposed on her on November 28, 2025 by an Immigration Aassistant, provideds that she was only permitted to remain in Hong Kong until 12th of August, 2027, “subject to the prescribed condition by virtue of Regulation 2 of the Immigration Regulations that you shall not establish or join in any business,” the information filed by the Immigration Department said.

Meanwhile, in Fan Ling Court, Acting Principal Magistrate Jason Wan jailed Michael Battung, 30 years old, for theft, contrary to section 9 of the Theft Ordinance.

Battung admitted stealing two SIM cards belonging to Lam Hoi-yin between November 18 and 21, 2025.
